OF ITHACA
BE IT ENACTED by the Common Council of the City of Ithaca, New York
as follows,
SECTION 1, ESTABLISHING THE ANNUAL SALARY OF THE MAYOR
OF THE CITY OF ITHACA
The annual salary of the Mayor of the City
of Ithaca is hereby established and set at
$24,000.00 per year commencing January, 1., 1982.
SECTION 2. This local Inv shall take effect immediately
after filing in the Office of the Secretary
of State.

A LOCAL LAW ESTABLISHING THE ANNUAL SALARIES OF EACH OF THE ALDERMEN
OF THE CITY OF ITHACA
BE IT ENACTED by the Common Council of the City of Ithaca, New York
as follows:
SECTION 1. ESTABLISHING THE ANNUAL SALARIES OF EACH OF THE
ALDERMEN OF THE CITY OF ITHACA
The annual salaries of each of the aldermen of
the City of Ithaca are hereby established and set
at $4,500.00 a piece per year commencing January 1,
1982.
SECTION 2. This local law shall take effect immediately upon
its being duly filed in the Office of the Secretary
of State subject to the provisions of Section
twenty -four of the Municipal Home Rule Law,
Mr. Leonard Ferris, 104 Short Street, appeared before the Council,
and commented that because Alderman Gutenberger, candidate for Mayor,
abstained from voting on the previous resolution, he would like to
see any candidate on the Council tvho is going to run for election
abstain from voting on this resolution.
Discussion followed on the floor.

BE IT ENACTED by the Common Council. of the City of Ithaca, Neta York
as follows:
1 SECTION 1. AMENDING SEC'T'IONS 4,1, 4.2, 4.3, 4.4, 4,5 and 4.6
of Article IV Entitled "TAXATION AND ASSESSMENTS"
of the Ithaca City Charter

to read as follows:

CHARTER
ARTICLE IV
TAXATION AND ASSESSMENTS
g 4.1 AD VALOREM TAX; LEVY, LIMITATION UPON LEVY, APPORTIONMENT
As soon as practicable after the assessment roll has been com-
pleted, corrected and certified by the assessors, the Common Council
shall cause to be assessed and raised by taxation upon. all the real.
(6000� and personal property in the city, taxable for city purposes, an
amount not exceeding, except as hereinafter provided, two per centum
of the average assessed valuation of such property as the same shall.
appear from the assessment rolls of the city for the five preceding
years, and shall designate the respective portions of the amount
so to be assessed and raised applicable to the following purposes:
1. For the uses of the Board of Public Works.
2. For the uses of the Fire Department.
.� 3. For all expenditures under the direct supervision
of the Common Council.
In addition to the total amount hereinabove authorized there
shall be included such amount as shall be necessary to meet: the
principal and interest on the bonded indebtedness of the city fall-
ing due on or before the first day of January in the next fiscal year,
to provide the sinking fund _required by law, and to meet all indebted-
ness remaining unpaid on all judgments against the city for damages
caused by negligence; and such further sums as shall have been voted.
at a special city election of taxpayers called for that purpose.
S 4.2 ESTIMATES BY OFFICERS, BOARDS; CONTENTS
On or before the first day of September each year, or at such
earlier date as the Mayor may prescribe, but not before the first
day of August, the head of each quasi-i_ndependent board or commission
receiving funds on a budgeted basis, or a designee, and the head of
each department or other spending unit of the city government, shall
furnish to the City Controller an estimate of revenues and expendi-
tures of such unit or authorized agency for the ensuing fiscal. year.
Estimates shall be submitted in such form and additional information
as the Mayor and the Controller shall prescribe; such estimates of
expenditures shall be based on and shall be accompanied by a proposed
work program prepared by each department head for such funds, and
shall justify the funds requested. The City Controller shall also
present to Common Council a statement of balances of funds on hand and
available for application toward the reduction of taxes in the ensuing
year.
S 4.3 LEVY OF TAXES; LIEN
The Common Council shall, not later than its first regular meeting
in December, consider such estimates and determine the entire amount
necessary to be raised by taxation, and shall. levy the aggregate amount
taxed, ascertained and determined, together with any special tax which

