Seneca The Clerk was directed to accept the annual
Street rental check of $12.00 from the Seneca Street
Garage Garage in accordance with their agreement and
license to maintain an overhead sidewalk gasoline
service pump.
Tax Sale The Clerk reported that the Co:__Aon Council passed
Properties a resolution at their veetinZ of Deceqber 7th re-
questing the Board of Public 7orbs to establish a
definite policy with respect to the various proper-
ties acquired each year by the City as a result
of tax sale.
The Natter was referred to the Public BuildinEs
Co,_ Vttee for study and report.
Floral Ave. Engineer Eustance reported that it had been
Grading found necessary to change the alignment of Floral
Avenue in front of the Novi dor and VanOrder propor-
ties. He agreed to file a revised Alga sho7ing such
change, for the approval of the 3oard.

Work Superintendent Feller sub::iitted a list of 77ork
Relief projects totalling $9,600 that had been approved
Projects and the necessary funds appropriated by the Co,r_1on
Council January 4th which action had been taken,
he explained, because of their- meeting prior to
that of the Boards and further that he had obtained
approval from most of the members of the Board so
that this i:.iportant Relief 17ork could be started
without delay.

Summit In accordance with the recora:aendation of the
Avenue Superintendent, the Board authorized a fence or
barrier constructed at the dnald end of Summit Ave;
Spring Lane also a street sign for Spring Lane. The Superintend-
ent also agreed to properly adjust the street sign
at Willard 'Cray.
Water Dept. 11r. Bishop, Superintendent of the :later Depart —
Annual meat submitted his annual Report for that Department
Report which was received and ordered filed.

Minutes of the preceding meeting duly approved.
Work
The Mayor reported that with the cooperation of
Projects
the Superintendent and Ur. VanBlarcora he had re-
duced the original Stork Relief Program for the
State College grounds to about $50..000 by omitting
undesirable projects. On this basis, he pointed
out, the City would be able to furnish this amount
in relief wages to its unemployed without any
expenditure. for materials, e u3praent, overhead etc.,
at an expense of only about 's 20, 000 because the
State had agreed to furnish % of the labor cost
or about M.000. He estimated that this a: fount of
work relief should relieve the Charity Department
to the extent of ;30, 000' to v 1 000. He also ex-
plained that one of the relief projects was the
construction of an intercepting sewer diagonally
across the Carpus which would materially benefit
the City sewer system by diverting a large a-aount
of ser.►age from the overloaded main on East State
street to the University Avenue sewer and thence
through the newly constructed sewer from Lake St.
The Mayor asked the Board to approve and recon lend
the prograri to the Conmon Council. Except for
Cori:lissioner Evans the discussion of the proposal
was favorable, with the understanding that the con-
struction of the intercepting sewer ;rust be under
the control, supervision and approval of the City
Sewer Inspector. On this basis, Cozra- i ssi oner Rizisey
MOVED: that the proposal be approved and recoizmaended
to the Connion Council for the appropriation of
necessary funds. The Notion was seconded by Cora

and report to the Conlon Council the cost of repair -
ing the same for use of the `. elfare Department.

recam fended to the Canooz Council that the clam
be rejected.
Reporting further the Attorney stated that
three damage actions against the City were to be
heard next creek in Supreme Court i.e. Hr. & Hrs.
Harshall and Hr. Updike. Also that the gas rate
hearing was to be resumed next Thursday.

Superintendent Feller reported that it had been

storm sewer as proposed in the last list of wort:
projects approved,which totaled 09,600 and beacuse of
this and other economies there would be 04, 600 left
when all other projects were finally completed. He
therefore suggested that the following three projects

Co::l.- issioner Runsey stated that in view of the

At the suggestion of Aldornan Causer the Lighting
Signs
Committee agreed to investigate the desirability of
placing electrically illu_zinated welcome signs at the
City limits on the main highrays.

repair each of the houses on Morris Avenue note
owned by the City. After a general discussion it
was agreed that the total cost would probably

the Co :mion Council was requested to anDropriate
tiP500 to fix up one of these houses as an
experiment; to see what it would cost to repair
and maintain these properties for the use of
the City 7,elfare Depart:aent.

