HomeMy WebLinkAbout5-9-12 Regular Meeting and Public Hearing.pdf Town of Enfield Public Hearing on Site Plan Review Local Law and Regular Town Board Meeting Minutes Enfield Community Building Wednesday, May 9, 2012 6:30 p.m. Present: Town Supervisor Roy Barriere, Town Councilperson Chris Hern, Town Councilperson Ann Rider, Town Highway Superintendent Barry Rollins, Town Clerk Alice Linton. Absent: Town Councilperson Vera Howe-Strait, Town Councilperson Debbie Teeter Supervisor Barriere opened the public hearing at 6:30 p.m. by leading the assemblage in the Pledge of Allegiance to the Flag. Supervisor Barriere read the notice of the public hearing that was published in the Ithaca Journal. Cris McConkey of 402 Aiken Road spoke regarding field drainage from a neighboring farm. When a neighbor returned from being out of town he discovered a deep trench and trees cut close to his property line. Mr. McConkey feels the Town of Enfield is ill prepared for industrialized agriculture and extremely limited in what can be done about problems. He feels there should be an addition put in the Site Plan Review Law regarding notification of adjacent properties in the instance that there is a large agriculture drainage project planned. Mary Jo Lovelace of 2504 State Rt. 79 stated she is a landowner close to a large farm also, and agrees there should be more protection in the Site Plan Review Law. Nancy Spero of 68 North VanDorn Road asked for clarification on what the fines would be since they are related to the cost of a building permit. Code Enforcement Office Alan Teeter responded building permits are on a sliding scale, so a small project would be a small fine and a large project would be a larger fine. Ms. Spero would like to see that the fines are as high as legally allowed. Supervisor Barriere closed the public hearing at 6:42 p.m. Supervisor Barriere stated that since there are two members of the board not present, he will table the moratorium on hydraulic gas drilling and moving forward with the Site Plan Review Law. Privilege of the Floor: Martha Fischer of 772 Bostwick Road gave an update on the “Tighten Up Enfield” home energy conservation project. This is an effort to help Tompkins County reach its goal of reducing carbon emissions by 80% by 2050. Another event is being planned for the fall. Mary Jo Lovelace of 2504 State Rt. 79 stated she is very disappointed there are two board members missing as she would like to see progress on the moratorium. Approval of Minutes: Councilperson Rider moved, with a second by Councilperson Hern to approve the minutes of the April 11, 2012 regular board meeting. Vote: Councilperson Hern aye, Councilperson Rider aye, Supervisor Barriere aye. Councilperson Howe-Strait and Councilperson Teeter absent. Carried Enfield Town Board Regular Meeting, May 9, 2012 2 Correspondence: Notice that the Ithaca-Tompkins County Transportation Council will be holding a policy committee meeting May 15 from 2-4 p.m. at 215 N. Tioga Street, Ithaca. Memo from the State of New York Department of Taxation and Finance with Certificate of Final Special Franchise Full Values for NYSEG, Verizon New York, Inc., Trumansburg Telephone Company and Haefele TV, Inc. Notice of the Tompkins County Healthy Homes Rehabilitation Program, with a pre-application included. Media release stating that Bolton Point Water clinched top honors at Tompkins County Taste Test. Newsletter from the Tompkins County Department of Assessment. Budget Amendment: Supervisor Barriere moved, with a second by Councilperson Rider to accept Resolution #2012-29. Resolution #2012-29 Resolution to Amend Voucher Numbers for Warrants #1-4 for 2012 WHEREAS, the new financial software for the Town of Enfield, Williamson Law, maintains all vouchers within the General Fund, Special Fund, and the H-Fund in numerical sequence, therefore, be it RESOLVED, that SF vouchers 1 & 2 be changed to 38 & 39, H-Fund vouchers 1-13 be changed to 40-52, General Fund vouchers 38-71 be changed to 53-86, SF voucher 3 be changed to 87, H-Fund vouchers 14-18 be changed to 88-92, General Fund vouchers 72-99 be changed to 93-120, H-Fund voucher 19 be changed to 121, and General Fund vouchers 100-123 be changed to 122-145. Discussion: Supervisor Barriere explained this resolution was necessary to number vouchers in accordance with the new Williamson Law Bookkeeping program where the H Fund, Special Fund and General Fund vouchers are all put together in sequence because all these funds go through the General Fund for payment. This resolution will change the numbers for the first four warrants of 2012. The Highway Fund is kept separate. Vote: Councilperson Hern aye, Councilperson Rider aye, Supervisor Barriere aye. Councilperson Howe-Strait and Councilperson Teeter absent. Carried Audit Claims: Councilperson Hern moved, with a second by Councilperson Rider to authorize the supervisor to pay General Fund vouchers #146 to #168 dated May 9, 2012 in the amount of $11,880.96 and Highway Fund vouchers #77 to #95 dated May 9, 2012 in the amount of $12,146.76. Vote: Councilperson Hern aye, Councilperson Rider aye, Supervisor Barriere aye. Councilperson Howe-Strait and Councilperson Teeter absent. Carried County Legislator’s Report: No report Enfield Town Board Regular Meeting, May 9, 2012 3 Highway Superintendent’s Report: Highway Superintendent Buddy Rollins reported clean-up week has started slowly. One dumpster was filled so far. The crew is working on ditching and cutting shoulders. They did a good job cleaning up after the April snow storm. Code Enforcement Officer’s Report: Code Enforcement Officer Alan Teeter reported in April there were 6 building permits issued which brings the year to date total to 