HomeMy WebLinkAbout1967-11-09 • 115 ` TOWN OF DANBY PUBLIC HEARING ON JUNK CAR VIOLATIONS November 9 , 1967 A Public Hearing on Junk Car Violations was held at the Danby Fire House , November 9 ', 1967 atr7 : 30 P . M . - • Present : Supervisor James H . Cortright , Justices Floyd Dorn and Moses Peter , Councilmen - Donald Barber and Donald Makie . Also Present : Zoning Officer Hatfield , Mr . and Mrs . Edward Monroe , Lawrence Scott , Mrs . Ruby Monroe ; Don Carroll , Joe Loomis , Ralph Wilbur , mRonald Addy' and . Alfred . Schoneman and Attorney Robert Cluneo • Supervisor Cortright called the Hearing to order and asked the clerk to read notice of Public Hearing . Cortright asked Zoning Officer Hatfield if there ' are still threee violators . Mr . Hatfield reported that it is down to twos Fred Brown did not appear for the hearing and the Floyd Nace property has been sold and cars removed . Mr . Lawrence Scott objected to the Junk Car Law saying that cars could be moved away and cost charged • to person ' s property , and asked that everything be done to avoid this . Supervisor Cortright stated the Town has done everything they could to avoid this charge by asking every individual involved in a situation of this type to remove the cars before any action had to be taken . Attorney Clune said that the Zoning Officer has , under this ordinance , been cooperative and attempted to notify' these people . and would have given them any extension whatsoever if they had difficulty in removing cars during the period they got notice . - Reluctantly , the town has • been forced into this position of calling a hearing and getting into the problem of removing it themselves . 1 Mr . Scott feels that the - two violators are probably the least able to have this action brought on them . This same thing might be extended to farmers who collect machinery on their . bacis lots . This is based on the principle of aesthetics , and another effort should be made to do bhis without getting into the business of contracting . Mr . Edward Monroe questioned if junk cars were there before zoning , they could not bring in anymore but operateon what they had . Supervisor answered he was confusing the local junk car law with the zoning ordinance and they have nothing to do with each other . Mr . Monroe said there are others in the Town and why aren ' t they served notice . Zoning Officer said there are several more in the Town who have promised faithfully they would get rid of the cars but yet have made no move . " If they don ' t make one pretty soon , they will all . have a hearing . ° . 8 : 00 P . M . TOWN OF DANBY PUBLIC HEARING ON PRELIMINARY BUDGET November 9 , 1967 A Public Hearing on the Preliminary Budget was held at the Danby Fire House , November 9 , 1967 . Present : Supervisor James H . Cortright , Justices Floyd .Dorntand Moses Peter , Councilmen Donald Barber and Donald Makie . Also Present : Zoning Officer Hatfield , Highway Superintendent Chaffee , Attorney Clune , Mrs . Sue Hautala , Mrs . Charlotte Hautala , Donald Carroll , Joe Loomis -s, John Myers , Willard Daetsch , Francis . Wright , John Teti , Gould Colman ; Robert Farrell , Mrs . Betty. Melchen , kmrmaaxf&gard; and Alfred Schoneman . Supervisor Cortright called the hearing to order and said that the Preliminary Budget for 1968 is on file with the Town Clerk , III and. that the Annual Budget will be filed with the Clerk as soon as it is adopted . . Mr . Cortright presented figures of the actual value for 1967 and proposed figures for 1968 , to clarify the error which was printed in the Ithaca Journal . For those present , Mr . Cortright, pointed out a tax rate of $ 16 . 71 per thousand assessed in 1967 and $ 8 . 93 proposed per thousand assessed for 1968 based on the preliminary budget . . Mr . Colman asked about full value figures--how calculated ? Supervisor answered " by Cleminshaw and based on the reappraisal and studied and approved by the Board of Assessors " . Supervisor Cortright covered in detail the preliminary budget for 1968 . Mr . Colman asked if the recreation figure of $ 3 , 550 . 00 - covers all the committments made by the Community' Council . Super ✓ isor answered " yes , and was covered thoroughly in the preparation o f the budget . The 81 , 500 . 00 will take care of the swimming pro - gram and the maintenance of the park . " The $ 2 , 000 . 00 is ivoived ` . w ith Youth Recreation . " In reference to the $ 6 , 000 . 00 , the Town Board had discussed the question of whether there would or would • not be a . part - time director for the youth . The consensus of opinion among the Town Board members was that if and when a part - time youth director came into being , at this time the money would be approriated--up to $ 6 , 000 . 00 . " The $ 6 , 000 . 