ORGANIZATIONAL MEETING OF THE ITHACA TOWN BOARD
Monday, January 9, 2017

1. Call to Order and Pledge of Allegiance Meeting called to order at 5:30 p.m.
2. Persons to be Heard
Herb Engman — Mr. Engman wanted to address the board regarding the issue of changing the
fire protect district to exclude Ithaca College saying that he would like the board to pursue that.
He stated that he was a little irritated when he read in the paper that it sounded liked the
President of Ithaca College was saying that the town went to him and asked, and when they
wouldn't give us any money, we threatened them with an action to get them to respond. Mr.
Engman wanted to remind the board that he went to President Rochon at least eight years ago to
ask them to make a contribution toward fire protection and many times after that. He added that
he even knew one of the trustees at the time and he asked her to see if she could talk with the rest
of the trustees and see whether they could make a contribution and she immediately said no,
we've talked about that before and we aren't going to do that. That left him with the impression
that even before he started asking for a contribution, others have, but there has been at least eight
years of effort in trying to get a contribution and it is time to try something other than just asking
because obviously it hasn't worked.
Mr. Engman stated that the point he wanted to make was that he sees absolutely no difference
between paying for your sewer, paying for your water, and paying for your fire protection and
that is what we are asking them to do. Pay for the fire protection just as other people in the town
do and it should be pointed out that Cornell makes a $750K a year contribution to their fire
protection, making Ithaca College the only major educational institution locally which doesn't do
that.
Mr. Engman closed by urging the board to pursue this aggressively and stating that he felt it was
a good solution to the problem if there is not agreement forthcoming.
Dylan Wattros —Mr. Wattros stated that he purchased a house at the end of Kendall Ave which
was built in 1986 and there is no paperwork on it because that is prior to substantial permits
being required. Because the house is at the end of Kendall Ave, he is not able to get a building
permit because my property ends just about at the end of the road but 15' feet of the house does
not front on a state identified roadway.

Mr. Bates explained that is a 1080a issue which would need an open development area to
allow any permits to be issued. The road needs to be declared owned by one of the landowners
or classified as an open development area.
Mr. Goodman added that there are a number of lots in that area and the town road stops before
those lots which raises the issue for all of them. The Board referred the issue to the Planning
Committee.
3. 5:30 p.m. Public hearing regarding a proposed local law "Authorizing a Monetary Gift
to the City of Ithaca to Support Gorge Rangers for the Six Mile Creek Gorge"
Julie Holcomb, City Clerk — Ms. Holcomb reported on last year stating that there really were
signs of success in 2016 over 2015. Last year there were huge numbers in the gorge and with the
assistance from the Town and County the number were reduced from: number of calls to law
enforcement down from 45 to 27; 46 instances were voluntary compliance was achieved;
group sizes reduced where in 2015 there were groups as large as 250, in 2016 we had one
instance of a group between 90-100 people and 6 instances of groups at 50-60 and 4 instances
where there were 40-50 people. The large crowd came in late August when Ithaca College
resumed and those were probably the most problematic times.
Ms. Holcomb stated that they hired 3 new Rangers and had one returning Ranger who were
recruited from the TO Criminal Justice program and they worked out great. They were outfitted
with new uniforms with body cameras and they had police radios. They partnered with the
Sheriff and Police departments and they provided training on a number of topics and they were
amazing.
Ms. Holcomb continued by saying that there were no fatalities and only two injuries compare to
4 in 2015; 37 instances of vandalism which included tree damage, spray painting on the falls,
fires, litter and the like and we still have a long way to go on that type of issue, but the types of
instances such as needles, camp sites and similar were not seen. She felt the enhanced program
of putting Rangers out in pairs and increasing their hours was very successful.
Ms. Holcomb stated that there are still parking issues and noise issues, but while in 2015 there
were reports of pod lighting and amplifiers for nighttime parties, this year the worst we saw were
a couple of beer pong tables left.
Ms. Holcomb said that they are asking for the Town's continued support but it is a promising
start. She reported that the Mayor appointed a small task force to look at some of the remaining
issues and ways to keep people out of the dangerous areas of the water; we are not targeting
families looking for crayfish or casual hikers, we are targeting larger parties with alcohol and
dangerous behavior such as cliff jumping. The task force is looking at giving the Rangers the
authority to issue parking tickets and signing some City areas as No Parking areas. She added
that if the Town is interested in having them do the same in the town, we should discuss and
coordinate that. Another topic is looking at restricting totally the really dangerous areas.
Mr. Goodman stated that he would follow up with Ms. Holcomb on the Rangers issuing tickets.

