registration and parti_cipat_ion in all elections, and
WHEREAS, there are several_ groups and organizations in the City of
Ithaca willing to conduct or become involved in voter registration
drives during September, 1952;
NOW, THEREFORE, BE IT RESOLVED, That the Ithaca City Common Co- uic-i.l.
does herewith designate September, 1952 as "Voter Registration Month,
and encourages all unregistered voters to register to vote.

City Rep. Nichols reported on the ollowing items:
'there will be a public hearing on "Tuesday, September 7, 1982 to
declare the Biggs Complex surplus property and offer it for sale.
Supt. of Public Works Kinsella raised the question of the county
hearl.ng some of the expense of curb cuts ill the area around the Court
house. The elevator is now fini -shed, and Curb cuts would be
appropriate in that block.
The City was represented on the maiden rum of the Tomtran bus by
Supt. Kinsella, Transit Supervisor Carpenter and Rep. Nichols.

WHERP.AS, the Planning and Development Department has been delegated
respons :lbi.l:i ty for encouraging economic development within the City
of Ithaca, and

WHEREAS, the Department has been working closely with the Chamber of
Commerce, the County, Cornell and the Tompkins County Area Development,
Inc. on the production of an industrial brochure to advertise and
promote the Tompkins County area in an e f t ort to attract new :indust=ries
to our area, and
WHEREAS, the Private Industry Council has expressed a willingness to
assist with the product =ion costs of the brochure, and
ld1EREAS, the Private Industry Counc=il. requires that its money be
p<:ssed throucyli a local agency;
NON', THUREFORE, BE IT RESOIXED, That the Mayor :is hereby authorized,

Section 1. That Chapter 34 entitled "Signs" of the City of Ithaca
Municipal Code is amended as follows:
1. That paragraph 1 of Subdivision n of Section 34.3 entitled
"Definitions" shall have added to the definition of "sign": "The
term shall not include murals, as defined elsewhere in this section,
except as further provided below."
2. That a new paragraph to he designated as paragraph 18 OF Sub-
division A of Section 34.3 entitled "Definitions" shall be added to
said subdivision to react as follows:
"18. The term "mural" shall mean a picture, design or decorative
treatment painted on or otherwise affixed to and covering a large
portion of a wall surface, and shall include sculpture and sculptural
treatments of solid elements for the purpose of this definii ion.
Murals may be erected on any wall of a structure. Si.gnage and
advertising .may be erected in conjunction with murals. plurals erected
in conjunction with signage shall not be considered signs for the
purpose of this ordinance if such murals are clearly separate from
the signage, and the content and design of the mural does not overtly
represent specific goods, services or activities offered for sale.
Generalized depictions of types of goods; commonly -used symbols other
than trademarks, brand names and logos; and scenes which do not
specifically illustrate commercial activity may be allowed in murals.
Graphic, pictorial or representational material which is clearly
subordinate to signage, which is contained AMP a sign or which
forms a design element integral to a sign, shall he considered to be
signage rather than a mural, and shall he counted as part OF the
signage for the premises on which it is located."

Where any part of a mural will be visible from a public: way, a
description of the proposed mural shall he submitted to the Building
CommIss oner for a determi- na.t_ion as to whether such mural, or any

and S 34.5(A)18 above. The description submitted shall fully explain
the proposal in terms of size, location on the property, graphic. /pic-
torial content, and relationship to any signage existing or proposed
for the property, to aid tho Building Commissioner in making his
determination.
Upon receipt: of a proposal for a mural for any property sub � �c.t to
the provisions of Chapter 30.59 or 30.60 (Design Review Board or
Courthouse Special Use Zone), or 32 (Landmarks Preservation) of thi
Code, or facing such property, the Building Commissioner shall notify
the Design Review Board and /or the Landmarks Commission, as applicable,
for their i.nCormatiou and any appropriate action, and shall so inform
the applicant.

Section 1. That Chapter 81, Section 81.2 Entitled "Limitations on
Exempt ion," Subdivision A, of Ithaca Municipal Code, is hereby