Standpipes Commissioner Whiting reported that after
Hit.chell & careful inspection of the East Ithaca and Mitchell
E.Ithaea Street standpipes, it appears that these tanks
would be good for at least 10 years and probably
12 to 15 years _bf further service if they were
thoroughly cleaned,scraped and wire brushed and
painted, at. an estimated cost of $900.00 and the
foundations reinforced at a cost of $400,, 00. ' To
further improve the tanks in accordance with
previous recommendations of Professor Chariot who
reported that an estinato had been secured for
furnishing suitable steel covers for both tanks
at a cost of $2.,900. Ile pointed out that the
Board could thereby save the expense of construct-
ing new tanks for a period of -.at least.10 years
at a total cost of less than $5,000.

Sewage Reporting for the Co E- iittee investigating the
Pumps sewage pu:rip bids that were received at a preceding
meeting, Coa.1_.1issioner Ru_isey stated that the
Co;:i..ii.ttee had been investigating the Economy pu-_ips
in an effort to satisfy themselves that the
claimed efficiency of 78% which is 10% higher
than all other pumps could be secured- and
maintained. The Engineer estisated that if
such were the case a saving of `100 to $200 in
the power bill could be realized.
It was suggested ghat the Board ;:right secure
a guarantee of efficiency as clai:.:edg and enter
into wn agree -lent whereby the Company , -ould
undertake to meet the specifications or re -love the
pumps or adjust their cost on a comparable basis.

Minutes It was moved, seconded and carried that the reso-
lution in the Minutes of the preceding meeting,
referring to the maintenance of privately owned
streets, be amended so as to refer to Miller,
Cobb and north streets only and that otherwise the

Bids Pursuant to advertisement the Clerk opened and
read bids for furnishing lumber for the deck of
Stewart Avenge Bridge over Fall Creek, and for
furnishing and erecting metyl roofs for both of the
East Hill standpipes.
The bids were referred to the Engineer for
tabulation and for report later in the meeting.
Sharpe Air. George Sharpe reported that the City had
Development laid its water main across land to which he
Trumansburg Rd. claimed title near the City line on the
Water Service Truulansburg Road, and asked certain concessions
in furnishing water service to his property in
consideration for this trespass. He also asked for
favorable consideration of his previous request fnr
City sewer service.to his property.
The question of the water main was referred to
the City Attorney, City Engineer, Superintendent
and ?Taster Committee; and the matter of sewer
service to the Committee on Sewers.

Hr. F.L. Tyler reported that he now had a steam

with the understanding that the sanitary sewer
extension for the Tyler Development be deferred
until funds are appropriated for the purpose.
Public The aayor reviewed the proposed program for
work Federal aid, outlined the methods of obtaining such
Program aid and submitted and reeomiended a program of City
work projects to be undertaken if and when such
Federal aid is secured. The cost of projects
totaled $286,000 of which $86,000, the "ayor explain
ed,would be paid by the Federal Government and the
remaining $200,,000 paid by the City by means of
issuing bonds for that amount and depositing theta
with the Federal. Treasury at an interest rate of
not over 3%.
In order to continue to relieve unemployment
until such time as Federal aid might be available,

be undertaken as T.E.R.A. work relief.

and further that the Fraternity was in no position
to meet at this time the added burden that such
construction would cost, pointing out that 300 feet
of sidewalk on Highland Avenue was constructed
last year and that a large pawing assessment was