Mr. Goodman opened the public hearing at 5:52 p.m. No one wished to address the board on
this topic and the hearing was closed.
TB Resolution 2017 - 001: Adopt Local Law 1 of 2017 entitled "Authorizing a Monetary
Gift to the City of Ithaca to Support Rangers for the Six Mile Creek Gorge"
Whereas, pursuant to the Town's New York State Municipal Home Rule powers, a local
law may be adopted to authorize the Town to make a gift to another municipality where the gift
furthers a public purpose of the Town,
Whereas, at its meeting on December 29, 2017, the Town Board of the Town of Ithaca
reviewed and discussed the proposed local law and adopted a resolution for a public hearing to
be held by said Town Board on January 9, 2017 at 5:30 p.m. to hear all interested parties on the
proposed local law, and
Whereas, notice of said public hearing was duly advertised in the Ithaca Journal, and
Whereas, said public hearing was duly held on said date and time at the Town Hall of the
Town of Ithaca and all parties in attendance were permitted an opportunity to speak on behalf of
or in opposition to said proposed local law, or any part thereof, and
Whereas, pursuant to the New York State Environmental Quality Review Act
("SEQRA") and its implementing regulations at 6 NYCRR Part 617, it has been determined by
the Town Board that approval of the local law is a Type II action because it constitutes "routine
or continuing agency administration and management, not including new programs or major
reordering of priorities that may affect the environment," and thus approval of the local law is
not subject to review under SEQRA, now therefore be it
Resolved, that the Town Board hereby adopts Local Law 1 of 2017 entitled
"Authorizing a Monetary Gift to the City of Ithaca to Support Gorge Rangers for the Six
Mile Creek Gorge," and it is further
Resolved, that the Town Clerk is hereby authorized and directed to file said local law
with the Secretary of State as required by law.

Mr. Wilcox introduced himself to the Town Board saying that he has not met a couple of the
newer members and thanked the board for the independence the Planning Board has.

Whereas, the Planning Board has recommended that Fred Wilcox be reappointed as Chair of the
Planning Board for 201,7 and
Whereas Fred Wilcox has indicated his willingness to serve another term as a regular member of
the Planning Board, now therefore be it
Resolved, that the Town Board hereby re-appoints Fred Wilcox as Chair of the Planning Board
for 2017 and as a regular member of the Planning Board through December 31, 2023.

Whereas the Zoning Board of Appeals members has recommended that Rob Rosen be
reappointed as Chair for the year ending December 31, 2017, and
Whereas the William Highland and Caren Rubin have indicated they would like to be
reappointed as Alternate Members and Rob Rosen has indicated he would like to be reappointed
as a Regular Member, now therefore be it
Resolved that the Town Board of the Town of Ithaca hereby reappoints Rob Rosen as
Chair for the year 2017 and as a Regular Member for a five year term and reappoints William
Highland and Caren Rubin as Alternate members for the year 2017.

TB Resolution 2017-005: Set Dates for 2017 Meetings of the Town Board
Whereas the Town Board of the Town of Ithaca meets on the first Monday following the first
Tuesday of each month at 5:30 p.m. and
Whereas the Town Board also sets aside the fourth Monday of each month for an additional
meeting; these second meetings are commonly called study sessions which begin at 4:30 and are
held in a smaller meeting room. These study sessions focus on reports from committees and
presentations to the board with action items added only when necessary and
Whereas the Town Board also sets aside the first Thursday in October for a meeting at 5:30
whose sole focus is the review and discussion of the Preliminary Town of Ithaca Budget, now
therefore be it

