The regular monthly meeting of the Town of Enfield Town Board was held Wednesday, September 8th, 2004 at 7:14 p.m. following the public hearing on the Enfield Community Council contract 2005, 2006, 2007 at the Enfield Community Building, 182 Enfield Main Road, Ithaca, NY with Supervisor Fisher presiding. Present: Supervisor Gary Fisher, Town Councilperson Greg Stevenson, Town Councilperson Larry Lanning, Town Councilperson Peggy Hubbell, Town Councilperson Sandra Small. Also present were Highway Superintendent David Miller and Town Clerk Alice Laue. Privilege of the Floor No one wished to speak. Report from United Way – Amy Bond Amy Bond, United Way representative reported that last year United Way invested $12,821.25 in the Town of Enfield. This went to support the After School Enrichment Program, Teen Program, Summer Camp, Newsletter, and After School Daycare. Approval of the Minutes 7/14/04 Regular Town Board Meeting Minutes Correspondence –Correct to read NY State Legislation Privilege of the Floor – Third line – Add dirt bike track between the words regarding and noise. Line 5 submit word dirt bike track in place of track. Musefest - Correct spelling of Musefeast to Musefest. Correct spelling of Ken Flescher to Ken Fleischer. SPCA Contract - Correct June 26th meeting to June 23rd. Motion made by Town Councilperson Stevenson, seconded by Town Councilperson Hubbell that the Town Board approve the adoption of the 7/14/04 regular Town Board Meeting Minutes as amended. Discussion Vote – Supervisor Fisher aye, Town Councilperson Stevenson aye, Town Councilperson Lanning aye, Town Councilperson Hubbell aye, Town Councilperson Small aye. Motion carried. Public Hearing Minutes 8/11/2004 Correct spelling of SPCCA to SPCA. Correct word lest to least. Motion made by Town Councilperson Hubbell, seconded by Town Councilperson Lanning that the Town Board approve the adoption of the 8/11/04 Public Hearing minutes as amended. 2 Discussion Vote- Supervisor Fisher aye, Town Councilperson Lanning aye, Town Councilperson Hubbell aye, Town Councilperson Small aye. Town Councilperson Stevenson abstained. Motion carried. 8/11/04 Regular Town Board Meeting Minutes Correct to read – N Y State Department of Wildlife Conservation – tree planting funds available. Highway – Specify NYSEG in place of gas and electric. Antivirus Software correct spelling to Newegg. Motion made by Town Councilperson Lanning, seconded by Town Councilperson Hubbell that the Town Board approve the adoption of the 8/11/04 regular Town Board Meeting Minutes as amended. Discussion – Vote – Supervisor Fisher aye, Town Councilperson Lanning aye, Town Councilperson Hubbell aye, Town Councilperson Small aye. Town Councilperson Stevenson abstained. Motion carried. 8/19/04 Special Town Board Meeting Minutes Add letter S to Thursday. Motion made by Town Councilperson Hubbell, seconded by Town Councilperson Lanning that the Town Board approve the adoption of the 8/19/04 Special Town Board Meeting Minutes as amended. Discussion Vote – Supervisor Fisher aye, Town Councilperson Lanning aye, Town Councilperson Hubbell aye, Town Councilperson Small aye. Town Councilperson Stevenson abstained. Motion carried. Communications Letter on modification of N.Y.S. Town Assistance Annual payment. Notice from Pleasant Valley Electric that community building annual fire alarm system test is due. Letter from Association of Towns concerning legislation passed in reference to traffic fines assessed by local justices. Notice of a series of workshops being held by the Town of Ithaca. Notice of Tompkins County accepting project proposals for consideration for Community Development Block Grant money. N.Y.S. Retirement payment in the amount of $24,634.00 due. Official notice of SARA grant approval and first payment received. 3 Committees/Reports Code – Submitted written reports. Highway – Superintendent Miller Patching potholes, hauling crusher run, doing some paving, fixed washouts, digging ditch, helped Ulysess stone and oil for three days, put in a driveway pipe, working on equipment. Personnel – Town Councilperson Small Employee Manual – Handbooks delivered. Need to make a change in Policy and Procedure – Page 13 Two entries that mean the same on Prepayment of Certain Bills (Policy 400.2) Motion made by Town Councilperson Small, seconded by Supervisor Fisher that the Town Board amend Policy 400.2 Prepayment of Certain Bills by deleting the first entry – “Prepayment of contracts exceeding one year in advance of audit of claim”. Discussion Vote – Supervisor Fisher aye, Town Councilperson Stevenson aye, Town Councilperson Lanning aye, Town Councilperson Hubbell aye, Town Councilperson Small aye. Motion carried. Economic Development – Town Councilperson Lanning Working on it and noted that it is a long slow process. Cemetery – Town Councilperson Hubbell Glenside Monument – Larry Weaver During January – February if stones taken to him he would charge $30.00 an hour to repair stones. Digging foundations for stones possible community service project. Discussed need of secure storage space for repaired stones this winter. Consensus of the board need to proceed. Old Business Town Clean-Up Report – Town Councilperson Stevenson Working on report. Tire Recycle – Town Councilperson Small Date is Saturday October 30th, 2004 from 8:00 a.m. – 1:30 p.m. next to the old highway barn. Hazardous Mitigation Plan – Town Councilperson Stevenson Haven’t had a meeting since last meetinmg. Standard Work Day/Hours Worked 4 Supervisor Fisher reported that he is still missing a few reports and expressed his need and desire to wrap this up. Limited Use Road Designation – Highway Superintendent Miller Traffic count – no vehicles on Butternut Creek Road. One truck and one car on W. Enfield Center Road hill. Town Board to review Limited Use Road Designation procedure. Dog Control/Community Council Contracts Town Attorney has reviewed both contracts. Final copy of Community Council