RECONVENE
Mayor Cohen reconvened the Common Council Meeting of June 5, 2002
into regular session.
10. PLANNING & ECONOMIC COMMITTEE:
10.1 Grant Applications for Clean Water/Clean Air Bond Act
for Cascadilla Boathouse
By Alderperson Blumenthal: Seconded by Alderperson Whitmore
WHEREAS, the City of Ithaca is applying to the New York State
Office of Parks, Recreation and Historic Preservation for a grant
under the Environmental Protection Act or the Clean Air/Clean
Water Act to fund the rehabilitation of the Cascadilla Boathouse
in Stewart Park, now therefore be it
RESOLVED, that H.M. VanCort, as Director of Planning and
Development of the City of Ithaca, is hereby authorized and
directed to file an application for funds from the New York State
Office of Parks, Recreation and Historic Preservation in
accordance with the provisions of Title 9 of the Environmental
Protection Act of 1993, or Title 3 of the Clean Air/Clean Water
Bond Act of 1996, in an amount not to exceed $148,000 and upon
approval of said request to enter into and execute a project
agreement with the State for such financial assistance to this
City of Ithaca for the rehabilitation of the Cascadilla
Boathouse, and be it further
RESOLVED, that the required City matching share of $148,000 shall
be derived by the issuance of serial bonds.
Historic Planner Chatterton explained changes made to the
proposed project budget. This phase of the project includes
building renovations and security including: roof repairs, window
and door restoration, carpentry, painting, structural repairs and
other miscellaneous items. Public use of the building will not
be possible without further renovations and remediation of code
violations.
A vote on the resolution resulted as follows:

NEW BUSINESS
Benchwarmer’s Alcohol Permit Request

WHEREAS, Benchwarmers Restaurant on the Commons has requested an
outdoor dining permit with permission for the sale and consumption
of alcohol, and
WHEREAS, this use of public property has generally been deemed
proper and successful, and
WHEREAS, the City of Ithaca wishes to promote diverse uses of the
Primary and Secondary Commons, including outdoor dining, and
WHEREAS, it is Common Council's responsibility to determine
whether or not to allow the serving and consumption of alcohol on
the Primary and Secondary Commons, and
WHEREAS, Common Council has determined that the use of this public
property for outdoor dining at Benchwarmers Restaurant, including
the responsible sale and consumption of alcohol, is desirable, and
WHEREAS, Common Council has determined that any use of this or
similar public property involving the same and consumption of
alcohol should be covered by a minimum of $1,000,000 insurance
under the Dram Shop Act; now, therefore be it
RESOLVED, For the year 2002, Common Council hereby approves a
revocable Alcoholic Beverage Permit for the outdoor sale and
consumption of alcohol for Benchwarmers Restaurant that includes
the sale of alcohol in accord with the terms and conditions set
forth in application therefore, including minimum Dram Shop
coverage in the amount of $1,000,000 and the approval of an
outdoor dining permit.