7. Discuss and consider 2017 Association of Towns' Resolutions and consider designation
of 2017 Official Delegate and Alternate Delegate for the New York State Association of
Towns 2017 Annual Meeting
The board discussed the submitted resolutions and Ms. Leary talked about the resolution
regarding wind facilities and whether they were trying to stand in the way of wind power. Mr.
Goodman stated that he assumes that might be some of the thought behind it, but the resolution is
even handed in his opinion, asking for more involvement in the siting of them not stopping them.
Ms. Leary stated that it would be nice to actually oppose the property tax cap instead of asking
for it to be reformed or take a harder position and call it what it is; a game to shift blame to local
government instead of state government. Mr. Goodman said it was interesting that they talk
about the gross receipts tax on utility bills which cities and villages can collect but towns cannot
and they mention that as a new source of revenue because of the tax cap. Some discussion
followed but the resolution was supported as is. Mr. Goodman explained that if we want to
propose a resolution to abolish the tax cap we would need to submit a resolution for next year
according to the bylaws and processes established.
TB Resolution 2017 - 007: Naming of Official Delegate and Alternate for the Year 2017 to
the New York State Association of Towns Annual Meeting and Support/Non Support for
Reported Resolutions
Whereas, the NYS Association of Towns Annual Meeting is held in New York City and
Whereas, the Town of Ithaca is a member in good standing with the NYS Association of
Towns and is eligible to have voting rights at the said meeting and
Whereas, it is necessary for the Town Board to appoint an Official Delegate and
Alternate who will have voting rights on behalf of the Town of Ithaca at the said meeting and
Whereas, the Town Board has reviewed the Reported Resolutions from the Association
of Towns of the State of New York dated received January 4, 2017, now therefore be it
Resolved, that the Town Board of the Town of Ithaca hereby appoints Tee-Ann Hunter as
the Official Delegate and Pamela Bleiwas as the Alternate Official Delegate on behalf of the
Town of Ithaca at the 2017 NYS Association of Towns Annual Meeting; and be it further
Resolved that the Town Board of the Town of Ithaca does hereby support Reported
Resolutions submitted by the Association of Towns.

8. Discuss and consider a budget amendment to increase the appropriation for 2017 Joint
Youth Commission programs
TB Resolution 2017-008: BUDGET AMENDMENT — Increase to Budget Appropriation
for 2017 Joint Youth Commission Programs
Whereas, the Town values highly its Youth Programs for the many benefits provided for
the Town's young people; and
Whereas, the Joint Youth Commission (JYC) has ably facilitated many of the Town's
youth programs for many years; and
Whereas, the Town has received a communication from the JYC requesting an increase
in the 2017 Ithaca Town Budget for Youth Programs due, in part, to increased contributions from
Tompkins County approved by the County Legislature subsequent to the Town Board's approval
of the 2017 Ithaca Town Budget on November 7, 2016; and
Whereas, the JYC has requested an increase to the Coddington Road Community
Center's Counselor-In-Training Program from $13,000 to $15,575 to 1) provide funding for
increase in the minimum wage for 2017, and 2)to provide one additional youth training position.
Resolved, that the allocation to the JYC Programs in the 2017 Ithaca Town Budget be
increased by $2,575 as follows:
• General Townwide Fund—Expenditures
- Account A7320.461: Coddington Road Community Center — Summer Camp
Counselor-In-Training Program is increased from $13,000 to $15,575.
And be it further
Resolved, that the revenue for the JYC Programs in the 2017 Ithaca Town Budget be
increased by $1,222 as follows:
• General Townwide Fund —Revenue
- Account A2350: Youth Services - County is increased from $65,435 to $66,657.

9. Discuss and consider authorization for the Town Supervisor to sign contracts on behalf
of the Town
Mr. Goodman noted that the contract for the contribution to the City Parks will be brought to the
board as a local law next month because it is a gift given that the benefit we receive is less than
the amount we are giving.

TB Resolution 2017 — 009 : Approval and Authorization for the Town Supervisor to
Execute Annual Contracts

10. Continue discussion regarding changes to the Capital Improvement Program (CIP) as
it pertains to the Agreement for the Expenditure of Highway Monies
Mr. Goodman reviewed the changes due to the heavy time commitment needed for the
Maplewood project. Mr. Weber added that additional impacts will be discussed at the next
Public Works Committee.
TB Resolution 2017 -010: 2017 Agreement for the Expenditure of Highway Monies
AGREEMENT between the Town Highway Superintendent of the Town of Ithaca,
Tompkins County, New York and the undersigned members of the Town Board.
Pursuant to the provisions of Section 284 of the Highway Law, we agree that moneys
levied and collected in the Town for the repair and improvement of highways, and received from
the State for State Aid for the repair and improvement of highways, shall be expended as
follows:
HIGHWAY:
1. GENERAL REPAIRS. The sum of $185,000 shall be set aside to be expended for
primary work and general repairs upon 7 miles of town highways, including sluices, culverts,
and bridges having a span of less than five feet and walks or the renewals thereof.

2. PERMANENT IMPROVEMENTS. The sum of $185,000 shall be set aside to be
expended for the permanent improvement of town highways, including paving, guide rails, etc.
The sum of $500,000 was identified to be expended for the permanent improvement of Perry
Lane to reconstruct curbs/gutters, drainage facilities and replacement of gravels and asphalt of
0.20 miles of road. Due to constraints on staff time for 2017, design of this project cannot be
completed; therefore the following projects will be substituted:
Northview Road, mill and fill, $200,000, Northview Road West, mill and fill $100,000 (2019
CIP) and Juniper Road, $150,000.