A danage claim was received from Louis Kalman
Claim
in the sure of $103, 50 to cover the actual cost of
Kalman
repairing the dar -lage done to his horse at
#1011 N. Cayuga Street when a libb from a City tree
darlaged his property to that extent during a severe
wind store on June 211 1933. Forester Baker re-
ported that the tree was sound and healthy that
there was no negligenoe or omission on the part of
the City and that the accident was caused
entirely by an unusually severe wind storm.
On motion of Commissioner Evans the claim was
referred to the City Attorney for investigation
and recorn- lendation.
Highway A request from Judge Crowley to construct or
Guards permit him to construct some type of highway
So. Cayuga guard along the westerly side of So.Cayuga. Street
opposite the intersection of So,Hill.Terrace,was
referred to the Highway Cor.1�iittee and Superintendent
for investigation and recorL_lendation.
Hedges at A cor iunication was received from C.E. Curtis,
Intersections Chairman of the Safety Committee of the Ithaca
Automobile Club pointing out the dangerous traffic
condition at the north --west corner of H'itchell and
Cornell streets9 due to high hedges that co:_Zpletely
obstruct the view of approaching traffic. The
Superintendent reported that although the hedges
were located outside the property lines and Within
the public street, that a very dangerous condition
was caused by these hedges and that he and the
City Forester had endeavored to find some
solution of the problem. A similar situation was
reported to exist at Fall Creek Drive and Highland
Avenue, and on .lotion of Cor_L_iissioner Merrill

of leaves in the streets. The sij_Zplicity,
efficiency and low cost of operation was stressed

on Court Street. The natter was referred to the

It was reported that Howe & Colbert who, as

GROUNDS
The Clerk reported that the Common Council,
pursuant to the City Charter, recommended to the
Board of Public Storks the purchase of the Fair Grounds
at a cost of $213,000. The " Sayor spoke in behalf of
the purchase and explained the desirable features
which had led the Alderman to recommend it. Commission-
er Rumsey criticised the Council for forcing the Board
to out necessary maintenance expenses from its Budget
and. then recommending this purchase which he claimed
was not only too high a capital lay out at this time
but would also increase the current budget expenses
for maintenance.
Commissioner i;:iller moved that the matter be
referred to the Committee on Highways and Public Grounds
but the notion was not seconded.
Corr- iissioner Evans roved that the matter be laid

The Clerk reported that the Common Council,
in accordance with the provisions of the Cha..rter,had
reco r-iended to the Board of Public Storks that they
approve the exchange of lands with the University,as
a_lended to include a triangular portion of land twest
of the Pier Road with additional frontage of about
500 feet along the Inlet.
Co: _iissioner Rurssey pointed out that the
original tract was laid out and agreed to by the
University and that according to this lay -out the
City constructed a special ditch and that he understood
the Department was still scatisfied with this tract and
suggested the deed be corrected and the property

transferred as is. The Mayor reported that the
University insisted on having more land to more nearly
balance the number of acres they were deeding to the
City.
A resolution by Commissioner Whiting; seconded by
Cortiaissioner Allen, to approve the transfer, as
amended to include the additional lands, received
the affirmative votes of Cor -rai ssioners Allen, Evans,
Whiting. Negative votes of i:ierrill,Rumsey; Commissioner
Miller not voting. It was pointed out that such a
resolution requires at least a two- thirds vote, and a
;notion by Comnilssioner Whiting to expunge the preceding
motion was duly carried. After further discussion
it was moved and seconded that the 1-Tayor and City Clerk
be and the same are hereby authorized to execute
the necessary deed to consummate the exchange.
In discussing this resolution it was found that the
additional property desired by the University included
the tract under lease to William Kastenhuber as well as
property containing one or two boat houses.

