The regular monthly meeting of the Town of Enfield Town Board was held Wednesday, July 14th, 2004 at 7:00 p.m. at the Enfield Community Building, 182 Enfield Main Road, Ithaca, New York with Supervisor Fisher presiding. Present: Supervisor Gary Fisher, Town Councilperson Greg Stevenson, Town Councilperson Larry Lanning, Town Councilperson Sandra Small, Town Councilperson Peggy Hubbell. Also present were Highway Superintendent Miller and Town Clerk Alice Laue. Pledge of Allegiance to the Flag Supervisor Fisher led the assemblage in the Pledge of Allegiance to the Flag. Privilege of the Floor Mr. and Mrs. Chilson, 309 S. Van Dorn Road, Tim Bailey, John Zifchock, Gray Road, and Richard French, Hines Road. Majority of these where there in regard to a article in the newsletter regarding noise on Gray Road and S. Van Dorn Rd that was attended by Gray Road residents. They were concerned that there were going to be issues about the track and they were at the meeting to find out what is going on, what has been brought up, what the board’s intentions are, and if there are any intentions to do anything in the future. Comments – Supervisor Fisher said the subject brought up during Privilege of the Floor but that does not necessarily require the board to take any action. It’s for the Board’s information to hear from the public directly what the public has on their mind and hear what the public’s concerns are. ATV – There is in NYS Legislator legislation to make it a misdemeanor or some kind of violation to ride a ATV on farmland without permission because of damage done by ATV’s riding over crops. Mary Jo Lovelace – Mecklenburg Road Planning Board needs direction and needs to know what the status of various laws/ordnances planning board is working under. Report from County Legislator – Peter Pennimen Update –Fiscal situation a little better than it has been the last couple of years. For the next two years the county has set a goal of only increasing spending by 3 percent per year. 3 percent increase on the levy, for most people that will represent a reduction in the tax rate because of assessments going up more than that around the county. Emergency Radio System – Problem for a number of years, working on a solution. Spent some time working with the state on negotiating a cooperative effort because they are expanding to a state wide wireless network. County in the last few months proceeding without the state in developing their own project. Currently doing analysis of radio coverage around the county and establishing where the sites will be and hoping to sign a contract within a few months with Motorola for the construction of these facilities. Sheriff’s Department has requested cell phones for backup because the present system is so unreliable. Approval of the June 9th, 2004 regular Town Board Meeting Minutes. Resolution #40 “Town of Enfield Budget Amendment #19” First Resolved, second line should be amended to read $687.06. Fourth line should read $687.06 from $1500.00 to $2187.06. Second Resolved, third line should read $3575.00. Last line should read $2187.06 to $2837.06. Motion made by Town Councilperson Stevenson, seconded by Town Councilperson Lanning that the Town Board approve the adoption of the June 9th, 2004 regular Town Board Meeting minutes as amended. Discussion – Vote- Supervisor Fisher aye. Town Councilperson Stevenson aye, Town Councilperson Small aye, Town Councilperson Hubbell aye, Town Councilperson Lanning aye. Motion carried. Communications Letter from town residents Molavitis concerning cleaning of a ditch that has been taken care of. Tompkins County Farm and City Day Saturday, July 24, 2004 at Fouts Farm in Groton. Letter from Assemblywoman Lifton thanking us for our resolution supporting Collateral Service bill. Letter from NYS Energy Research Development Authority Wind and Energy Outreach education program for local decision makers would like to talk to board about using wind energy. Chevrolet Blazer used by Code Enforcement was vandalized. Received settlement from insurance company less $50.00 deductible for damages in the amount of $432.05 that included towing expenses. Copy of Tompkins County Youth Services Board letter to the county legislative with cuts in programs and services. NYMIR letter concerning contracting with CDID Evaluation Group wish is a change in their appraisal services. Chase Bank notice of changing interest rates 1.3 percent compounded daily. Governor’s Office for Small Cities letter stating Technical Assistance Grant for the Strategic Development study has been closed out. Recreational Partnership Board a copy of letter sent to Tompkins County Legislative Board asking for their support. Matt Furman – Supervisor received information concerning removal of tires. Mr. Furman would like the town’s help in disposing of his tires. SPCA letter – Director Winograd leaving the SPCA in September. Interim Executive Director to be Jim Tantillo. Reports/Committees Code Enforcement – Written report submitted. Highway Department – Superintendent Miller Mainly working on Shudaben Road taking out trees. Road pretty much straightened Patching potholes, doing normal stuff. Personnel Committee– Town Councilperson Small Nothing to report. Economic Clearing House – Town Councilperson Lanning Nothing to report. Cemetery Committee – Town Councilperson Hubbell Don’t have figures on stone repairs. Decided to finish up booklet that was started a few years ago on plot orders and another booklet for the general public on how they should be treating cemeteries. Discussed setting cemetery funds up for specific cemeteries. Old Business Town Clean Up – Town Councilperson Stevenson Report in progress. Tire Recycling Tompkins County Water and Soil Conservation Department to be contacted about a tire collection day for the Town of Enfield. Discussed the town helping Mr. Furman eliminated his tire pile. Hazard Mitigation Plan – Town Councilperson Stevenson July 16th, 2004 cut off for public input on plan. Standard Work Day/Hours Worked Hours