YOUTH AWARD:
Alderperson Glasstetter presented the Youth Award to Avery Dimanocio. Avery is the
Director of the Cornell Elderly Project, which operates through the Cornell Public
Service Center. The project brings Cornell Students to local nursing homes for one on
one, and group activities with the elderly.
MAYOR’S PROCLAMATION
Mayor Cohen presented Grayson Miller with the Distinguished Citizen Award for his
assistance to the Ithaca Police Department on a motor vehicle accident investigation.

Alderperson Hershey requested the postponement of Item 5.1 - Public Hearing to

Quarterly Recognition Awards
Mayor Cohen presented the Quarterly Employee Recognition Group Award to
employees of the Department of Public Works for their work on the Fall Clean-up
Project. Mayor Cohen stated that the employees did their work efficiently and without
complaint, and that they deserve both our thanks and recognition for the excellent job
they did.
Mayor Cohen presented the Quarterly Employee Recognition Individual Award to Travis
Brooks, Youth Program Coordinator at GIAC, for his work on the Youth and Team
Program at GIAC. Mayor Cohen stated that Travis took on the huge task of organizing
and preparing our Youth and Teen Programs to become New York State Accredited
After School Programs.
COMMUNICATIONS
City Clerk Holcomb announced that WHCU and Bangs Ambulance would share the
hosting of the Distinguished Youth Award with Tompkins County. They will alternate
months to provide awards to both the City and the County.
PETITIONS AND HEARINGS OF PERSONS BEFORE COUNCIL:
Jim Meyer, City of Ithaca, spoke on behalf of the South Hill Civic Association. He
announced that there would be a neighborhood clean-up day on Saturday March 24th
from 10 a.m. to 2:00 p.m. This event is being co-sponsored by the South Hill Civic
Association and the Community Service Network at Ithaca College in conjunction with
President Peggy Williams’ Day of Service.
Larry Beck, Town of Lansing and a member of the Tompkins County Landlords
Association, spoke in support of the intent of the existing Exterior Property Maintenance
Ordinance if administered properly and fairly.
Neil Oolie, City of Ithaca, voiced his concern regarding the proposed Defense and
Indemnification Local Law.
Fay Gougakis, City of Ithaca, voiced her concerns regarding the Drug Task Force
Coordinator and the need for continued funding of this position since the Mayor has
discontinued the Drug Task Force Committee. She also voiced her concern about no
public comment being scheduled for the Economic Development Committee meetings.
Joel Harlan, Town of Dryden, addressed Council regarding Collegetown block
parties/Economic Development.

Dan Cogan, City of Ithaca, voiced his concerns regarding the proposed Defense and
Indemnification Law.
Jim Miller, City of Ithaca, voiced his concerns regarding the proposed Defense and
Indemnification Law.
RESPONSE TO THE PUBLIC:
Alderpersons Manos and Hershey responded to concerns expressed regarding the
proposed Defense & Indemnification Law.
Alderperson Blumenthal responded to comments regarding the Exterior Maintenance
Ordinance.
Mayor Cohen responded to concerns raised about the Drug Task Force and the
Coordinator position.
COMMUNICATIONS FROM COMMON COUNCIL:
Alderperson Hershey announced that the Ithaca Downtown Partnership is offering free
two hour parking in the two garages and the lot behind the library, validation is not
required. Parking is free in the evening and on weekends at all ramps, lots and on the
metered streets.
Mayor Cohen stated that even though validation is not required for the two hours, there
are shop keepers that still offer validation stickers to their customers which would
enable those customers to park for even longer for free. He recommended checking
with individual merchants to see if they are still participating in that program.
REPORT OF CITY BOARDS, COMMISSIONS AND COMMITTEES:
Ithaca Landmarks Preservation Committee
Steven Somogy addressed Common Council to express the ILPC’s support of the
Cornell University office project moving downtown. The ILPC would like project site
moved, as Bank Alley is a historical site, worthy of designation. He requested that the
ILPC be formally invited to participate in the project as it proceeds.
17. HUMAN RESOURCES COMMITTEE:
17.2 DPW/Water and Sewer – Amendment to Personnel Roster – Resolution

RESOLVED, That the Personnel Roster of the Water and Sewer Division of the
Department of Public Works be amended as follows:
Add (1) Environmental Engineer (40 hours)
and, be it further
RESOLVED, That the position of Environmental Engineer be assigned to the City
Executive Association at salary Grade 3.

18. BUDGET AND ADMINISTRATION COMMITTEE:
18.1 Common Council – Request Sponsorship of Celebration

WHEREAS, the Cornell-Ithaca Partnership is requesting the City to sponsor five area
women to attend the Room Full of Sisters luncheon in Auburn on March 8, 2001, and
WHEREAS, the event will celebrate womanhood and costs $30 per person, and
WHEREAS, the cost of the sponsorship of five women to attend the event will be $150;
now, therefore, be it

RESOLVED, That Common Council hereby approves the sponsorship of five women from
our community to attend the Room Full of Sisters luncheon on March 8, 2001 at a cost not
to exceed $150, and be it further
RESOLVED, That said funds shall be transferred from account A1990 Unrestricted
Contingency to account A1012-5435 Community Services.

18.2 DPW – Request to Amend Capital Project for West State Street

WHEREAS, as part of the 2000 City of Ithaca Approved Budget, a $1,400,000 Project,
$800,000 General Fund and $600,000 Water and Sewer, was established for West State
Street Reconstruction, and
WHEREAS, the Project was bid in August, 2000, with only one bid received, the bid was
rejected and re-bid in February, 2001, and
WHEREAS, the new bid saved the City $168,000, but was still $390,000 over the
authorized project budget at a total post-bid project cost of $1,790,000; now, therefore, be
it
RESOLVED, That Common Council hereby amends Capital Projects #328, #509, and
#609 West State Street Reconstruction by an amount not to exceed $390,000 allocated as
follows:
#328 $226,200
#509 81,900
#609 81,900
and, be it further
RESOLVED, That the total project cost for West State Street Reconstruction will not
exceed $1,790,000 distributed among Capital Projects #328 ($1,026,200), #509
($381,900), #609 ($381,900), and be it further
RESOLVED, That said amendment shall be derived from the issuance of Serial Bonds.
Mayor Cohen reported that the Board of Public Works approved this project at their
meeting earlier today.

