HomeMy WebLinkAbout1966-12-28 7 TOWN OF DANBY PUBLIC HEARING - MINUTES ON TOWN OF DANBY JUNK CAR LAW The Town Board of the Town of Danby conducted a public hearing in the Town Hall , December 28th , 1966 at 7 : 30 P . M . for • the purpose of hearing all those interested in a local law pro- posed to be adopted by such Town Board entitled " Town of Danby Junk Car Law . " This local law regulate and control junk cars . • Town Board Members present : Supervisor James H . Cortright , Councilmen Donald Barber , Donald Makie , Justices Moses Peter and Floyd Dorn . Also Harry Hatfield , Zoning Officer . Others present : John Teti , George Kouf , Sidney Underswood , Roy Casterline , Ed Monroe , John Shepardson , Rick Dobson Supervisor Cortright opened the Public Hearing and asked the clerk to read official publication of such hearing on The Ithaca Journal and to read The Town of Danby Junk Car Law . The following persons were heard : Rick Dobson asked when will law go into effect referring to bad weather now and that he has 10 trucks he is using for parts . Also asked about junk dealer license . Supervisor Cortright said he knows of no local law providing for the licensing of the storage of junk cars . " There are three commercial junk yards which were in existence before the zohing law was passed and constitute a legal non- conforming use . They are Auto - Salvage of Ithaca , Inc ., George Kouf and Roy Casterline .; George Kouf asked if this law compared with Town of Newfield ' s Junk Yard Law . John Shepardson said his father had junk cars on his place 10 - 15 years . Supervisor Cortright said the burden of proof is with the offender . Mrs . Cortright suggested dismantling the cars and storing the parts in a building . Councilman Donald Makie said the law was primarily to prevent the spread of junk cars being stored , but there is a possibility that the board will pass an ordinance providing for the licensing of certain establishments to store junk cars on their properties under certain limited conditions . . Justice Peter : said this procedure to remove junk cars puts teeth in a state law which has no means of enforcement . Supervisor Cortright said the proposed ordinance is not to be confused with the Town ' s zoning rodinance which does not affect those persons with a non conforming use . No further questions or comments , Supervisor Cortright closed the public hearing at 8 : 25 P . M . for the purpose of auditing the books of the following town officers : Zoning Officer Harry Hatfield Justice of the Peace - Moses Peter Town Clerk and Tax Collector - Dorothy Roberts Supervisor - James Cortright DthetUb&Oiness to be taken care of : RESOLUTION #8 TRANSFER OF FUNDS Barber moved to rescind Resolution #3 ( 1966 ) . Seconded by Makie . 5 ayes , 0 noes , carried . RESOLUTION #9 BLANKET RESOLUTION P eter moved to adopt a blanket resolution authorizing Supervisor Cortright to transfer funds from surplus items to overdrawn items . Seconded by Makie . 5 ayes , 0 noes , carried . P eter moved to accept the Supervisor ' s Annual Report as his statement of receipts and disbursements for 1966 . Seconded by Barber . 4 ayes , 0 noes , carried . ' January 11 at 8 : 00 P . M . at the Board Room , 400 Lake Street was set to meet with Mr . ' Bardwell , Superintendent of the Ithaca City School District . Change of Town Board meeting night - Makie made the motion that the Town Board change their meeting night to the first Thursday after : the first Monday each month to give more time for monthly reports to be made out ' and give the time needed for bills coming into the town .
