MINUTES Minutes of the preceding meeting were duly approved.
BIDS ON FIRE STATION #6 The following bids on #6 Fire ,Station were
opened and read by the Clerk.
All bids were accompanied by a certified check amounting to
5jo of the bids submitted and all bids were made subject to govern-
ment regulations.

A motion to refer the bids to the Buildings and Grounds
Committee for consideration was withdrawn as it was agreed that
the contracts should be awarded without delay in order to secure
the necessary materials before further restrictions are placed, and
it was moved,

Resolved, that the low bid of VV. D. McElwee & Son for general
construction in the amount of X15,634.00; that the low bid of Earl
Cortright for the electrical work in the amount of X373.00; that
the low bid of Hull & Wheaton Plumbing Co. for plumbing work in
the amount of y946.00; that the low bid of dull & Vvheaton Plumbing
Co. for heating work in the amount of 4786.00 be and the same
hereby are accepted and awarded, subject to changes necessary due
to priorities, and
Be It Further Resolved, that the Buildings & Grounds Committee,
Architect., and Fire Chief be and they are hereby empowered to
authorize necessary changes due to priorities.

PUBLIC HEARING ASSESSIiLNTS Mayor Comfort announced the public
hearing on assessments for public improvements as advertised for
this time, As no one appeared, it was moved,

BOARD OF EDUCATION REQUEST FOR SIDEVYALKS Ai'?D CURB AND GUTTER- COR'NELL
STREET A letter from the Board of Education was presented request-
ing the City to install a sidewalk and curb and gutter along Cornell
Street between Tdiitchell Street and Valley Road at the Belle Sherman
School. Acting City Engineer Cass reported that the installation
will require approximately 200 ft. of curb and 4001ft. of curb
and gutter and approximately 600 ft. of sidewalk for which the Board
of Education will pay 50;1-) for the curb and gutter and 100;0 for the
sidewalk.

Resolved, that the request be approved and the Engineer author-
ized and directed to proceed with the installation.

REPORT OF ACCIDENT TO CITY TRUCK A staten--nt signed by city truck
driver William B. Daineswas presented reporting an accident which
occurred April 1, 1942 when a car driven by aymond L. hider of
Dryden, N. Y. struck a city truck at the intersection of S. Plain
and Center Streets which pushed the truck over the curb brewing
off a telephone pole causinj- considerable darzage to both truck and
e'.ar.
Acting City Engineer Cass reported that the insurance adjustor
has not yet examined the truck.
MUNICIPAL, FI1,Ti i.1CF; OrFIC' RS - TRAINI.,TG SCHOOL The Clerk reported
that a training school of T:- iuniclpal 'vir-iance Officers will be held
in Albany on April 22, 23, and 24 and i1e requested permission to
attend.

Resolved that the Clerk be authorized to attend the school
at City expense. Carried.
CLEANING STORT,i SE`�ERS Actinb City engineer Cass reported that the
cost to date for cleaninf °. storm sewers amounts to w1357.00 and that
due to the excessive amount of gravel and debris in the sewers that
additional funds will be required to cornllete the cleaning,

Resolved, that the Common Council be requested to appropriate
,{ 2,000.00 additional to budget item #168 - storm. sewers, making
a total of p'5,630.00 for that account. Carried.
STONE RESURFACING Acting City Engineer Cass reported that it has
been found that the stone shipped from the Jamesville quarry of the
General Crushed Stone Co. is more satisfactory for the top dressing
on streets and,he requested permission to specify the Jamesville
stone for that use. He stated that the freight _rate is .25� more
per ton from Jamesville and that the total additional cost will be
approximately w150.00.

Resolved, that the Engineer be authorized to order the necessary
stone for top dressing from the Jamesville quarry. Carried.
PURCHASE OF EMULSION IN DRUIMS Actin; City Engineer Cass reported
that approximately two car -loads of emulsion in drums will be re-
quired for street repairs this year and that the American Bitumels
Co. has quoted a price of .127 per gallon in drums. He called
attention to the fact that the American Bitumels submitted the only
bid received for emulsion and he recommended the purchase of two
car -loads from that Company.

Whereas, it is necessary to purchase emulsion in drums for use
with power sprayers in making street repairs, and
Whereas, it is the sense of this Board that no benefit, finan-
cial or otherwise, would accrue by advertising for bids thereon, and
Whereas, the American Bitumels Co. has quoted a price of .127
per gallon,
Now 'Therefore Be It Resolved, that the purchase of two car -loads
of emulsion in drums be authorized without the formality of advertis-
ing for bids thereon; and that the quotation of the American Bitumels

SUPPLEMENTAL AGREEMENT - AMERICAN BRIDGE CO. Acting City Engineer
Cass reported race pt o a letter rom the merican Bridge Co. in
which they agreed to Install clip angles for the installation of
sewer and water lines across the Stewart Avenue bridge on a cost
plus basis, which Mr. Cass stated would amount to approximately 025.
By Commissioner Hopper, seconded by Commissioner Halverson:
Resolved, that the offer of the American Bridge Co. to install
the clip plates be and hereby is accepted. Carried.
NEW TRUCKS Acting City Engineer Cass reported that the applica-
tions for release of the five trucks ordered December 31, 1941, have
been returned disapproved, and that appeal has been filed on the
basis of excessive repair costs, but as yet no reply has been re-
ceived from the appeal.
RE- CAPPING TIRES Acting City Engineer Cass reported that the Local
Rationing Board has approved the application for permission to re-
cap fifteen truck tires.
CONSTRUCTION AND PERMANENT IMPROVEMENT PROGRAM Acting City :Engineer
Cass presented a schedule -of items to be considered for the con-
struction and permanent improvement program for 1942, and suggested
that the Board consider the items and approve those considered
possible to complete this year.
The schedule follows:
Item 1. Street resurfacing 410,000.
2. State St.- drainage, curb & gutter 14;300."
3, University Ave.- curb & gutter, drainage 3,650.
4.•Eastwood & Woodcrest Aves.- curb & gutter,
drainage 6,800.
5. Curb & gutter replacement 6,500.'
Total X41,250.
Each item was considered separately as follows:
Street Resurfacing
By Commissioner - Egbert, seconded by Commissioner Rumsey:
Resolved, that the schedule of streets to be single and double
surface treated be and hereby is approved as presented. Carried.
State St. - Drainage, Curb & Gutter
Engineer amass presented plans for the installation of storm
sewers and curb and gutter in State Street at an estimated cost of
814,300. which the Board suggested should be done at least one
year prior to repaving of that street.
Commissioner !:gbert stated that conditions have changed since
it was agreed to proceed with the work and that it is now impossible
to purchase materials necessary to replace those which must be used,
and he recommended that this work be abandoned for this year.

Resolved, that the plans as submitted be and hereby are approved
and
Be It Further Resolved, that the work of installing storm
sewers, curb and gutter and new water and sewer services be deferred,

Univerditv Ave. Curb & Gutter. Drainage
A Ling Uity-Engineer Cass presented plans for the proposed in-
stallation of curb and gutter and necessary drainage on the east
side of University Avenue and stated that the estimated cost Will be
93,650. of which approximately ,x;)700, will be assessable to property
owners.

Resolved, that the plans as presented be and hereby are
approved, and
Be It Further Resolved, that the property owners be notified
of a hearing on the proposed assessable improvements, to be held
at a later meeting of this Board. Unanimously Carried.

Eastwood & Woodcrest Aves. Improvements
The Engineer presented p an ffor the proposed improvements in
Eastwood and Wooderest Avenues covering the following installations:
curb and gutter, storm sewer, under drainage and grading, the
estimated cost of which is 461800. of which approximately ,pl,500,
will be assessable against property owners.
By Commissioner Egbert, seconded by Commissioner Ward:
and Resolved, that the plans as submitted be and hereby are approved.
Be It Further Resolved, that the property owners be notified
of a hearing on the proposed assessable improvements, to be held at
a later meeting of this Board. Unanimously Carried.
Curb & Gutter Replacement Acting City Engineer Cass recommended
carrying out the curb and gutter replacement program the cost of
which is estimated at 4p6,500. which was planned for last year and
not completed due to the work of paving in Thurston Avenue and
Taughannock Blvd.

Resolved, that the recommendation of the Engineer be accepted
and the program approved. Carried.
APPROVAL - CONSTRUCTION & PERMANENT IMPROVEMENT PROGRAM

Resolved, that the program for construction and improvements
for the year 1942, as amended, be and hereby is approved, and
Be It Further Resolved, that the Common Council be requested
to provide the sum of 426,950.00 in the budget for 1942 to permit
carrying out this program. Unanimously Carried.
PURCHASE OF DRAINAGE; MATERIALS The Engineer presented a list of
materials needed o carry ou the improvement program approved by
the Board and he recommended the purchase of these materials at this
time together with materials needed for the State Street project.
He stated that the cost of the materials including iron pipe, catch
basins, manhole rings and covers will be approximately 43,350. and
that the supplies may be purchased at this time from the usual source
of supply at little or no increase in price, and by application of
our present priority rating.
It was agreed that any delay in ordering the materials
might make it impossible to procure them and it was moved,

Whereas, it is necessary to purchase drainage materials for
the completion of permanent improvements already approved, and
Whereas) it is the sense of` this Board that no benefit, fin-
ancial or otherwise, would accrue by advertising for bids on these
materials, and
Whereas, it is understood that these materials may be purchased
at this time with little or no increase in price.
Now Therefore Be It Resolved, that the purchase of these
materials be authorized without the formality of advertising for bids
thereon, at a cost not to exceed 43,500.

BUFFALO STREET BRIDGE PLANS The Engineer reported that the final
plans and estimates For the Buffalo Street bridge over Cayuga Inlet
have been completed by Bridge Engineer James Towart and that the
estimated cost will be 450,000.
He stated that Commissioners Ward and Halverson have examined
and approved the plans.