18.3 DPW – Request to Amend Contract for SEQRA Work Scope Changes for
Municipal Wastewater Collection System Improvements

WHEREAS, the Ithaca Area WWTP-SJS, Owners, and Stearns & Wheler, LLC, Engineer,
entered into an agreement dated January 6, 1999 for professional engineering services in
connection with the performance of an engineering study to determine the cost of various
improvements to the Ithaca Area Wastewater Treatment Plant in the amount of $53,800,
and
WHEREAS, said agreement was amended February 17, 1999 (Amendment 1), in the
amount of $160,000, and July 7, 1999 (Amendment 2), in the amount of $120,000, to
include additional tasks which included the development of a budgetary project cost
estimate for upgrading the Ithaca Area Wastewater Treatment Plant to provide tertiary
effluent filtration for further reduction of phosphorus discharges by retrofitting one of two
existing 60-foot diameter phosphorus stripper tanks with continuous backwash, up-flow
sand filter modules; and to achieve compliance with federal and state regulations

pertaining to the on-site storage and use of gaseous chlorine for effluent disinfection and
other in-plant uses, and
WHEREAS, some of the Parties submitted a joint application dated June 3, 1998, for
funding available for wastewater improvements under the 1996 Clean Water/Clean Air
Bond Act, and they received a grant award for some of the improvement projects in their
application, and
WHEREAS, the original contract of $53,800 and amendment 2 of $160,000 are being paid
for from existing IAWWTP Capital Reserves and are not part of the current cost-sharing
agreement, and
WHEREAS, all of the Parties will benefit from the improvement projects that were awarded
grant funding, and
WHEREAS, to assist in meeting conditions for acceptance of the awarded grant funding,
the Parties have hired engineers to 1) prepare a unified engineering report describing the
wastewater improvements, and 2) perform tasks related to the State Environmental
Quality Review Act (SEQRA) process associated with the wastewater improvements, and
WHEREAS, the cost estimate to complete the SEQRA and Final EIS has increased; now,
therefore, be it
RESOLVED, That Common Council hereby amends the agreement for Engineering
Services with Stearns & Wheler and Capital Project 403J, Proposed Amendment No. 3, by
an amount not to exceed $204,000 for a revised total agreement, not to exceed $537,800,
and, be it further
RESOLVED, That the increased funds be derived from an amended cost-sharing
agreement among the City of Ithaca, Town of Ithaca, Town of Dryden, Village of Cayuga
Heights, Town of Lansing and Village of Lansing, each unit agreeing to pay one-sixth of
the cost of amendments two and three, or up to $54,000 for a total of $324,000, and, be it
further
RESOLVED, That the City will not expend the City’s share until the cost-sharing
agreement has been signed by said participants, and, be it further
RESOLVED, That the Mayor be hereby authorized to sign the amended cost-sharing
agreement on behalf of the City, and, be it further
RESOLVED, That the City’s share of up to $54,000 shall be derived from existing Sewer
Capital Project funds.

19. NEIGHBORHOOD AND COMMUNITY ISSUES COMMITTEE:
19.1 A Local Law Amending Chapter 181 of the City of Ithaca Municipal Code
Entitled “Fire Prevention”

BE IT ENACTED by the Common Council of the City of Ithaca as follows:
Section 1. Legislative Purpose
It is the intent of the Common Council of the City of Ithaca to enhance the safety, health,
and protection of city residents by increasing the enforcement of parking violations that
have a bearing on fire safety and prevention. Pursuant to Municipal Home Rule Law,
§10(4)(a), Common Council may enact a local law authorizing issuance of appearance
tickets by public servants charged with enforcing local laws or ordinances relating to

parking, fire prevention, health and safety. In this regard, Common Council authorizes
designated Fire Department personnel to issue appearance tickets for parking violations
relating to fire prevention, and public safety, including but not limited to illegal parking in
fire lanes, and blocking of fire hydrants.
Section 2. Appearance Tickets.
Chapter 181 of the Ithaca Municipal Code is hereby amended by adding a new section
181-23 as follows:
Section 181-23. The Chief of the Fire Department, the Deputy Chief, and other Fire
Department personnel designated by the Chief of the Fire Department shall have the
authority, as provided by Municipal Home Rule Law §10(4)(a), to issue appearance
tickets in accordance with Article 150 of the New York State Criminal Procedure Law to
enforce any statute, local law, or ordinance, rule, or regulation with regard to parking
violations relating to fire prevention, public health and/or safety.
Section 3. Effective Date.
This law shall take effect immediately upon filing with the office of the Secretary of
State.
Discussion followed on the floor regarding the possible future authorization for the Fire
Department to tow vehicles in violation of the law.

19.2 An Ordinance Adopting Chapter 346 Entitled “Vehicles and Traffic” of the
City of Ithaca Municipal Code

BE IT ORDAINED AND ENACTED by the Common Council of the City of Ithaca as
follows:
Section 1. Chapter 346 Entitled “Vehicles and Traffic” of the City of Ithaca Municipal
Code is hereby amended to read as follows:
ARTICLE I
General Provisions
~ 346-1. Definitions.
A. The words and phrases used in this chapter shall, for the purposes of this
chapter, have the meanings respectively ascribed to them by Article 1 of the Vehicle
and Traffic Law of the State of New York.
B. The following words and phrases, which are not defined by Article 1 of the
Vehicle and Traffic Law of the State of New York, shall have the meanings respectively
ascribed to them in this section for the purposes of this chapter:
BUSINESS DISTRICT -- The territory contiguous to and including a roadway
when within any 600 feet along such roadway there are buildings in use for business or
industrial purposes, including but not limited to hotels, banks or office buildings, railroad
stations, and public buildings which occupy at least 300 feet of frontage on one side or
300 feet collectively on both sides of the roadway.

CENTRAL BUSINESS DISTRICT --- All streets and portions of streets within the
area bounded by both sides of the following streets:
(a) State Street from Plain Street to a point six hundred
(600) feet west of Cayuga Street.
(b) Seneca Street from Aurora Street to Cayuga Street.
(c) Green Street from Tioga Street to a point two hundred
(200) feet west of Cayuga Street.
(d) Aurora Street from Buffalo Street to Six Mile Creek.
(e) Tioga Street from Buffalo Street to Six Mile Creek.
(f) Cayuga Street from Seneca Street to a point two hundred
twenty (220) feet south of Clinton Street.
COMMERCIAL VEHICLE -- [Reserved]
CURBLINE -- The prolongation of the lateral line of a curb or, in the
absence of a curb, the lateral boundary line of the roadway.
GROSS WEIGHT --- The weight of a vehicle without load plus the weight
of any load thereon.
HOLIDAYS -- New Year's Day, Lincoln's Birthday, Washington's Birthday,
Memorial Day, Independence Day, Labor Day, Columbus Day, Veterans Day,
Thanksgiving Day and Christmas Day.
ITHACA COMMONS --- Unless otherwise stated, “Ithaca
Commons” or “Commons” shall mean both Primary and Secondary Commons as
described below:
Primary Commons – All streets and portions of streets within the area described as
follows: All that area bounded by the property between the south building lines on the
north side and the north building lines on the south sided of the former bed and
associated sidewalks of East State Street between the east line of Cayuga Street and
the west line of Aurora Street and that area of public property between the west building
lines on the east side and the east building lines on the west side of the former bed and
associated sidewalks of North Tioga Street between the north line of State Street and
the south line of Seneca Street.
Secondary Commons – All streets and portions of streets within the area described as
follows: All that area bounded by the property between the south building lines on the
north and north building lines on the south side of the 100 and 200 blocks of East Green
Street, the 300 block of East State Street, the 100 block of West State Street and the
100 block and 200 blocks of North Aurora Street, the 100 block of South Aurora Street,
the 200 block of North Tioga Street, the 100 block of South Cayuga Street and the 100
block of North Cayuga Street.
OFFICIAL TIME STANDARD -- Whenever certain hours are named herein
or on traffic control devices, they shall mean the time standard which is in current use in
this state.
PARKING METER -- Any mechanical device or meter not inconsistent
with this article placed or erected for the regulation of parking by authority of this article.
Each parking meter installed shall indicate by proper legend the legal parking time
established and, when operated, shall at all times indicate the balance of legal parking
time and, at the expiration of such period, shall indicate illegal or overtime parking.
PARKING METER SPACE -- Any space within a parking meter zone,
which is adjacent to a parking meter and which is duly designated for the parking of a
single vehicle by lines painted or otherwise durably marked on the curb or on the
surface of the street or lot adjacent to or adjoining the parking meters.

