SPECIAL ORDER OF BUSINESS: 1. Lead Agency for the South Plain Street Bridge over Six Mile Creek - Resolution By Commissioner Gutenberger: Seconded by Commissiner Jenkins WHEREAS, State Law and Section 176.6 of the City Code require that a lead agency be established for conducting environmental review of projects in accordance with local and state environmental law, and WHEREAS, State Law specifies that for actions governed by local environmental review, the lead agency shall be that local agency which has primary responsibility for approving and funding or carrying out the action, and WHEREAS, the proposed South Plain Street Bridge over Six Mile Creek is an "Type I" Action pursuant to the City of Ithaca Environmental Quality Review Ordinance and an "Unlisted" Action pursuant to the New York State Environmental Quality Review Act, which requires review under the City's Environmental Quality Review Ordinance; now, therefore, be it RESOLVED, That the Board of Public Works of the City of Ithaca does hereby declare itself lead agency for the environmental review for the proposed South Plain Street Bridge over Six Mile Creek. A vote on the resolution resulted as follows: Carried Unanimously 2. Lead Agency Declaration for the Taughannock Boulevard Extension - Resolution By Commissioner Tsagaye: Seconded by Commissioner Beach WHEREAS, State Law and Section 176.6 of the City Code require that a lead agency be established for conducting environmental review of projects in accordance with local and state environmental law, and WHEREAS, State Law specifies that for actions governed by local environmental review, the lead agency shall be that local agency which has primary responsibility for approving and funding or carrying out the action, and WHEREAS, the proposed Taughannock Boulevard Extension is an "Type I" Action pursuant to the City of Ithaca Environmental Quality Review Ordinance and the New York State Environmental Quality Review Act, which requires review under the City's Environmental Quality Review Ordinance; now, therefore, be it RESOLVED, That the Board of Public Works of the City of Ithaca does hereby declare itself lead agency for the environmental review for the proposed Taughannock Boulevard Extension. Lead Agency Declaration for the West Spencer Street Conversion to Two-Way Traffic - Resolution By Commissioner Leonardo: Seconded by Commissioner Jenkins WHEREAS, State Law and Section 176.6 of the City Code require that a lead agency be established for conducting environmental review of projects in accordance with local and state environmental law, and WHEREAS, State Law specifies that for actions governed by local environmental review, the lead agency shall be that local agency which has primary responsibility for approving and funding or carrying out the action, and WHEREAS, the proposed conversion of West Spencer Street to two-way traffic is an "Type I" Action pursuant to the City of Ithaca Environmental Quality Review Ordinance and an "Unlisted" Action pursuant to the New York State Environmental Quality Review Act, which requires review under the City's Environmental Quality Review Ordinance; now, therefore, be it RESOLVED, That the Board of Public Works of the City of Ithaca does hereby declare itself lead agency for the environmental review for the proposed conversion of West Spencer Street to two-way traffic. Lead Agency Declaration for the Widening of Meadow Street - Resolution By Commissioner Jenkins: Seconded by Commissioner Gutenberger WHEREAS, State Law and Section 176.6 of the City Code require that a lead agency be established for conducting environmental review of projects in accordance with local and state environmental law, and WHEREAS, State Law specifies that for actions governed by local environmental review, the lead agency shall be that local agency which has primary responsibility for approving and funding or carrying out the action, and WHEREAS, the proposed widening of Meadow Street is an "Type I" Action pursuant to the City of Ithaca Environmental Quality Review Ordinance and an "Unlisted" Action pursuant to the New York State Environmental Quality Review Act, which requires review under the City's Environmental Quality Review Ordinance; now, therefore, be it RESOLVED, That the Board of Public Works of the City of Ithaca does hereby declare itself lead agency for the environmental review for the proposed widening of Meadow Street. Lead Agency Declaration for the Removal of the Diagonal Diverters on Wood and South Streets - Resolution By Commissioner Beach: Seconded by Commissioner Jenkins WHEREAS, State Law and Section 176.6 of the City Code require that a lead agency be established for conducting environmental review of projects in accordance with local and state environmental law, and WHEREAS, State Law specifies that for actions governed by local environmental review, the lead agency shall be that local agency which has primary responsibility for approving and funding or carrying out the action, and WHEREAS, the proposed removal of the diagonal diverters on Wood and South Streets is an "Type I" Action pursuant to the City of Ithaca Environmental Quality Review Ordinance and an "Unlisted" Action pursuant to the New York State Environmental Quality Review Act, which requires review under the City's Environmental Quality Review Ordinance; now, therefore, be it RESOLVED, That the Board of Public Works of the City of Ithaca does hereby declare itself lead agency for the environmental review for the proposed removal of the diagonal diverters on Wood and South Streets. A vote on the resolution resulted as follows: Carried Unanimously 6. Curb Cut Request for 121 East Spencer Street - Resolution By Commissioner Leonardo: Seconded by Commissioner Beach WHEREAS, staff has turned down a request for a curb cut to install a driveway at 121 E. Spencer Street due to the narrow one-way street with parking on one side and the steep bank on the side of the proposed driveway, which result in an unusually wide and steep driveway apron and the need to lower the sidewalk over two feet, and WHEREAS, the property owner feels that a serviceable driveway can be installed which will improve his property and reduce the demand for on-street parking; now, therefore, be it RESOLVED, That the Board of Public Works has reviewed the property owners request for a curb cut and driveway at 121 East Spencer Street as well as staff’s concern for the proposed driveway and grants the requested curb cut provided the homeowner obtains the other necessary permits and approvals to undertake this project, and be it further RESOLVED, That the board grants this approval with the understanding that no parking will be removed across the street now, or in the future and that the sidewalk adjustments should be completed within the property lines of 121 East Spencer Street. Discussion followed on the floor. Commissioner Beach questioned the option of temporary no-parking during the construction period. It was noted that procedures are in place and available to contractors during construction. Commissioner Gutenberger noted that the memo from Planning and Development indicated that the grades are steep and therefore impact drainage; the building permit would address those issues. A vote on the resolution resulted as follows: Carried Unanimously March 6, 2002 4 Plain Street Vehicular Bridge Project - Resolution By Commissioner Gutenberger: Seconded by Commissioner Tsegaye WHEREAS, the Board of Public Works has been designated as lead agency for environmental review of the proposed reconstruction of a vehicular bridge across Six Mile Creek at South Plain Street, and WHEREAS, this Board is fully prepared to carry out that mission in a fair and inclusive manner, and WHEREAS, this Board has the authority and responsibility pursuant to the City Charter to undertake this mission; now, therefore, be it RESOLVED, That the Board of Public Works respectfully asks Common Council to refrain from any action, including the creation of an advisory committee that would impede our ability to undertake and implement the Plain Street bridge project in a timely manner consistent with our responsibility and authority.
