APPROVAL OF MINUTES: Approval of the Minutes of the June 14, 2000 Board of Public Works Meeting By Commissioner Korherr: Seconded by Commissioner Jenkins RESOLVED, That the Minutes of the June 14, 2000 Board of Public Works meeting be approved as published. Carried Unanimously Open Public Hearing: Traffic Diverters By Mayor Cohen :Seconded by Commissioner Korherr RESOLVED, That the Board of Public Works open the public hearing portion of the meeting to allow the public to speak on the topic of the traffic diverters. Wendy Close the Public Hearing: Traffic Diverters By Mayor Cohen :Seconded by Commissioner Beach RESOLVED, That the Board of Public Works close the public hearing on the traffic diverters. Carried Unanimously ADDITIONS TO OR DELETIONS FROM THE AGENDA: Superintendent Gray requested that an item relating to an Award of Bid for Loader be added to the agenda. No board member objected. COMMUNICATIONS AND HEARINGS OF PERSONS BEFORE THE BOARD: Fay Gougakis, City of Ithaca, stated that the metal debris near the bicycle rack adjacent to City Hall is a problem. She further addressed the issue of the absence of a boardwalk around the inlet island area. Discontinuance of Taughannock Boulevard. By Mayor Cohen :Seconded by Commissioner Jenkins WHEREAS, the Board of Public Works has held a public hearing on a proposal to discontinue 80 feet of the northern most part of Taughannock Boulevard, and WHEREAS, the board has heard comments from the public and staff concerning this matter; now, therefore, be it RESOLVED, That the Board of Public Works approves the discontinuance of 80 feet of the northern most portion of Taughannock Boulevard. Carried Unanimously Senior Environmental Landscape Planner Cornish presented the Planning Board’s rationale for the parking changes that are proposed for the inlet island development and the need for the discontinuance of Old Taughannock Boulevard. Discussion followed on the floor regarding the number of parking spots available for the 200 seat restaurant proposed for the dead end of Taughannock Boulevard. Asst. Superintendent Fabbroni questioned the status of the Brownfield remediation. Planner Cornish stated that the work is in progress. Mayor Cohen concurred with Commissioner Gutenberger’s concern regarding limited parking at the large scale restaurant. HUD has approved the release of funds and has supported the positive image for this project. Planning Board review of future projects should include parking concerns. Commissioner Gutenberger stated that parking should be added to the restaurant site in order to accommodate future patrons. Planner Cornish stated that failure to abandon the street would result in the City maintaining ownership and the restaurant would be granted permission to use the lot. Planner Cornish added that Common Council has already adopted the entire development plan more than two years ago. Board of Public Works – July 12, 2000 - Page 3 Superintendent Gray stated that the restaurant owners have taken the risk in developing the site without the parking issues finalized. Alderperson Hershey stated that the Board of Public Works has a right to say that insufficient parking was included in the plan and a possible re-order of the work plan could be warranted. Mayor Cohen directed staff to review parking north of the Taughannock Boulevard bridge. Request to Council to Modify Sidewalk Assessment for 306 Dey Street. By Mayor Cohen: Seconded by Commissioner Korherr WHEREAS, the 1999 sidewalk assessments have been forwarded to the City Chamberlain for collection, and WHEREAS, staff has recognized that the assessment for 306 Dey Street was calculated incorrectly; now, therefore, be it RESOLVED, That the Board of Public Works requests that Common Council take appropriate action in order to modify the 1999 sidewalk assessment for 306 Dey Street from $834.50 to $487.25 due to a calculation error. Carried Unanimously CREEKS, BRIDGES AND PARKS: Declaration of No Significant Environmental Effect- Replacement of the Linn Street Bridge over Cascadilla Creek Project By Mayor Cohen: Seconded by Commissioner Jenkins WHEREAS, at the May 23, 2000 meeting of the Planning and Development Board, and in accordance with Ordinance No. 99-15, Chapter 276 of the City of Ithaca Municipal Code, the board reviewed and acted favorably on the Final Site plan for Linn Street Bridge Replacement project, and