Resolved, that the plans and specifications as presented be
and hereby are approved and accepted, and
Be It Further Resolved, that the bill for engineering services
be paid upon receipt from Engineer Towart.
Unanimously Carried and Approved.
SURFACE WATER DRAIN - N. CAYUGA STREET Commissioner Ward recommended
that the two foot drain under the highway at Lake Inn in N. Cayuga
Street be increased to four feet.

specifications for the enlargement of the drain and present to the

BUS SERVICE - WEST HILL SECTION Commissioner Hopper reported that
Ithaca Railways will be unable to extend bus service to the 'lest
Hill section due to the condition of the Chestnut Street bridge and
the Engineer was directed to examine the report made by Engineer
Towart and report conditions to the Board.

filter plant from .58 to.64 per hour affective April 19, 1942.

J. J. Driscoll; and that it be purchased in the order set forth
herein.

UNIVERSITY AVENUE A petition signed by several residents on Univers-
ity Avenue was presented and read. The petitioners requested the
Board to modify the plans in regard to a seven inch curb in order
that parking of cars would still be permitted on the east side of
the street. A few residents personally appeared and verbally re-
quested that further consideration of the plan for the drainage
problem be given before parking be entifely eliminated.
By Commissioner Rumsey, seconded by Commissioner Egbert:
Resolved, that the matter be referred to the Highway Committee
for further study and report. Carried.
CONSTRUCTION & PERMAN,NT IMIPROVEMENT PROGRAM Acting Engineer Cass
recommended that an item of y4,000. for bridge plans and designs be
added to the program approved at the last meeting. He explained
that %pl.600, of this amount had already been authorized for the
Buffalo Street bridge.

Resolved, that the Construction & Permanent Improvement Program
approved at the last meeting be amended by adding thereto an item
of yW4,000. for design of bridges. Carried.
TRUCKS Acting Engineer Cass reported receipt of a letter from the
Local Allocation Board in Binghamton in reply to an appeal filed
for release of the trucks ordered by the City some time ago. The
letter stated that the appeal could be held in Binghamton, pending
appointment of an Appeal Board there, or if desired, be sent direct
to Washington for action. He reported that he had sent the appeal
direct to Washington.
N. CAYUGA,STREET EXTENSION Acting .Engineer Cass withheld his
fina l report on the dr ainage system on N. Cayuga L)treet pending a
more complete survey which would involve the extension of the open
ditch to take care of more drainage areas east of the old trailer
lot than originally contemplated.
CHESTNUT STREET BRIDGE Mr. Cass reported that Mr. Towart in his
Report on BrIdges agreed that the Chestnut Street Bridge would be
safe for a 6 -tan load.

UNIVERSITY AVENUE DRAINAGE Mr. Cass reported on a conference with
University officials relative to the failure of a 10" storm sewer
line on south side of University Avenue adjacent to Stewart Avenue,
to adequately take care of the present drainage load. He stated
that he was unable to ascertain to whom the line belonged, and that
to put it back in operation would be very expensive. He also stated
that, if the Board would permit, the University would be willing to
connect it to the city owned catch basin east of Stewart Avenue, at
their own expense, with repairs to the lawn of the ATO fraternity
house to be borne by the City..

Resolved, that the University be granted permission to mare
this connection at their own expense and under the supervision of
F the City &ngineer.
PURCHASE OF TRAILER Mr. Cass reported that the City, during the
construction o tewart Avenue and W. State Street, had borrowed
on different occasions a four - wheeled trailer owned by Arthur I.
Merrill, and that it has been kept since at the city barns. Mr.
Merrill just recently brought this to his attention and now offers
to sell it to the City for the sum of 020.00. 11r. Cass recommended
its purchase.
By Commissioner Halverson, seconded by Commissioner Hopper:
Resolved, that the purchase of this trailer for the sum of
820.00 be and it hereby is authorized. Carried.
STEWART AVENUE BRIDGE Mr. Cass reported that all structural steel
on the first three panels of the bridge has been erected and that
the work is progressing favorably.
$ WATER DISTRICTS Commissioner Egbert expressed his dissatisfac-
tien because of the failure on the part of the City to have the
contracts ready for the proposed new water districts being formed.
Mayor Comfort stated that he had taken this matter up with the
City Attorney who assured him they would be ready within ten days.
PURCHASE OF 24" PIPS: Commissioner Egbert recommended the purchase
of sufrIcient 24 pipe to guard against any emergency in the water
supply.
By Commissioner Hopper, seconded by Commissioner Lgbert:
Resolved, that Supt. Carpenter be and he hereby is authorized
to purchase an emergency supply of 24" pipe and fittings. Carried.
COAL BIDS Commissioner Egbert recommended that informal bids be
secured on the purchase of coal for the needs of the Water Depart-
ment for the ensuing year. In this connection it was suggested
that coal for all other departments under jurisdiction of the Board
should be secured at this time, This was urged by the Mayor.

Resolved, that informal bids be secured for the coal require-
ment for the ensuing year of all departments under the jurisdiction
of the Board. Carried.
AMERICAN WATER WORKS MEETING Supt. Carpenter reported that a
meeting of the New York Section of American eater Works Association
was scheduled to be held in NiaGara Falls, N. Y. on April 30 and
May 1, and requested permission to attend,

Resolved, that Supt. Carpenter and one member of the Board be
and they hereby are authorized to attend this meeting at City ex-
pense. Carried.
NO. 6 FIRE STATION Commissioner Halverson reported that some of
Me unsuccess ul bidders an No. 6 Fire Station had not yet received
the checks filed with their bids. The Clerk was directed to return
these checks. Commenting on the fact that the City's request for a
priority rating to obtain materials for this building had been
denied, Mayor Comfort reported that he had contacted Dr. Day and
given him more detailed information on this matter, who, he reported
had assured him he would contact Washington officials in an effort
to renew the City's plea.

Resolved, that the bills audited by the Finance Committee
be and the same hereby are approved and ordered paid. Carried.

MINUTES Minutes of the preceding meeting were duly approved.
UNIVERSITY AVENUE - CURB & GUTTER DRAINAGE A delegation of resid-
ents of n vers ty venue were present and their spokesman Mr.
Ernest Ellis requested information as to the decision of the Board
in regard to installation of curb and gutter on the east side of the
street.
When informed that the Highway Committee would recommend carry-
ing out the work as shown by plans submitted by the Engineer, Mr.
Ellis expressed the opinion that the installation of curb would
create a public hazard and he protested such installation.
It was explained that a Public Hearing would be held at a later
meeting of the Board when interested property owners could be heard.
TREE REMOVAL Alderman Crawford reported receipt of a complaint in
regard to a tree at the corner of Fifth and Madison Streets which
is in dangerous condition. Forester Baker reported that the greater
part of the tree has now been removed and that the balance will be
taken care of as soon as time will permit.
CURB & GUTTER - FARM STREET Alderman Crawford reported receipt of
requests from property owners in Farm Street for the renewal and
alignment of curb in that street.
It was explained that the renewal of the curb and the widening
and surfacing of the street was planned far this year but due to
restrictions on materials it will be impossible to do the work until
restrictions are removed.
MRS. CHARLOTTE MARKELL - COMPLAINT RE WATER DAMAGE A letter from
Mrs. Charlotte Markell was presented calling attention to damage
to her property at 504 S. Cayuga Street due to seeping of water into
the basement, and other damage to her property and asked the City
to repair the damage to her sidewalk.
The Engineer explained that the water damage was caused by a
leak in the Morse Chain Co. water line from Six Mile Creek, and
since the leak was repaired in January no further damage has occurred.
The Commissioners agreed that since the damage was caused by a leak
in the Chain Co. water line the City is not responsible for the
damage, and it was moved

Resolved, that the City Clerk be directed to notify Mrs. P,:arkell
that the City is not responsible for the damage to her property and
that she should look to the Morse Chain Co. for reparation.

SURFACE WATER DRAIN - N. CAYUGA STREET Acting City Engineer Cass
presented plans or the enlargement o the drain under the highway
near the Lake Inn in N. Cayuga Street. He stated that to install
a 4 ft. pipe the cost would be approximately X4200. but that an open
ditch with catch basins to collect the gravel could be installed for
approximately 61600. if a ditcher is used.

Resolved, that the matter be referred to the Highway Committee
for further study and report. Carried.
DRIVEWAY S. PLAIN STREET Acting City Engineer Cass reported
receipt of a request for permission to cut the curb and install a
30 ft. driveway on the S. Plain Street side of the property at
212 Center Street.

Resolved, that the matter be referred to the Highway Committee
with power. Carried.
AMERICAN BRIDGE CO. - ESTIMATE #1 Acting City Engineer Cass re-
ported that Estimate 71 submitted by the American Bridge Co. for
work on the Stewart Avenue bridge to May 11 1942 in the net amount
of 615,517.44 has been presented.

Resolved, that the Estimate be and hereby is approved and
ordered paid. Carried.
FREEZING ORDERS - BITUMINOUS MATERIALS The Engineer reported
rece pt of notice that all asphalt an heavy tars have been placed
on the restricted list, and that it will be impossible to get more
emulsion or tar for the resurfacing program without specific
approval by the Federal Government.
Mr. Cass was directed to make application to the Government
for permission to purchase materials necessary to maintain the
City streets.
CURB REPLACEMENT - STATE & MITCHELL STREETS Acting City Engineer
Cass reported receipt of a request from the J. F. Morgan Co. for
the City to replace sections of curbing in State and Mitchell Streets
for which a supplemental contract was executed.
He stated that while the Morgan Co. deposited a certified check
in the amount of $500.00 as a guarantee for this work they preferred
to have the City submit a bill for the work instead of using the
check.
Mr. Cass stated that there is approximately 80 ft. of curbing
in Mitchell Street and two sections in State Street at Eddy Street
and one section near the Strand Theatre which must be replaced.