STATEMENT FROM THE 14AYOR
TO THE BOARD OF PUBLIC WORKS AT ITS
REGULAR MEETING JULY 12, 1933
In as much as considerable publicity has been given through
the press and on the street corners of the City, reflecting upon
the City Administration and the Board of Public storks.
I desire, with your approval, to make the following statement
a part of the records of the Board of Public Works:
Statements and inuendoes have been made evidently for
Political purposes, that this Board does not represent
"the tax - paying public" and that the City's bonded indebtedness
is increasing at an alarming rate."
We all know that this board is a bi- partisan board and that
party politics has never been permitted to enter into any of
the problems that we have been confronted with.
We have conscientiously and at all times in our deliberations
given full consideration to the tax - payers, who in the end foots
the bills.
We have practiced all the economies that an enlightened and
progressive administration demands. All major or important
measures that have come before us have been dkoided and placed
in execution by the unanimous vote of the entire board of
six members.
All requisitions for bond issues to the Common Council for
action, have after careful consideration and discussion been
unanimously voted by your full board, that is without a dissenting
vote, The Common Council has also approved without a dissenting
vote your requisitions for issue of bonds.
During 1930 of the present Administration an issue of $300,000
four percent bonds were sold to provide the necessary funds for
the completion of our sewage disposal plant and other imperative
work that afforded work relief to the great mass of unemployed,
that the City was morally and legally bound to take care of,
and thus preserve their self respect and morale.
During 4N2! the present administration an4 issue of
$275,000 of unanimously approved by your board and
unanimously by the Common Council. $®
These two City bond issues which amounts to a total of
$575,000 have been used as your know in permanent City improvements,
which represents to the City an investment, which enabled us to make
a reduction of about $24.,000 in our annual operating and maintenance
expenses.
This considerable expenditure of City funds during these
three and one half years of distress among our citizens has from an
economic standpoint been of great value to the City not only for the
present, but for many years to come, in as much as the vast amount
of materials used in these permanent improvements have been pur-.
chased at unprecedented low prices, that will probably not occur
again in another generation. It has enabled the City to provide
relief wages for the great army of unemployed in our city, which
at times has registed as high as 1,400 men many of whom had large
families to feed and otherwise support.
When the City was running short of suitable work projects
last Minter, the City Administration succeeded in interesting
the State Emergency Relief Administration to give us State work
in our local State Colleges and thus provide work for our
unemployed. This arrangement with the State has

proved to be o2000raalebodi saving men and theirsfamiliesmfrom the

Home Relief list who were receiving dole and to which work
tickets were issued by our Rork Bureau.
This State College work gave employment to about 500 men
and some women on a staggering basis* for this partiavlar project,

trucks, fools and all overhead expense* The State
appropriations of $15,600 in wage relief in which the City
did not participate except that all this labor was furnished

Now, about "the alarming increase in the City's bonded
indebtedness":
The total net bonded indebtedness at this time 1933
including: General City Bonds, School bonds and Water Department
Bonds stands at $1,642.,000 (or about 3.6 %) of an allowable 10%
under the State Law. $575,000 of General City Bonds were
issued during the past four years increasing the City bonded
indebtedness by that amount, but the City during these four
years has also reduced its total indebtedness by payments
of $330, 000, so the net increase has amounted to only $245, 000.
If we choose to deduct for assessments financed through these
two bond issues the City has received $78,000 in paid assessments,
and there is still owing the City under the deferred payment plan
$46, 000 making a total refund of $1190000, deducting this sum
from the net indebtedness during0thetpast further

which in no way can be considered alarming.

A petition was received from 12 property owners
on Cobb Street asking that certain improvements be
made in this street this year.
Engineer Eustance explained why the owners desired
the City to obtain the deed for this street and that
they agreed that the,' cost of such deed, estimated
at $25.00 should be ph& ged as part of the cost of
these improvements, for which they agreed to pay
the regular assessment.
The matter was left with the Engineer.
"Lyceum"
I LyCel'XI Theatres Inc., as owners of the property

along their frontages on South Cayuga Street and
East Green Street. Corraissioners Miller and Evans
objected to granting such permission for the full
frontage on Green Street. They pointed out that this
would endangex pedestrians along the sidewalk for a
distance of 66 feet and suggested that one or possibly
two driveways across the sidewalk should be sufficient.
The matter was referred to the Highway Committee
with power to act providing their decision is approved
by the other menbers of the Board.