PARKING METER ZONE --- A designated on-street parking area or off-street
parking lot location within which the parking of vehicles is regulated by parking meters.
SCHOOL --- Any public, private, or non-profit educational institution providing
pre-school, elementary, or secondary educational instruction. For purposes of this
Chapter, the term school includes a facility designed to provide day care, nursery school
or pre-school in an institutional setting.
TRUCK --- A commercial motor vehicle with a weight in excess of 10,000
pounds, which motor vehicle is designed, used, or maintained primarily for the
transportation of property. For purposes of this Chapter the applicable weight shall be
either the registered weight, the gross weight, or the vehicle specification plate weight,
whichever is higher.
~ 346-2. Authority to install traffic control devices.
The City Traffic Engineer in cooperation with the Department of Public Works, shall
install and maintain traffic control devices when and as required under the provisions of
this chapter, to make effective the provisions of this chapter, and may install and
maintain such additional traffic control devices as he/she may deem necessary to
regulate, warn or guide traffic under the Vehicle and Traffic Law of the State of New
York, subject to the provisions of ~~ 1682 and 1684 of that law.
~ 346-3. Delegation of authority to regulate traffic.
A. Emergency and experimental regulations. The Chief of
Police, by and with the approval of the City Traffic Engineer, is hereby empowered to
make regulations to make effective the provisions of this chapter and to make and
enforce temporary or experimental regulations to cover emergency or special
conditions. No such temporary or experimental regulations shall remain in effect for
more than 90 days, without formal enactment by the Common Council.
B. Stop and yield signs. The City Traffic Engineer shall be authorized to
determine and designate intersections where a particular hazard exists upon other than
through streets and to determine whether vehicles shall stop or yield at one or more
entrances to any such intersection, and shall erect a stop or yield sign at every such
place where a stop or yield is respectively required.
C. Traffic and turning lanes. The City Traffic Engineer is authorize to place
markers, buttons or signs within or approaching intersections indicating the course or
lanes to be traveled by vehicles turning at such intersections, and such course or lane
to be traveled as so indicated shall conform to this chapter or as the City Traffic
Engineer shall prescribe.
D. Restricted turning. The City Traffic Engineer is hereby authorized to
determine those intersections at which drivers of vehicles shall not make a right, left or
U-turn, and shall place proper signs at such intersections. The making of such turns
may be prohibited between certain hours of any day and permitted at other hours, in
which event the same shall be plainly indicated on the signs or the signs may be
removed when such turns are permitted.
E. Crosswalks, safety zones and traffic lanes. The City Traffic Engineer is
hereby authorized:
(1) To designate and maintain, by appropriate devices, marks or lines
upon the surface of the roadway, crosswalks at intersections where, in his opinion, there
is particular danger to pedestrians crossing the roadway and at such other places as
he/she may deem necessary.

(2) To establish safety zones of such kind and character and at such
places as may be deemed necessary for the protection of pedestrians.
(3) To mark lanes for traffic on street pavements at such places as
may be deemed advisable, consistent with the traffic regulations of the city.
F. Play streets. The City Traffic Engineer shall have authority to declare any
street or part thereof a play street and to place appropriate signs or devices in the
roadway indicating and helping to protect the same.
G. Parking adjacent to schools. The City Traffic Engineer
is hereby authorized to erect signs indicating no parking upon that side of any street
adjacent to any school property when such parking would, in his/her opinion, interfere
with traffic or create a hazardous situation.
H. Parking on narrow streets. The City Traffic Engineer is hereby authorized
to erect "No Parking" signs:
(1) On both sides of any two-way street where the width of roadway
does not exceed 26 feet.
(2) On one side of any two-way street where the width of roadway
does not exceed 32 feet.
(3) On both sides of any one-way street where the width of the
roadway does not exceed 20 feet.
(4) On one side of any one-way street where the width of roadway
does not exceed 26 feet.
I. Parking or standing on one-way streets. The City Traffic Engineer is
authorized to prohibit parking or standing upon the left-hand side of any one-way street.
J. Divided highways. In the event that a highway includes two or more
separate roadways and traffic is restricted to one direction upon any such roadway, the
City Traffic Engineer may prohibit parking or standing upon the left-hand side of such
one-way roadway.
K. Stopping, standing or parking in hazardous places. The City Traffic
Engineer is hereby authorized to determine and designate places open to vehicular
traffic not exceeding 100 feet in length in which the stopping, standing or parking of
vehicles would create an especially hazardous condition or would cause unusual delay
to traffic.
L. Passenger and freight loading zones. The City Traffic Engineer is hereby
authorized to determine the location of passenger and freight curb loading zones and
the hours during which such zone shall be operable.
M. Bus stops and taxicab stands.
(1) The City Traffic Engineer is hereby authorized and required to
establish bus stops and taxicab stands and stands for other passenger common carrier
motor vehicles on such public streets in such places and in such number as he shall
determine to be of the greatest benefit and convenience to the public.
(2) The operator of a bus or taxicab shall not park
upon any street in any business district at any place other than at a bus stop or taxicab
stand respectively.

N. Application of pavement markings. The City Traffic Engineer is hereby
authorized to apply or cause to be applied pavement markings in accordance with the
standards and specifications established by the Department of Transportation on such
highways or portions of highway as shall be determined to be necessary or appropriate.
O. Traffic-control signals. The City Traffic Engineer is hereby authorized to
regulate traffic by means of traffic-control signals.
§346-4. Schedules; adoption of regulations.
A. The Board of Public Works is hereby authorized to adopt, and from time to
time, to amend, appropriate regulations for the effective administration of the provisions
of this Ordinance. Such regulations shall be kept in the Office of the Ithaca City Clerk.
B. Except as provided in §346-3 above, Common Council delegates to the
Board of Public Works, the authority to adopt regulations in accordance with the
provisions of General City Law, and the Vehicle and Traffic Law, §1603.
C. For the purpose of maintaining an accurate record of all regulations
adopted under the provisions of this chapter, there is hereby established a system of
schedules, appearing as regulations of the Board of Public Works. Such schedules shall
be deemed a part of the section to which they refer. All regulations shall be adopted
with reference to the appropriate schedule as indicated in the various sections of this
chapter.
ARTICLE II
Traffic Regulations
~ 346-5. Traffic control signals.
Traffic control signals shall be installed and operated at the intersection of those
streets described in Schedule I of the regulations of the Board of Public Works.
~ 346-6. Speed limits.
A. The maximum speed at which vehicles may proceed on or along any
streets or highways within the city is hereby established at 30 miles per hour, except
that the speed limit for vehicles proceeding on or along those streets or parts of streets
described in Schedule II of the traffic regulations of the Board of Public Works, shall be
as indicated in said schedule. This provision shall not apply to ambulances, fire vehicles
or police vehicles when on emergency trips.
B. Fifteen miles per hour is hereby established as the maximum speed at
which vehicles may proceed on or along any streets or highways at or within the
following parks:
(1) Stewart Park.
(2) Cass Park (except temporary Route 89 - Park Road).
(3) Newman Golf Course, including Pier Road from Willow Avenue to
its terminus.
~ 346-7. School speed limits.
Pursuant to the authority granted cities by Section 1643 and Section 1180(C) of the
New York State Vehicle and Traffic Law, no person shall drive a vehicle at a speed in