all property, real and personal, taxable for city purposes, in the city,

assessment roll so completed and corrected in each year, and shall
p certify such to be a correct roll of city taxes. Such roll shall then
be delivered to the City Chamberlain not later than the thirty -first
day of Decembei with a warrant annexed under the hand of the Mayor and
City Controller and the seal of the city, commanding him to receive,
levy and collect the several stuns in the roll specified as assessed
against the person or property therein mentioned or described, and to

return said warrant and roll within eleven months after the date of
the warrant, unless such time be extended by resolution of the Common
Council. From the time of the receipt of the tax roll and warrant by
the City Chamberlain, all taxes assessed and levied upon any real
property shall be a lien thereon for the amount of such tax, with
percentage and interest, until the same shall be fully paid.
S 4.4 NOTICE OF COLLECTION; PUBLICATION AND POSTING
Immediately upon the delivery of the roll and warrant to the City
Chamberlain, the City Controller shall cause to be published a notice
thereof in one of the city papers, stating that until a. date therein ,
specified, which shall be not less than one month after the first
publication, the City Chamberlain will collect and receive said tax
at his office; such tax shall be payable in two (2) installments, the
first installment shall be payable in January of each year without
penalty addition, but that on all taxes unpaid at the end. of the period
specified and thereafter, the City Chamberlain will require and collect
the penalty addition as provided in the following section (5 4.5); the
second installment shall be payable in June of such year without penalty
addition, but that on all taxes unpaid at the end of the period speci-
fied and thereafter, the City Chamberlain will require and collect the
penalty addition as provided in the following section (8 4.5). Each of
said installments shall be fifty percentum (50 %) of said tax. Such
notice, printed in large type, shall also be conspicuously post:ed'in
at least three public places in each ward of the city.
g 4.5 PERCENTAGE ADDITIONS TO UNPAID TAXES
The City Chamberlain shall accept payment of the first install-
ment during the month of January without penalty addition. On all
taxes unpaid at the expiration of such period, five percent (5 %)
shall be added and collected in February. On all taxes remaining
unpaid after March 1, an additional one percent (1 %) per month shall
be added and collected up to and including October of each year.
Commencing on the first day of June of each year, the second install-
ment of said tax shall become due; the City Chamberlain shall give
notice in the same manner as hereinabove provided. The City
Chamberlain shall accept payment of the second installment during
the month of June without percentage addition. On all taxes unpaid
at the expiration of such period, five percent (5 %) shall be added
and collected in July. On all taxes remaining unpaid after. August
1, an additional one percent (1 %) per month shall be added and
collected up to and including October of each year. All such per-
centages shall be collected and added to the funds of the city.
g 4.6 PROCEEDINGS TO COLLECT UNPAID TAXES, ARREARAGES
A. Notice of sale.
The City Chamberlain, in the name of the city, shall forth-
with proceed to collect in the manner hereinafter prescribed, any
tax, including arrearages, unpaid after October fifteenth, with
thirteen (13 %) added to the first installment and eight percent (8 %)
added to.the second installment. On the first Monday in November
the City Chamberlain shall cause to be published in at least one of
the daily newspapers published in the City of Ithaca a notice of
tax sale, giving a brief description of each parcel of land to be
sold, including the approximate square foot area of each parcel, the
amount of tax unpaid, the name of the owner of each parcel so to be
sold as such name appears on the assessment roll of the year in
which unpaid taxes were assessed. Said notice shall be published at
least once a week and three times before the sale and there shall
elapse at least twenty -one days between the first publication and
the date of sale. The City Chamberlain shall also cause such notice
of tax sale to be sent by first class mail to the owner of each
parcel so to be sold, as such name appears on the assessment roll.
Said notice shall give a brief description of each parcel of land
to be sold, including the amount of tax unpaid, and the name of the
owner of each parcel. In the event that there is more than one
parcel of land to be sold for taxes, the City Chamberlain may insert
in one notice the description of the several parcels to be sold,
the names of the owners of such parcels and the items of taxes due.
In the event that a parcel. of land is to be sold for unpaid taxes

