PLEDGE OF ALLEGIANCE:
Alternate Acting Mayor Hershey led all present in the Pledge
of Allegiance to the American Flag.
SPECIAL ORDER OF BUSINESS:
2.1 Ithaca Children’s Garden-Home Rule Request for
Enactment of a Special Law

WHEREAS, the Common Council, by resolution dated September
6, 2000, gave conceptual approval for locating a Children’s
Garden in the southern end of Cass Park, and
WHEREAS, the Common Council, by resolution dated May 2,
2001, requested Senator James Seward and Assemblyman Martin
Luster to introduce legislation in the New York State Senate
and Assembly respectively, authorizing the City of Ithaca to
enter into a long term lease with the Ithaca Children’s
Garden for a site at the southern end of Cass Park, and
WHEREAS, pursuant to Common Council’s resolution, Senator
James Seward has introduced legislation in the Senate as
Senate Bill Number 5365, and Assemblyman Martin Luster have
introduced the same legislation in the Assembly as Assembly
Bill Number 8883, and
WHEREAS, Alan J. Cohen, Mayor of the City of Ithaca, has
made a Home Rule Request for Enactment of a Special Law by
the New York State Legislature requesting enactment of
Senate Bill Number 5365 and Assembly Bill Number 8883 and
seeks concurrence therein by Common Council; now therefore
be it
RESOLVED, That Common Council hereby concurs in the request
by the Mayor for Enactment of a Special Law authorizing the
City of Ithaca to enter into a lease with the Ithaca
Children’s Garden for a site at the southern end of Cass
Park for the purposes of providing hands-on educational
opportunities for youth of all ages, which compliment
existing park purposes, and be it further
RESOLVED, That Common Council hereby authorizes the Mayor to
take the necessary steps to formalize said Home Rule
Request, including signing of all necessary documents.
Carried Unanimously
Alderperson Blumenthal explained the reasons why a home rule
request enactment of a special law was required.