Works, in the school areas described in said schedule, during school days between the
hours of 7:00 a.m. and 6:00 p.m.
~ 346-8. One-way streets.
The streets or parts of streets described in Schedule IV of the traffic regulations of the
Board of Public Works, are hereby designated as one-way streets in the direction
indicated.
~ 346-9. U-turns.
No person shall make a U-turn on any of the streets or parts of streets described in
Schedule V of the traffic regulations of the Board of Public Works.
~ 346-10. Prohibited turns at intersections.
No person shall make a turn of the kind designated (left, right, all) at any of the
locations described in Schedule VI of the traffic regulations of the Board of Public
Works.
~ 346-11. Prohibited right turns on red signal.
No person shall make a right turn when facing a steady red signal (stop indication) at
any of the locations described in Schedule VII of the traffic regulations of the Board of
Public Works.
~ 346-12. Stop intersections.
The intersections described in Schedule VIII of the traffic regulations of the Board of
Public Works, are hereby designated as stop intersections. Stop signs shall be installed
as provided therein.
~ 346-13. Yield intersections.
The intersections described in Schedule IX of the traffic regulations of the Board of
Public Works, are hereby designated as yield intersections. Yield signs shall be installed
as provided therein.
~ 346-14. Trucks excluded.
A. Trucks, commercial vehicles, tractors and tractor-trailer combinations are
hereby excluded from the streets or parts of streets described in Schedule X of the
traffic regulations of the Board of Public Works.
B. Notwithstanding any other provisions of this chapter, all northbound and
southbound vehicles having a registered total gross weight in excess of nine tons are
hereby excluded from Aurora Street from the south line of the City of Ithaca to State
Street; Hudson Street; Coddington Road to South Aurora Street; and Stone Quarry
Road, from the south city line to Spencer Road, except the following:
(1) Buses engaged in, or normally engaged in, receiving or delivering
passengers along Route 96B between its intersection with Route 96 in the Town of
Candor, Tioga County, and the intersection of Aurora Street and State Street in the City
of Ithaca.
(2) Trucks engaged in delivery or pickup of merchandise or other
property along Route 96B between its intersection with Route 96 in the Town of Candor,

Tioga County, and the intersection of Aurora Street and State Street in the City of
Ithaca.
(3) Buses being operated by public or private schools.
~ 346-15. Truck route system.
A. A truck route system upon which all trucks, tractors and tractor-trailer
combinations having a total gross weight in excess of five tons are permitted to travel
and operate, shall consist of all numbered N.Y.S. highway routes through the city and
the streets set forth in Schedule XI of the traffic regulations of the Board of Public
Works.
B. All trucks, tractors and tractor-trailer combinations having a total gross
weight in excess of five tons are hereby excluded from all streets except those streets
listed in Schedule XI, except that this exclusion shall not be construed to prevent the
delivery or pickup of merchandise or other property along the street from which such
vehicles and combinations are excluded.
C. Such exclusions shall not prevent the necessary delivery of merchandise
or other property along the streets from which trucks are excluded, provided that the
vehicle from which any such delivery is made shall enter and leave any such designated
truck route by the street which is reasonably the nearest, and safest accessible street to
the place where the such delivery is made. Further provided that such delivery vehicles
shall remain on such prohibited streets for a period of time no longer than is necessary
and reasonable to make such delivery or to complete a loading of such vehicle; nor
shall such exclusions prevent the necessary operation of trucks while in use by the
United States Postal Service or military services by fire, police, sanitation, or street
maintenance services, or by public service corporations while on emergency repair
work.
~ 346-16. Lower gear regulations.
A. All trucks shall make use of transmission gears lower than the normal
cruising gear when descending grades on city streets at the following locations:
(1) Ithaca Road from Dryden Road to Mitchell Street.
B. All vehicles shall make use of transmission gears lower than the normal
cruising gear when descending grades on city streets at the following locations:
(1) Aurora Street from the south City line to State Street.
(2) Mitchell Street from Ithaca Road to State Street.
(3) State Street from Mitchell Street to Seneca Way.
~ 346-17. Pedestrian crossings.
A. Traffic control signals. No pedestrian shall cross between adjacent
intersections at which traffic control signals are in operation except in a crosswalk.
B. Business districts. No pedestrian shall cross a street
or roadway except in a crosswalk in the central business district or in any other
business district.

ARTICLE III
Parking, Standing and Stopping
~ 346-18. Application of article.
The provisions of this article shall apply except when it is necessary to stop a vehicle
to avoid conflict with other traffic or in compliance with the directions of a police officer
or official traffic control device.
~ 346-19. Parking prohibited at all times.
No person shall park a vehicle at any time upon any of the streets or parts thereof
described in Schedule XII of the traffic regulations of the Board of Public Works.
~ 346-20. No stopping.
No person shall stop a vehicle upon any of the streets or parts of streets described in
Schedule XIII of the traffic regulations of the Board of Public Works.
~ 346-21. No standing.
No person shall stand a vehicle upon any of the streets or parts of streets described in
Schedule XIV of the traffic regulations of the Board of Public Works.
~ 346-22. Parking prohibited certain hours.
No person shall park a vehicle between the hours specified in Schedule XV of any day,
unless otherwise indicated, upon any of the streets or parts of streets described in said
schedule of the traffic regulations of the Board of Public Works.
~ 346-23. No stopping certain hours.
No person shall stop a vehicle during the times specified in Schedule XVI of any day,
unless otherwise indicated, upon any of the streets or parts of streets described in said
schedule of the traffic regulations of the Board of Public Works.
~ 346-24. No standing certain hours.
No person shall stand a vehicle during the times specified in Schedule XVII of any day,
unless otherwise indicated, upon any of the streets or parts of streets described in said
schedule of the traffic regulations of the Board of Public Works.
~ 346-25. Time limit parking.
No person shall park a vehicle for longer than the time limit shown in Schedule XVIII at
any time between the hours listed in said schedule of any day, unless otherwise
indicated, upon any of the streets or parts of streets described in said schedule of the
traffic regulations of the Board of Public Works.
~ 346-26. Overnight parking.
Effective November 1 through April 1 of each year no person shall park a vehicle
between 2:00 a.m. and 6:00 a.m. on the odd-numbered side of all city streets on the
odd numbered days of the calendar month, and on the even numbered side of all city
streets on the even numbered days of the calendar month except for streets or parts
thereof described in Schedule XIX of the traffic regulations of the Board of Public
Works, attached to and made a part of this chapter. This section shall not apply to the
streets repealed under Sections 346-27 and 346-28 below.

