1. Trusts: (Funds Paid into Court)
Total Open Accounts: 1 in the process of being claimed & disbursed if / when
court-ordered.
2. Open Estates:
I have been approved as Administrator of a small estate in which I collect and
distribute estate assets to debtors. This is unique in that I, rather than an
attorney, do the legal paperwork. I am currently awaiting receipt of an invoice
from Cortland County Medicaid to satisfy the lien against the estate and close
this legal action.
I’m currently holding 7 open mortgage foreclosure estates, 5 of which I am the
Administrator. Auctions for mortgaged properties are arranged by a court
appointed “Referee” (attorney) independent of our office. Surplus funds as a
result of sale are considered “funds paid into court”, transferred to the County
Clerk for recording, then deposited with the Treasurer (Trusts above) until
claimed and disbursed or deemed abandoned and transferred to the NYS
Comptroller.
3. Delinquent Tax Foreclosure Auction: In November a list of potential
foreclosure parcels was submitted to Phillips Lytle for title searches, which
requires ~ 90 days. The Petition of Foreclosure will probably be filed at the
County Clerk and mailed to property owners this month.
4. It’s not 1990 anymore. The County Clerk and Sheriff’s Office coordinated in
requesting email addresses and phone #’s of persons posting bail. This saves
time and money for the county and less money is sent to Albany due to funds
being deemed “abandoned” when we can’t locate claimants. In 2023 we have
zero abandoned bail and unclaimed Surplus Mortgage Foreclosure funds to send
to Albany. I encourage all County entities to adopt the policy of requesting
email addresses and phone #’s.