Commissioner Whiting reported that the Water De-

Water The City Chamberlain and the Board discussed the
Bills regulations in regard to the collection of water
bills and the discontinuance of service for failure
to pay, within a reasonable time. It was agreed that
the Chamberlain might exercise his own judgment
in unusual cases which would normally call for
discontinuance of water service.
Haller A deed was received from Mr. 8� i,rs. George H. Hook
Avenue giving the City a 25 foot right -of -way for highway
purposes from Hook place northerly across their
property at the City line. In this connection
Cdr. Haller told the Board that he was ready to
likewise deed a 25 foot strip across his property
which would continue the right -of -way to the West Hill
Reservoir, and suggested that this be continued to the
Mecklenburg road, and recommended that the City
arrange with the Town for an additional 25 foot
right -of -way west bi the City line so as to make a
50 foot roadway.
The matter of securing additional rights -of -way
and a joint City line road with the Town was referred
to the Highway Coraittee to take up with the Town
Board.
E.Statc The Engineer reported progress on the proposed
Street paving of East State Street by the State .under the
Paving Federal Aid program and suggested that the Finance
Com,littee obtain options for the necessary
rights -of -way.
On motion of Commissioner Whiting The Finance Com-
mittee was instructed to secure options and file a
rernzest with the Common Council for an appropriation
to cover the cost of the options and rights -of -way.
Also an appropriation to cover the cost of engineering
on this and the other projects approved as a
Federal Aid program.
Lake Commissioner Evans stated that the Cor,=ittee
Street recory:lends that Warne'.s request be granted and a
stOT -In sewer constructed in front of his property
on Lake Street to replace the present open ditch.

Minutes of the regular and adjourned regular meetings
of July 26th, August 2nd and August 9th were duly
approved.
EAST ?,fir. ' 'T.L.Tyler requested the Board to reimburse
STATE him 0364 being the cost to him of excavating
STREET to grade the easterly end of East State Street
at the time the sanitary and water mains were extended
for his development. He stated that he was deeding the
City about 0500.00 worth of his property without charge
in connection with the right -of -way for the new pavement
and stated that he felt the City should pay the cost
of the excavation. Engineer Eustance pointed out that
Mr. Tyler made the excavation on his own volition
and agreed to stand the expense in order to secure
immediate sewer and water service, and that the paving
contractor would have graded this portion of the road-
way at no expense to the City if it had not been done
by Xr. Tyler. There was a general discussion of the
Proposition. Reference to the Minutes of the imeeting
of May 24,1933 substantiated the Engineer's staternlent
with respect to .r. Tyler's agreement to make the
excavation at his expense.

Highway & Public Grounds Committee with power to decide
on 11r. Tyler's request and to requisition the Common
Council ,Qn behalf of the Board for an appropriation

Mr. Rogers of 948 E. State Street requested per-
mission to install only one set of services for his
100 foot lot claiming that it would never be split up
into two lots so as to necessitate another sewer and
water service. Superintendent Feller reported at
least eight other similar situations along the proposed
pavement and stated that the Chairman of the Sewer and
Water Co.imittee and City Attorney had prepared and
recommended a formal agreement be signed by all
property owners who may be allowed to waive the
BoardIs rule that a sewer and water service be
provided for each 50 foot frontage, such agreement
stipulating that the pavement shall no' be open for
sewer or water services within the next 10 years. There
was a general discussion of this matter and it was finally
agreed that the ;;members of the Board would ::feet at
11 A.,!,.., the following day to make a, survey of these
conditions along; East State Street and make a definite
decision at that ti::ie.

Markers Highway Department on behalf of the Historical

Haller Corriissioner Evans reported that the Cori:_iittee
Avenue had r_iet with the Town Board in relation to the
iriproloement of the City line road on West Hill
known as Haller Avenue, and that the Town Board was
agreeable to the proposal providing that they should
be allowed to furnish one half of the labor for the
improver_lent of the road in viecr of the fact that they
n one half of the expenses. Also that they agreed
would be no tax on that portion in the Town
owned by the City so long as the City maintained the
roadway. At Conmissioner Evans' suggestion it was agreed
that the City Attorney draw a proper resolution so
that both Boards might adopt it in accordance with the
Audit agre e:.lent . y

E. State The Board discussed the survey, they had made
Street during the morning, of the East State Street properties,
with respect to the number of service slaterals
to be constructed for over -sized or double lots.

RESOLVED: that all sewer and water services, for
each 50 feet of frontage on East State Street where such
service would be required from a main under the proposed
paving, be ordered in forthwith by the Superintendent
and further,
RESOLVED: that on the failure of any owner to
carry out such order within the time required, the Superintend-
ent shall carry out such order at City expense and charge the
expense thereof to the respective properties.