~ 346-27. Continuous parking.
No person shall park a vehicle for longer than 24 consecutive hours upon any of the
streets or parts thereof described in Schedule XX of the traffic regulations of the Board
of Public Works, attached to and made a part of this chapter.
~ 346-28. Curbline parking.
No person shall stop, stand or park between the curbline or edge of pavement and the
sidewalk or adjacent property line of any street or highway except the streets or parts
thereof described in Schedule XXI of the traffic regulations of the Board of Public
Works, where parking shall be limited to a period of time no more than 24 consecutive
hours.
~ 346-29. Loading zones.
The locations described in Schedule XXII of the traffic regulations of the Board of
Public Works, are hereby designated as loading zones.
~ 346-30. Taxi stands.
The locations described in Schedule XXIII of the traffic regulations of the Board of
Public Works, are hereby designated as taxi stands.
~ 346-31. Buses.
A. Unless otherwise provided to the contrary, no bus or common carrier,
whether for hire or not, shall be operated upon, stop on or stand on any city street in the
corporate limits of the City of Ithaca, nor shall such bus or common carrier pick up or
discharge passengers on any such city street or curb, or any other public property, or at
or within 200 feet of any city bus stop in said corporate limits of the City of Ithaca,
unless a permit is obtained therefor from the Common Council of the City of Ithaca, or
its designee, the issuance of which permit shall be at the sole discretion of the Common
Council of the City of Ithaca.
B. The locations described in Schedule XXIV of the traffic regulations of the
Board of Public Works, are hereby designated as bus stops.
~ 346-32. Handicapped parking.
The locations described in Schedule XXV of the traffic regulations of the Board of
Public Works, are hereby designated as handicapped parking zones, and no persons
shall park therein without appropriate handicapped parking permits displayed on the
vehicle.
~ 346-33. Designation of emergency snow routes; restrictions pertaining thereto.
The Mayor is hereby authorized to declare that a snow emergency exists. The Board
of Public Works is hereby authorized to determine and to designate and declare snow
emergency routes for the purpose of this section. The locations described in Schedule
XXVI of the traffic regulations of the Board of Public Works, are hereby designated as
snow emergency routes. It shall be unlawful to park or stand a motor vehicle, except for
the expeditious loading or unloading of passengers, upon any portion of any emergency
snow route during the period of time the Mayor has declared that a snow emergency
exists.

~ 346-34. Private driveways.
A. The city shall, for the purpose of improving access to private driveways
where such improved access shall be primarily for the benefit of the applicant, furnish,
install and maintain for a period of five years at the expense of the applicant a "No
Parking" sign or signs in proximity to private driveways that enter upon city streets.
B. Any property owner may make application to the City Traffic Engineer for
such a sign to be installed adjacent to his/her driveway. The City Traffic Engineer shall
approve such application if he/she determines that such sign will improve access to the
driveway of the applicant and will not be deleterious to the general public.
C. Upon such approval, the City Traffic Engineer shall determine the location
and method of placement of such sign.
D. A fee of $50 per driveway shall be paid to the City Clerk in order to defray
the expense of the initial installation and to provide for maintenance of the sign in proper
condition for five years.
E. After expiration of five years from the date of the initial installation or the
date of renewal the sign may be removed by the city.
F. Any adjacent owner desiring the continued service of such sign adjacent
to his driveway for an additional five years shall:
(1) Apply to the City Traffic Engineer for approval of the continued
service of such sign.
(2) Present the application for continued sign service approved by the
City Traffic Engineer to the City Clerk together wit a fee of $25 per driveway.
G. If at any time prior to the expiration of either the initial or renewal five-year
period the applicant requests the City to remove such sign, or if the driveway for any
reason ceases to function as a driveway, the sign shall be removed by the city and
there shall be no rebate or apportionment of the fee.
~ 346-35. Ithaca Commons loading zones.
Use of the loading zones at the entrances to the Commons is strictly reserved for
vehicles making deliveries or loading and unloading passengers, and no other use of
the loading zones shall be made without the express written permission of the Chief of
the Police Department.
ARTICLE IV
Metered Parking
~ 346-36. [reserved]
~ 346-37. Designation of parking spaces.
The Board of Public Works shall be responsible for the installation of parking meters in
the city and is hereby directed and authorized to provide for the marking off of individual
parking space in the parking meter zones designated and described in Schedule XXVII
of the traffic regulations of the Board of Public Works, said parking spaces to be
designated by lines painted or marked on the curbing or surface of the street or lot. At
each space so marked off, it shall be unlawful to park any vehicle in such a way that
said vehicle shall not be entirely within the limits of the space so designated.

~ 346-38. Alternate meter parking.
Parking is hereby prohibited at each alternate metered parking space from 4:00 p.m.
and 6:00 p.m. as designated and marked by the City Traffic Engineer in the parking
meter zones designated and described in Schedule XXVIII of the traffic regulations of
the Board of Public Works.
~ 346-39. Overnight parking in metered zones prohibited.
No person shall park a vehicle in any metered zone for a period of time longer than 15
minutes between 2:00 a.m. and 5:00 a.m. except for streets or parts thereof described
in Schedule XXIX of the traffic regulations of the Board of Public Works.
~ 346-40. Installation of parking meters.
In said parking meter zones, the Department of Public Works shall cause parking
meters to be installed upon the curb, sidewalk or area immediately adjacent to the
parking spaces provided in this article. No parking meters shall be installed in areas
where parking is prohibited. The Ithaca Police Department shall be responsible for the
regulation, control, operation, maintenance and use of such parking meters. Each
device shall be so set as to display a signal showing legal parking upon the deposit of
the appropriate coin, lawful money of the United States of America, for the period of
time prescribed in this article. Each device shall be so arranged that upon the expiration
of the lawful time limit, it will indicate by a proper, visible signal that the lawful parking
period has expired, and in such case the right of such vehicle to occupy such space
shall cease, and the operator, owner, possessor or manager thereof shall be subject to
the penalties hereinafter provided.
~ 346-41. Operation of parking meters.
Except in a period of emergency determined by an officer of the Fire or Police
Department, or in compliance with the directions of a police officer or traffic control sign
or signal, when any vehicle shall be parked in any parking space alongside or next to
which a parking meter is located, the operator of such vehicle shall, upon entering the
said parking meter space, immediately deposit or cause to be deposited in said meter
such proper coin of the United States of America as is required for such parking meter
and as is designated by proper directions on the meter, and when required by the
directions on the meter, the operator of such vehicle, after the deposit of the proper
coin, shall also set in operation the timing mechanism on such meter in accordance with
directions properly appearing thereon, and failure to deposit such proper coin and to set
the timing mechanism in operation when so required shall constitute a violation of this
article. Upon the deposit of such coin (and the setting of the timing mechanism in
operation when so required), the parking space may be lawfully occupied by such
vehicle during the period of time which has been prescribed for the part of the street in
which said parking space is located, provided that any person placing a vehicle in a
parking meter space adjacent to a meter which indicates that unused time has been left
in the meter by the previous occupant of the space shall not be required to deposit a
coin so long as his occupancy of said space does not exceed the indicated unused
parking time. If said vehicle shall remain parked in any such parking space beyond the
parking time limit set for such parking space and if the meter shall indicate such illegal
parking, then and in that event such vehicle shall be considered as parking overtime
and beyond the period of legal parking time, and such parking shall be deemed a
violation of this article.
~ 346-42. Manner of parking.
When a parking meter space is parallel with the adjacent curb or sidewalk, no person
shall park or permit the parking of any vehicle in such parking space in any other
position than with the foremost part of such vehicle nearest to the parking meter; when

