TOWN BOARD MINUTES
April 8 , 1968 _
The regular meeting of the Town Board of the Town of Danby ,
was held at the Danby Town Hall , Monday , April 8 , 1968 at 8 : 00 P . M .
Board Members Present : Supervisor James H . Cortright , Justices
Floyd Dorn and Moses Peter , Councilmen
• Donald Makie and Francis Wright .
Also Present : Attorney Richard Thaler , Zoning Officer Hatfield ,

Supervisor Cortright called the meeting to order . Minutes
of the March meeting were approved as submitted .

PRIVILEGE OF FLOOR
None from the Board'.
S Supervisor Cortright announced that privilege of the floor
be extended to public present , but will not , and expects
the same from the Board members , engage in debate or answer any
questions . However , if any member desires to have any comment
put on the agenda , please note it after the comment is made .
Harold Cook asked where the 27 . 6 figure came from regarding
water district . Put on the agenda .
Nan Webber asked . about street light for Danby Pond . Supervisor
asked the Highway Committee to include this in their study .

COMMITTEE REPORTS
Highway - Chairman Moses Peter - nothing to report .
Zoning - Chairman Donald Makie has discussed with Attorney Thaler ,
Zoning Officer Hatfield ' s changes , which each Board
member has a copy of , and asked that this be put on
the agenda' , for May .
Fire - Chairman Francis Wright reported that the architects
are drawing the specifications on the proposed fire
hou'se . . The department is in session tonight and planning
the purchase of a 4-wheel drive 3/4 ton truck .
A request from the chief that the Town Board con-
• sider legislation prohibiting the burning of trash ,
etc . during the hours of 8 A . M . to 5 P . M . Reason

being a very large rash of grass fires in the last
month and in the Town of ° Danby , we have no firemen
on hand , all men working at - these hours . Mr . Wright
suggested that if such legislation is considered , it
should be limited to two periods of the year- - one
being April 15 through May 1 and in the fall September 15
through the danger period . Supervisor Cortright re -
quested the Fire Committee , Makie and Wright , work with
the Attorney in drafting a local law for presentation
to the Board at the next meeting . However , Cortright
asked that particular attention be to the periods - of
times mentioned as to the advisability of setting a
period of time during the year as regards outside -
bunking . If possible , ..may want to consider the total
year because of wind , etc . in winter . This local - law
would be for board ' s scrutiny , not necessarily adoption .
Cemeteries - Chairman Floyd Dorn reported finding some of the
cemeteries on the map . Clarification of the policy in
taking care of the cemeteries is the selection of
cemetery inmost urgent need . It may be only one in
some cases more - -allotted $ 500 . 00 ih the budget for
cemeteries . Anticipated cost is a controlling factor .
Youth - Chairman Donald Makie said there is no report .
Insurance - Reported by Chairman Moses Peter to watch for a
credit from Ithaca Agency and Mrs . Welter is in the
process of inventorying the contents of the Town Hall ,
so when this is done there will be a proposed change .
Clerk to advise Ithaca Agency that the Town Board
agrees to accept the refund in a check .
Refuse Collection and Disposal - Chairman Moses Peter reported
that he has talked with Mr . Landstrom and his offer
is as follows : For a fee of 3350 . 00 per month , and
this would be under contract , Mr . Landstrom would
provide the Town with a place to dump its refuse ,
at the location near our present dump . This fee is
based on his minimum income needed to make the business
profitable'. . It would not be trenched , covered on
occasion , not on a daily or weekly basis . There would
not be supervision , the dump would be open full time . .
In view of this , Mr . Peter cannot see where it would
afford the Town anything better than we now have and
a far greater cost , so suggestedtthe Town Board not
give favorable consideration to this proposal . Mr .
Peter inspected the existing dump and ' showed the Board
photos , mentioning the deplorable condition . A fuither
study reveals a large percentage of the use of the dump
is by non- residents of Danby . Mr . Peter suggests that
the Board consider closing present dump , after reason=
able notice , be fenced off , posted and covered .
In inquiring about sanitary landfill , Mr . Peter
understands there is a very successful landfill opera-
tion in the Town of Cayuta - - operating pretty much as
proposed the operation of the one in Danby . This is
open one day per week , on Saturdays , under strict
supervision . Users are instructed where to dump and not
allowed to bring refuse in uncovered receptables and

