TOWN OF DANBY
TOWN BOARD MINUTES
December 11 , 1968
The regular meeting of the Town Board of the Town of
Danby was held at the Danby Town Hall , Monday , December 11 , 1968
at 8 : 00 P . M .
Present : Supervisor James H . Cortright

Supervisor . Cortright called the meeting to order . Minutes
of the November meeting were approved as submitted .
COMMUNICATIONS
1 . Planning Board Minutes of meeting held 11 /26 /68 were read .

as our representative in the New York State Assembly .
4 . From Department of Agriculture and Markets requesting enumera -
torts list of owners and harborers of dogs .
5 . From Bruce Osadchey of the Farmers Home Administration -
interest due on the bond as of January 1 , 1969 will be
$ 1 , 143 . 46 . SUPERVISOR SAID THIS IS PROVIDED FOR WHEN WE
ADOPTED THE BOND RESOLUTION .
6 . From the Danby Fire Department requesting the Town Board
to change meeting night . ON AGENDA .
PRIVILEGE OF FLOOR
None from the Board .
Moses Peter once again suggested to the Town Board to
consider the possibility of initiating a County -wide Planning
and. /or zoning ordinance - - to propose to the County Board of
Supervisors .
Supervisor Cortright said there is under consideration and
provided for a County Planning Department , but at this point ,
have not been able to hire a Planning Director .
Mr . Peter asked if this would be a town option as far as
participation . Supervisor answered , !tyes " .
COMMITTEE REPORTS
Highway - Councilman Wilbur reported that he has looked into the
criticism received from persons over road conditions
during last big snow storm .
Mr . Wilbur talked with our Highway Superintendent
and the following is a run -down of - events :
As early as 9 : 30 A . M . the day of the storm a grader was on the
main road . By 11 : 00 A . M . , three trucks with snow plows were
on the roads . Three men worked until 12 : 00 Phat night . Two
other ' men including Chaffee worked until 2 : 00 A . M . All were
back to work by 7 : 00 A . M . When Mr . Chaffee left at 2 A . M . ,
d& l main roads were open except Gunderman Road - - reason being
many cars were stranded in the road and in the ditches . 25
cars were pulled out .
Mr . Wilbur had complaints from several of the bus drivers of
the Ithaca Public Schools and personally feels that the Ithaca
Schools are one of the biggest offenders of the troubles that
they have that we have . It is hot necessary , no matter what
the weather is and other schools are closing , to take the
children out on roads in the buses . For example , South Hill
closed at 2 p . m . and no buses to pick them up until 4130 .
Suggested some of the parents send letters to the School

Board or to the Town Board , possibly , as downtown the situation
is not realized out here . Definitely , thinks the Highway
Superintendent does all that he can do .
Mr . Wilbir reported the Erwin Projects not completed .
Zoning - Councilman Makie commented that the zoning map was
never lost to which Supervisor added he didn ' t think
it was either . Also Makie commented . on a . meeting
not being held because our attorney was too busy
before election and after that , we were broke and
Makie felt it was his decision not to promote it
because of lack of funds . Should be settled at
12 /18 /68 meeting .
Fire - Councilman Ralph Wilbur reported there are two new
Fire Commissioners - Kenneth Colburn from West Danby
and Clyde Carrier from Danby . The footings are in
and some cinder block has been laid for the new Fire
House .
Cemeteries - Justice Dorn will contact Mrs . Sue Hautala
about an original map of the Peter Road Cemetery .
Youth - Makie reported assurances that the youth program will
go along fine .
Insurance - Wilbur reported this to be on the agenda for later .
Refuse Collection & Disposal - Reported by Supervisor , Cortright .
After the Highway Superintendent pushes refuse over the
bank at the town dump , people are backing in from 15 to 30
feet off the road and dump . All the space in back can not
be reached . Something must be done one way or another ,
even if to borrow money to do it . It is possible to put
some persoW. attending the dump . Mr . Lis has volunteered
to stay there a couple of weekends . There is complete
misuse of the dumping area and do not know whether it is
Spencer or Danby people . Enough people interested to stay
at the dump certain times may have to be deputized as
constables . Residents of the town might be issued
permits . The County has appropriated for 1969 $ 100000 . 00
for acquisition of land for a sanitary landfill site so
it is reasonable to assume that the county will take over
refuse disposal . Until such time , Danby must do something .
D iscussion on negotiating with Mr . Landstrom .
W ILBUR TO CONTACT MR . LANDSTROM AND SCHEDULE A MEETING
W ITH THE TOWN BOARD .
The old dump site will then be fenced , dum covered ,
and signed that it is private property .
O LD BUSINESS
H ighway Superintendents Report - Chaffee absent .
Zoning Officer ' s Report - no report .
P lanning Board Chairman - Mr . Short absent . Mrs . Epp said to
wait until their meeting for any discussion .
Appeals Board Chairman - Mr . Roberts absent .
Assessors - none present .
West Danby Water : District - Water Commissioner Carlton Hunt
✓ eported that he and Water Commissioner Kenneth Colburn
are present to present a peculiar request for one water
u ser in the West Danby Water District and showed the Board
the plans to point up this inequity . Of the six ends to
the Water LInee in the Water Distrri1ct , all but one
✓ esidence has a water line goinfheir house . This
residence is in the Water District , but was cut off 150
feet ' from the water line and will have to pay for digging
a drench 150 feet and buy pipe for 1 .50 feet . The Board
o f Water Commissioners feel and recommend to the Town
Board that at least 2 / 3 of this cost to Mr . Sinn be an
added cost to the Water District .

