COMMON COUNCIL PROCEEDINGS
Special Meeting 7:30 P.M. January 17, 1990

0-1 PLEDGE OF ALLEGIANCE:
Mayor Nichols led all present in the Pledge of Allegiance to the
American flag.
(� REPORT OF CITY ATTORNEY:
Jason Fane Lawsuit
+° City Attorney Guttman reported that we have received a decision
from City Court Judge Sherman on the case of the City of Ithaca
vs. Jason Fane regarding various violations at his premises at
705 East Buffalo Street. Judge Sherman has ruled in the City's
favor and has fined Mr. Fane a total of $16,550.00.
Alderperson Cummings asked City Attorney Guttman if the charge
that was a violation of the Landmark Ordinance that had to do
(400e with demolition of a chimney without permission was upheld.
City Attorney Guttman stated that that charge was not covered in
the decision itself. It is his understanding that during the
trial itself Judge Sherman had dismissed that charge. He has
spoken with Atty. Kennedy, who is handling the housing issues,
and to Planning & Development Director Van Cort and they are
looking into that question.
Alderperson Johnson asked City Attorney Guttman if his perception
is that Mr. Fane is likely to appeal this decision. He stated
that he would not like to see an empty victory in this case.
City Attorney Guttman stated that he does not know if Mr. Fane is
likely to appeal. He said that he does not think it would be an
empty victory because it speaks importantly of two issues. One
is that the City will prosecute violations and that the courts
are willing to penalize quite severely. He thinks it sends a
message to anyone who is going to violate the housing codes that
these are going to be seriously prosecuted and punished.

Filling of 4th Ward Alderperson Seat on Common Council
Motion to Act
By Alderperson Johnson: Seconded by Alderperson Schroeder
(4well RESOLVED, That this Council act to fill the vacancy for the 4th
Ward Alderperson seat on Common Council.
Carried Unanimously
Nomination
Alderperson Schroeder nominated Neil Golder.
Motion to Close Nominations
By Alderperson Johnson: Seconded by Alderperson Hoffman
RESOLVED, That the nominations for filling the vacant
Alderpersons seat in the 4th Ward be declared closed.
Carried Unanimously

Mayor Nichols stated for the record that it has been his feeling
for sometime that Sean Killeen could serve the City very well
with all of his experience and knowledge and in the course of the
last few weeks, through the good offices of the City chair of the
democratic party, John Oakley, Sean was offered the position of
Co -chair of a commission which the Mayor will be creating to
study the City /Cornell relationship. As of now Mr. Killeen has
not accepted that position but the Mayor would like everyone to
know that he is eager to use Mr. Killeen's talents and will be
discussing with him what position jointly they might agree on
where he could serve.
Discussion followed on the floor with the Alderpersons stating
their reasons for supporting or not supporting the nomination of
Neil Golder for Alderperson of the 4th Ward.
A vote on the nomination of Neil Golder to fill the 4th Ward
Alderperson's seat resulted as follows:
Ayes (7) - Peterson, Hoffman, Johnson, Blanchard, Booth,
Cummings, Schroeder
Nays (2) - Romanowski, Daley
Carried
Mr. Golder took the oath of office and was sworn in by Deputy
City Clerk Boyle.
Standing Committees Appointment
Mayor Nichols stated that Alderperson Golder will serve on the
Budget and Administration Committee and the Human Services
Committee.
Announcements
Mayor Nichols reported that Attorney Gitlin will be here on the
23rd of January at 4:00 p.m. to discuss the baling station.
Mayor Nichols stated that he would like to call a Common Council
Committee of the Whole meeting for that time. The discussion
will be in executive session as it regards litigation.
Adjournment
On a motion the meeting adjourned at 8:00 p.m.