need to be turned in to supervisor so a standard workday can be established. New Facilities – Town Councilperson Stevenson Town Councilperson Stevenson presented a synopsis of past activities on the proposed new town hall, community building and highway facility. New Business Dog Control and Community Council Contracts SPCA Contract – June 26th, 2004 board members met with SPCA representative Winograd to discuss proposed three year contact. Copies of contract given to board members for their review. SPCA recommended that the board look at impoundment and dog licensing fees charged and recommended an increase in same. Community Council Contract – Questions concerning finances, how finances flow that need to be clarified. Upon receipt of contract copies will be put in board members boxes. Public Hearing – SPCA Contract Motion made by Town Councilperson Stevenson, seconded by Town Councilperson Lanning that the Town Board hold a public hearing on the proposed SPCA contract 2005, 2006, 2007 Wednesday, August 11th, 2004 at 7:00 p.m. at the Enfield Community Building. Discussion Vote – Supervisor Fisher aye, Town Councilperson Stevenson aye, Town Councilperson Small aye, Town Councilperson Hubbell aye, Town Councilperson Lanning aye. Motion carried. Resolution #41 – 7/14/04 “Town of Enfield Budget Amendment #20 Magistrate Dues Resolution presented by Supervisor Fisher, seconded by Town Councilperson Lanning.(Resolution attached). Discussion – Magistrate dues need to be charged against justice’s account. Resolution #42 – 7/14/04 “Town of Enfield Budget Amendment #21 General Fund Voucher #117” Resolution made by Supervisor Fisher, seconded by Town Councilperson Hubbell. (Resolution attached). Resolution #44 -7/14/04 “Town of Enfield Policy 400.1 Investment Policy” Resolution made by Supervisor Fisher, seconded by Town Councilperson Hubbell. (Resolution attached). Resolution #45 –“ Town of Enfield Policy 400.2, Prepayment of Certain Bills” tabled. Software – Antivirus Software License Supervisor Fisher asked for authorization to purchase a Antivirus Software Five Pack license. Motion made by Town Councilperson Stevenson, seconded by Town Councilperson Lanning that the Town Board authorizes the Supervisor purchase a Antivirus Software Five Pack license for computers that require such. Appointment of Dog Enumerator Amy Lynch – Trumbulls Corners Road applied for the dog enumerator’s position. Defined salary - $1.75 per dogs counted plus 37.5 cents a mile for mileage. Motion made by Town Councilperson Stevenson, seconded by Town Councilperson Small that the Town Board appoint the applicant for the dog enumerator position at $1.75 per dogs counted plus 37.5 a mile for mileage. SARA Grant – Judicial records Received a Local Government Records Management Improvement Grant in the amount of $1247.00 for justice’s records management. Motion made by Town Councilperson Lanning, seconded by Town Councilperson Small that the Town Board authorizes the Records Management Officer sign the grant acceptance application form. Discussion –Not enough funds, but a start. Annual Software Support Supervisor Fisher asked for authorization for the Town Clerk to sign the Williamson Law Book Company Annual Software Support Contract for Town Clerks plus Annual contract paid for maintaining the software and keeping it up to date. Motion made by Town Councilperson Stevenson, seconded by Town Councilperson Small that the Town Board authorize the Town Clerk to sign the Annual Software Support Contract for Town Clerks Plus and Williamson Law Book Company software license agreement. Discussion Vote – Supervisor Fisher aye, Town Councilperson Hubbell aye, Town Councilperson Lanning aye, Town Councilperson Small aye, Town Councilperson Stevenson aye. Motion carried. County Hiring for County Jobs Town Councilperson Stevenson expressed his disappointment in the county’s hiring for county jobs. Currently there is no residency requirements for county jobs and the county is continually going outside of the county to fill county positions when there are county residents more than qualified to fill these positions. Audit Claims Supervisor Fisher presented monthly bills for payment. Motion made by Councilperson Hubbell, seconded by Councilperson Small that the Town Board of the Town of Enfield authorizes the Supervisor to pay General Fund vouchers #125-150, dated 7/14/04, in the amount of $7,837.34. Highway Fund vouchers #71-93, dated 7/14/04, in the amount of $33,059.94. Community Development Grant fund vouchers #15-20, dated 7/14/04, in the amount of $36,729.07. Musefeast Ken Flesher – 211 Gray Road asked for approval of his application for the Musefeast to be held 9/3 – 9/5/04 at Newhart”s Lodge. Motion made by Town Councilperson Lanning, seconded by Town Councilperson Hubbell that the Town Board approve the application for the 2004 Musefeast to be held 9/3-9/5/04 at Newhart’s Lodge. Discussion Vote – Supervisor Fisher aye, Town Councilperson Hubbell aye, Town Councilperson Lanning aye, Town Councilperson Small aye, Town Councilperson Stevenson aye. Motion carried Announcement – Harvest Festival Saturday September 25th, 2004. Chairperson Gumaer looking for volunteers to work. Privilege of the Floor Pat Dougherty – 330 Sheffield Road Happy to hear people are reading the newsletter. Questions – What is the Town Board doing, do we find out what the Town Board is doing, do the Chilson’s find out if there is something going on, and how do they find out? What does the Town Board do at this point? Answer – There is no noise ordnance. People need to compromise, and get along with each other. . Will the Town Board be saying to all parties there is no noise ordnance; therefore, there is nothing we can do? What are you doing to let complainants know that? Suggested that people read the newsletter, newspaper and attend Town Board meetings. Planning Board – Town Councilperson Hubbell There was no planning board meeting this month as there was no one to chair the meeting. Planning board needs reorganization.