WHEREAS, the Department of Public Works has prepared a Long Environmental Assessment Form, and WHEREAS, the proposed action is a Type II action under the State Environmental Quality Review Act, and is a Type I action under the City Environmental Quality Review Ordinance, and WHEREAS, it appears that the proposed action will not have a significant effect on the environment; now, therefore, be it RESOLVED, That the Board of Public Works, as lead agency in this matter, hereby does adopt as its own the findings and conclusions more fully set forth on the Long Environmental Assessment Form dated June 26, 2000, and be it further RESOLVED, That The Board of Public Works, as lead agency, hereby does determine that the proposed action at issue will not have a significant effect on the environment, and that further environmental review is unnecessary under the circumstances, and be it further RESOLVED, That this resolution shall constitute notice of this negative declaration, and the City Clerk be, and hereby is, directed to file a copy of the same, together with the attachment, in the City Clerk's Office and forward the same to any other parties as required by law. Carried Unanimously Board of Public Works – July 12, 2000 - Page 4 Request for Expungement of Water and Sewer Bill for 617 Cascadilla Street. By Mayor Cohen Commissioner Leonardo WHEREAS, the Board of Public Works has received a request for expungement of a water and sewer bill for 617 Cascadilla Street, and WHEREAS, the Nick Stavropoulos, owner of the property was notified that the inside meter indicated a higher usage amount than the outside remote showed, and WHEREAS, it is believed that the remote meter may have been inaccurate for up to ten years, and WHEREAS, staff recommends a reduction in the bill to $519.72 based on the average rates since the last spot check on the meter; now, therefore, be it RESOLVED, That the Board of Public Works hereby reduces the water and sewer bill for 617 Cascadilla Street to an amount of $519.72, and be it further RESOLVED, That the board requests that the City Chamberlain bill the property owner accordingly. Carried Unanimously ADMINISTRATION AND COMMUNICATIONS ITEMS: Award of Bid for Backhoe By Mayor Cohen: Seconded by Commissioner Beach WHEREAS, bids were received on June 8, 2000 for a new backhoe, and WHEREAS, staff has reviewed the bids and has determined that the low bidder does not meet the minimum specifications, and WHEREAS, staff is recommending that the third lowest bid be awarded the contract for the new backhoe; now, therefore, be it RESOLVED, That the Board of Public Works hereby awards the bid of a new backhoe to Rupp Rental, Anderson Equipment, 720 E. Franklin Street, Endicott, New York 13760 for their bid that meets minimum specification for an amount of $65,812.00, and be it further RESOLVED, That the board authorizes the Assistant Superintendent of Public Works to enter into an agreement with Rupp Rental for the purchase of a new backhoe. Carried Unanimously Commissioner Leonardo complimented Asst. Superintendent Ferrel’s inclusion of bid specifications with the supporting documentation. Superintendent Gray stated that the specs need to be written general enough to allow for competitive bids with several different types of equipment. The piece that is accepted is the one that most closely meets the requirements. Deputy Controller Thayer stated that there is a five year warranty on this piece of equipment. Award of Bid for Loader By Mayor Cohen :Seconded by Commissioner Leonardo WHEREAS, bids were received on June 20, 2000 for two new and unused Wheel Loaders, and Board of Public Works – July 12, 2000 - Page 5 WHEREAS, staff has received the bids, including the alternate options and recommends that the bid be awarded to the lowest bidder; now, therefore, be it RESOLVED, That the Board of Public Works hereby awards the bid of 2 new and unused Loaders to S.C. Hansen, Inc. 110 Old Ithaca Road, Horseheads, NY 14845 for their total bid of $ 196,105.00, and be it further RESOLVED, That the Board authorizes the Assistant Superintendent of Public Works to enter into a contract with S.C. Hansen, Inc. for the two loaders. Carried Unanimously Alderperson Hershey felt that persons who spoke before the Board regarding the diverters today should be allowed to speak again tomorrow at the second public hearing held at Titus Towers.