covered each day . Mr . Peter intends to inspect this and to
have photographs, - Mr . Peter hopes that if the townspeople
can " be convinced of : the efficiency of this type of operation ,
that those people who signed a petition against it , would
reoconsider and petition for it . Put on the agenda for
discussion .
OLD BUSINESS
Highway Superinteeddn.t :Chaffee reported some frost break-up on
roads and state three questions for consideration :
1. . Putting a fence across the entrance to the Town Barns
because of children playing around buildings .
2 . Landstrom has asked if Town Board will give permission
to put gravel on a road off from Hillview Road , making
it necessary to close road .
3 . For discussion , list of roads under Erwin Plan , which
Town Board should approve . All of these to be discussed
under New Business'.
Zoning Officer Hatfield reported receiving complaints from
people regarding garbage left uncovered and blowing around .
Threeople have started moving old cars in .
Planning Board Chairman - - absent . No minutes of a Planning
Board meeting .
Appeals Board Charmani - absent .
Board of Assessors - Chairman- absent . . Clerk to write the
Chairman of the Assessors to attend some of the Town
Board meetingq .
West Danby Water District - Supervisor Cortright referred to
letter read under communications from Standard Engineering
pointing out their anticipated completion date of specs which
is May 15 , 1968 . They are working on those although the
actual authorization they have not received-.
RESOLUTION # 4 Presented by Attorney Thaler .
BE IT RESOLVED : That pursuant to a contract heretofore
entered into between The Standard Engineering Corporation ,
consulting engineers of Albany , New York , and the Town of Danby , '
that the Standard Engineering Corporation is hereby authorized
to proceed with the final plans and specifications for sub-
mission to State and Federal authorities for final approval
on the West Danby Water District pursuant to the terms of
said contract .
The above resolution made the Town Magistrate , Moses Peter ,
and seconded by Town Councilman, Donald Makie and passed unanimously
by siad Town Board .
A copy of the above resolution be certified and sent to
. the Standard Engineering Corporation along with letter .
RESOLUTION # 5 Presented by Attorney Thaler .
BE IT RESOLVED : That the Town AUorneys , Thaler and Thaler ,
are hereby authorized to submit a final offer on the 27 . 6 acres
of land and two rights of way proposed to be purchsed from the
- Swartwood Estate , said offer to be in the amount of $ 7 , 000 . 00
That should said offer be refused that the -said attorneys are
hereby authorized to proceed with condemnation of the said 27 . 6
acres of land plus the two rights of way as are shown on a map
dated May 1967 made - by Thomas G . Miller , consulting engineer
and surveyor`.
The above Resolution made by the Town Magistrate , Moses
Peter and secondedd by Town Councilman , Donald Makie and passed
unanimously by said Town Board .

Supervisor Cortright answered Harold Cook ' s question that
it was agreed better to own a block of land . The original
request made by the engineers was for 4 . 7 acres but they were
thinking only in terms of a well site and ` a pump house . On
further study of the area , they came to the conslusion that
they would have to go higher on the mountainside to set up
their tank and to feed= the ' whole system by gravity .
Cortright talked with the FHA representative in Harrisburg ,
Pa . late this afternoon , who said he will do his best to have
the papers in Syracuse the first of next week .
Councilman Makie asked that a check be made of all things
that FHA requires to be met . Makie will meet with Thaler on
Friday".
Recreation Land - Attorney Thaler talked with Attorney' George =
Pfann . Mr . Locke has come down in price
but will wait for letter in writing as to the
amount before being made public .
A letter was sent to Ronald H . Laberge ,
Consulting Civil and Sanitary Engineers .
Cortright received a telephone reply . They
are interested in drawing 'specs on this and
• are in a position to help us get Federal y
monies . First , have to know what will have
to be paid for the property and if we are
going to buy it .
Gas Survey - The New York State Electric and Gas has delivered
petitions to Mr . Hatfield who has distributed them .
Reed Right of Way - already settled by resolution.
Zoning Ordinance and Proposed Changes - Town Board agreed to
hold zoning changes which Mr . Hatfield has made and to
wait for Autosalvage who has contacted , so far , the
Community Council and Firemen`: on their plans for
operation .
Letter from Dr . Broad .to Mr . Short and from Dr. Broad to Mr .
Awad - Supervisor Cortright reported satisfactory progress is
being =; made .
NEW BUSINESS
Final Equalization Rate - Supervisor reported this to be 94% .
A memorandum from the Regional
Planning Board of a briefing on the
proposed Nuclear Reactor Generating
Plant on Cayuga Lake , to take place
at 7 : 30 P . M . April 22 at the Electric
& Gas Auditorium .