contract to be put in Town Board members boxes for review. Dog Enumeration – Town Clerk Laue To date Enumerator has counted over 700 dogs. Licensed seventy-one unlicensed dogs since enumeration was started. New Business Modifying 284 2004 Agreement to Spend Highway Funds; Highway Superintendent Miller reported that due to the weather conditions this summer and the hold up of work on Shudaben Road he would like to spend highway funds agreed to spend on S. Buck Hill Road for trenching, pipes, etc. on paving one mile of Aiken Road. Hold up on Shudaben Road is highway department is waiting for Verizon to move their wires from the NYSEG electric pole. Resolution #51 9/8/04 Amend the 2004 Agreement to Spend Highway Funds. Supervisor Fisher proposed the following resolution to amend the Agreement to Spend Town Highway Funds presented at tonight’s meeting: Pursuant to the provisions of Section 284 of the Highway Law, we agree that moneys levied and collected for the repair and improvement of highways, and received from the state for the repair and improvement of highways, shall be expended as follows: 1. General Repairs: The sum of $120,000.00 may be expended for general repairs upon 44.45 miles of town highways, including sluices, culverts and bridges having a span of less than five feet and boardwalks or the renewals thereof. 2. Improvements. The following sums shall be set aside to be expended for the improvement of town highways: (a) On the road – Aiken between North Buck Hill and Waterburg Roads, a distance of 1 +/- miles, there shall be expended no over the sum of $38,000.00 for: type –overlay, width of traveled surface – 20’, thickness – 3-4”, sub-base gravel. 5 (b) On the road – Shudaben it remains the same as the previous 284 Agreement. No money set aside for such improvements shall be expended, nor shall any work be undertaken on such improvements, until the County Superintendent approves the plans, specifications and estimates for such construction. This agreement shall take effect when it is approved by the County Superintendent of Highways. Executed in duplicated this 8th day of September 2004. (To be signed by Town Highway Superintendent and Town Councilpersons.) Seconded by Town Councilperson Stevenson Discussion – Supervisor Fisher explained that he had talked with Highway Superintendent Miller with respect to the need of showing the breakdowns for budgeting and accounting purposes for each project. The Town needs to show the numbers on paper in order to track the expenditures and the source of the funds. He further explained that there is $120,000.00, which is in the budget for general repairs, and then there is an account for general improvements, which adds up to more than the CHIPS money. Highway Superintendent Miller was unclear as to Supervisor Fisher’s reasoning and budget entries and explained that the way it had been done in the past is that the Town uses $53,540.00 from CHIPS on these three roads, and then the balance comes out of local funds. He added that the CHIPS money isn’t always the same, it could be less or it could be more. At the August 11th meeting, out of the $53,540.00 available from CHIPS, $38,790.00 was Buck Hill Road South and $14,750.00 was for Shudaben Road. Because work will not be done on Buck Hill South, an amendment needs to be made reallocating funds. Therefore, out of the previously approved $38,790.00 in CHIPS, $38,000.00 will be allocated for Aiken Road, leaving Shudaben Road with the $14,750.00 plus the remaining $790.00. The amendment further needs to include the additional $23,000.00 of local money needed to complete the work on Shudaben Road. Town Councilperson Stevenson suggested that the Board sign the 284 Agreement as presented tonight and do a budget amendment for next month’s meeting. During the confusion the Town Council members signed the modified 284 Agreement to Spend Highway Funds. Highway Superintendent Miller asked Supervisor Fisher on what he should do with respect to stock piling of sand for the winter. Supervisor Fisher said that he will need to 6 meet with Superintendent Miller to discuss a budget transfer and indicated that it would be helpful if Superintendent Miller could work up some numbers prior to their meeting. Superintendent Miller agreed. Resolution #52 9/8/04 “Town of Enfield 2004 Budget Amendment No. 24-CHIPS” (Attached), Resolution made by Supervisor Fisher, seconded by Town Councilperson Hubbell. Resolution #54 9/8/04 “Town of Enfield 2004 Budget Amendment No. 26-General Fund Unemployment Insurance” (Attached) Resolution made by Supervisor Fisher, seconded by Town Councilperson Stevenson. Budget Workshop Supervisor Fisher asked for a budget workshop to be held September 15th, 2004. Motion made by Town Councilperson Hubbell, seconded by Town Councilperson Lanning that a budget workshop meeting be held Wednesday, September 15th, 2004 at 7:00 p.m. Discussion Vote- Supervisor Fisher aye, Town Councilperson Stevenson aye, Town Councilperson Lanning aye, Town Councilperson Hubbell aye, Town Councilperson Small aye. Motion carried. N.Y. State Retirement Payment/Reserve Fund Payment not due until February 2005 so we have time to accumulate money to pay it. Consensus of the Board – If we have the money at the end of the year we need to pay it not wait until February. Unemployment Insurance Fund Suggested that instead of paying State Unemployment Insurance premium Town put same amount of money in an unemployment insurance reserve fund and be self-insured. 7 Audit Claims Supervisor Fisher presented monthly bills for payment. Motion made by Town Councilperson Stevenson, seconded by Town Councilperson Lanning that the Town Board of the Town of Enfield authorize the Supervisor pay General Fund vouchers #169 –187, dated 9/8/04 in the amount of $6681.31. Highway Fund vouchers #110-125, dated 9/8/04 in the amount of $13,726.37. Community Development Grant vouchers #25-27, dated 9/8/04 in the amount of $8942.02.
