M . Board Members Present : Supervisor James H . Cortright , Councilman A . Francis Wright Councilman Donald C . Makie Town Justice Floyd Dorn Town Justice Moses Peter Also Present : Zoning Officer Hatfield , Chairman of Assessors Thayer , Assessor Nelson , and John Myers , Alfred Schoneman and Mrs . Webber . Supervisor Cortright called the meeting to order . Minutes of the April meeting were approved as submitted . COMMUNICATIONS 1 . , From Danby P . T . A . Safety , Health & Civil Defense Chairman to Supervisor re school zone signs . 2 . From Ithaca City School District to Mr . Reimers concerning 1 communication . PUT ON THE AGENDA . 3 . From Ronald H . Laberge , Consulting Civil & Sanitary Engineer regarding Park & Recreational Development in the Town . FILE . 4 . From the Tompkins County Board of Supervisors -copy of a resolution Authorization for Highway Superintendnt to Execute Contracts - Snow Removal - Towns . THERE WERE NO PLANNING BOARD MINUTES . PRIVILEGE OF FLOOR Justice Peter asked that discussion of our Justice Court facility be placed on the agenda under old business , None from the public in attendance . COMMITTEE REPORTS _ Highway - , Justice Peter reported on his study of 2 sites requesting outdoor lights - - Jennings Pond and Danby Federated Church driveway . For Jennings Pond , Mr . Peter stated it seemed practical to first contact the Parks Commission to see if they will erect a light or if not , give the Town authori - zation to erect one for the park . Clerk to write to the Parks Commission . For the church drive , Mr . Peter definitely recommedns not to erect a light because this is beyond the town ' s authority . Although not a private drive it is not public or town property or highways ' Erecting a light would cause requests for lights at ' businesses or residences . Zoning - Councilman Makie filed a copy of the original zoning map - with the clerk . - A meeting was scheduled for May 14 , with the Planning Board , Town Board and Town Attorney - to discuss the revisions to the zoning ordinance . Fire - Councilman Wright said there was no report . Cemeteries - Jusp. e Dorn advised the Board of the bad condition of Peter Road Cemetery - -many depressions and no topsoil - - far from a nice job . Peter and Dorn recommend work be done to finish this as the Town Barn Cemetery and Nelson Road Cemetery are . Peter moved that the attorney draw up a contract with Mr . Dobson to redo the Peter Road Cemetery for $1 , 000 . 00 Seconded by Makie . 5 ayes , 0 noes , carried . Dorn to advise Dobson that we °: are in process of drawing up a contract for his signature and to contact Hemmo Huttunen to review the area with the map . 1152 Youth - Councilman Makie reported many favorable comments to the Danby Youth Program and a couple of comments wishing for a broader spectrum to the Summer Program . Will follow through with persons in charge of summer program when discussing this . Supervisor advised that this summer ' s program is budgeted so a broader program will have to be. considered in the fall . budget . Makie reported that Reed ' s are letting children play ball on their land but do not feel it . a good recreation site . Instead recommend a suitable site on the Swartwood property between Sedat and The Knoll in West Danby . Makie suggests this be considered along w ith recreation land developments . Insurance - Justice Peter reported there . is $ 15 , 000 insurance on the Town . Hall Building and $ 1 , 000 on the contents . A change on . the insurance of . the contents will be made w hen an inventory . is completed . Refuse . Collection & Disposal - Justice Peter still recommends that the present dump be closed but expects no action at this point . Mr . Peter did inspect the Sanitary Land- fill in Odessa but was not able to contact the attendant o r Supervisor , but will continue . The Board agreed that Mr . .Peter contact Mr . Mosher o n land receommended as a prime site for a sanitary landfill . OLD BUSINESS Highway - Superintendents Report - Chaffee absent . . Zoning Officer - Hatfield reported there are two or three places where buildings are ready to fall down and asked the Board ' s permission to get these cleaned up . Granted . Planning Board - no one present . Assessors - Chairman Thayer reported the assessors have been busy going over property cards - -much record keeping . Peter suggested that Mr . Thayer prepare a statement or letter to Danby Area News giving the means for arriving at an assessed valuation , nand to emphasize that cleaning up and painting does not increase one ' s assessment . On question of tax exemption for people over 65 , all renewals plus few more applications . WEST DANBY WATER, DISTRICT - Clerk read a . communication from Attorney Thaler to the Supervisor enclosing a copy of a letter which he received from Mr . LoPinto which reads : " Dear Mr . Thaler : Thank you for your letter of May 6 , 1968 . " I : have gone over the contents of _ the same very carefully with my clients , today , and they have authorized me accordingly to advise you which I hereby do , that they agree in principle and generally to the terms of settlement of the above matter set forth in your said letter . " There are certain details which will not vary the final settlement substantially in my opinion which I would like to go over with you at your convenience at a ✓ easonable time . " Please let me know when we can discuss this w ith finality . " In the meantime _ the price of $ 7 , 000 . 