GIVEN TO EACH BOARD MEMBER .
Communication from the Assessment Department - Supervisor
Cortright filed with the Clerk a list of people on joint
deeds .
Study of Market Values in the Town of Danby - Town Board
members and Assessors , April 11 at 1 : 00 P . M . in the Town Hall . is
Supervisor Cortright filed the following with the Town Clerk :
Procedures for Local Governments under the Taylor Law .
Directory , New York State Services to Local Governemts .
Copies of Serial Bond and Resolution for $ 26 , 020 for
Bucket Loader .
Mr . Wiggins is desirous Of building more houses and would
like to build an access road into these houses according to
town specifications , with an eye to the future as regards
the town taking over these roads , Supervisor Cortright
asked the Highway Superintendent and the Highway Committee
to secure specifications based on the Erwin Plan and what
other Towns are doing and to have this in order so can be
adopted at the nnt Board meeting . Supervisor will advise
Mrs . Wiggins or tnis .

Authorization to sign the deed for transfer of Town-owned land
t o the Fire Comssioners - -
RESOLUTION # 6 Presented by - Attorney Thaler .
BE IT RESOLVED ; That the Town of Danby wishes to convey
to the Danby Fire District all that tract or parcel of land
conveyed to the Town of Danby by the City School District of the
City of Ithaca , New York as described in a deed dated May 23 ,
1963 and recorded in the Tompkins County Clerk ' s office in
L iber 446 of deeds at page 1039 for the consideration of $ 3000 . 00
• and the Town Supervisor is hereby authorized to convey said
property to said Fire District by Corporate Quit -Claim Deed
subject to the provisions of Section 90 and 91 of the Town
Law of the State of New York .
The above Resolution made by the Town Councilman , Donald
Makie and seconded by:'_ - the Town Magistrate , Moses Peter and
passed unanimously by said Town Board .
Voting Machine Use by Ithaca School District -
Councilman Donald Makie made the motion authorizing use
of the Town Voting Machine for the Annual School Election on
Tuesday , May 7 , 1968 , and to have Harry Hatfield tend the
machine ' . Seconded by Floyd Dorn . 5 ayes , 0 noes , carried .
Closing of the Present Dump - Town Justice Moses Peter made the
motion to give immediate notice
that the dump will be closed in
30 days from date of notice and
to take steps to have it covered ,
fenced and signed that the dump
is closed . NO SECOND . MOTION
LOST . Leave as is .
Fence across entrance to the Town Barns -
Town Board agreed to let Highway Superintendent build a
fence across the entrance to the Gown Barns .
Gravelling Old Road o Town Board agreed to allow Mr . Landstrom
to gravel road , running from Hiilview
Road and Rte . 960 This is to done under
Chaffee ' s guidance so in the event this
road is opened , it will be an asset to
the Town .
Councilman Wright moved to authorize the Town Clerk to
write a letter to Mr . Landstrom advising him that he :.shas the
permission from the Town Board to gravel road between Hillview Rd .
and Rte 96 under the Highway Superintendent ' s supervision .

Fututcee Erwin Road Projects - Highway Superintendent Chaffee
• will bring a list of roads to
be considered under the Erwin
Plan to the next meeting and have
a motion at that time .
Need for Fire House as Town Hall - Board agreed that Clerk write
to the Board of Fire Commissioners
to put the need of present fire
house as a Town Hall under considera -
tion and arrive at a reasonable
figure so thate Town Board will
have a basisto proceed in planning .
General Fund Bills - Dorn moved to pay General Fund Bills # 36
through #43 as listed on Warrant #4 totalling
608 . 22 . ' Seconded by Wright . 5 ayes , 0 noes ,
carried .
Highway Fund Bills - Peter moved to apy Highway Fund Bills # 34-
through #42 as listed on Warrant # 4 totalling
$ 721 . 62 . Seconded by Makie . 5 ayes , 0 noes ,
carried .