Resolved, that the Engineer be directed to proceed with the
installation of the curbing and submit the bill for same to the
Morgan Co. Carried.
NEW CAR - FORESTRY DEPARTMENT Acting City Engineer Cass reported
that the car used by the City Forester is now nine years old and in
such bad condition that further repairs are nearly impossible.
He recommended the purchase of a new coupe if approval can be
secured from the Rationing Board, since the prices on good used
cars arc: excessive*

ORDER FOR CITY TRUCKS Mayor Comfort reported that the Local Ration-
ing MR has received a letter from Mr. D. B. Lee in the Office of
Price Administration in Washington, suggesting that the applications
for the purchase of five trucks for the City be traced as they are
not in the office at Washington and no record of their disposition.
The Mayor stated that the Collage Chevrolet Co. is anxious to
deliver the trucks to the City or receive a cancellation order, as
they have an opportunity to sell them to the Government.

WATER DISTRICT CONTRACTS Commissioner Egbert reported that con-
tracts for the newly formed water districts have been propaxed by
City Attorney Powers and it was agreed thgt the Water Committee
should moot with Attorney Charles Newman and representatives of the
water districts to study the contracts after which they are to be
presented to the Board for approval.
WATER SERVICE CHARGE - J. W. WILLIAMS Supt. Carpenter roported
that at the time new servioes wore installed in E, State Street
prior to the installation of the new pavement, a new water service
was installed at the: J. W.Wlilliams property at 336 E. State Street,
and that Mr. Williams objects to paying the charge amounting to
$29.59 since water is furnished the property from the service at
332 E. State Street.
Mr. Carpenter stated that the service was renewed to provide
for the property in case of change of ownership and that the
present rules and regulations of the Board provide that the owner
must pay when the installation is made.
The Commissioners agreed that since the service is not used
at this time the charge should be deferred until such time as it is
used.

Resolved, that the payment of the bill amounting to X29.59 be
deferred until such time as connection is made with the property,
and
Be It Further Resolved, that the City Attorney be directed to

SEWER AND WATER SERVICES - H..W. DAVENPORT PROPERTY Mayor Comfort
reported that Mr. H. 14. Davenport of 46 ornell treet has requested
privilege of paying the bill for the installation of sewer and
water services at his property in Cornell Street, amounting to
4411.02, over a ten year period, as it would be a distinct hardship
to pay the bill in larger installments.

Whereas, water and sewer services were installed for H. W.
Davenport for premises at 46 Cornell Street at a total cost of
$411.02, and
Whereas, said H. W. Davenport has requested permission to pay
such bill in installments over a period of ten years and the amount
and circumstances justify the granting of such request,
Now Therefore Be It Resolved, that permission is hereby granted
to said H. W. Davenport to pay said bill In nine equal annual .in-
stallments of 441.10 and a final installment of 941.12 with interest
on all sums unpaid at the rate of 5% per annum. The first such in-
stallment shall be due and payable on or before May 15, 1942 and
subsequent installments shall be due on or before April 15th in each
year. Upon default in the payment of any such installment, the
entire unpaid balance and accumulated interest shall become due and
payable and shall be added to the tax roll for the year in which
such default occurs to be collected in the manner provided by
Section 128 of the 6ity Charter. The permission hereby granted shall

chlorination of sewage effluent may be deferred until such time as
raw sewage is diverted from Fall Creek, but should be resumed two
weeks prior to opening the bathing beach at Stewart 'ark.

PUBLIC HEARING - ASSESSABLE IMPROVEMENTS - UNIVERSITY EASTWOOD AND
WOODCREST AVENUES The Mayor announced the opening of the hearing
on proposed assessable improvements as advertised for this time.
Q number of residents and property owners were present and two
additional petitions were presented, protesting the installation of
curb and gutter in University Avenue.
Several persons were also heard protesting the installation and

EASTWOOD AND WOODCREST AVENUES Mr, V. L. Tyler asked that the
proposed improvements in Eastwood and Woodcrest Avenues be deferred
until after the war, as Government regulations now make it impossi-
ble to build and sell new houses, and therefore the extra assess-
ments would be a distinct burden at this time.
Mr. Nathan Resnick of 203 Eastwood Avenue stated that he was
definitely in favor of the installation of curbsand guttersin these
streets as under present conditions surface water is causing con-
siderable damage to his property.
It was explained that in order to properly maintain the streets
and protect private property, it is necessary to install the curbs
and gutters in these streets and that the Common Council makes pro-
vision for installment payments of the assessments.

Resolved, that Acting City Engineer Cass be directed to proceed
with the work in Eastwood and Woodcrest Avenues in accordance with
plans submitted and approved, and prepare the usual assessment maps.

ROSEMARY LANE County Supervisor Harry Gordon reported that resid-
ents of Rosemary Lane have requested the Town of Ithaca Board to
improve that street, and that the Town may only do work in streets
owned by the Town.
It was explained that the City does not own the entire right -
of -way and therefore could not pass title and that the Stewart Park
Commission who furnished funds to purchase the Bergholtz Tract does
not favor disposing of any property or rights -of -way in the Tract.

MAYORS CONFERENCE The Clerk reported that the Mayors Conference
is to be held in Syracuse on June B. 9, and 10 and he requested per-
mission for the Acting City Engineer and City Clerk to attend.
By Commissioner Hopper, seconded by Commissioner Halverson:
Resolved, that Acting City Engineer Cass and Clerk Springer be
authorized to attend the Conference at City expense. Carried.
A1VLLNDMENT TO THE RULES OF THE _BOARD IN REGARD TO WATER CONNECTIONS
Attorney Powers reported that at the last meeting the Board
directed that the rules be amended to provide for payment for the
installation of water services when connection is actually made with
the property, but at Supt. Carpenter's suggestion a complete revi-
sion of the rules will be presented for the Board's consideration
at an early date.
DAMAGE TO CITY TRUCK City Attorney Powers reported receipt of a
check for repairs to a City truck which was damaged on April 1, 1942
at the corner of S. Plain and Center Streets, when hit by a car
driven by Raymond L. Rider of Dryden, N. Y.
ENGINFR JAMES TOWART - ESTIMATE Acting City Engineer Cass reported
that he has prepared an estimate of the amount due Engineer James
Towart to date in the amount of X363.16.
By Commissioner Egbert, seconded by Commissioner Hopper:
Resolved, that the estimate as submitted be approved and paid.
Carried.
CITY TRUCKS Acting City Engineer Cass reported that the applica-
tions and appeals for the purchase of five trucks have been rejected
and that a cancellation order has been sent the College Chevrolet
Co.
He recommended that the old trucks be put in good repair and
that two or three trucks be taken out of service and used only in
emergencies, and it was moved

Resolved, that the Engineer be authorized to have the trucks

SALE OF OLD HANGAR TRUSSES Commissioner Ward reported receipt of
an offer from th3 Town o Ithaca to purchase five of the roof
trusses removed from the old hangar. After discussion it was agreed
that the trusses would be of no use to the Gity and it was moved

STEWART AVENUE BRIDGE Commissioner Hopper reported progress on the
Stewart Avenue bridge. He stated that the Bridge Co. has had
difficulty in securing riveters but that there are now two crews
working.

tracts have been prepared for the water districts, and that copies

OLD WATER AND SLVV -;R SERVICE CHARGES EXPUNGED Water & Sewer Supt.
Carpenter presented e list of the accounts therewith appended) cover-
ing tli:wing of water services, pumping cellars, and other miscellan-
eous services totaling X402.63, and since these accounts have been
outlawed, he recommended that they be expunged.
He stated that since the Charter change in 1940 all such
charges become a lien against the property if not paid.

PHYSICAL DISABILITY - WATER & SEWER DEPARTMENT EMPLOYMi Commission-
er 7gbert reported that one emp oyee o Me Water Department has been
incapacitated by heart trouble and one employee of the Sewer Depart-
ment by tuberculosis and that both are now anxious to return to work.
He called attention to the fact that the City might be held re-
sponsible if these employees were again incapacitated after returning
to work. A letter from his physician was presented in the case of
the 'Water Department employee, stating that he should not do his
regular work unless someone else is in the immediate vicinity to
carry on in case of an emergency,
in the case of the Sewer Department employee the physician has
st=ated that the employee might return to light work for a few hours
daily and gradually work into his regular duties.
By Commissioner Egbert, seconded by Commissioner Ward:
Resolved, that Supt. Carpenter be directed to confer with the
Water Department employee in regard to the physician's statement and
report at the next meeting of the Board. Carried.

Resolved, that a statement of the duties of the Sewer Depart-
ment employee be furnished the physician and request a letter from
him as to the employees physical ability to perform the regular
work required, before his return to work. Carried.
LICENSE TO PURCHASE AND USE DYNAMITE Supt. Carpenter reported that
in order to secure a permit to purchase and use dynamite it v�ill be
necessary to designate and authorize a City employee to apply to
the County clerk for the necessary permit.

Resolved, that Supt. Carpenter be authorized to apply to Le
County Clerk for a permit to purchase and use dynamite. Carried.
INSPECTION OF PLUMBING - CITY BUILDINGS Commissioner Halverson
reported that there will probably be no plumbers or tinners avail-
able by Fall and recommended the inspection and necessary repairs
to all plumbing and tinning at once.

and an immediate inspection be made of all plumbing in the City

MINUTES Minutes of the preceding meeting were duly approved.
PUBLIC HEARING - ASSESSABLE IMPROVEMENTS - UNIVERSITY AVENUE The
Mayor announced the opening of the continued hearing on the proposed
assessable improvements in University Avenue.
Commissioner Ward reported that the Highway Committee and City
Engineer met with the committee from University Avenue and agreed
on a plan to improve drainage conditions in that section at a mini-
mum cost and without the installation of curb and gutters which would
b, assessable.
By Commissioner Ward, seconded by Commissioner Hopper:
Resolved, that the report of the Committee be accepted and that
the work be done as recommended by the Committee. Carried.
REQUEST FOR TREE REMOVAL A letter from Mrs. Harriet K. Roskelly
was presented requesting the City to remove some of the trees at
her property at 1102 N. Cayuga Street.
Forester Baker reported that the trees have been trimmed but
that he does not recommend removal.

sented calling attention to the fact that after July 1, 1942, the
Federal Government will not carry free insurance on private or
municipal property to cover damage resulting from enemy attack, in-

in resisting enemy attack.