00 with the general terms are satisfactory and my clients hereby accept them . " This is delivered to you by hand at your office 411 so that there will be no delay in your receiving it . " Yours truly , John LoPinto . Supervisor Cortright contacted Standard Engineering while f . in Albany , They want to look over the side hill to see if they can go up this hill with their access road , so it is possible the right -of-way from Dr . Reed will not be needed . Cortright had a sketch showing the location of electric line poles and well site . The Gas and Electric has this sketch so will know w here they have to , build their line . Each pole will cost $ 75 . 00 and as explained to Cortright , the first span of wire between the existing line to the first may possible cost 10 ¢ per running foot . The Gas and Electric and Standard Engineering have agreed they will use a phase convertor , purchased by Standard Engineering . Both Supervisor and the Gas and Electric have data • on the phase convertor . Sinson would like to have Layne make the - well permanent - -no resolution at this time. . Plans and specs are being done in the Nashville , Tennessee office and will be ready shortly after May 15 . Construction rights - of -way will be done on a blanket easement . 153 Town Board Minutes - May 13 , 1968 - continued Supervisor Cortright asked Attorney Thaler to proceed with haste on closing with Swartwood in view of the fact there is a little more than $ 8 , 000 . 00 remaining in a bond anticipation note . LoPinto and Thaler agree in taking a 50 foot right -467of -way in fee and construct a town road . Also agree , depending upon the engineer ' s discretion , to give Swartwood the greatest number of building lots along this road . Clerk read the last paragraph in a letter from Attorney Valsing , Harrisburg office of FHA , to Attorney Thaler quoting , aI apologize for the delays in the processing of this application that were caused by me and hope that with the material now furnished the matter can be concluded in as expeditious a way as possible " . The engineers will study , when her , the access road location between routes 34 and 96 and will make a recommendation to % Attorney Thaler and _ Attorney LoPinto and Ruuspakka in a meeting . Recreation Land ( Locke ) - Reported by Supervisor Cortright Attorney Thaler has had a communication from Locke ' s attorney but still feels more can be done for the town so needs more time for negotiation . Gas Survey - Reported by Zoning Officer Hatfield Petitions have all been turned in to New York State Electric and Gas . Reaction of the people was favorable - -average of 17 signers per mile , requirement is 15 . There will be tore involved in getting Public Service Commission permission . Reed Right - of -Way - Councilman Makie has had no word from Reed or their attorney . Consideration of Future Erwin Projects - Highway Superintendent not present to present his recommendations . Justice Court Facility a Town Justice Peter repeated the need for better Jutice Court facilities , since the new Justice Court Act of September 1967 made it necessary that Town Court be held in a public place . Justice Peter proposed building movable petitions to follow existing steel posts in basement of the fire house . These to be set up on court nights and taken down by the custodian . Peter gave the estimates for this work : Lightweight hardboard framed in a routed 2 x 2 , 6 feet in heighth . Three spans - 4 feet , 6 inches long ; 6 feet , 9 inches long ; and 4 feet , 11 inches long . Platform be 18 inches in heighth , 6 feet by 6 feet - - spece enough for a folding table and justice ' s chair . Deck would be 3 /4 inch a . c . interior plywood and 2 x 4 frame 16 inches on center , 2 x 4 legs faced with 1 /8 inch hardboard . Contractor's price is $ 116 . 16 for material and $ 168 . 00 for labor . . Peter recommends the Board take immediate action toward at least providing a temporary court facility . Councilman Makie moved that the Town Board proceed with 411 construction of a Justice Court facility as outlined by Justice Peter ' s estimate and firm price . Seconded by Dorn . 5 ayes , 0 noes carried . NEW BUSINESS School Zone Signs - Supervisor Cortright asked Peter and Wright to find out from the highway superintendent if zoning signs and " school zone " signs are in the confines of the. signing program . The wording on the zoning signs are Welcome to Danby , Zoned for your Protection . Change of Town Board Meeting Night - Peter moved to change the official night of the Danby Town Board meeting to the second Monday of each month . Seconded by Wright . 5 ayes , 0 noes , carried . Clean-Up-Date - Scheduled for May 25 , 1968 Makie moved to use 4 town trucks and drivers for Danby 154 Clean-up and to pay the drivers out of the General Fund . Seconded by Wright . 5 ayes , 0 noes , carried . Discussion from Mrs . Webber regarding Autosalvage picking up junk cars - - " whether they will be paid , up to the Town Board , but will do it regardless " . Peter stated at all presentations , made , Autosalvage has made issue - that they are here in the community , part of the community and • that they will participate and help in picking up junk ears so would assume teas would be done at no cost to theTown . Supervisor Cortright : saidit would be fair that - if picking up the junk cars is costing money to Autosalvage , the Board may not object a bill to put them on a break- even basis . 1 General Fund Bills - : Dorn moved to pay the General Fund Bills # 44 through # 57 as listed on Warrant # 5 • totalling $ 819 . 56 . « sSeconded by Makie . 5 ayes , 0 noes , carried . Highway Fund Bills - Wrightmoved to pay the Highway Fund Bills # 43 'through # 54 as listed on Warrant 5 totalling $ 984 . 37 .