a parking meter space is diagonal to the curb or sidewalk, no person shall park or
permit the parking of any vehicle in such parking space in any other position than with
the foremost part of such vehicle nearest to the parking meter; when a parking meter
shall have been installed at the head of and immediately adjacent to any parking space
on a municipal off-street parking lot, no person shall park or permit the parking of any
vehicle in such parking space in any other position than with the foremost part of such
vehicle nearest to the parking meter; provided, however, that in municipal off-street
parking lots, signs shall be erected indicating that head-on parking only is permitted. In
any event, a vehicle shall be parked within the lines marked on the pavement
measuring such parking space.
~ 346-43. Parking meter fees.
A fee of $0.25 per half hour, or $0.10 for each twelve-minute period, and $0.05 for six
minutes, is hereby established for parking in all parking zones except for the following
locations which shall be subject to a parking fee of $0.25 per hour:
A. The 200, 300, 400, and 500 blocks of Thurston Avenue; the 100 block of
Edgemoor Place; the 500, and 600 blocks of Stewart Avenue, which locations shall
have a 9-hour limit.
B. The 400 block of North Cayuga Street; the 100 block of West Court Street; the
300 block of East Buffalo Street; the 600 block of West State Street; the 300 and 400
blocks of Stewart Avenue; and the 100 block of Osmun Place.
~ 346-44. Violations.
It shall be unlawful and a violation of the provisions of this article for any person to:
A. Cause, allow, permit or suffer any vehicle registered in the name of or
operated by such person to be parked overtime or beyond the period of legal parking
time established for any parking meter zone as herein described, or to deposit in any
parking meter any coin for the purpose of parking beyond the maximum legal parking
time for the particular parking meter zone.
B. Permit any vehicle to remain or be placed in any parking space adjacent
to any parking meter while said meter is displaying a signal indicating that the vehicle
occupying such parking space has already been parked beyond the period prescribed
for such parking space.
C. Park any vehicle across any line or marking of a parking meter space or in
such position that the vehicle shall not be entirely within the area designated by such
lines or markings.
D. Deface, injure, tamper with, open or willfully break, destroy or impair the
usefulness of any parking meter installed under the provisions of this article.
E. Deposit or cause to be deposited in any parking meter any slug, device or
metal substance or other substitute for lawful coins.
F. Park or permit the parking of any vehicle in any parking meter space
where the meter does not register lawful parking.
~ 346-45. Reports of violations; citations.
A. It shall be the duty of the police officers, acting in accordance with
instructions issued by the Chief of Police, to report:

(1) The number of each parking meter which indicates that the vehicle
occupying the parking space adjacent to such parking meter is or has been parked in
violation of any of the provisions of this article.
(2) The state license number of such vehicle.
(3) That such vehicle is parked in violation of any of the provisions of
this article.
(4) Any other facts, a knowledge of which is necessary to a thorough
understanding of the circumstances attending such violation.
B. Each such police officer shall also attach to such vehicle a notice to the
owner thereof that such vehicle has been parked in violation of a provision of this article,
and instructing such owner to report to the court with regard to such violation.
~ 346-46. Purpose of meter deposits.
The coins required to be deposited in parking meters as provided herein are hereby
levied and assessed as fees to provide for the proper regulation and control of traffic
upon the public streets and also the cost of supervising and regulating the parking of
vehicles in the parking meter zones created thereby, and to cover the cost of the
purchase, supervision, protection, inspection, installation, operation, maintenance,
control and use of the parking meters described herein.
~ 346-47. Collection of coins from meters; disposition thereof.
It shall be the duty of the Police Department to designate some proper person or
persons to make regular collections of the moneys deposited in said meters, and it shall
be the duty of such person or persons so designated to remove from the parking meters
the locked containers therein containing the coins so deposited in said meters and to
deliver such locked containers to the City Chamberlain, who shall be responsible for
and shall keep a record of the collection of fees from parking meters and shall credit
such fees to the Parking Meter Fund.
ARTICLE V
Miscellaneous Provisions
~ 346-48. Vehicle idling.
A. Applicability. This section shall apply to all motor vehicles defined in Article
1 of the Vehicle and Traffic Law of the State of New York.
B. No person who owns, operates or leases a motor vehicle or who owns,
leases or occupies land and has the actual or apparent dominion or control over the
operation of a motor vehicle on such land shall allow or permit the engine of such motor
vehicle to idle for more than five consecutive minutes when the motor vehicle is not in
motion, except as otherwise permitted by Subsection C below.
C. Exceptions. The prohibitions of Subsection B of this section shall not apply
when:
(1) The motor vehicle is forced to remain motionless because of traffic
conditions over which the operator thereof has no control.
(2) Regulations adopted by federal, state or local agencies having
jurisdiction require the maintenance of a specific temperature for passenger comfort.
The idling time specified in Subsection B of this section may be increased, but only to
the extent necessary to comply with such regulations.

(3) The engine is being used to provide power for an auxiliary purpose
such as loading, discharging, mixing or processing cargo; controlling cargo temperature;
construction; farming; or operation of the engine is required for the purpose of
maintenance.
(4) Fire, police and public utility trucks or other vehicles are actually
performing emergency services.
D. Penalties for offenses. Any person who violates the provisions of this
section shall be guilty of a violation and, upon conviction thereof, shall be punishable by
a fine not to exceed $250 or imprisonment of not more than 15 days, or both such fine
and imprisonment.
~ 346-49. Penalties for offenses.
Every person convicted of a traffic infraction for a violation of any provision of this
chapter which is not a violation of any provision of the Vehicle and Traffic Law of the
State of New York shall, for a first conviction thereof, be punished by a fine of not more
than $100 or by imprisonment for not more than 15 days, or by both such fine and
imprisonment; for a second such conviction within 18 months thereafter, such person
shall be punished by a fine of not more than $200 or by imprisonment for not more than
45 days, or by both such fine and imprisonment; upon a third or subsequent conviction
within 18 months after the first conviction, such person shall be punished by a fine of not
more than $300 or by imprisonment for not more than 90 days, or by both such fine and
imprisonment.
~ 346-50. Civil penalty for parking violations.
A. Notwithstanding the provisions of ~ 346-49 above and in full acquittance of
any violation for parking for a longer period of time than is permitted, a civil penalty in
the sum of $5 may be paid if such sum is paid within 20 days of such violation.
B. Civil penalty for delinquent violations. In addition to the penalties provided
in Subsection A above, additional civil penalties shall be payable upon any violation for
parking for a longer period of time than is permitted in accordance with the following
schedule:
(1) Penalty to be added after 20 days: $15.
(2) Upon submission of uncollectible fines to a collection agency or
other entity for enforcement, an amount not to exceed 35% of the total delinquent fine
and penalties will be added to cover collection fees.