City Engineer Cass reported that the second estimate for t e construc-
tion on the Stewart Avenue bridge amounting to 415,505.29 has been
presented by the American Bridge Co. and he recommended payment.

STET "J'kRT AVENUE BRIDGE Acting City Engineer Cass reported that

RAT REMOVAL Mayor Comfort reported receipt of letters,telegrams
anz Iersonal calls from representatives of the Bureau of Industrial
Conservation of the War Production Board, urging the removal of
old street car rails from the City streets. He stated that the
Co�rcrnment reports an acute shortage of scrap steel and iron for
war reeds and that the Government is in a position to order rail re-
mo sal.
Engineer Cass reported that J.P.A. is the only Federal agency
to provide help to the City in the work and that a material allow-
ance of w25.00 per man month will be allowed instead of X5.00 as on
former projects, and that he bolieved a project can be drafted to
remove the rails without cost to the City.
Commissioner Egbert recommended that due to shortage of men.
on W.F.A. that the City undertake the removal of rails from Eddy
Street before a project is drawn and submitted for 1 "I.P.A. participa-
tion.

WATER DISTRICT CONTRACTS Commissioner Egbert presented the con-
tract with the Town of Tthaca (Cayuga Heights water district) which
has been approved and signed by the Town of Ithaca and he recommend-
ed approval by this Board.

Resolved, that the contract be and hereby is approved and the
Mayor and City Clerk authorized to execute same on behalf of the

He reported that contracts for Cayuga Heights village, Spencer

possibility of the City being liable for a recurrence of the trouble.

AIRPORT IMPROVEMENTS Commissioner Egbert reported that Mr. H. M.
Peters has secured information on procedure to be followed to se-
cure help in the improvement of the airport. The Mayor agreed to
appoint a special committee to follow the matter.
HOUSING Mayor Comfort reported on a conference with officials in
Geneva in regard to housing workers at the new Naval station to be
constructed near Ovid, N. 'Y.,and thatitis expected that Ithaca
will benefit by the large number of persons to be employed on the
project.

Buffalo Street and protested the charge of X2.75 for cleaning the
sidewalk at that address which has now been placed on the tax roll
for collection, and he requested the Board to expunge the charge
stating that the City records do not show the namesof the persons
doing the work.
The Clerk reported that Commissioner G'iard has investigated the
matter and does not recommend expungement of the charge, and City
Attorney Powers reported that the Board does not have the power to
expunge the charge.

CITY PASSENGER CAR AND TRUCK REQUIRETdI—ENTS The Clerk reported re-
ceipt of a questionnaire from the 7ayors Conference requesting in-
formation for the Government Requirements Branch of IR?B as to the
number of passenger cars and trucks the City will need for the
period July lst 1942 to June 30th 1944,
Acting City Engineor Cass reported on tho numb:Dr of cars and

E. CLINTON STREET BRIDGE Acting City Engineer Cass reported that
the approaches have been compl�tod to the E. Clinton Street bridge
at a cost to date of ;p5953.00, and that there may possibly be a fuw
small bills still outstanding.
STEWART AVENUE BRIDGE Acting City Engino,r Cass reported that the
City's work on the Stewart Avenue bridge is progressing satisfactor-
ily but that the painting has been held up due to the condemnation
of the painting contractor's equipment by the State Labor Department.
Mr. Cass stated that the contractor is in the Cite today making
arrangments to provide proper equipment and put on additional paint-
ers.
BIDS ON OLD STREET CAR RAILS Acting City Engineer Cass reported
receipt of two bids for the old street car rails although four
dealers had been requested to submit informal bids.
He stated that the highest bid is ;;;1.00 lower than the price
received for the rails removed from State Street, and that the. bids
received were for the rails at point of r. enoval and in full .len`;th.
BITUMINOUS ROAD MATERIALS Acting City Engineer Cass reported re-
ce:lpt of an allottment of 8100 gallons of asphalt emulsion and 5600
gallons of heavy tar which is approximately 25j' of the amount applied
for.
Ivlr. Cass recommended that the heavy tar be used. in a sin l
surf aco treatment program and the care of some of the dirt streets

The matter was referred to the Highway Committee to work with

tracts with the Spencer Road district and the Glenside district which
have been approved by those districts and he recommended approval
by this Board.

'VILLAGE OF CAYUGA HEIGHTS - WATER CONTRACT Commissioner Egbert re-
torted that the contract with the Village of Cayuga Heights has been
anproved by a committee from the Village and will be acted upon by
:; he Village Board at a meeting to be held July 6, 1942 and then may
he acted upon by this Board at the July 8th meeting.
LAKE ROAD, RENWICK HEIGHTS - WATER DISTRICT Commissioner Egbert
.'eported that the contract with the Lake Road, Renwick Heights dis-
I;rict has been prepared but has not yet been approved by that dis-
trict, but that it is hoped that it will be approved by July 1st,
and in the event it is not approved by that time it will be necessary
for this Board to order discontinuance of water service or extend
the time in which the district may be completed.
NEW SEDAN - WATER DEPARTMENT Commissioner Egbert reported that the
1935 Ford sedan used by the Water Department is in poor condition
and should be replaced and it was moved

coupe now used by the repair shop. Mr. Carpenter was directed to

MINUTES After correcting the last item on page 16 of the minutes
Or-Mg-meeting held June 11, 1942, to read "Elmer Hook - Disability",
the minutes of the preceding meeting were duly approved.
RENWICK HEIGHTS-McKINNEYS - WATER DISTRICT Commissioner. Egbert re-
ported that residents of the Renwick Heights-McKinneys district have
expressed the desire and willingness to form a water district and
have requested the Board to extend to August 1, 1942 the time in
which the City will provide water service to them.
Mr. Egbert reported that on December 13, 1939 the Board passed
a resolution that after January 1, 1942, no water was to be fur-
nished users outside the city limits except to established water
districts, and that on December 23, 1942, the time was extended by
resolution to June 30, 1942, he recommended that the time be again
extended to August 1, 1942, and it was moved,

Resolved, that the time for the formation of water districts
be extended to August 1, 1942.

STEWART AVENUE BRIDGE Commissioner Hopper reported that the paint-
ing of the Stewart Avenue bridge le not progressing satisfactorily
and he felt the matter should be again brought to the attention of
the Bridge Company.

W. J. RYAN - SALARY Commissioner Ward recommended that the Board
consider an increase in wages for Timekeeper W. J. Ryan.
He stated that Mr. Ryan has had an offer of a position at a con-
siderable increase in wages and singe he is thorou;; ily familiar with
the rules and regulations of the Board, that some effort should be
made to retain his services.
It was agreed that a committee consisting of Commissioners
Rumsey, Ward and Hopper should investigate the matter and make
recommendations to the Board.

ELKER HOOK - DISABILITY The Water Committe reported that it had
conferred with Dr. Orman Moore regarding tho physical condition of
Elmer Hook and that it appeared from the conference that IVIr. Hook
is differing from a heart ailment that might be aggravated, perhaps
Fatally, by any physical strain in the discharge of his duties and
t-.h ^.t such an injury in addition to its effect on the emplo;teE, would
rusuit in a serious financial loss to the City. The committee
recormiended that 1r. Hook be advised to resign and take his retirement
area zpon his failure or refusal so to do, that he b<, removed under
the provisions of the Civil Service Rules.

Resolved, that the report and recommendations of the Water
Committee be accepted and that the City Attorney be instructed to
write Mr. Hook advising him of the Board's decision and that, upon

for Mr. Hook's romoval and dismissal. Carried.

STE):'"ART AVENUE BRIDGE OPENING Acting City Engineer Cass reported
that a protest was made to Mr. Nash of the American Bridge Co. in
regard to the progress of painting on the Stewart Avenue Bridge, and
that he has received a letter from Mr. Nash authorizing the opining
of the bridge before completion of the painting if necessary.
Mr. Cass stated that the installation of tho guard rail at the
southwest corner of the bridge will be completed today and that the
bridge will be opened Saturday, July 11, 1942.
RAIL REMOVAL - EDDY STREET Acting City Engineer Cass reported that
approximately 900 ft. of rails have been removed from Eddy Street
and that approximately 800 ft. of concrete patching will be installed
today.
RETAINING WALL - 618 HUDSON STREET Commissioner 'guard reported re-
ceipt of a request from T homas D. Speno for further consideration
of his request for permission to install a retaining wall in front
of his property at 619 Hudson Street.
The matter was .referred to the HI ghwa,.T Committee for further
study and report.
ELMER HOOK - RSTIREMENT Supt. Carpenter reported that Elmer Hook
is preparing to apply for retirement and it was suggested that he
confer with City Attorney Powers before filing his application.
MC KINNEYS - RENWICK HEIGHTS WATER DISTRICT Commissioner Egbert
reported that approximately 957o of the residents along the McKinneys
line have signed up for water service but no report has been re-
cc.ived on the number from the Renwick - �teiFhts district.
11. J. RYAN - SALARY Commissioner Rumsey reported that the Cormnitteo
has studied the matter of a salary increase for 1':Ir. Ryan and that
it is felt that no change should be made until the study of the
entire personnel is completed by the State Civil Service Commission,
as that Commission is to miaku recommorid.ations for salaries in all
City dcpartinents.