for more than one year, the City Chamberlain may insert in the notice
of sale a statement of the items of taxes due for each year, with the
name of the owner of such parcel as such name appears on the assess-
ment rolls of the several years in which the unpaid taxes were
assessed, together with a statement of the total amount of taxes unpaid.
The expense of advertising and of mailing such notices shall be an
additional expense chargeable against the parcel.
B. Conduct of sale; certificate
Upon the date of the tax sale, the City Chamberlain shall
offer separately the parcels of land to be sold and shall conduct: the
(Wool auction in a fair and equitable manner. He shall first offer the
parcel of land in its entirety for the amount of the tax, with the
aforesaid additions, plus the proportionate share of the expense of
publication. If he obtains a bidder, the bidder's name and address
shall be recorded and the City Chamberlain shall then offer a one -half
interest in said parcel of land for the amount of tax, plus interest
and expenses as aforesaid. If he obtains a bidder, he shall offer a
one - quarter interest in said parcel of land, and shall repeat this
method, each time thereafter reducing the interest to be sold by one -
_� half, and each time recording the name and address of the bidder, until
no bid is made; whereupon the City Chamberlain shall declare the
\.1 interest last bid for duly sold to the last bidder. Upon receipt: by
_.] the City Chamberlain of the amount of tax, plus interest and propor.-
s' tionate share of the expense aforementioned, the City Chamberlain shall
issue to the person making the bid a certificate as nearly as may be
in the following form, to wit:
City of Ithaca Tax Certificate for the Year (insert year),
This is to certify that on the (insert date), (insert
name of purchaser) duly purchased a (insert extent of interest
purchased) in the following described premises: (insert
description of property) at the (insert year) Ithaca City
(4000, Tax Sale, and paid therefor the sum of (insert amount) for
taxes, interest and expenses. If said property is not
duly redeemed by payment of the aforementioned amount,
plus fifteen per centum thereof, within one year from the
date of such sale, the City of Ithaca will give to 1-111(' holder of this certificate a tax deed of the interest: here-
inbefore mentioned.

C. Notice of Redemption.
The owner of any interest in the premises sold ma.), redeem
said premises from said tax sale at any time within one year from
the date of sale by paying to the City Chamberlain of the City of
Ithaca for the benefit of the owner of said tax certificate the
amount bid as hereinbefore provided, plus fifteen per centum.
After one year of said tax sale, the amount bid as hereinbefore
provided, plus twenty per centuin.
The City Chamberlain shall, at least three months prior to
the expiration of the one year provided for the redemption of said
tax sale property, cause notice to be published at least once a week
for three weeks in at Least one of the daily newspapers designated by
City Council. 'The notice shall give a brief description of each parcel
of unredeemed land and the amount necessary to redeem said parcel.
The City Chamberlain shall also, prior to the commencement of such
publication, cause such notice of unredeemed land to be sent by first
class mail to the owner of such parcel as such name appears on the
assessment roll. Said notice shall give a brief description of each
parcel of unredeemed land and the amount necessary to redeem said
parcel expense of advertisin,, and of mailing such notices shall
be an additional expense chargeable against the parcel.

D. Tax Sale Docket; contents, use.
The City Chamberlain shall provide in his office a city tax sale
docket with spaces designated for the names of property owner,
description of property sold, amount bid, date of sale, date of
expiration of redemption period and names of assignees of certificate
owners, in which book the City Chamberlain shall., within five days
after a tax sale is held, enter the information required above. Said
book shall be open for inspection at all times when the City Chamber-
lain's office is open for business. If the owner of a tax certificate
transfers his interest therein, or his interest is transferred by
process of law or otherwise, the person or persons to whom the interes .
has been trarsferred shall furnish forthwith to the Ithaca. City Chambe
lain evidence of said transfer, whereupon notations shall be made in
the docket aforementioned by the City Chamberlain of the transfer. If
and when redemption has been made as provided herein, the City Chamber-
lain, by postcard directed to the owner of said certificate as his name
then appears on such docket book, shall give notice that redemption has
been made and that the money therefor is on deposit in the city
Chamberlain's office for the benefit of the said owner, whereupon, upon
surrender of the tax certificate by the owner indicated. by the City
Chamberlain shall draw a City of Ithaca voucher payable to the said
owner for the amount of redemption. No transfer in interest shall
affect the validity of the payment by the City of Ithaca. of the sum
received on redemption unless said transfer of interest has been
indicated upon the docket book herein before provided.
E. Purchase by City.
If there is no other bidder for any parcel of land duly advertised
and offered for sale pursuant to this section, it shall. be lawful for,
and the City of Ithaca, by the City Chamberlain or one of his deputies,
may bid in said parcel of land for the City of Ithaca pursuant to the
same rules and regulations as to docketing, redemption and tax deed as
herein provided.
F. Tax deed.