Schedule II: Speed Limits.
(a) In accordance with the provisions of ~ 346-6, speed limits other than 30 miles per
hour are hereby established as indicated upon the following described streets or parts
thereof:
Fifteen (15) MPH on Buffalo and Court Streets from 100 feet east of Albany Street
to 100 feet west of Plain Street, and on Albany Street and on Plain Street from 100
feet south of Buffalo Street to 100 feet north of Court Street.
7.Fifteen (15) MPH on Mitchell Street from a point 100 feet west of Elmwood Avenue to
a point 100 feet east of Cornell Street.
Schedule III: School Speed Limits
(a) School speed limits are hereby established no lower than 15 MPH and may extend
no father than 300 feet in either direction from the school building. School speed limits
may only be established on highways abutting the school building. School speed limits
within the corporate limits of the City are as follows:
1. Fifteen (15) MPH on Chestnut Street adjacent to the Alternative Community
School.
2. Fifteen (15) MPH on Cornell Street from 100 feet north of Mitchell Street to Valley
Road, on Elmwood Avenue from 100 feet north of Mitchell Street to Valley Road,
on Valley Road from Elmwood Avenue to Cornell Street, on Ridgedale Road from
100 feet west of Elmwood Avenue to 100 feet east of Cornell Street adjacent to
the Belle Sherman School.
3. Fifteen (15) MPH on Hillview Place between Hudson Street and Aurora Street
adjacent to the South Hill School.
4. Fifteen (15) MPH on Hudson Street adjacent to the South Hill School.
5. Fifteen (15) MPH on North Aurora Street, Linn Street, King Street and Queen

Project Boundary Map – Resolution

WHEREAS, the Community Development/Urban Renewal Plan (Urban Renewal Plan)
adopted by the Common Council in 1975 provides a legal basis for implementing urban
renewal and community development activities of the Ithaca Urban Renewal Agency
(IURA), and
WHEREAS, the Urban Renewal Plan includes a Community Development/Urban
Renewal Project Boundary Map (Project Boundary Map) that defines the project area
where the IURA is authorized to undertake urban renewal and community development
activities, and
WHEREAS, the Urban Renewal Plan found that areas within the Project Boundary Map
designated for urban renewal activities are substandard, insanitary or blighted as
defined by the community, and
WHEREAS, the term “substandard, insanitary or blighted” is defined in the Urban
Renewal Plan to include not only deteriorated housing, but also incompatible land use,
visual blight, inappropriate land uses, and other criteria which make for a less than
acceptable neighborhood, and
WHEREAS, the IURA recognizes that neighborhood conditions have changed since
1975 and desires to amend the Urban Renewal Plan to reflect current neighborhood
conditions, and
WHEREAS, the Urban Renewal Plan may be amended by a majority vote of the
Common Council, and
WHEREAS, the IURA considered the legal criteria for areas to be included in the Urban
Renewal Plan and considered the following amendments to the Project Boundary Map
shown on the attached 12/19/00 map entitled “Proposed Amendments, 12/19/00, to the
Community Development/Urban Renewal Project Boundary Map:”
1. Delete west side of Hector Street on West Hill
2. Add South Hill area west of Hudson Street
3. Add Cliff Street corridor on West Hill
4. Add area east of Chestnut Street on West Hill
5. Add area west of University and extending to north bank of Fall Creek
6. Add waterfront areas along Cascadilla Creek and the Cayuga Inlet, and

implement adoption of the revised Project Boundary Map, such as adding a metes and

20.2 Planning Department – CDBG Program Amendment to Fund Phase I of the
State Theatre Restoration Project – Resolution

WHEREAS, Historic Ithaca, Inc. (HI) has requested funding in the amount of $300,000
from the IURA to fill a projected financial gap to complete Phase I restoration of the
State Theatre located at 117 W. State Street to that will result in the reopening of the
theatre by January 2, 2002, and
WHEREAS, the Phase I scope of work focuses on basic stabilization and code
compliance work necessary to reopen the theater including, but not limited to, roof
replacement, fire alarm installation, upgrade of electrical systems, ventilation system
repair, stabilization of plaster ceilings/walls, bathroom repairs, boiler repairs, hazardous
material abatement, and stage repairs, and
WHEREAS, the projected cost of Phase I is approximately $1.3 million, and
WHEREAS, the IURA has previously approved a total of $182,000 in financial
assistance to HI for Phase I, but a total funding gap of approximately $662,000 remains
to complete Phase I, and
WHEREAS, HI’s funding plan has identified the following proposed funding sources to
fill the Phase I funding gap:
1. IURA $300,000
2. HI fund raising commitment by 6/2002 $125,000
3. NYS Council on the Arts Capital Grants
Program $30,000
4. Environmental Protection Fund Grant $159,000
5. HI Fund Raising after 6/2002 $48,000
$662,000
WHEREAS, upon granting HI’s funding request in a timely manner, Historic Ithaca, Inc.
has indicated it will commit to raise the additional funds necessary and undertake
renovations to reopen the theater by January 2002, and
WHEREAS, HI has submitted the following information to support their funding request:
Phase I project narrative (dated 1/19/01)
Phase I project budget breakout identifying estimated costs by activity (dated
1/17/01)
Phase I funding plan to fill the funding gap (dated 1/19/01)
Draft Phase I budget narrative (dated 1/19/01)
Phase I construction schedule (received 1/19/01)
Phase I 2001 monthly work plan (dated 12/19/00)
State Theatre operating cost/income projections for Year 2002
WHEREAS, the IURA found the above submissions satisfactory to demonstrate need
and feasibility of the project, and that restoration of the State Theatre is critical to
revitalizing the downtown, the West State Street corridor and the surrounding low/mod
neighborhood, and
WHEREAS, the at their 1/23/01 meeting the IURA approved funding for Historic Ithaca,
Inc. in an amount not to exceed $320,000 for phase I of the State Theatre restoration
project, and
WHEREAS, such funding commitment is conditioned upon Historic Ithaca, Inc.
committing to raise the additional funds necessary, and to complete renovations, to
reopen the theater by January 2002, and
WHEREAS, the IURA recommended that such IURA funding shall derive from the
following sources:

1. FY 1998 Small Cities CDBG, activity 1.1, W. State Street Commercial Loan Program
(approximately $280,000), and
2. Urban Development Action Grant (UDAG) repayments (approximately $40,000), and
WHEREAS, use of funding available through the West State Street Commercial Loan
program is limited to activities that directly generate employment opportunities at a rate
of one job per $35,000 of CDBG assistance, and
WHEREAS, the major public benefits of the phase I of the State Theatre restoration
project is the removal of slum and blight conditions created by a vacant theatre and the
creation of indirect employment opportunities at nearby businesses, and
WHEREAS, the IURA hereby recommends that the City of Ithaca approve a CDBG
program amendment request to HUD seeking authorization to use up to $282,000 from
the W. State Street Commercial Loan Program to provide CDBG funds to a Community-
Based Development Organization (CBDO) to fund the Phase I State Theatre project as
a neighborhood revitalization and community economic development activity in a
low/mod income neighborhood in accordance with CFR 24 §570.204; now, therefore be
it
RESOLVED, That Common Council approves a program amendment to the 1998
CDBG award to provide up to $282,000 of funds from the W. State Street Commercial
Loan Program (Activity 1.1) to a Community-Based Development Organization (CBDO)
to fund the Phase I State Theatre Restoration project on behalf of the City as a
neighborhood revitalization and community economic development activity in a low/mod
income neighborhood in accordance with CFR 24 §570.204, and, be it further
RESOLVED, That the IURA Executive Director, upon advice from the City Attorney, is
authorized to sign any and all documents necessary to carry out this resolution.
Community Development Director Bohn reported that the original request was $300,000,
and the IURA granted $320,000 based on demonstrated need.
Alderperson Hershey clarified that this action is simply asking HUD for the transfer of
funds. A SEQR will need to be done if this is HUD approved.

