A Public Hearing was held by the Town Board of the Town of Cortlandville at the Peter
Alteri Jr. Municipal Garage, 3587 Terrace Road, Cortland, New York, with Supervisor Williams
presiding, concerning the 2023 Preliminary Budget.

MODIFICATION OF INCOME LEVELS FOR THE
REAL PROPERTY TAX EXEMPTION FOR SENIOR CITIZENS
A Public Hearing was held by the Town Board of the Town of Cortlandville at the Peter
Alteri Jr. Municipal Garage, 3587 Terrace Road, Cortland, New York, with Supervisor Williams
presiding, concerning the modification of the Real Property Exemption from Taxation for
persons over the age of 65 years in the Town of Cortlandville.

Councilman Donlick made a motion, seconded by Councilman Cobb, to receive and file
the Cortlandville Zoning Board of Appeals Minutes of October 18, 2022. All voting aye, the
motion was carried.

the Comprehensive Plan Implementation Committee Minutes of October 12, 2022. All voting
aye, the motion was carried.
Councilman Donlick made a motion, seconded by Councilman Cobb, to receive and file
the Cortlandville Planning Board Minutes of September 27, 2022. All voting aye, the motion
was carried.

Supervisor Williams offered privilege of the floor to Gary Freelove.
Town resident, Gary Freelove addressed the Board regarding the speed limit on Highland
Road and presented a petition signed by over 60 people requesting a reduction in the speed limit
from 40 MPH to 30 MPH for the entire length of the road. He explained that when the bridge
was under construction on Kinney Gulf Road, the traffic on Highland Road significantly
increased and has not subsided. Motorists travel at high speeds, averaging between 50-60 MPH.
In addition to his concern for the many pedestrians who walk on the side of the road, and for
those who walk their dogs, Mr. Freelove was concerned for the many families with children that
have recently moved to the Highland Road neighborhood. He explained that a number of those
family’s homes are located along the steepest part of the hill, closer to the intersection of Route
222. School buses make numerous stops on the road and some of the stops are not visible until
you are over the knoll of the hill, which creates a dangerous situation for the speeding vehicle,
the children, and the bus. He added that semi-trucks have to use their jake-brakes while going
down the hill in order to stop, which is not only loud but is dangerous. He voiced his concern
that the situation would be more dangerous with the upcoming winter weather and icy roads.
Mr. Freelove pleaded with the Board to take action on the petition that was being submitted.
In addition to the request for a reduction in speed limit, Mr. Freelove requested the Board
authorize the installation of a flashing stop sign at the intersection of Highland Road and Hoy
Road as well as a flashing sign that says “stop ahead” to warn drivers of the upcoming stop. He
stated that people have gone through the stop sign many times, and that there have been deaths at
that location. Mr. Freelove also suggested signs that read, “slow, children at play” be installed to
warn drivers that there are children in the area. Mr. Freelove thanked the Board for their
consideration.
Supervisor Williams thanked Mr. Freelove and acknowledged receipt of the petition. He
explained that after Board approval, speed limit requests are processed by the NYS Department
of Transportation (NYS DOT) via the County Highway Department. The requests take time as
the NYS DOT conducts a study prior to issuing its response. He suggested that Mr. Freelove
contact the County Sheriff to request radar signs be placed on Highland Road. Mr. Freelove
mentioned that the petition he presented includes the signatures of police officers who are also
residents of Highland Road, as well as bus drivers and representatives from the NYS home for
the disabled that is close to the intersection of Hoy Road.
Supervisor Williams offered privilege of the floor to Gerry Ruggiero.
Town resident, Gerry Ruggiero, commented on the recent opinion editorial published in
the Cortland Standard regarding executive session matters. He suggested the newspaper
“scratched the surface” and that their opinion ends up misleading to the public. While the Board
has to do public business in public, there are certain matters that require the Board to tal k in
private outside of the public’s purview. Mr. Ruggiero stated that the Cortland Standard saw that
there are certain topics the Board is allowed to go into executive session for, such as pending
litigation, as listed in the Open Meetings Law. He stated that what the Cortland Standard
missed, which ends up confusing the public, is there are certain things the Board discusses in
private that are not subject to the Open Meetings Law like attorney-client privilege.
He stated, if the Board has a contract that they want advice from the attorney on, it is
exempt from the Open Meetings Law/Public Officers Law. To avoid confusion, he suggested
the Board add an attorney-client privilege section to the agenda. If there are topics that qualify
for executive session the Board would follow the rules for executive session and state what they
are going to be discussing. If there are topics the Board wants to discuss with the Attorney
without the public knowing what they are going to talk about, the suggested the Board state that
there are no executive session topics, but there are matters to be discussed with the attorney that
are privileged.
Mr. Ruggiero stated that he has spent 10-12 years studying the Public Officers Law and
provided an example of a situation that occurred in the City of Cortland years ago involving
action taken in an executive session, which he said the Cortland Standard did not report on. In
closing, Mr. Ruggiero stated that the Board can have an attorney-client privileged conversation,
and hoped the public understood that and did not simply listen to what the media says.
Supervisor Williams thanked Mr. Ruggiero for his comments.

