Referendum Veto Issue
Mayor Cohen stated that upon the advice of outside Counsel, he
will not make a statement regarding the referendum items until he
has submitted his veto messages. He noted that he regrets not
advising Council of this sooner, and apologized for any
impressions of disrespect.
Discussion followed on the floor regarding the Mayor's statement.
SPECIAL ORDER OF BUSINESS:
Establishment of the Ithaca Downtown Business Improvement
District

WHEREAS, during the thirty day period since the public hearing on
the proposed Ithaca Downtown Business Improvement District less
than fifty-one percent of the property owners and the owners of
less than fifty-one percent of the assessed value of property in
the proposed district have filed objection petitions; now,
therefore, be it
RESOLVED, That the Common Council, pursuant to Section 980-f of
Article 19-A of the General Municipal Law governing Business
Improvement Districts, determines the following:
1. The notice of hearing for the BID was published and mailed
as required by law and is otherwise sufficient;
2. all property within the proposed BID will benefit from the
establishment of the district;
3. all real property benefiting from the services proposed to
be provided by the BID is included within the BID boundaries
as defined in the plan;
4. the establishment of the proposed BID is in the public
interest.

Municipal Law

Local Law No. 96-
City of Ithaca
A Local Law establishing a Business Improvement District in the
City of Ithaca in accordance with Article 19-A of the General
Municipal Law.
Be it enacted by the Common Council of the City of Ithaca as
follows:
Section I. The Ithaca Downtown Business Improvement District
shall be and is hereby established in the City of Ithaca, the
Common Council having found that the establishment of the
district is in the public interest, that all notice, mailing and
hearing requirements have been complied with, that all properties
within the district will benefit from its establishment and that
all property benefitted is included in the boundaries of the
district. The boundaries of said district are contained in the
district plan attached to the resolution of this body dated July
2, 1996 calling for a public hearing, and are set forth below:
ALL THAT TRACT OR PARCELS OF LAND, situate in the City of Ithaca,
County of Tompkins and State of New York, more particularly
bounded and described as follows:
North Boundary: All properties fronting on Buffalo Street
from N.Aurora Street to N.Geneva Street.
All properties fronting on the South side of
W.Buffalo Street from N.Geneva to N.Albany Streets.
West Boundary: All properties fronting on the East side of
Albany Street from W.Buffalo Street to
W.Green Street.
South Boundary: All properties fronting on the North side of
W.Green Street from S.Albany Street to
S.Geneva Street.
All properties fronting on W.Green Street
from S.Geneva Street to S.Cayuga Street.
All properties fronting on S.Cayuga Street
from W.Green Street to Clinton Street.
All properties on North Side of
E.Clinton/Prospect Streets from S.Cayuga
Street to S.Aurora Street.
East Boundary: All properties fronting on West side of
S.Aurora Street from Prospect Street to
E.State Street.
All properties fronting on E.Green Street and
E.State Street from S.Aurora Street to
Schuyler Place and entire Tax Parcels 69-6-
13,14,15.
All properties fronting on Seneca Way
All properties fronting on E.Seneca Street
from N.Aurora Street to Parker Street.
All properties fronting on N.Aurora Street
from E.Seneca Street to E.Buffalo Street
Section II. The provision of services within the district shall
be pursuant to such district plan of the Ithaca Downtown Business
Improvement District. All said services shall be in addition to,
and not a substitution for, required municipal services provided
by the City of Ithaca on a city-wide basis.
Section III. To the extent not otherwise explicitly provided
herein, the provisions set forth in Article 19-A of the General
Municipal Law shall govern the operation of the BID and the
District Management Association in the City.
Insofar as the provisions of this Local Law are inconsistent with
the provisions of any other Local Law or act, the provisions of
this Local Law shall be controlling.
Section IV. Any amendments to the BID or to the BID Plan shall
be made in accordance with the provisions set forth in Section
980-i of Article 19-A of the General Municipal Law.
Section V. The invalidity of any word, section, clause,
paragraph, sentence, part or provision of this Local Law shall
not affect the validity of any other part of this Local Law which
can be given effect without such invalid part or parts.
Section VI. This local law shall become effective upon
compliance with the requirements set forth in Section 980-g of
Article 19-A of the General Municipal Law, and upon compliance
with all other requirements of law.

Mayor Cohen, Alderperson Efroymson, and Mr. Arthur Pearce
expressed their thanks to everyone who worked so hard on the BID
project.
