M . Present : Supervisor James H . Cortright , Justices Floyd Dorn and Moses Peter , Councilmen Donald Makie and Donald Barber . Also Zoning Officer Hatfield and Highway Superintenden,- Chaffee and Mrs . Harriet Moore , Alfred Schoneman , Mrs : • Joan Stewart and Gabriel Radzik . Supervisor Cortright called the meeting to order . Minutes of the December meeting were read and approved . COMMUNICATIONS 1 . From . Office of Planning Coordination re : Urban Planning Assistance Project P - 61 , Local Agency Share $ 2 , 088 . 49 . 2 . Copy of minutes of Joint Municipal Sewerage Committee . 3 . - Association of Towns acknowledging receipt - of dues . 4 . From Department of Public Works re : Town Highway Improvement Program . 5 . From Department of Motor Vehicles e Subject : State Aid for Highway , Traffic 4nd Transportation Purposes beginning April 1967 . PRIVITEGE OF FLOOR •None from the Board . None from those present . REPORTS OF COMMITTEES Highway - none Zoning - Minutes of the Planning Board were passed to Board members re : The Proposed Zoning Map . Fire - none Cemeteries - Supervisor Cortright appointed Floyed Dorn to serve on the Cemetery Committee -w4-th 141e-s-e-s P-et-e-r , explaining the practice of clearing one or two cemeteries a year . Mrs . Vose wishes to donate more land to the town near the Adams Settlement Cemetery . Supervisor has to look into legal aspects . Insurance - Peter reported January 1 , 1967 renewal date on motor vehicles and highway equipment , therefore should do something by the 1st . Supervisor asked that Floyd Dorn work with Mose on this committee also and suggested the two meet with the Highway Superintendent . A time was set for December 5 , at 7 : 30 P . Zoning Officer reported he had received application for a building 'permit for house on Deputron Road . Road is listed as having no houses , therefore there a ie no numbers to give out , but there are two houses , Supervisor asked Mr . Hatfield to assign numbers on this road . Supervisor Cortright declared a recess : ; as Frank Saturn of the Cayuga Lumber Company arrived at 8 : 50 P . M . Renovation of the Town Hall was discussed . Meeting reopened at 10 : 00 P . M . • :Plan ring Board - no one present . Appeals Board - no one present . Board of Assessors - no - one present . • 70 Jennings Pond - Supervisor reported that the dike is in and completion will be done shortly . Town Office Building - Discussed during recess . Mr . Frank Saturn will prepare preliminary estimates by the end of the month . Estimates will be considered before any definite action is taken . Sanitary Land Fill - still in process of negotiating . Local Junk ; Car Law = Public Hearing date to be set . . � 1 NEW BUSINESS I , Councilman Makie made the motion that the Clerk write to the Board of Education asking that they meet With the Town Board to clarify the use of the Danby Elementary School by Danby Youth and to send a copy to the Community Council . Seconded by Barber . 5 ayes , O . noes , carried . Supervisor asked Mrs . Moore to provide him a list of all persons using the school Audit Date o December 28 , 1966 , 8 : 00 P . M . , Town Hall . , • Public tearing on Junk Car Law - December 28 , 1966 , 7 : 30 P . M . Town [Hall . Supervisor Cortright reported that Spencer School has asked to use Town of Danby dump temporarily . Supervisor Cortright reported County Tax Rate - $ 8 . 48 , Town ., • Tax Rate $ 16 . 71 , Total Tax Rate - $ 25 . 19 . 701 Plan = Justice Peter made the motion to pay the local agency share of $ 2 , 088 . 49 under the Urban Assistance Grant Agreement . Seconded by Makie . 5 ayes , 0 noes , carried . Makie asked if the Town Board minutes could go out week after Town Board meetings . Supervisor will call Ralph Wilbur to schedule meeting with the Fire Commissioners to discuss the water district in West Danby and the ruling regarding the Fire District . Highway Salaries - Peter. moved to grant a 250 an hour wage increase across the board for highway employees . Seconded by Makie . 5 ayes , 0 noes , carried . Open bids for highway dumptruck to be December 15 , 1966 , 8 : 00 P . M . at Town Barns . General Bills - Peter moved that General bills totalling • Hen 44A Warrant 12 be paid . Seconded by Makie . 5 ayes , 0 noes , carried . Highway Bills - Peter moved that Highway Bills totalling $ 2 , 953 . 57 # 110 through #115 as listed on Warrant 12 be paid . Seconded by Barber . 