EDNA LOVEJOY - VACATION The Clerk reported that Mrs. Lovejoy, care-
taker at the ladies restroom has requested one month vacation leave
beginning July 20th and that Mr. Baldwin has approved the request
and that a daughter -in -law Mrs. Marian Lovejoy has been employed for
the period.
EDDY STREET RAIL REMOVAL Acting City Engineer Cass reported that
the rai removal project in Eddy Street has been completed and that
the net cost to the City will be approximately 4p550.00 or about 10V
per foot of rail.
TIOGA STREET RAIL REMOVAL The matter of removal of rails from
Toga Street was discussed and it was agreed that the cost would be
considerably more than the Eddy Street job due to the condition of
the pavement.
After discussion it was agreed that the rails should be re-
moved if the cost is not excessive, and it was moved

CURB AND GUTTER REPLACEMENT PROGRAM Commissioner Ward reported
that the curb and gutter program has been discussed with the
Eng.incer and that the following program is recommended:
S. .Plain St., Green St. to Clinton St., both sides.
Cleveland Ave., Plain St. to Meadow St., both sides.
Farm St., Aurora St. to Linn St., both sides.
Linn St., Yates St. to Tompkins St,, west side.
Lini St., Farm St. to Marshall St., both sides.
Fie also reported a section of the curb in Schuyler Place on. the
west side between Seneca and State Streets and a section. on the
west side of N. Cayuga Street in the 1100 block should be replaced,
possibly substituting the two later locations for the Linn Street
replacement.

SID WALK REPAIRS Acting City Engineer Cass reported that City
forces are installing the sidewalk at Belle Sherman School for the
Boas,d of Education and that all other City sidewalks are in good
condition.
He stated that first notices have been sent to ten property
owners to repair sidewalks, and that in most cases the repairs were
necessitated on account of damage by tree roots.
RETAINING WALL - 619 HUDSON STREET Commissioner Ward reported that

Thomas D. Spena for permission to install a retaining wall in front
of his property in Hudson Street and that the Committee does not
recommend that permission.bo granted.
HOMESTEAD ROAD IMPROVEI ENTS Attorney George Russell representing
residents of f-16mestea Road was present and the matter of the accept -
ance of the street by the City was discussed.
The improvements necessary before the City may accept the
strc;et were outlined and Mr. Russell stated that the property owners
are anxious to comply with the regulations but that it is impossible
to hire private contractors at this time.
Attorney Powers stated that if the owners were willing to place
a sufficient sum of money in escrow to cover the cost of the improve-
ments that an agreement might be, made; whereby the City could do the
work. It was also pointed out that the curb and gutter should be
installed when the work is done and that this installation would be.

three City employees from the Department.

LAKE ROAD REMU CK - WATER DISTRICT Commissioner Egbert reported
that ake Road residents have ATI signed for water service but that
nothing further has been heard from the residents of Renwick Heights.
WAR DAMAGE INSURANCE Commissioner Halverson reported that consider,
ation has been given the matter of securing war damage insurance
and that he felt that the sewer and water buildings should be
covered. After further discussion the study was continued with the
committee.

MINUTES Minutes of the preceding meeting were duly approved.
PUBLIC HEARING - HOMESTEAD ROAD IMPROVEN,E'NTS The Mayor announced
the opening of a public hearing on the proposed installation of curbs
and gutters in Homestead Road for which assessments will be levied,
as advertised for this time.
Several property owners were present and their spokesman stated
that they are particularly anxious to have the curbsand gutters in-
stalled.
The Clerk reported that Henry C. and Johanna Hoefle have de-
posited a fund in escrow, sufficient to pay for the work necessary
to place the street in condition for acceptance as a City street.

Resolved, that the curbs and gutters be installed in Homestead
Road and the Engineer directed to prepare the usual assessment map
after completion. Carried.

5% BONUS - LABOR DEPARTMENT Commissioner Ward reported that due
to the shortage of labor that in some instances it is necessary to
work the men more than the regular 44 hour week and that in accord-
ance with the resolution adopted on December 23, 1941 that these
men do not receive the 57o bonus when their wage equals 835.00 and
he recommended that the bonus be paid to all laborers now being
paid on the hourly basis.
By Commissioner Ward, seconded by Commissioner Hopper:
Resolved., that effective August 10, 1942 all laborers on the
hourly rate be paid the 510 bonus irrespective of wages earned.

KARLTON TAYLOR - OVERTIME Commissioner Egbert reported that in

Taylor to work overtime for which he receives no pay since he is

OLD WATER AND SEWER SERVICE CHARGES EXPUNGED Water and Sewer Supt.
Carpenter presented a 1 st of accounts herewith appended) covering
miscellaneous charges made by the Water and Sewer Department total-
ing X1,066.31, and since these accounts have been outlawed, he
recommended that they be expunged,
Attention was called to the fact that since the Charter change
in 1940 all such charges now become liens against the property if
not paid.

P. K. REED - HYDRANT CHARGE REFUNDED Commissioner Egbert reported
that Pr. P. K. Ree ci of 807 Hanshaw Road had paid a bill for hydrant
charge amounting to X3.45 which was billed in error since Mr. Reed's
residence is located 520 feet from a hydrant and the Insurance
Company will not allow reduced rates, and it was moved

E. F. LARKIN - WATER BILL REFUND Commissioner Egbert reported that
due to an error in f.ot reporting removal of a water service to
property in Cook Street owned by Mr. E. F. Larkin that Mr. Larkin
has been billed for >'p9.00, ��3.00 of which has been paid and lie
recommended reimbursement in the amount of �q3.00 and expuneement of
the balance amounting to X6.00.

SEVEE'R RENTAL CHARGE - ARMY ENGINEERS OFFICE Supt. Carpenter re-
ported that when the sewer rental charges were set up for properties
outside the City that the Army Engineers office was omitted and
that in order to collect this rental a copy of a resolution establish-
ing; the charge must be presented with the bill.
He stated that the price established for the 'University build-
ings outside the City was w4.50 per fixture and as there are 14
fixtures in the Army Engineers office, the rate would be #63.00
annually.

Resolved, that the sewer rental charge for the Army Engineers
office be fixed at 463.00 annually effective: August 1, 1942.

GRATES FOR CITY HALL BOILERS Commissioner Halverson reported that
the matter of securing grates for the boilers in City hall has been
discussed since it may be necessary to heat with coal due to the
oil shortage.

HEAR-NG RE SIDEWALKS In response to final sidewalk notices ordered
c�,rr _-d at the meeting held August,12, 1942, Mr. D. H. Bonne, owner
of property at the corner of State and Corn Streets reported that
t�ec�amage to his sidewalk was caused by the installation of a near
�F -r v_ ##_--ce and by workmen at the time W. State Street was paved, and
Ile stated that he did not feel that he should be compelled to re-
place the walk.
By Commissioner Egbert, seconded by Commissioner Rumsey:
Resolved, that the matter be referred to the Highway Committee
for investigation and report. Carried.
By Commissioner Egbert, seconded by Commissioner Rumsey:
Whereas, final sidewalk notices have been duly served and a
public hearing thereon held by the Board, and
Whereas, all persons wishing to be heard in relation thereto
have been considered,
Now Therefore Be It Resolved, that the City Engineer be author-
ized to proceed with the installation of all sidewalks on which
final notices have been sent which are not constructed in accord-
ance with the orders of this Board. Carried.
STREET RAILWAY BRIDGE - FALL CREEK The Mayor reported receipt of
two letters from Mr. Georg; R. Bennett, District Chief, Special
Projects Salvage Section of WPB in which the removal of the old
Street Railway bridge over Fall Creek at the foot of Tioga Street
was demanded.
Letters from Mr. Claude L. Kulp, Superintendent of the Public
Schools and from Mr. Laurence S. Hill, Director of the Department
of Physical Education of Ithaca College were presented.
These letters outline the use made of this bridge and definite-
ly established the need for the bridge. Commissioner Hopper re-
ported that the Bridge Committee has examined the bridge and feel
that it is in too good condition to remove for scrap as it might
well be used in some other location, and do not favor removal at
this time as it is serving a very useful purpose.
The question of the removal of the bridge was discussed at
length and while the Commissioners expressed the desire to cooper-
ate in the war effort in every way, they did feel that Mr. Bennett
has not been fully informed of the use of the bridge, and it was
moved
By Commissioner Hopper, seconded by Commissioner Halverson:
Resolved, that the Mayor be authorized to write Mr. Bennett
explaining the situation and calling attention to the fact that
the bridge is used at least eight months each year to good advantage,
and is essential as an entrance to the al-2etic fields used in
the program of "Physical Fitness' carried on by both the High School
and Ithaca College. Carried.
DAMAGE CLAIM - VERA READ City Attorney Powers called attention
to the claim for damages amounting; to X2500.00 filed by Mrs. Read
for injuries alleged to have been received when she fell at 109
Cook Street, where the sidewalk was in a defective condition caused
by roots of a tree.
Mr. Powers stated that the claimant is willing to settle on
a reasonable basis.

Resolved, that this Board recommend to the Common Council that
the case be settled. Carried.

APPROVAL OF PURCHASE OF ROAD TAR Acting City Engineer Cass re-
ported that the app cat on for an additional 13,200 gads. of road
tar has been approve the Public Roads Administration and that this
will be sufficient glace many of the dirt streets in good condi-
tion.