Supervisor Cortright stated that the Department of Audit
and Control may criticize us but has ho objection as long as
the Water Commissioners can bear up under the criticism which
may possibly start .
Mr . Hunt said there will not be any entailed expense , only
the 150 feet of pipe and drench to put the water to this house .
At a meeting of the Board of Commissioners there were four who
suggested the above recommendation and the one absent said he
would agree .
Councilman Makie moved to accept the recommendation of the
Water Commissioners in extending 150 feet of drench and 150
411 feet of pipe to the Sinn residence , who is in the Water District ,
and to add 2 /3 of this cost to the West Danby Water District .
Seconded by Justice Dorn . 5 ayes , 0 noes , carried .
Mr . Hunt reported two people asked for services on their
property and have now refused to sign the authorization of
placement . Mr . Hunt will be willing to furnish the Town Board
w ith an affidavit . stating that these two told him to put service
o n their property . Supervisor Cortright said this is fal'r
e nough .
Discussion_ followed of some who have signed authorization
but are not hooking on to Water - -Resolution #19 states that
there shall be a minimum uniform fee charged to each property
owner regardless of water use or the amount of gallonage used
o r whether said property owner is using water from said system
o r not . The minimum monthly fee is $ 4 . 50 .
Recommendation of a Water Superintendent by the Water
Commissioners is Mr . Harold Cook .
Councilman - Makie moved to appoint Harold Cook of West
Danby , Water Superintendent of the West Danby Water District .
Mr . Cook is to be paid $ 10 . 00 per inspection fee until 60
inspections are made , then at the beginning of the next month ,
he receives ; 100 . 00 a month , and $ 10 . 00 for remaining hookup
inspections .
Seconded by Justice Wright . 5 ayes , 0 noes , carried .
Supervisor Cortright asked that the Water Commissioners furnish
the Town Board with a list of the original users .
Gas -
It was expected to have someone here from New York State
Electric and Gas .
Zoning Ordinance - Proposed Changes - Wait for the December 18 meeting
NEW BUSINESS
Discussion of Compensation Insurance - Clerk read letter from
Carey Insurance regarding
various towns and villages

agents presently writing
the rest of their business . 1
Councilman W± lbur moved to change the Town and Fire Company
Compensation Insurance to Ithaca Agency effective January 1 , 1969 .
Seconded. by Councilman Makie . 5 ayes , 0 noes , carried .
Councilman Wilbur brought to the Board ' s attention an all -
risk insurance policy which can be bought for $ 20 . 00 to cover
- such things as garage door broken and frozen water pipes with
- possibly a $ 50 . 00 deductible . Question of whether it will include
the Town Hall because of age and construction
Justice A . Francis Wright and Deputy Edward. Roberts , who
deposits tax collections , have to have bonds :
Councilman Makie moved to buy an all - risk coverage for `' 20 . 00
and to bond Deputy Clerk Edward Roberts up to :; 5 , 000 . 00 .

Lieberman Road Petition - Clerk read letter from Attorney Thaler
regarding abandoned roads .
Clerk to write letter to Mr . Lieberman that Thalerts letter
is being referred to the Danby "Canning Board and that the
Town Board is desirous of the Planning Boardts recommendation
as regards Lieberman Road , and to report findings to the
Town Board_ .
Audit Meeting - Scheduled. for December 26 , 1968 , 8 P . M . at the
Danby Fire House .
Bill Card Gas Mr . Card lives in the Town of Danby and is
about 12 feet from the gas one and has told
Supervisor Cortright that he may be hooked
up . to gas if the Town of Danby Board writes
a letter to New York State Electric and Gas
in favor of this hook-up .
Councilman Wilbur moved that the clerk write to the New
York State Electric & Gas stating that the Town Board is in
favor of their hooking up gas to Bill Card ' s residence .
Seconded by Councilman Makie . 5 ayes , 0 noes , carried .
Amount due County Treasurer - The Town of Danby owes the County
Treasurer $ 289 . 65 . We could levy for this in taxes but
d id not so will write a check after the first of the year .

Discussion of County Ordinance Regarding Soliciting - Clerk to
write to Supervisor James Graves that the Danby Town.
Board is interested in someone from the Chamber of
Commerce coming out to talk with us .
L etter from Danby Fire Company - Town Board discussed their
request that the Board change the night of Town Board
meetings . There is no other night available . •
Clerk to write an answer to the Fire Department
pointing out that Tuesday and Thursday nights are Justice
Court , Wednesday night is Planning Board , and Monday nights
are working out very well . Unanimously agreed. .
