REGULAR MEETING : A regular meeting of the Town of Denby Planning
Board was held Monday , March 28 , 1966 in the
Town Hallo
ATTENDANCE : Harold Adsitt , Floyd Dorn , Darwin Geuther , Herbert Muzzy ,
Joseph Short , Fred Thayer and Mrs . Weitzel .
Meeting called to order by Chairman Fred Thayer
at 8 : 00 P . M0

DISCUSSION : Jennings Pond Progress . Each member expressed the hope
the pond would be ready for use the Summer of 1966 .
Correspondence from Tom Niederkorn of Egner and
Niederkorn to the Danby Council outlining an action
program for the Town Hallo
MOTION : A motion was made to submit the following to the town Board :
( Passed unanimously )
1 . The Danby Planning Board should like to remind the Town Board
that approximately a year ago ; the Planning Board unanimously
voted the present Town Hall site to be used for the new Town
Hall in the event the o d Town Hall , in the opinion of experts ,
should be razed .

It has come to the Planning Board ° s attention that Mr . S0 W.
Jacobs , Associate Professor of Architecture at Cornell , who
inspected the building , made his report to the Town Board .
No one on the Planning Board is cognizant of his findings °
Is there a copy of the report available ?
The Planning Board should like to reiterate that it is still
on record as being in favor of the present site for a Town
Hall and retaining the present Town Hall if at all possible .
2 . In view of the fact that the State has passed a law relative
to junkyards , and knowing that surrounding towns are acting
" to do something " about its junk mess , the Planning Board of
the Town of Danby% strongly recommends s that the Town Board
pass an enforceable ordinance ( Lei ) ; an ordinance - that
would be enforced by an ordinance officer :, not a zoning .
officer . Something similar perhaps to the Montour Falls
Ordinance , quoted below from the Ithaca Journal :
" The ordinance regulates collections of abandoned junk ,
discarded and unregistered motor vehicles , vehicles which
are not selfepropelled ; other personal property ( such as
appliances ) , brush , grass and rubbish of any kind and garbage
" beyond the state of good husbandry " upon real property .

Regulations will apply whether the site is controlled by
the land owner or another persona
The village clerk will be authorized to serve witten
notice on violators . If , within 10 days the responsible
party has failed or refused to correct the situation ,
village officers will have the job done at the expense
of the owner or occupant .
Failure to pay " shall constitute a lien upon . O N the
real property . 0 . to be collected by the village treasurer , "
the ordinance states ®
resistance or failure to comply " shall be in violation of
the law , " subject to a penalty not to exceed $ 100 for each
and every violation . The new -ordinance also allows a charge
of disorderly conduct to be placed against the person who
may fail to comply .
Individuals may , by petition , question of validity of
any charges .
Exempt from compliance are sites occupied and used for
repair , reconditioning or remodeling of vehicles or other
personal properties providing such establishments are in
conformance to zoning laws . "