5 ayes , 0 noes , carried , Supervisor ' s - Reports - Makie moved to accept the Supervisor ' s Reports for October and November . They are a source of potential hurt to cbil4ren Lind ' of er s who msy. find ten an :attractive nuisance . They' are replete with broken glass , sharp torn metal edges and points , gasobin© remaining in tans of a highly explosive and combustible nature and hurtful acid in batteries , to 'mentLOA :but a few of the more obvious seurees of potential physical hurt found on these junk carp . Besides . this , tCh - se junk. ears constitute a blight on the townA s• lcndscape ; ! they destroy - the aesthetic qualities of the town and they are grsmerally other- dse unsightly . . Their . existence tends to depreciate net only the property on which . they . are located but also the property of other : . : personas in the neighborhood and town generally . They constitute the tovrt a less safe and less pleasant place in which to live and to do business . They hurt the welfare . of the town as a whole . The intent of this local law is . to establish a legal procedure for the removal of those . ,junk: can where t Ey tre found in the town outside duly licensed eetablishMents . ' . § 2. Definitions ( a ) A " junk car " , as the . term is. used herein , shall mean any motor vehicle whether. automobile , bus , truck , trailer , tractor , mobile hose or any other contraption originally intended for travel on public highways Which ie abandoned , Stored , . left or located by its . owner or any other person , or is permitted or condoned to be abandoned , stored , left or located by its owner or any other person , on private premises in. the Town of Denby outside any village in said town and outside. any establishment duly - licensed by the town and which just: car is unregistered by the State of New York or any other state and , not operable . The use of the term inothe singular herein is intended , where applicable , to include the plural . ( b ) The "enforcement officer " under this local law shall be the r town clerk . of the town unless the town board by resolution designates some other town officer as enforcement officer or by resolution e sta bl .she 's t ie position of ` enforcement officer for the town and appoints some qualified person thereto at ' a salary specified in such resolution , III) r ('j )` The. • term l . erson " shall : lean and include any individual person or' persons , firm , partner ship , ' corporation ' whether business , membership ,. religious , " charitable or of terc ise , any association or other unit or entity owning real property in the Town of Denby outside any ''tvllage. therein . § a Removal 'Procedure ( a ) Any junk car , as ' defined 'by ' section 1 herein a bovo , m..ay be removed from the premises on which '. it its located by the Town : of 'Denby in the manner hereinafter provided d (b ), The - enforcement ' officer upon detecting, a junk . car shall serve written 'notice on the person owning the premises on which the sat is ' Located ordering such person to remove the 'r same or cause the IIsame to :be: .removed therefrom within thirty days of the date of such I ,service . Such notice shall also contain a description of the premises , a . statement .as to the location thereon of a junk car , reference to this local ' lace and to the fact that t h e location of such junk car on : such pre uses , is in violation of this local' law-, If ° such premises are owned ' `.by more than per son , personal service . on on any one, of such . . owmer s't shall suffices however , as to any owner not personally served with such% notice , or if no ` owner can be located'' upon wwhom to make personal. • service , the , enforcemeneofficer shall mail such notice to owners - not , personally served , or to the owner and to all -the owners , if no 'owner was personally served. , by registered' mail , to their or his last kn'own • "address as shown on the latest cowpleted ' assessment roll of the town . In addition., such enforcement officer shall post conspicuous- ly a Copy of such notice on the premises' upon which such junk car is located ; . , ( 6) At the expiration of . thirty days after the . service or mailing and posting of such notice if such junk car has not been removed , the • . enforcement officer „shall report such fact . to the town board in . writing . ' Such report shalt , recite the violation , the notices given as required, hereunder and the failure to comply, therewith , and may include or refer , to photographs ' of such junk car and of the premises upon which it is located . Such report shall be entered in the official minutes of the town board by the town clerk and any such photographs • shall be filed in the town clerk ' s office . The town board shall there = , - after hold a public hearing on ten days ' prior notice published in the official newspaper of the town , if there be one , otherwise in a news - paper ' having general circulation in the town , and posted on the sign ' board of . the town maintained pursuant to § 30 ( 6 ) of the Town Law . . , - Such notice of hearing shall include . a statement that the purposes of the hearing are to give . the person owning such junk car an opportunity to be heard as to why the - same has not been removed and also for the town board to receive proposals for the removal of such junk car . ( d ) - After the hearing the town board may contract for the removal - . of such junk car . Any expense to the town in accomplishing such removal • may be assessed by the town board on the real . property from which such . - junk car ' was removed and the expense so assessed shall constitute a lien and charge on the real . property on which it is levied until paid or otherwise satisfied or discharged as other. town charges . § 4 This local law shall take effect thirty days after filing same as required by law .