G'13 FUEL OIL KEROSENE CONTRACTS Acting City Engineer Cass re-
that the present---contract for furnishing gas, fuel oil and

ri_a possible to participate in State purchases and that notice has
jusc been received that the State is about to ask for bids on gaso-
line for a six months period beginning October 1, 1942.
By Commissioner Rumsey, seconded by Commissioner Ialverson:
Resolved, that the Engineer be authorized and directed to
submit an estimate of the quantities of gas needed for the six
months period from October 1, 1342 to be included with State bids,
and
Be It Further Resolved, -that the Engineer be authorized and
directed to prepare specifications for the purchase of gasoline,
fuel oil and kerosene for the ensuing year, and the Clerk directed
to advertise for bids thereon, said bids to be opened at a regular
meeting of the Board to be held September 23, 1942. Carried,
EXTRA HELP - ENGINEER'S OFFICE Acting City Engineer Cass reported
receipt of a letter from ames F. Morgan Jr. requesting employment
in the Engineer's office as soon as their present contract is com-
pleted which will be some time in November.
Mr. Cass stated that Mr. Morgan's work was very satisfactory
and that there is a great deal of work to be done in preparation
for post -war work.
The Engineer was authorized to offer Mr. Morgan 4p45.00 per week
for his services.
STREET LIGHT - HOMESTEAD ROAD Commissioner Ward reported that the
Highway Committee has nvest gated the request for the installation
of a street light in Homestead Road, and it was moved

Resolved, that the light be installed as was requested.
Carried.
LABOR DEPARTMENT PROMOTIONS Commissioner Ward reported that due
to the loss of sem -sk ed men in the Labor Department, it has
been necessary to change laborers to a higher position which carries
an increase in the hourly rate of pay and he suggested that the
Highway Committee be authorized to make necessary changes which will
be reported to the Board for confirmation.

Resolved, that the Highway Committee be authorized to make
changes in the Labor Department as is necessary to carry out the
work of that department. Carried.
STEWART AVENUE BRIDGE ACCEPTANCE Commissioner Hopper reported that
77. George Layton is unable to come to Ithaca to make final inspec-
tion on the Stewart Avenue bridge before acceptance but that he
states the general construction is satisfactory.
commissioner Hopper reported that the Building Committee has
inspected the bridge and recommend acceptance.

Resolved, that the Stewart Avenue bridge be and hereby is
accepted, and
Be It Further Resolved, that the final estimate be paid when
the amount is worked out with the American Bridge Co. Carried.

Commissioner Miller left the Council chamber at this time.
DAMAGE TO FLORAL AVENUE PROPERTY Commissioner Hopper reported that
due to removal of soil along the bank of the Inlet near Floral
Avenue by unknown persons, that during the recent high waters con-
siderable damage was done to property in that section.
He stated that it did not seem to be the responsibility of the
City but suggested that any suitable refuse available should be
dumped in the excavation to prevent further damage.

Resolved, that the matter be referred to the Creeks & Bridges
Committee with power. Carried.
SILT DAM BRIDGE Commissioner Egbert reported that the bridge at
the s t dam is need of repairs and that the Town of Ithaca has re-
quested the Water Department to make the needed repairs, claiming
it is a responsibility of the City. Mr. Egbert stated that no
agreement can be found in regard to the maintenance of the bridge
and since it is on a Town road felt, that the City might assume
liability if repairs are made by the City.
City Attorney Powers suggested that an agreement be reached with
Town officials before any repairs are made.
The matter was left with the Highway Department to arrange
an agreement with the Town.
SEWER RENTALS - OUTSIDE PROPERTIES Water & Sewer Supt. Carpenter
reported that on May 2, 1940 the annual sewer rental for the
Federal Laboratory at Cornell University was set at 4p60.00 with no
provision for additional charges as fixtures are added, and that
since that time three new fixtures have been installed. He
recommended that provision be made to in'Clrease the rental 4;4.50
per fixture in all University buildings situated outside the City
limits as additional installations are made.

Resolved, that the Federal Laboratory be billed for three extra
fixtures at 44.50 per fixture making a total annual sewer rental
of 473.50, and
Be It Further Resolved, that 0ornell University be billed for
sewer services for State College buildings situated outside the
City limits at the rate of w4.50 per annum per fixture. Carried.
PAINTING - CITY HALL Commissioner Halverson reported receipt of
an estimate for painting the external trim and metal work on City
Hall and he recommended that the work be done.

applied and that formal bids should be received, and it was moved

GRATES - CITY HALL BOILER Commissioner Halverson reported that
grates have been ordered for the City Hall boilers. fie expressed
the opinion that considerable savings could be made in heating if
certain parts of the building are cut off and the matter was con-
tinued with the Building Committee.
GOLF PRO - MUNICIPAL COURSE Commissioner Halverson reported that
Mr. Wester While ' Pro at the Municipal Course, has received several
offers to teach at other locations and as it is increasingly diffi-
cult to secure goods to sell at the concession he asked if the City
would consider an increase in salary.
The Commissioners agreed that it would be impossible to assure
a definite salary for next year and it was suggested that 1r1r. White
state the amount of salary that will be satisfactory.
PURCHASE - MOVER SHARPENER Commissioner Halverson reported that
the cost of sharpening mowing machines is approximately 4100,00 per
year and he recommended the purchase of a sharpener at a cost not
to exceed 4250,.00,E

Resolved, that the bills audited by the Finance Committee
be and the same hereby are approved and ordered paid. Carried,
EXTENSION OF WATER & Sr,VYER LINES - HOMESTEAD ROAD Commissioner
Egbert recommended the extension o the water line a distance of
60 ft. and the sewer line a distance of 15 ft. in Homestead Road
to carry them beyond the new surfacing that is being placed in the
street.

Resolved, that the Water & Sewer Department be and hereby is
authorized to extend the lines as recommended, Carried.

BIDS - PAINTING CITY HALL The following bids for painting exterior
trim and metal work on ity Hall were opened and read by the Clerk:

SIDEWALK REPAIRS Acting City Engineer Cass reported that in three
instances no effort has been made by property owners to make re-
pairs to sidewalks where preliminary notices have been sent and he
asked if the Board wished final notices sent to these owners. He
stated that the sidewalks in question were damaged by tree roots.
After discussion it was agreed that where sidewalks are damaged
by City trees, repairs should be made at City expense, and it was
moved

Resolved, that the Engineer be authorized to proceed vdth the
repair of sidewalks at City expense where walks have been damaged
by City trees. Carried.
WAGE ADJUSTMENTS - LABOR DEPARTMENT Commissioner Ward reported
that the Highway Committee has studied the matter of necessary
changes in the Labor Department and that in accordance with the
authority granted the Committee at, the meeting hold August 26, 1942,
the following list of employees have been promoted to the classifi-

requested the Board's approval:

DRAIN - MORSE CHAIN CO. Commissioner Ward reported that the High-
way Committee has approved the request of the Morse Chain Co. for
permission to install an overflow drain from an oil trap located
on Morse Chain property to the catch basin in S. Cayuga Street
extension.
He explained that the installation will eliminate oil in the
butters in S. Cayuga Street and that the work is to be done under
the supervision of the City Engineer.

SALARY INCREASE W. J. RYAN Commissioner V�,ard reported that the
Highway Committe has discussed the matter of Increase in salary for
tim; keeper, W. J. Ryan and that the Committee feels he should be
retained if possible and recommends that his salary be increased to
X45.00 per week.
By Commissioner Ward, seconded by Commissioner Egbert:
Resolved, that the salary of W. J. Ryan be increased to .;e45,00
per week effective September 7, 1942. Unanimously Carried.
WATER DISTRICTS Commissioner Ward reported that the Water District
for Renwick ieights, McKinneys and Lansing districtswill be com-
pleted in a short time and the Water Committee was authorized to
negotiate the agreements with these districts and bring to the
Board for approval,.
PLUMBERS CONVENTION - CLEVELAND OHIO Supt. Carpenter reported
that theourneymen lumbers will hold a convention in Cleveland,
Ohio on September 21 and 22, 1942 when many matters pertaining to
war emergencies will be discussed. He recommended that Plumbing
Inspector Wismar be authorized to attend.
By Commissioner Egbert, seconded by Commissioner Halverson:
Resolved, that Plumbing Inspector Wismar be authorized to
attend the convention at City expense. Carried.
D. H. BONNE - SIDEWALK REPAIRS Supt. Carpenter reported that no
evidence of damage to the sidewalks caused by the installation of
water service was found at the Bonne property in W. State Street,
but that the sidewalk is in poor condition partly caused by the
roots of trees.
By Commissioner Egbert, seconded by Commissioner Hopper:
Resolved, that the walk damaged by City trees be repaired at
City expense and that Mr. Bonne be advised that the balance of the
walk must be replaced at his expense. Carried.
GOLF PRO - MUNICIPAL COURSE Commissioner Halverson reported that
Wester White has decided to continue as Pro at the Municipal Course.
GAS, FUEL OIL KEROSENE CONTRACTS The Clerk reported that C. H.
Murray who was successful bidder for furnishing gas, fuel oil, and
kerosene for the year beginning October 1, 1941 has agreed to
furnish these items under the same agreement for the year beginning
October 1, 1942 and he suggested that advertising for new bids be
deferred until after the next meeting or until word is received
of the result of bids being received by the State.

Resolved, that advertising for bids for gas, fuel, oil and
kerosene be deferred. Carried.
AUDIT By Commissioner Miller, seconded by Commissioner Hopper:
Resolved, that the bills audited by the Finance Committee
be and the same hereby are approved and ordered paid. Carried.