00 . Unexpended Balance in . the General Fund very definitely places the Town in a position to fill any gap as regards the Youth Program . Mr . Colman questioned seeming lack of plan for how highway taxes are going to be used for coming year- -what is going . to be done as far as highways ? Highway Superintendent explained that roads are rebuilt under the Erwin Program . State tells us each year how much money they will furnish and what portion the Town has to raise in taxes . There is no additional money raised in the . BridgeFund for 1968 as it . is an Unexpended Balance carried from 1967 . Two bridges in West Danby plan totreplace with eight to ten feet of pipe . The $ 89000 . 00 for repair of machinery constitutes anticipatedlannual repairs . Purchase of Machinery , Tools & Equipment of $5 , 000 . 00 would be such as cinder spreader which was purchased last year and III small tools like log chains and tire chains . . . John Myers asked about comparing figures with last year or I year before . Councilman Makie loaned his copy' showing these comparisons . Supervisor went over the General Fund appropriations . Gould Colman asked about false economy in highway superintendent ' s salary . - Recommended that salary be increased with the expectation that plans be submitted by the Highway Superintendent concerning work of the Department for the Coming year . The regular meeting of the Town Board of the Town of Danby was held at the Danby Fire House , Thursday , November 9 , 1967 at 9 : 15 P . M . Board Members Present Supervisor James H . Cortright , Justices Moses ' Peter , Floyd Dorn , Councilmen Donald Makie and Donald Barber . Also Present : Zoning Officer Hatfield , Highway Superintendent Chaffee , Attorney Clune , Mrs . Betty Melchen , Alfred Schoneman , and Mrs . Esther Eckert . ` Supervisor Cortright called the meeting to order . Minutes of the October meeting were read and approved . Co MMUN ICAT IONS 1-. From constables who walked children to school waiving wages for the month . 2 . Petition from 78 signers protesting and opposing purchase by Town of land for dump site purposes . 3 . From Tompkins County Chamber of Commerce re : Out of Town Solicitors . 4 . From Department of Audit and Control acknowledging receipt of an Order of the Town Board establishing West Danby Water District . 5 . Resolution # 176 from Board of Supervisors - Workmen ' s Compensation Budget ` and Apportionment - Mutual Self - Insurance Plan . 6 .. Resolution # 188 from Board of Supervisors - Apportionment of Mortgage Tax . Communication # 1 - Supervisor Cortright pointed out that this was not done by him alone but with the help of the Town . Board , parents , Dr . Bardwell , State Traffic Commis - sion , Chief Traffic Engineer , cooperation of Mrs . Cook and Commissioner of Education . Commendable gesture in not claiming wages , and will reply personally . Communication # 2 - Referred to the Refuse Collection and Disposal Committee . PRIVILEGE OF FLOOR None from the Board . ' John Myers - Is the Town doing anything in attracting people to build in Danby ? Reply - the Zoning Officer ' s reports of building permits issued show that people are building here . . Willard Daetsch - All colleagues building outside of Danby such as Dryden and Trumansburg . Makie replied the reason banks do not want to give loans on the type of homes these people want to build is that many of these people are of a transient nature . John Myers - So much potential on this side of Ithaca - -we cannot wait . for banks to decide to okay a loan but act on our own.. Supervisor Cortright encourages a sewage system in the Danby area-- something to attract people to build , but need people to be interested . Town Board II will be glad to carry through as long as a group of interested citizens will pass it to them . Discussion on natural gas service in Danby . Don Carroll - Reasoning behind the opposition to the Sanitary Landfill is that Danby has great potential growth ani that the only way Ithaca could expand would be southward . The Sanitary Landfill idea is too close to the area of growth . Peter answered the Town Board was following the plans of experts . Sue Hautala - What has the Town of Danby spent on the Autosalvage Case ? Supervisor said past records are in the Town Vault and will get them . 18 COMMITTEE REPORTS Highway - Reported by Justice Peter - Anticipate the purchase of a Bucket Loader , rental runs out last of month . It is Highway Superintendent ' s recommendation to purchase bucket loader . Zoning - Reported by Councilman Makie - Supervisor and Makie met with Jim Lee , approved the final zoning map and is in prepara- tion , master copies being made . Fire - Reported by Councilman Barber - none . Cemeteries — Reported by Justice Dorn - Mr . Huttunen seeded the Peter Road Cemetery weekend after last Town Board. meeting . He set as many - stones as he knew where . It will need stones picked off in the spring , but wished to be relieved of any further responsibility . . Insurance - - Reported by Justice Dorn or Peter - Peter reported the = Insurance Committee met with Mr . Chaffee , to go over valuations of highway equipment . - Made some recommended changes-basically the change for equipment as regards t to the snowplows which town now owns . These are appraised at about $ 2 , 000 . 