Councilman Leach made a motion, seconded by Councilman Donlick, to receive and file
correspondence from Charter Communications, dated October 21, 2022, and two dated October
28, 2022, regarding programming services. All voting aye, the motion was carried.
RESOLUTION #307 APPROVE MODIFICATION OF INCOME ELIGIBILITY
LEVEL FOR SENIOR CITIZENS TAX EXEMPTION
REQUIREMENTS FOR THE TOWN OF CORTLANDVILLE

ADOPTED
WHEREAS, the Town Board of the Town of Cortlandville by Resolution #194 of 1994, adopted
December 7, 1994, established the maximum income eligibility level of $16,200.00 for
exemption from taxation for real property owned by persons sixty-five (65) years of age or older,
and
WHEREAS, the Town Board of the Town of Cortlandville by Resolution #54 of 2008, adopted
February 20, 2008, modified the maximum income eligibility level up to $22,200.00 for
exemption from taxation for real property owned by persons sixty-five (65) years of age or older,
with the percentage of exemption based on the maximum annual income range as authorized by
Real Property Tax Law § 467-d, and
WHEREAS, the Town Board desires to modify the levels of income and corresponding
exemptions for persons over age sixty-five (65), and
WHEREAS, a Public Hearing was held by the Town Board on November 9, 2022 in relation to
such modification, now therefore
BE IT RESOLVED, that the maximum income eligibility level of $22,200 as set forth in
Resolution #54 of 2008 is hereby modified pursuant to and in accordance with Real Property Tax
Law § 467-d, and it is further
RESOLVED, the percentage of exemption shall be based on the maximum annual income range
specified herein, as follows:

AND IT IS FURTHER RESOLVED, this modification for Senior Citizens Tax Exemption shall
take effect with the 2023 Town of Cortlandville Final Roll.

Under new business, Town Clerk Rocco-Petrella informed the Board that the water and
sewer delinquent notices were mailed. Accounts with balances over $60.00 would be relevied
onto the 2023 Cortlandville Town/County Tax Bill if not paid by November 30, 2022. The
Board would be presented with the list of delinquent accounts as required at the next meeting.
Attorney DelVecchio reported:
Executive Session / Attorney-Client Privilege:
Attorney DelVecchio briefly commented on the topic of attorney-client privilege. He
stated that moving forward, it may be prudent that at the end of each meeting if an executive
session is appropriate the Board identify the issue to be discussed as it has in the past. But, if
anyone on the Board, especially the Supervisor, wants to speak to him privately amongst the
group, the Open Meetings Law has always had that exception. His suggestion was for the
attorney-client discussion to be had at the end of the meeting if needed and to indicate to the
public that they are going to meet in an attorney-client setting and discuss matters. He stated that
the Board can choose to identify those matters, but they don’t have to as those discussions are
exempt from the Open Meetings Law. He stated it was important that if the Board wants to
speak with him in a private setting to please let him know.
Town Board Member reports:
Councilman Guido asked the Board to adopt a resolution he drafted in honor of Veterans ,
and prior to Veteran’s Day. Upon adoption, Supervisor Williams asked the Town Clerk to
forward a copy of the resolution to the Cortland County Veterans Administration.

BE IT RESOLVED, it is with great honor and respect that the Cortlandville Town Board thanks
the Veterans of our community for their time, bravery, and sacrifice for this Country. We are
forever grateful for what you've done to maintain America's freedom. Thank you for your
bravery, and the example you set for us all. We honor all current and former members of the
Armed Services. Our country’s greatness is built on the foundation of your courage.
Councilman Guido informed the Board he attended the last CCTVS meeting. The topic
of discussion was the new emergency alert program for Cortland County. He explained that the
new program is basically a reverse 911 system available to the public to receive emergency alerts
via Hyper-Reach on cell phones. The public may register for the alert system by visiting
cortlandcountyfire.org. Fliers were available to public at the Town Clerk’s Office.
Councilman Donlick provided an update regarding the progress of Greenspot JC, LLC to
install electric vehicle charges in the Town of Cortlandville. He explained that Greenspot has
filed the permitting paperwork with National Grid, however the process could take time as there
is an overwhelming number of permits being requested for electric vehicle chargers. The project
was progressing as expected; the chargers were not planned to be installed until 2023. It was
also mentioned that the location of the chargers has not been decided.
Councilman Leach asked the Board to take action with regard to Mr. Freelove’s request
for a reduction in speed limit on Highland Road from 40 MPH to 30 MPH.
RESOLUTION #309 AUTHORIZE REQUEST TO REDUCE THE SPEED LIMIT ON
HIGHLAND ROAD IN THE TOWN OF CORTLANDVILLE