MINUTES Minutes of the preceding meeting were duly approved.
RESIGNATION - COMMISSIONER HALVERSON Mayor Comfort announced the
resignation o y_Y. Halverson as Commissioner of Public Works, who
is entering military service.
DAMAGE CLAIM BLANCHE RUSSELL The Clerk reported receipt of a
ctaim, riled 7-y—rs. Blanch ssell of 312 Hook Place in the amount
of 42500.00 for injuries alleged to have been sustained when she
fell on the sidewalk at 601 W. Clinton Street.
By Commissioner Egbert, seconded by Commissioner Hopper:
Resolved, that the claim be referred to the City Attorney,
Carried.
GASH FUEL OIL, KEROSENE CONTRACTS The Clerk reported that the State
will open bids for gasoline on September 25th after which the Board
should decide on contracts for the coming year. The Clerk was in-
structed to notify Mr. C. H. Murray that action will be taken at the
next meeting of this Board.
STREET RAILWAY BRIDGE - FALL CREEK A letter to Mayor Comfort from
Mr. George R. Bennett, DIstrict hief, Special Projects Salvage
Section of WPB was read in which Mr. Bennett expressed appreciation
of the Mayor's letter of August 28, 1942, but pointed out the urgent
need for scrap and expressing the hope that the removal of the
bridge would be authorized without the necessity of drastic action
by the Federal Government.
The matter was discussed at length by the Commissioners after
which it was moved,

Resolved, that the City Engineer be and hereby is authorized
to dispose of the bridge for scrap, to the best advantage to the
City. Unanimously Carried and Approved.

FINAL h6TIMATE - STEWART AVENUE BRIDGE Actin; City Engineer Cass
reported that an agreement has been reached with the American :Bridge
Company and that the final estimate amounting to 010,766.92 is in-
cluded in the bills for audit today.
He stated that the ten percent of the total cost amounting to..
44643.30 is to be retained in accordance with contract provisions
until released by the bonding company.

Resolved, that the final estimate amounting to 410,766.92 be
paid, and
Be It Further Resolved, that the ten percent retained amounting
to v4643.30 be paid to the American Bridge Company upon receipt of
release from the honding company. Carried.
SEAL CAPS - ABUTMENT BASES - STEWART AVENUE BRIDGE Acting City
Engineer ass reported that a balance of 437 . remains in the
appropriation for the two bridges and he recommended that the sum
be utilized to install a seal cap on the abutment bases at the
Stewart Avenue Bridge.

EXTRA HELP - ENGINEER'S OFFICE Acting City Engineer Cass reported

due to present living conditions he feels he will not be able to
accept the position for less than 450.00 weekly.
Mr. Cass stated that extra help is needed in the office and
that it will be impossible to secure the services of a graduate
Engineer for less.

Resolved, that Acting City Engineer Cass be and hereby is
authorized to offer Mr. Morgan the position on a temporary basis

ALLAY LOT - PARK STREET AND SPENCER ROAD Attorney rowers reported
that at the time the new Inlet road was constructed, the City was
expected to provide the rights of way but that one lot owned by the
Bradford Almy Estate at the intersection of Park Street and Spencer
Road was overlooked and that the road was constructed across the
property without acquiring title.
He stated that recently attention has been called to the
matter and that the Estate has agreed to accept W500.00 in settle-
ment and he recommended that a committee be appointed to investigate
the matter and report.

Resolved, that the matter be referred to the Highway Committee
Slid City Attorney for invostigatiot and recommendation. Carried.
&&TFR DISTRICTS Commissioner Egbert reported the completion of
CWIng of water districts and that the contracts will be ready for
f►roval at an early date.
OF OLD HANGAR TRUSSES Commissioner Egbert reported that in
ecordance with authority granted at the meeting held May 27, 19420
five trusses removed from the old hangar were sold to the Town of
Ithaca at 6/ per pound. He stated that the weight was approximately
4b300 lbs. and he recommended the Town be billed for 4500.00.

CREEK MAINTENANCE APPROPRIATION Acting City Engineer Cass reporest
that due to extra expense for diking during the dredging operatiot.,
there will be insufficient funds in the creek maintenance budget to
complete necessary- cleaning work in Cascadilla Creek and opening
ditches in the Fifth Street marsh section.

a -r ter reported that in accordance with a "Jar Co ncil regulations,
he is required to be in central headquarters during blackout and
other emergencies and that it is necessary to call a man who is
familiar with the water valves of the City and he recommended tha4
a phone be installed in the residence of E. N. Shaw at 437 Flpral
Avenue. H3 stated that Mr. Shaw es familiar with the locatim of
all water valves.

opinion that a phone should be i alled at the residence during
the present emergency, and it was moved

ROCCO RICCI DISABILITY- Wator Supt. Carpenter reported that the
constructlon ome has advised that Rocco Ricci will be discharged
from that institution on October lst and the Water Department has
been asked to provide NIr• Ricci with light work.

Mr. Carpenter reported that at present Mr. Ricci will be unable
to stand at work and that there is no avail -able work in the depart-
ment at this time.
The Commissioners expressed the opinion that Mr. Ricci should
riot return to work in the Water Department until he is fully re-
covered or until some light work is available.

welcomed Mr. Barr as the new member of the Board of Public Works.
DAMAGE CLAIiti - MRS. HAL LA.- IRENCE The Clerk reported receipt of a
claim filed by Mrs. Pdiae Lawrence of 210 ;. Lincoln Street in the
amount of V26.09 for damages to her residence caused when a limb
from a large tree fell striking the porch. The claim stated that
the limb did not fall during a storm.
Forester Baker reported that the limb had apparently been
split during an earlier storm but was not found to be in a. rotted
condition when removed.
City Attorney Powers stated that the City could not be held
responsible for the damage since there was no negligence on the part
of the City and he recommended rejection of the claim.

Resolved, that the claim be rejected as recommended by the City
Attorney. Carried.
FIREPROOF STORAGE - CITY COURT RECORDS The Clerk reported that the
ommon ouncil has referred to the Board of Public corks for study
and report, a request from City Court for construction of a fire-
proof storage vault for City Court records.

Resolved, that the matter be referred to the Buildings &; Grounds
Committee and City Engineer for study and recommendation. Carried.
GA50LTNE BIDS The Clerk reported receipt of advice by telephone
from the Mayors Conference that State bids for gasoline for the
third district, in which Ithaca is located, was awarded to the
Sinclair Refining Co. at.1D15 per gallon, the contract to run for
six months.
It was agreed that no action should be taken until further
written information is received from the Conference.
ALMY LOT - PARK STREET AND SPENCER ROAD Commissioner Ward reported
that the Highway Committee has investigated the matter of the use
of the Almy lot which was reported at the meeting held September
2339 1942 and that the Committee recommends payment of %1500.00 to the
Almy Estate in full payment for the lot.
By Commissioner Ward, seconded by Commissioner Hopper:
Resolved, that thts_Bo�-rd recommend to the Common Council
that the sum of ',,500,00 be paid the Bradford filmy Estate in full
payment for the lot. Unanimously Carried and Approved.
RENWICK HEIGHTS WATER DISTRICT - CONTRACT Commissioner Lgbert re-
ported that the water contract for Renwi7k Heights district has bccn
completed and approved by the Committee and it was moved

Resolved, that the contract be and hereby is approved and the
Mayor and City Clerk authorized to execute same on behalf of the
City after its execution by Officers of the water district.

RETEST FOR FIRE HYDRANT - TRUKANSBURG ROAD Commissioner Lgbert
reported receipt of a petition signed by seven residents of the
Trumansburg Road requesting the installation of a hydrant approximate
ly 250 ft. north of the Stone house on the Trumansburg Road.
The petitioners agreed to pay the installation cost as well as
the usual hydrant rental fee.
The Commissioners agreed that the installation cost should be
paid prior to installation and an agreement prepared for each
petitioner to sign guaranteeing payment of hydrant rental.

Resolved, that the hydrant be installed as requested provided
the cost of installation is made in advance, and provided that a
guarantee of hydrant rentals is filed with the City before installa-
tion. Carried.

Resolved, that the bills audited by the Finance Committee be
and the same hereby are approved and ordered paid. Carried.
REMOVAL OF STREET RAILWAY BRIDGE - FALL CREEK Acting City Engineer
Cass reported receipt of the following bids for the steel in the
old railway bridge over Fall Creek, the bidder to dismantle the bridge

DRINKING FOUNTAIN - THOMPSON PARK City Engineer Cass reported that
the Common ouncil has approved scrapping the drinking fountain at
Thompson Park and that the following bids have been received for the
scrap:

FUE- -, OIL - CITY HALL Notice of the rejection of the application
for fuel oil for heating City Hall was presented.
The Engineer reported that one boiler has already been converted
cr the use of coal and that the other will be converted within a

S. R. HAFELY - CLAIM FOR PERSONAL INJURIES A damage claim in the

:,.ount of 0 .00 filed by Mr. S. R. Hafely of Culver Road, Ithaca
for injuries alleged to have been received when he fell into an
excavation near the old Stanford - Crowell building in W. Seneca Street.
IVIr. Carpenter reported that the excavation was made by workmen
employed by Hull & Wheaton, plumbers, and that the firm should have
erected proper barricades.

Resolved, that the City Clerk be directed to notify Mr. Hafely
that the Board does not consider the City responsible for his in-

CERTIFICATE OF V'AR NECESSITY - CITY TRUCKS Acting City Engineer
Cass reported receipt of a Certificate o War Necessity for the
City trucks representing a 45% reduction in gas from the amount used
in 1941.
LAKE ROAD - WATER DISTRICT Attorney A. G. Adams representing the
Fake Road water district reported that a meeting has been called
for next Tuesday to discuss the contract which was submitted by the
'Nat--r Department.
He stated that only one or two items in the contract are in
question at this time.

Resolved, that the City Clerk be directed to notify officers
of the water district that the contract must be agreed upon and re-
turned to this Board by December 9, 1942. Carried.

60 ft. to accommodate the property..

1943 BUDGET The Clerk reported that the Budget requisitions as
submitted at the last meeting were reviewed by the Committee at a
meeting hold November 17, 1942 and due to probable increase in cost
of maintainance of equipment, recommended that three items be in-
creased as follows:
Item 114 B.P.W. Administration - increase $30. to $11,673.
Item 161 Street Cleaning - increase $200. to $9,400.
Item 162 Refuse and Garbago - increase $500. to $24,600.