Whereas, Section 142, Subdivision- l(a) of the New York Highway Law authorizes the
Town Board to adopt a resolution permitting the Town Superintendent of Highways to purchase
equipment, tools and implements without prior approval of the Town Board in an amount or
amounts to be fixed by it from time to time; and
Whereas, the Town Board adopted a 2017 Ithaca Town Budget which included monies
for the purchase of vehicles, tools and equipment; and
Whereas, it is determined by this Board to be reasonable and proper and in the best
interests of the efficient functioning of the Public Works Department that the Town
Superintendent of Highways be granted permission to purchase such items without its prior
approval in amounts not to exceed the approved respective budgeted amounts; now therefore be
it
Resolved, that the governing Town Board of the Town of Ithaca does hereby authorize
the Town Superintendent of Highways to spend amounts, not to exceed what is identified within
the adopted 2017 Ithaca Town Budget, without the prior approval of this Board, for the purchase
during fiscal year 2017 of vehicles, tools and equipment to be used for highway maintenance,
construction, reconstruction, and/or snow removal; except when the lowest responsive and
responsible bidder is not selected and be it further

Mr. Goodman noted that a map and a chart of the parcels that Ithaca College owned properties.
Tax parcels in red, the main campus and two undeveloped parcels are included on the resolution
as the parcels to be exempt. College Circle Apartments is not being included in the resolution
because they have a PILOT that includes payment for fire protection. The parcels in blue are not
tax exempt are therefore paying for fire protection now.

14. Discuss Planning Committee's progress regarding two-family dwellings and
consider setting a public hearing,if needed, to extend the moratorium on same
Mr. Goodman asked Mr. DePaolo to give an update on what has been discussed at the Planning
Committee regarding the issue.
Mr. DePaolo stated that the Committee has been tasked with researching various rental property
oversight strategies related to issues from occupancy, owner-occupancy rules, a rental property
registry and what may be advantageous for us.
He stated that the Committee is in favor of pursuing a rental property registry that would enable
Code Enforcement to gain access to dwellings that they are currently precluded from entering;
they would be able to access dwellings periodically at determined intervals which would enable
them to make sure that buildings that are listed for uses are in fact being used for those purposes.
Mr. DePaolo stated that they haven't discussed in great detail the owner-occupancy provision,
but he thought that they are generally in favor of it in certain areas, recognizing that any kind of
oversight or restrictions would have an impact on our overall housing stock, so we also want to
simultaneously look at allowing duplex housing in certain areas of the town to offset any
potential impacts that we might have by trying to preserve traditionally single-family
neighborhoods.
Mr. DePaolo said that is where they are now and he thinks there is agreement on the Committee
on the direction they want to head in but given the timeframe under which we had to work, it will
not be possible for us to draft and enact legislation by the expiration of the moratorium and that it
would be prudent to extend the moratorium for perhaps three months to get a law on the desks

that we could consider which is probably ambitious. He thought we could start by considering
components of regulations that exist in other municipalities to try and save some time, then go
from there.
Mr. DePaolo stated that if we were to allow the moratorium to lapse, there is the likelihood that
some of the protections we are trying to achieve would be undermined and so it is time for us to
figure out how serious we are and start writing legislation.
Ms. Hunter asked if the actions would be town-wide or using overlays. Mr. DePaolo responded
that it was his impression that the authority would be town-wide so we don't limit ourselves;
where owner-occupancy would be required we have discussed overlays but we don't have the
construct in the town yet to apply those so he assumed the town would move forward with town-
wide for the sake of expediency and use existing zoning lines and move forward with that idea
through the rezoning process. He added that we did exempt the high density residential zones
and owner-occupied residences now so he did not feel we had created an unmanageable hardship
for the majority of our residents with this moratorium and it was reasonable to think we can have
the extra time.
Ms. Ritter asked about "accessory" apartments and Mr. DePaolo responded that we can either
change our definition for "accessory" to apply to owner-occupied and two-family to non-owner-
occupied adding that the precedent is there in other municipalities but an overlay will take
significantly more time.
Some discussion followed on how we would extend the moratorium and Ms. Brock explained,
adding that we have done this before and it would be a local law with associated public hearing.
Mr. Goodman stated that he would look to get a draft for the study session and depending on
timelines, a special meeting may need to be held.

