HomeMy WebLinkAboutMN-CC-1999-09-16COMMON COUNCIL PROCEEDINGS CITY OF ITHACA, NEW YORK Special Meeting 7:00 September 16, 1999 PRESENT: Acting Mayor Blumenthal Alderpersons (6) Shenk, Sams, Marcham, Hershey, Spielholz, Taylor OTHERS PRESENT: City Clerk – Conley Holcomb Assistant City Attorney – Dunn Human Resources Director – Michell-Nunn PLEDGE OF ALLEGIANCE: Acting Mayor Blumenthal led all present in the Pledge of Allegiance to the American flag. EXECUTIVE SESSION: Resolution By Acting Mayor Blumenthal: Seconded by Alderperson Hershey RESOLVED, That Common Council go into Executive Session to discuss the employment history of an individual. Carried Unanimously Reconvene Common Council reconvened into regular session at 9:00 pm with no action taken. Acting Mayor Blumenthal reported that the hearing requested by Building Commissioner Richard Eckstrom will be held on September 30, 1999, October 1, 1999 and October 5, 1999 if needed. The hearing will be conducted between the hours of 9:00 am – 5:00 pm. The location of the hearing will be announced at a later date. 2.1 Resolution – Hearing Officer By Acting Mayor Blumenthal: Seconded by Alderperson Hershey WHEREAS, disciplinary charges were brought against the Building Commissioner, Richard Eckstrom, and WHEREAS, the Building Commissioner has requested a hearing pursuant to Section 26.1 of the Charter of the City of Ithaca, and WHEREAS, pursuant to Section 26.1 of the Charter of the City of Ithaca, the hearing officer is the Common Council or its designee, and WHEREAS, the Common Council has appointed John M. Crotty, Esq. as hearing officer in this matter, and WHEREAS, pursuant to Section 26.1 (L)(2) of the Charter of the City of Ithaca, the Common Council may be the final decision-maker after a hearing; now, therefore, be it RESOLVED, That the Common Council has determined that the hearing officer shall make the final decision as to findings of fact and recommend the imposition of penalty, and, be it further September 16, 1999 RESOLVED, That, pursuant to Section 26.1(L)(2) of the Charter of the City of Ithaca, Common Council directs the hearing officer to preside over a hearing on this matter, to weigh the evidence, to make written findings of fact and, if the hearing officer shall uphold the charges, to recommend the imposition of penalty and to present same to Common Council, who shall then make a determination as to penalty. Ayes (6) Blumenthal, Hershey, Taylor, Marcham, Spielholz, Shenk Nays (1) Sams Carried ADJOURNMENT: On a motion the meeting was adjourned at 9:15 pm.