The Clerk reported that John Shuder and Lloyd Ellis have agreed
to fire the coal boilers for '10.00 per week each, and Assistant
Firo Chief Travis stated that the arrangement is satisfactory with
the Fire Department,
The Commissioners agreed that such an arrangement would be more
economical than hiring special firemen and it was moved
By Commissioner Rumsey, seconded by Commissioner Egbert:
Resolved, that Firemen Shuder and Ellis be paid -10.00 weekly
from oeptember lst to May 31st and $3.00 weekly from June 1st to
hugust 31st each year. Carried.
By Commissioner Egbert, seconded by Commissioner Barr:
Resolved, that the Budget for the year 1943 as amended (a copy
of which is herewith appended) be and the same hereby is approved
and adopted and a requisition ordered filed with the Common Council
for an appropriation of $173,652,00 to cover estimated cost of
general care, maintenance and operation of the several departments
unde-, control of the Board, and an appropriation of X23,000.00 to
cover estimated cost of new construction and improvements making a
total requisition of X196,652.00. Carried.
EWIPI,41ENT RESERVE Acting City Engineer Cass presented a schedule
Mowing depreciation on equipment over a period of years, and a
program which would avoid an excessive demand for funds for equip-
ment in any one year.
The program would require an appropriation of $26,876.00 for
the year 1943 and additional amounts in successive years and would
provide funds to replace equipment which would normally be purchased
during the ;;ear 1943 <s well as a fund for depreciation on other equipment.
After discussion and complete approval of the program it was
moved,

Resolved, that this Board recommend to the Common Council that
an equipment reserve fund be established in the amount of $26,876.00
for the year 1943 and that additional funds as set forth in the
schedule be provided in successive years Carried.

Resolved, that it is the sense of this Board that the Common
Council should continue to set aside funds for the bridge and paving

SIDT;�U�� LK ASSESSI, -EITT - JOHN FLYNN ESTATE 1,'Irs. John Flynn appeared
beforE the Board and protested the charge of ` )24,23 which was
assessed against the Flynn property in W. Seneca Street for the
repairs to a sidewalk damaged by roots of a tree,
Mrs. Flynn stated that the assessment has not been paid and
that the property is advertised for sale at the Tax Sale to be held
November 27, 1942.
It was expiained that this sidewalk was repaired before action
by the Board authorizing the repairs at City expense, of sidewalks
cu.ama;ed by tree roots.
No further action was taken.

TEMPORARY HANGAR - AIRPORT Mr. H. M. Peters requested permission
to construct a temporary shed approximately 36 ft. x 80 ft. north
of the present hangar to protect the training planes which cannot
be housed in the regular hangar.
By Commissioner Egbert, seconded by Commissioner Hopper:
Resolved, that permission be granted to construct a temporary
hangar as requested, subject to the approval of the City Attorney and
City Engineer. Carried.
Lq.'�; ROAD - MC KINN7EYS WATER DISTRICTS Attorney A. G. Adams, repre-
senting the Lake Road and Lansing water districts,reported that thc
are prepared to approve the contractssubmitted by the Water Depart -
r.ant provided two changes suggested by the districts are approved
by the Board of Public Works.
In the matter of the Lansing district, P.r. Adams stated that
the Town Board of Lansing requests that a clause be added to the con-
tract guaranteeing to that district any reduction in rates that raight
be made to another district. He also stated that the Lake Road users
request the rate for amortization of the cost of the water line be
reduced from w300. to w100. per year.
Ivir. Adams was informed that the Board would discuss the matter
at a later time and give the district an opportunity to be heard at
a later meeting of the Board.
During a discussion held later in the meeting the Commissioners
agreed that the addition to the contract requested by Town of
Lansing users would not be acceptable, and that the amortization rate
for the Lake Road line should not be reduced to less than X250. per
year, and it was moved

Resolved, that the sum of $250. annually be set as the minimum
amount acceptable for amortization of the Lake Road line, and

to notify Attorney Adams that this is the final concession by the

!ATJdrIST ALBY - LETTER A letter from August Alby was presented ex-
appreciation for the sick leave granted, and expressing the
hope that lie will soon be able to return to his duties.
V1ELFi-Pu�1 DLPA.RTI:ENT PROPERTY- 423 E. LINCOLN STREET A letter from
Yr. John Ii. Post, Director of Public Welfare, was presented calling
attention to the fact that that Department has recently acquired
title to property at 423 E. Lincoln Street for the sum of 11"'>935., and
lie expressed the opinion that the City might wish to take over the
property and remove the building since it is in very poor repairs
and encroaches within the street line.

Resolved, that this Board recommend to the Corlmon Council that
the property be acquired by the City and the building removed.

FIRLIk N - CITY HALL HEATING PLANT The Clerk reported that Fire
Department drivers Shuder and Ellis have declined to care for the
City Hall heating plant at the wages agreed upon by the Board at the
November 25th meeting but have agreed to do the work for x}9.00 per
week each for the entire year.

Resolved, that the action taken by the Board on November 25, 1942
in regard to wages for caring for the City Hall boilers be and hereby

a bill in the amount or $15.40 covering repairs to a car owned by

conditions will permit.

HCME STEAD ROAD IMPROVEMENTS The Clerk reported that Mrs. N. Co
Hoefle of 110 Homestead Road has requested that her sincere thanks
be extended to the members of the Board of Public Works and to
certain individuals responsible for the splendid manner in which
,;I^e improvements were carried out in that street.
She also expressed deep appreciation of the fact that the cost
urderrun by a considerable amount the original estimate.
ROCCO RICCI DISABILITY City Attorney Powers reported that Rocco
Mice! who is naw receiving compensation for partial disability has
requested the opportunity to resume limited duties with the City,
as the compensation allowed by the Labor Department is insufficient
f'cr him to live on. Mr. Powers reported that doctors have stated
that Mr. Ricci is capable of assuming light duties but the Commis-
sioners agreed that at present there are no vacancies where: he
might be employed.
LAKE ROAD - IVIC KINNEYS WATER DISTRICT Attorney A. G. Adams reported
that at a meeting of the residents of the Lake Road water district
held December 15th, the modification of the agreement approved by
the Board of Public Works on December 9, 1942 was rejected, but that
he felt sure they would agree to the original charge of $4.50 per
service, and the Board agreed to consider that figure. Attorney
Powers suggested that it might be well to prepare a new agreement
based on the original charge of $4150 for each service, and it was
moved
By Commissioner Egbert, seconded by Commissioner Hopper:
Resolved, that the City Attorney be directed to prepare a n,.w
agreement for the McKinneys district based on the original charge:',
of 'p4.50 for each service for amortization charges, with a minimum
of 53 services, plus the usual rate and one -half for metered water,
and at an annual charge of $40.00 for each fire hydrant, and
Be It Further Resolved, that upon failure of thf: district to
execute the contract by January 13, 194$, that all customers services
be cancelled on that line. Unanimously Carried.
PROFESSOR J. G. NEEDHAM - DAMAGE CLAIM Attorney George H. Russell
.,eported that a claim for damages to a car owned by Prof. J. G.
Needham was presented to the Board of Public Works at a meeting held
October 22, 1941 and that after investigation, the claim was rejected
by the Board on recommendation of the City Attorney.
Mr. Russell stated that the accident occurred on Thurston
Avenue when a City truck turned in front of the Needham car, and
that Prof. Needham is determined that he is entitled to damages and
intends to bring suit to recover.

CHARTER AMENDIENT - WATER MAIN EXTENSION As suggested by the Board
at a previous meeting, 7ity Attorney Powers presented a proposed
amendment to Section 142 of the City Charter which would regulate
future installations of water mains outside the City limits, and
after discussion it was moved

Whereas, this Board has negotiated and completed contracts
with various water districts for the supply of water to various areas
outside tho City of Ithaca, and
Whereas, it is the sense of this Board that future extensions
of mains outside the City for the purpose of supplying additional

services should be made only in organized water districts in order
to avoid problems relating to cost and ownership of mains, cost of
leekage, and liability for damage and repairs, except in unusual
circumstances, and that the merits of any unusual case should be
passed upon by the Common Council as well as by this Board,
NOW THEREFORE BE IT RESOLVED, that this Board recommend the
aCootion of the following amendment to Section 142 of the City
r er and request the City Attorney to submit to said Council a
loc.ai 1sw in proper form covering such amendment.

COAL - CITY HALL HEATING Commissioner Barr reported that it was
found necessary to order a car of coal for heating City Hall and
that an order was placed with the Lynch Coal Co. for one car of
sizerl lump coal at X6.30 per ton. He stated that it is estimated
tl.at an additional 220 tons will be required for the balance of the
season and suggested that it might be well to advertise for formal
bids,

Resolved, that the action of the Buildings & Grounds Committee
In authorizing the ordering of one car of coal from the Lynch Coal
Co. be and hereby is approved and confirmed. Carried.
The Commissioners agreed that due to present war conditions
that a further supply of coal should be ordered at once and that
nothing would be gained by advertising for formal bids, and it was
moved

Whereas, it is necessary to purchase coal for heating City
Hall, and
Whereas, it is the sense of this Board that no benefit, finan-
cial or otherwise, would accrue by advertising for bids on coal, and
Vuhereas, Robinson & Carpenter have quoted a price of $6.30 per
ton and the Ithaca Fuel Supply Co. has quoted a price of ? %.25 per
ton,
Now Therefore Be It Resolved, that the purchase of one car of
coal from each of the above mentioned firms be authorized without
the formality of advertising for bids thereon.

COD'MISSIONER J. P. EGBERT RETIRES Mayor Comfort called attention
I ;o the fact that this Ts the last regular meeting of the Board
which Mr. Egbert will attend before his retirement on December 31,
1942. In a few well choosen words he warmly thanked Mr. Egbert
for his loyal and unselfish service to the City, and expressing
the sentiments of the entire Board, stated that his retirement
would be a distinct loss to the administration as well as to the
City.
On motion-the meeting was adjourned.
