PLEDGE OF ALLEGIANCE:
Acting Mayor Manos led all present in the Pledge of Allegiance to the American Flag.
SPECIAL ORDER OF BUSINESS:
2.1. A Resolution Approving an Agreement between Cornell University and the
City of Ithaca and Recommencing Construction on the Inlet Island Promenade
Project

WHEREAS, on December 11, 2002, the Common Council of the City of Ithaca passed a
resolution to halt construction of the Inlet Island Promenade Project for a two week
period pending approval of an Agreement between Cornell University and the City of
Ithaca, and
WHEREAS, Cornell University, in a Memorandum of Understanding (MOU) with the City
of Ithaca, signed December 13, 2002, agreed to pay all reasonable costs associated
with the delay, and
WHEREAS, construction was immediately suspended in order to allow time for Cornell
University and the City of Ithaca to discuss possible impacts of the designed bulkhead
to the rowing programs and design modifications that might mitigate such possible
impacts, and
WHEREAS, a committee of Cornell University and City of Ithaca representatives have
met intensely since December 11, 2002 to come up with a mutually acceptable
modification to the design of the promenade bulkhead, and
WHEREAS, an agreement has been reached between Cornell University and the City of
Ithaca which is more fully described in a document entitled Memorandum of
Understanding Concerning Inlet Island Promenade Design and Construction Matters,
dated December 26, 2002, and
WHEREAS, Cornell University has agreed to pay, within 30 days of billing, any and all
reasonable costs for modifications and relocation of the bulkhead and associated
expenses in excess of the amount set forth in a Construction Contract signed by the
City of Ithaca on October 22, 2002, now therefore be it
RESOLVED, that the Mayor is authorized and directed to sign the above referenced
agreement between the City of Ithaca and Cornell University, and be it further
RESOLVED, that Superintendent William Gray, on behalf of the Board of Public Works,
is directed to sign all necessary change orders and resolve any other contractual
obligations necessary to implement the above described modifications to the existing
construction contract for the Inlet Island Promenade, and be it further

RESOLVED, that Superintendent Gray, acting on behalf of the Board of Public Works,
is directed to immediately resume construction work on Phase One of the Inlet Island
Promenade Project, in accordance with the design modification and payment
agreement set forth in the above referenced agreement as soon as it is practicable and
legal.