22.1 Local Law to Amend Article IX of Chapter 90 of the City of Ithaca Municipal
Code Entitled “Defense and Indemnification: Civil Actions”

BE IT ENACTED by the Common Council of the City of Ithaca as follows:
Section 1. Legislative Purpose.
Pursuant to Section 18 of the New York State Public Officers’ Law, the governing body of
a municipality may, by adopting a local law, by-law, resolution, rule or regulation, confer on
its public employees and officers, the benefit of a defense and indemnification with regard
to legal action brought against them during the performance of their official duties for the
City. It is the intention of Common Council that the current Article IX of the City of Ithaca
Municipal Code be repealed and replaced with this Local Law, a new Article IX entitled
“Defense and Indemnification: Civil Actions” which extends the benefits outlined in Public
Officers Law, Section 18, as follows:

Section 2.
90-59 Definitions.
As used in this Article, unless the context otherwise requires:
The term "employee" shall mean any commissioner, member of a city board or
commission, trustee, director, officer, employee, volunteer expressly authorized to
participate in a publicly sponsored volunteer program, or any other person holding a
position by election, appointment or employment in the service of the City of Ithaca,
whether or not compensated, but shall not include an independent contractor. The term
"employee" shall include a former employee, his estate or judicially appointed personal
representative.
Section 3.
90-60 Defense Provided.
A. Upon compliance by the employee with the provisions of Section 90-62 of this Article,
the City shall provide for the defense of the employee in any civil action or proceeding,
state or federal, arising out of any alleged act or omission which occurred or allegedly
occurred while the employee was acting within the scope of his or her public employment
or duties. This duty to provide for a defense shall not arise where such civil action or
proceeding is brought by or at the behest of the City against such employee.
B. Subject to the conditions set forth in paragraph (A) of this section, the employee shall
be entitled to be represented by private counsel of his/her choice in any civil action or
proceeding whenever the City Attorney or other counsel designated by the City determines
that a conflict of interest exists, or whenever a court, upon appropriate motion or otherwise
by a special proceeding, determines that a conflict of interest exists and that the employee
is entitled to be represented by counsel of his/her choice, provided, however, that the City
Attorney or other counsel designated by the City may require, as a condition to payment of
the fees and expenses of such representation, that appropriate groups of such employees
be represented by the same counsel. Reasonable attorneys' fees and litigation expenses
shall be paid by the City to such private counsel from time to time during the pendency of
the civil action or proceeding with the approval of Common Council.
C. Any dispute with respect to representation of multiple employees by a single
counsel or the amount of litigation expenses or the reasonableness of attorneys' fees
shall be resolved by the court upon motion or by way of a special proceeding.
D. Where the employee delivers process and a written request for a defense to the
City under section 90-62 of this Article, the City shall take the necessary steps on behalf
of the employee to avoid entry of a default judgment pending resolution of any question
pertaining to the obligation to provide for a defense.
Section 4.
90-61. Indemnification.
A. The City shall indemnify and save harmless its employees in the amount of any
judgment obtained against such employees in a state or federal court, or in the amount of
any settlement of a claim, provided that the act or omission from which such judgment or
claim arose occurred while the employee was acting within the scope of his or her public
employment or duties; provided further that in the case of a settlement the duty to
indemnify and save harmless shall be conditioned upon the approval of the amount of
settlement by Common Council.
B. Except as otherwise provided by law, the duty to indemnify and save harmless
prescribed by this subdivision shall not arise where the injury or damage resulted from
intentional wrongdoing or recklessness on the part of the employee.
C. Nothing in this subdivision shall authorize the City to indemnify or save harmless an
employee with respect to punitive or exemplary damages, fines or penalties, or money
recovered from an employee pursuant to section fifty-one of the general municipal law;
provided, however, that the City shall indemnify and save harmless its employees in the
amount of any costs, attorneys' fees, damages, fines or penalties which may be imposed

by reason of an adjudication that an employee, acting within the scope of his or her public
employment or duties, has, without willfulness or intent, violated a prior order, judgment,
consent decree or stipulation of settlement
entered in any court of this state or of the United States.
D. Upon entry of a final judgment against the employee, or upon the settlement of the
claim, the employee shall serve a copy of such judgment or settlement, personally or by
certified or registered mail within thirty days of the date of entry or settlement, upon the
Mayor, and if not inconsistent with the provisions of this Article, the amount of such
judgment or settlement shall be paid by the City.
Section 5
90-62. Conditions of defense. The duty to defend or indemnify and save harmless
prescribed by this Article shall be conditioned upon:
A. Delivery by the employee to the City Attorney or the Mayor of a written request to
provide for his or her defense together with the original or a copy of any summons,
complaint, process, notice, demand or pleading within ten days after he or she is served
with such document, and
B. The full cooperation of the employee in the defense of such action or proceeding
and in defense of any action or proceeding against the City based upon the same act or
omission, and in the prosecution of any appeal.
Section 6.
90-63. Construal of provisions A. The benefits of this Article shall inure only to
employees as defined herein and shall not enlarge or diminish the rights of any other
party nor shall any provision of this section be construed to affect, alter or repeal any
provision of the workers' compensation law.
B. This Article shall not in any way affect the obligation of any claimant to give notice to
the City under section ten of the court of claims act, section fifty-e of the general
municipal law, or any other provision of law.
C. Except as otherwise specifically provided, the provisions of this Article shall not be
construed in any way to impair, alter, limit, modify, abrogate or restrict any immunity to
liability available to or conferred upon any unit, entity, officer or employee of the City by, in
accordance with, or by reason of, any other provision of state or federal statutory or
common law.
Section 7.
90-64 Insurance.
A. The City is hereby authorized and empowered to purchase insurance from any
insurance company created by or under the laws of this state, or authorized by law to
transact business in this state, against any liability imposed by the provisions of this
section, or to act as a self-insurer with respect thereto.
B. The provisions of this Article shall not be construed to impair, alter, limit or modify the
rights and obligations of any insurer under any policy of insurance.
Section 8.
90-65. Public Purpose
All payments made under the terms of this Article, whether for insurance or otherwise,
shall be deemed to be for a public purpose and shall be audited and paid in the same
manner as other public charges.
Section 9.
90-66. Severability If any provision of this Article or the application thereof to any person
or circumstance be held unconstitutional or invalid in whole or in part by any court, such
holding of unconstitutionality or invalidity shall in no way affect or impair any other

provision of this Article or the application of any such provision to any other person or
circumstance.
Section 10. Effective Date.
This law shall take effect immediately upon filing with the office of the Secretary of
State.
