Property Location: 607 Utica Street
Requirement for Which Variance is Requested: Temporary Special Permit for Accessory Apartment; Area
Variance for parking, lot size and rear yard for construction of accessory apartment structure. NOTE: The BZA
can waive existing area deficiencies for existing primary structure. However, variances from these
deficiencies will be lost if the property does not remain an owner- occupied, single- family home with
accessory apartment. The BZA waived the existing deficiencies because the proposal will have no negative
effect on surrounding properties.
Applicable Section of City Zoning Code: Section 325 -10, Accessory Apartment; Section 325 -8, Columns, 4, 6,
& 14/15, Parking, Lot Size, and Rear Yard.

Hearing: A Public Hearing was held on September 1, 2015. Nine persons spoke in favor of the variance. No
person spoke against the variance. One letter from a neighbor was read into record supporting the variance
requests.
Motion: A motion to grant the variance requests was made by Marshall McCormick.
Tompkins County Review per Section 239 -1 and -m of New York State General Municipal Law: N/A
Environmental Review: Type 2 no review required.
Planning & Development Board Recommendation: The Planning Board does not identify any long -term
planning issues with this appeal and supports granting it. The proposal is in character with the surrounding
neighborhood.

Reasons-, The Board must deny the variance request if the project will have a negative impact on traffic,
congestion., property values, and/or municipal services. The facts presented by the applicant, heard by the
neighbors, and discussed during deliberations, show that this project will not have any of the negative
impacts the Board must evaluate. Also, because the project will not affect traffic or congestion, the applicant
does not have to present the Board with a plan showing how he would gate these impacts.