16. Report of Town Officials, Committees and review of Correspondence
Mr. Goodman reviewed the study session agenda; Housing Summit review and discussion and
the Planning Staff's Zoning Report which has gone through the Planning Committee.
Mr. Goodman reported on the status of the petition from resident in the Renwick Heights area
regarding short term rentals such as Air B&B rentals and some of the residents went to the
Planning Committee.
Mr. Goodman reported on the status of the petition from a resident, David Stotz, regarding the
ditches in the Grandview area and wanting them replaced with piping. The Public Works
Committee discussed it in December and they are looking into the request.
Mr. DePaolo noted that regarding the short-term rental petition, the Committee had suggested
that the Board consider raising the penalties as a deterrent. It seemed to be the most expedient
thing we could do that might have the greatest effect rather than taking a macro-long-term look
at the issue while we are dealing with the moratorium and rezoning. The thought was it might
create a disincentive for those who are constantly abusing the system and operating a hospitality
business without a permit in a residential neighborhood.
Discussion followed with Mr. Goodman noting that they are illegal under our zoning but we
don't have the enforcement power to go after them. Ms. Brock noted that this issue should be
discussed and the Town Board looked at this about 10 years ago when someone on the lake was
doing short-term rentals and at that time, she thought the interpretation was that it was allowed in
our zoning and then a few years later the Air B&B started and New York State determined that it
was illegal in the State under Building Code but she was not sure it was prohibited under our
zoning as long as they rent to a family because families are permitted to rent houses in our zones.
She went on to say that we can change our zoning to prohibit rentals, but at that time, that was
the only issue out there and the Board decided it wasn't a big enough issue to address at the time
and maybe now it is. The Board would have to look at the uses they want to allow and it is more
complicated than it sounds; what about people who just rent their houses for graduation
weekends or sabbaticals and on and on.
Mr. DePaolo stated that the discussion in Committee was not the people who live in their houses
and vacate for a couple of weekends a year, but people who buy houses for the sole purpose of

operating short-term rentals. He said he understands there is a slippery slope but those houses
are the ones that generate the complaints; the ones owned and occupied by owners generally do
not.
Ms. Brock responded that the Board would have to change its zoning to address those types of
uses and Mr. Goodman added that it is a big issue in the County because they made a deal with
Air B&B to accept taxes without checking with the municipalities regarding the legality of the
use.
Mr. Bates stated that he is interpreting our Code as our Code is silent so if it is not in our Code it
is not allowed and then he turns to New York State and its definition of short-term and long-term
rentals. He added that he was not aware of the issue on the lake from the past, but this would
affect those properties on the lake that do this.
Mr. Goodman stated that the Committee was trying to do a simple fix to address the concerns.
Ms. Leary stated that the Committee is looking at something that would allow the couple of
weekends a year which would alleviate the overcrowding which is a different use, a commercial
use.
Mr. DePaolo followed up and said our Code is based on uses and if it doesn't allow commercial
uses and you buy a house for the sole purpose of renting it out, that is a business and not a use in
our zone. Ms. Brock responded that that was not the interpretation in the past and that may be
the interpretation now; uses allowed include single and two family dwellings and as long as one
family was renting, the Town said we do not have any restrictions on length of rentals, whether it
is one day, one month, six months or one year. She added that she has no leaning either way, but
historically that was the interpretation and conclusion and the "family" would have to fit our
definition of "family, so we will have to be very clear in our law. She suggested the Board
choose its policy and then make sure the law clearly spells out what can and cannot be done in
terms of uses.
Ms. Hunter stated that she would like to have a bigger discussion about this as a policy because
there are a lot of implications to this. She thought that it is an opportunity for some to generate
revenue for themselves and she would hate to turn everything over to corporate entities because
private individuals are no longer allowed to do things with their property. That said, she would
be interested to know how many people do do this and what kind of revenue they generate and
how important it is to them. She added that there are other municipalities that have dealt with
this and put restrictions or requirements that owners be in the area and able to respond to
complaints within a certain period of time or things like that and this seems draconian to her to
have a blanket regulation. Ms. Hunter stated that she does not like to enact laws that we are then
not able to enforce, don't have the staff to enforce, and then only enforce the ones that are a
problem and we know by a complaint, yet there are countless of others out there doing the same
thing and flying under the radar.

Mr. Goodman suggested the Planning Committee continue discussion and the Board continue at
the study session or set aside another time to determine which direction the majority of the board
wants to go in.
Mr. Goodman reported that the County's Bicentennial is this year and they are giving each
municipality a new historic marker; we have one outside of town hall talking about how the town
was created and we need to tell them where we want the new marker. Mr. Howe had suggested
the East Shore Park because you can see the Town of Ulysses where the Town was created from
and you can actually see the Town of Ulysses from the park. The Board thought that was a good
idea.