20. There was 1 Certificate of Occupancy issued, 1 Certificate of Completion issued, 21 building inspections and progress checks, 1 complaint received, 2 complaints investigated, 1 fire and safety inspection, and 1 house number installed. He also reported he received 30 training hours. Committee Reports: Planning Board: Alan Teeter reported George Frantz brought his class from Cornell to do a presentation on a project they are working on. They will be using the Town of Enfield as a practice model for a comprehensive plan, at no cost to the town. When the project is completed, they will submit it for the Planning Board to use as completed, use part of the plan, or none of it – it will be up to the Planning Board to decide. The model will be available on-line for other municipalities to look at. Health Insurance Consortium: No report. Enfield Community Council: Ann Rider reported they are co-sponsoring a community yard sale day on Saturday, May 12. Applications are now available for summer camp. The Recreation Partnership met in Enfield and had a presentation from the Youth Bureau on the history of youth programming. There was no Youth Board report. Supervisor Barriere moved, with a second by Councilperson Rider to approve Resolution #2012-30. Resolution #2012-30 Adoption of the 2013-2017 Intermunicipal Recreation Partnership Agreement WHEREAS, the Town of Enfield is currently a member of the Intermunicipal Recreation Partnership by agreement dated August 21, 2007, with an original 5 year term expiring December 31, 2012; and WHEREAS, the Recreation Partnership has been an excellent and cost efficient model of intermunicipal collaboration which enables municipalities to jointly plan, finance, and share a diverse set of high quality recreation programs; and WHEREAS, the Intermunicipal Recreation Partnership agreement by its own terms may be renewed for an additional five years by appropriate resolutions by each o f the municipal partners on or before December 31, 2012; and WHEREAS, any municipality may withdraw from the Intermunicipal Recreation Partnership agreement upon a full calendar year’s notice; Now therefore be it Enfield Town Board Regular Meeting, May 9, 2012 4 RESOLVED, that the Town of Enfield agrees to renew the August 21, 2007 Intermunicipal Recreation Partnership agreement for an additional 5 years, expiring December 31, 2017 and further RESOLVED, that a copy of this resolution be sent to the Recreation Partnership Board care of Tompkins County Youth Services Department at 320 West State / MLK Jr. Street, Ithaca, New York 14850. Discussion: Councilperson Rider stated with this agreement parents do not have to pay as much for their children to attend activities sponsored by the County Youth Services Department. Vote: Councilperson Hern aye, Councilperson Rider aye, Supervisor Barriere aye. Councilperson Howe-Strait and Councilperson Teeter absent. Carried Enfield Volunteer Fire Company: No report Facilities Manager: No report Communication Access Committee: No report Facilities Development: No report Personnel Committee: No report Tompkins County Council of Governments: Supervisor Barriere reported there will be a public educational event on gas pipelines that will be held May 17 at the public library. Information has been received from Tompkins County Human Resources on the Tier 6 Retirement Plan that started April 1, 2012. The contribution of 3% will continue by employees for the duration of their employment. That amount could be increased, based on salary, up to a maximum of 6%. Old Business: Update on Road Preservation Plan: Supervisor Barriere reported there is a task force working on the law. Dan Walker from our Planning Board is on the committee that was formed with representatives from the towns of Enfield, Caroline, Ithaca and Ulysses. Dan and Buddy Rollins will be working to put together an inventory of our infrastructure – roads, culverts, etc. Moratorium on Gas Drilling Discussion: Review/discuss Site Plan Review Local Law: Supervisor Barriere again stated that since there were only three board members present, the discussion on both the moratorium and Site Plan Review Law will be postponed until next month. These are important issues that the entire board has been working hard on and they should have the right to vote as well. Park-and-Ride Update: No update New Business: Agreement for Tompkins County Community Celebrations Grant: Supervisor Barriere stated this is basically to accept the funds, $1,000.00, to go towards the 2012 Enfield Harvest Festival which Enfield Town Board Regular Meeting, May 9, 2012 5 will be used for local musical groups and publicity items. The Community Council will need to complete a payment voucher and submit that to the county for the funds. Councilperson Hern moved with a second by Councilperson Rider to authorize the supervisor to sign the Agreement between the Town of Enfield and the County of Tompkins to accept the Community Celebrations Grant. Discussion: Councilperson Rider stated this is much less than has been received in prior years. Vote: Councilperson Hern aye, Councilperson Rider aye, Supervisor Barriere aye. Councilperson Howe-Strait and Councilperson Teeter absent. Carried Announcements: Supervisor Barriere thanked Highway Superintendent Rollins for moving the “Welcome to Enfield” sign by the new highway facility on Enfield Main Road. Supervisor Barriere stated notice has been posted for the NYS Retirement System, as required, for 2010 and 2011 and forwarded to the appropriate parties. At 7:17 p.m. the board moved into executive session for a personnel issue. At 7:35 p.m. the executive session was closed by motion of Supervisor Barriere and second by Councilperson Rider.