WHEREAS, a petition was received from Town residents to reduce the speed limit from 40
MPH to 30 MPH on the entire length of Highland Road, a distance of approximately 1.03 miles
(5,438.4 feet) between the intersection of NYS Route 222 and the intersection of Hoy Road
within the Town of Cortlandville, and
WHEREAS, Highland Road is a Town road, therefore
BE IT RESOLVED, the Town Board does hereby authorize and direct th e request to reduce the
speed limit on Highland Road from 40 MPH to 30 MPH, a distance of approximately 1.03 miles
(5,438.4 feet) between the intersection of NYS Route 222 and the intersection of Hoy Road
within the Town of Cortlandville, be submitted to the NYS DOT for approval, via the Cortland
County Highway Superintendent for his input as required.
Supervisor Williams reported:
Supervisor Williams informed the Board that the Town received its last sales tax check
for the year which was $845,000 more than budgeted. He stated that including the excess sales
tax from 2021, the Town had approximately $2 million in unexpended revenue from sales tax.
He attributed a large portion of the sales tax revenue to PBR Tournaments and the Gutchess
Lumber Sports Complex (GLSC).
He also mentioned that the Fire Department and Code Department went through an audit
with our insurance carrier [for workers’ compensation]. The rating was excellent, which meant
that the insurance should not be increasing.
Lastly, Supervisor Williams noted that he has been working on the financial formulation
for GLSC and planned to have a report to the Board soon regarding a plan for financing for the
project.
Councilman Guido reverted back to discussion on the speed limit and request for signage
on Highland Road. He asked Highway Superintendent Drach if he could look into the request,
which he stated he could and would report back to the Board.
At this time in the meeting, the Board proceeded with action on agenda items.

construct a 72.25’ x 63’ (4,551.75 sq. ft.) cold storage building with an attached 24’ x 63’ (1,512
sq. ft.) lean-to, for property described as 607 NYS Route 13 the Town of Cortlandville, tax map
#105.00-03-12.000.
Councilman Guido made a motion, seconded by Councilman Cobb, to receive and file
correspondence from Robert Corpora, Cortland County Administrator, dated October 19, 2022,
regarding ARPA Funding Quarterly Reporting, as well as the Town Supervisor’s response letter,
dated October 25, 2022, indicating that the Town has not incurred any expenses through
September 30, 2022 in regard to the Gutchess Park project. All voting aye, the motion was
carried.

Cortland County Planning Department Review and Recommendations, dated October 14, 2022,
and Cortland County Planning Board correspondence indicating that no action was taken/no
recommendations made due to the lack of a quorum, dated October 20, 2022, regarding the
Aquifer Protection Permit application submitted by Route 13 Inc./Essex Steel Co. Inc. to

Councilman Cobb made a motion, seconded by Councilman Leach, to receive and file
correspondence from Kevin Whitney, Cortlandville Fire District Chairman to the Town of Solon,
dated October 19, 2022, regarding the end of the CVFD contract with the Town of Solon for fire
protection services effective December 31, 2022 at midnight. All voting aye, the motion was
carried.

No action was taken with regard to agenda item I-15 and the proposed Sponsorship
Agreement (dated October 19, 2022) between the Town of Cortlandville and Guthrie Clinic
regarding sponsorship benefits for Gutchess Lumber Sports Complex. Attorney DelVecchio
asked that the proposed contract be discussed in Executive Session.

WHEREAS, pursuant to Chapter 98 of the Code of the Town of Cortlandville the Highway
Superintendent of the Town is authorized by Section 98-4 to enforce grass and weed control,

weed control charges for the year 2022, as submitted by the Town Highway Superintendent and
Code Enforcement Office, be relevied onto the 2023 tax roll of the Town of Cortlandville:

Councilman Leach made a motion, seconded by Councilman Cobb, to receive and file
correspondence from the New York State Public Service Commission, dated October 31, 2022,
regarding the letter of opposition submitted on behalf of the Town in regard to the New York
State Electric & Gas Corporation’s (NYSEG) latest rate filing. All voting aye, the motion was
carried.
With no further comments or discussion to be heard, Supervisor Williams requested the
Board convene to an Executive Session to discuss a contract. Action may or may not be taken
afterwards.
Councilman Leach made a motion, seconded by Councilman Cobb to recess the Regular
Meeting to an Executive Session to discuss a contract. All voting aye, the motion was carried.
The meeting was recessed at 5:47 p.m.