00 value , checked with the agency , and they will be considered part of the vehicle in which they are mounted , so accounts for some of the recommended •iherease for some of the vehicles listed . Change made on contents , small tools , etc . in the town barns from $ 2 , 000 . 00 to $ 5 , 000 . 00 . Noted $ 100 . 00 insurance on contents in Town Vault -- should be increased . ( Put under New Business ) Youth - Reported by Councilman Barber - Youth are working at Town Hall . Refuse Collection & Disposal - Reported by Justice Peter or Councilman Makie . Peter offered the following resolution : Resolved that Supervisor Cortright be authorized and directed to contract with an engineering firm to secure the necessary surveys , preliminary reports , to satisfy the Tompkins County Board of Health require - ments for public use of a sanitary landfill site under negotiation with Autosalvage of Ithaca , and after final approval by the Tompkins County Board of Health , Supervisor Cortright be authori - zed and directed to arrange for the actual purchase of said property . In view of - the petition presented , this resolution was withdrawn , but - would like petition kept on file in the Town 1 • Clerk ' s office . Requests that Committee be authorized to con- tinue search for another suitable site . In answer to Supervisor ' s questions , Committee will consider talking with Landstrom . Would not make a recommendation to have someone contract to haul refuse out of the town as has been established that if done , would have to be all residents of the Town which does not feel is practical . Councilman Makie moved that the Town not purchase land on the Hornbrook Road ( as has been voted to purchase ) , because if we are notgoing to have a sanitary andfill there , " we should not own it . Seconded by Peter . • 5 ayes , 0 noes , carried . Makie stated this is an example of where he is acting as Town Board member against the Planning Board ' s recommendation which was to purchase this site for future use . Based on the petition , has to exercise an override of a normal procedure where the Town Board would accept the Planning Board ' s recommendation . Committee also reasons if site was acquired and did not put it into operation ; it would be an open invitation for a County site , which would be against the petitioners . OLD BUSINESS . Highway Superintendent ' s Report - Chaffee reported some signs have been received , and will be getting them up . No progress from County on signing of County Highways where the Towns cross . Zoning Officer ' s Report - Hatfield reported one permit issued last month . Planning Board - no one present . Appeals Board - on one present . Assessors - no one present . West Danby Water District - Attorney Clune reported they have come municated with attorneys representing 1 119 ' TOWN BOARD MINUTES - November 9 , 1967 - continued Sheet # 3 the Swartwood property . Meeting scheduled for next week , have drawn the descriptions of property to be taken . No wordhieceived from the Federal Government regarding a closing date . Recreation Land - Supervisor has no additional information . Makie • feels this is associated with a Capital Improve - ments ; Program ; Sidewalk District - Supervisor asked BoardAs pleasure in view of the school bus situation being settled . Attorney Clune reported that the State will not give right - of-way on their roads but suggested the other side of ditch which would be taking property • of landowners either by condemnation or negotiation . Clerk to advise Planning Board to study require - ments for sidewalks as regards to location , right -of-way , etc . Revisions in Agreement between Town Board and the Danby Community Council - • 1 . That use of drugs or alcohol being grounds for discontinuing youth activity . Community Council does not want to be held responsible if beer cans were found on the premises , this would constitute use of same by youth . 2 . The Community Council would like the option to renew agreement at the end of 10 years . Makie reminded that Town Boards are elected by the people , still needs to maintain some overall jurisdiction . Attorney Clune said for $ 1 . 0G consideration , getting into a big document , started out with just a letter of intent , now into a contract trying to define the use of alcohol so it does not embrace a collection of beer cans on the premises . Board agreed with the option to negotiate , can be included but no reason . At the termination of any lease , one attempts to renegotiate . Town Board authorized Supervisor Cortright to sign the agreement if Community Council agrees to it . • NEW BUSINESS . Republican Custodian for District II - Peter moved that Carlton Hunt be appointed a custodian for the voting machine in District 2 , retroactive to October 1 , 1967,, Seconded by Barber . 5 ayes , 0 noes , carried . Dog Enumerator - Dorn moved to appoint Ted K . Merritt the Dog Enumerator for Danby for 1968 census retroactive to October 1 , 1967 . Seconded by Makie . 5 ayes , 0 noes , carried . Adoption of the Preliminary Budget - Discussion on a . $ 500 . 00 raise in salary for the Highway Superin- tendent .