Mr. Tyler again discussed with the Board the
proposition he presented at the meeting last evening. After
a long and detailed consideration_ of the roblem it was
found that '.1r• Tyler owed the City $163.,4 for storm sewer
construction and $$225.00 for sanitary swer assessments
against nine lots, or a total of $388- 86-0- As against this
charge, X3$
he claimed a refund due him of 4.00. It was
agreed to compromise .his claim at $ 288.86 and apply that
toward the payment of his charges thereby leaving a balance
due the City of $100.00.

RESOLVED: that inaecordance with the mutual
agreement and understanding between the Board and 2r.Tyler
it is ordered that his sewer assessments ii-i the amount
of $225 be credited in full; his bill for storm sewer
construction credited in the amount of $63.86, thereby
leaving a balance due of $ 100.00 and these total credits
charged in full payment of his claim for $364.00; all in
consideration of his executing a deed for right -of --way
across his property necessary for the new alignment of
East State Street, and the complete satisfaction of his
claim for expenses incurred in excavating along the East
end of East State Street.

Mitchell St. Corr.7,issioner Whiting reported that the new
Standpipe cover for the Mitchell Street standpipe had
been inproperly designed and would have to be
changed as the pitch is too flat to satisfactorily
withstand the Winter snow load. He stated that the
Pittsburgh- Des1loines Steel Companyy had offered to make the
,necessary changes at a cost of $24-0.00.

Avenue regulations with respect to the Morris Avenue
Property properties was again discussed, and at the
Superintendent's suggestion, it was agreed that the
use and occupancy of these premises be left with
power with the Committee on Public Buildings with
the understanding that any one might use any of
the premises at their own risk providing that they
deposit $10.00 with the City Chamberlain to
install a water meter and to guarantee the
payment of $2.00 per week thereafter for such
service.
Sidewalks On motion of Commissioner Evans the Superintendent
W.Seneca was directed to order the property owners on the
So.Side South side of Nest Seneca. Street between Brindley
Street end Floral Avenue to construct a cinder
walk in front of their properties.

Federal Mayor Bergholtz reported that the previously
Aid approved Federal Aid Program and application to
Program the Federal Emergency Administration had been
temporarily withdrawn in order to reconsider and resubmit
the projects and request a 34o grant only ; it having been

the City to only ask a grant of the Federal Administration

Meter meter truck was in need of major repairs; that it

delivery truck pointing out that although it cost
about $p70.00 more than a Ford or Chevrolet, its
rugged construction and other advantages appear to
mkke it worth the diffrence.

on the grounds that it was little riore than a Touring car
chassis with truck body and reconu ended that a
regular truck type be considered.

C.W.A. Mayor Bergholtz reported that the reason for
Work calling this :meeting was to approve a Work
Program Program prepared in the amount of $89,000 to be
undertaken by the C.J.A. whereby the labor cost amounting
to $70,000 would be furnished 100% providing the cost of
materials, equipment and supplies amounting to $19,000
would be furnished by the City. He also stated that there
was a possibility of the C.W.A. paying part of the cost
of the equipment and perhaps the Material.
Engineer Eustance explained in detail each of the

Mayor Smith announced that he called this special
meeting to recommend to the Board that the position
of Superintendent be abolished and that the acting
City Engineer be required to assume the administrative
and supervisory duties of the Superintendent. He
acknowledged this as his own idea and that it was
suggested to the Board primarily in the interest
of economy and reduction of over -head expense. The
nayor summarized the proposition by asking the Board
"should we economize and is this a good tray to do it" 7
After a brief discussion, which centered, as
a result of a query from Commissioner Sawdon on the City's
present financial status, Commissioner Evans stated that he
believed the members should have more time to carefully
consider such an important matter; and for that purpose,
he moved that no action be taken until the next meeting.
The motion was seconded by Commissioner Hiller and
unanimously carried and approved.
The meeting then adjourned.
