RE: Suit-Kote Terminal Tank Project
Suit-Kote respectfully submits the enclosed plans, application, and related analysis for
construction of 2 asphalt storage tanks at our Cortlandville Terminal site. The two proposed tanks will
support Suit-Kote’s continued operation in Central New York, providing materials utilized by civil
construction firms throughout the region in critical infrastructure projects.
The tanks will be located in the existing containment of the terminal property, which will be
upgraded to meet or exceed current environmental standards. The containment area will be impervious,
per the industry standard Gulf Oil Field test, as is the case with all Suit-Kote Facilities. The capacity of
the system will exceed the 110% capacity of the largest tank and storm water, ensuring high levels of
safety and environmental protection.
The tanks will be erected on reinforced concrete pads and placed in service in accordance with the
highest standards of construction, testing, operation, and maintenance; as prescribed by the NY
Department of Environmental Conservation (DEC), the industry reference American Petroleum Institute
(API), and all other applicable standards, as is the case with all of Suit-Kote’s facilities.
As one of the area’s largest employers, we are excited to embark on this substantial investment in
our facilities and community with this upgrade to our existing industrial site, which is adjacent to other
Industrial Zone 2 Properties.

Dear Chairman Newell,
First and foremost, congratulations on your reappointment as Chairman of the Cortlandville Town
Planning Board. The Cortlandville Fire District had the opportunity to attend the Cortland County Coordinated
Review Committee meeting on Friday January 6111, 2023 at 10 am regarding Suit Kote's application to add two
asphalt storage tanks at their Cortlandville Terminal site; 3911 Route 11. This is the site of the previous fire that
occurred on February 16`h 2022
While the Cortlandville Fire District based on information provided by Suit-Kote concedes the potential
for these tanks to erupt in fire is minimal, the overall fire load at this facility is significant. The Fire District is
requesting that Suit-Kote be required to install at least one fire hydrant prior to the railway crossing as pail of
this application process. We have discussed this with Suit-Kote and the Cortlandville Water Department. A
quote was obtained last year for informational purposes and provided to Joe Perrone, EHS Director Friday
January 6", 2023 as it was indicated the cost to install said would hydrant would cost around $150,0000.00. The
quote is from last year and enclosed with this letter but said cost then was $44,164.00.
As has been discussed previously, the fire department needed to lay 3,000 feet of five -inch hose to reach
the fire. This is not practical and is time consuming to accomplish allowing the fire to grow exponentially before
adequate water flow can be established and applied to any fire. We also want to be very clear in stating we
appreciate having Suit-Kote as a business and neighbor in our Fire District. By no means do we want to
financially burden Suit-Kote, any existing or new business looking to locate in our Fire District but feel this is a
consideration that requires attention.

WHEREAS, on December 22, 2022 the Code Enforcement Officer, Town of
Cortlandville pursuant to General Municipal Law 239 M submitted an application for a conditional
permit, site plan review and aquifer protection special permit because the property is located within
500 feet of Kellog Road (County Route 121), AND
WHEREAS, the Cortland County Planning Department has reviewed this request and
submitted a written report dated January 6, 2023, which is on file, AND
WHEREAS, the Cortland County Planning Board, on January 18, 2023, held a regular
meeting with a quorum and did consider this request, AND
WHEREAS, the Cortland County Planning Board did thoroughly consider the material
submitted by the petitioner, Department comments, and all other relevant reports on file, NOW
THEREFORE BE IT
RESOLVED, the staff recommends approval of this application for conditional permit,
site plan review, & aquifer protection special permit to install two base asphalt tanks only if the
following contingencies are satisfied
1. that the Town consider revising §178-45 (B) (1) & (2) of the Code to refer to the NYS Department of
Environmental Conservation (DEC) regulations instead of Cortland County Health regulations.
2. that the applicant obtain approval from the NYS Department of Environmental Conservation (DEC)
including possible modifications to existing permits and Stormwater SPEDES.
3. that the applicant follow recommendations submitted by the NYSDEC in regards to containment area and
construction activities.
4. that any positive consideration of this proposal by the Town be contingent upon NYSDEC approval.
5. that the applicant provide an updated site plan to the Town including a lighting plan and, if necessary, the
locations of emergency zones / fire hydrants.
6. that the updated site plan be reviewed and approved by the Town of Cortlandville Fire Department.
7. that the applicant provide the Town with provisions for removal of the tanks once they are no longer in
use.
8. that a water line be run from Route 11 to the railroad right-of-way and a fire hydrant be installed there.
9. that the applicant provide the Town with provisions for the site no longer in use is returned as per DEC
guidelines to original condition.
10. compliance with SEQR requirements.
BE IT FURTHER RESOLVED, that the Board reminds the Town of Cortlandville the
requirements of General Municipal Law Section 239 M that a supermajority vote is to be attained
by the Town in order to approve this application unless every contingency documented in this
resolution is followed, AND
BE IT FURTHER RESOLVED, that the Board reminds the Town of Cortlandville the
requirements of General Municipal Law Section 239 M that the Town is to file a report of final
action with the Planning Department within thirty days after final action, AND
BE IT FURTHER RESOLVED, that the Planning Department is hereby authorized to
convey this action to the Code Enforcement Officer, Town of Cortlandville.