If no redemption has been effected. in. accordance with the pro-
visions of this section within one year from the date of such sales
the City Chamberlain, for an in behalf of the City of Ithaca, shall
execute and deliver to the owner of the tax certificate, as such name
appears upon the docket book, upon presentation of the certification
of tax sale, a tax deed to the interest called for in said. tax
certificate. If and when a tax deed be given in accordance with the
provisions of this section, there shall be duly conveyed to the
grantee therein named the interest in the real_ estate sold as specified
in said deed.
G. Death of owner, transfer of interest,
The death of the owner or a transfer of interest: at any time of
the property assessed and sold as provided herein shall in no way
invalidate any of the said proceedings.
H. Payment prior to tax sale.
The tax upon any property noticed for sale as provided herein
may be paid prior to the sale by paying to the City Chamberlain the
amount of said tax, with interest at six per cent, plus the expenses=
Of publication.
I. Affidavits.
The City Chamberlain shall secure and file in his office proper
affidavits of publication of notices of sale and affidavits of sales.
Section 2. This Local Law shall take effect immediately after
filing in the Office of the Secretary of State.

Resolution To Open Public Hearing

RESOLVED, That the Public Hearing to consider a local law deleting I,'
Section 1.3-a, Entitled "WARD BOUNDARIES UNTIL DECEMBER 31, 1975,
FOR SOLE AND LIMITED PURPOSE" and amending Section 1.3 of the City of
Ithaca Charter Entitled "WARD BOUNDARIES" and amending Section 2.6
Entitled "MAYOR, CITY JUDGE, ALDERMEN, ELECTION, TERMS OF OFFICE"

The following persons addressed the Council:
Mr. John Schmidt, 211 Auburn Street, suggested confining Fifth Ward
as outlined by Mayor Bordoni at a hearing in the public Library, and
in addition a division between Linn Street and University Avenue,
proceeding north to meet Lake Street at the bend below the Ithaca
Gun Co., and then north along Lake Street, thus creating another
natural boundary between the hill which is essentia.1.1y a portion of
Cornell University and the Fall Creek Area which is a. community area.
He feels it would also help to equalize the wards.
Mr. Leonard Ferris, 104 Short Street, spoke, supporting Mr. Schmidt,
and in addition suggested including both sides of Linn Street, none
of University Avenue, and tocmtinue the area at the lower part of
Lake Street in the area below the Ithaca Gun. Co. down to Fall Creek,
Mr. Ferris amended his suggestion to say that instead of having Fa.l_h
Creek the boundary line he suggested that the division would be in
the center of Lake Street with the east side of Lake Street to be
taken out of the Fifth Ward and the west side of Lake Street and
East Shore Drive to remain in the Fifth Ward,
Mr. Robert Wood, 210 Franklin Street, read the following -resolution
from the Fall Creek Civic Association;
"RESOLUTION ON REAPPORTIONMENT PASSED BY THE MALL CR.EEK.CTVTC
ASSOCIATION- -July 13, 1981
The Fall Creek Civic Association supports the Fifth Ward
boundaries as drawn in the "I -4- Modified Plan" for reapportionment,
proposed by the City of Ithaca, for the following reasons:
Cascadilla Creek forms a natural and accepted southern
boundary to the Fall Creek neighborhood,
Residents of the blocks between Cascadilla Creek and Mar 'hall
Street have long considered themselves part of the Fall Creek
neighborhood and have expressed a desire to be part of the
Fifth Ward.
The student dormitories that l.ould be added to the Fifth IVard
in the County's "I -9- Modified Plan" are not in keeping with
the existing character of the lard.
We strongly encourage the City and County to come to agreement
on a single rcapI)orti.oni «ent Ilan, to avoid .r.-o►ifusion for voters.
Finally, representatives of the Civic Association should
cornrnunicate this resolution to Corunon Council and the County Board
of Representatives.

Asst. City Attorney Nash requested that the aldermen read the
document and contact him with any corrections or changes which they
may have.
A casual unofficial vote was taken and all council members present
expressed support for the Plan 4- Modified.

PETITIONS AND HEARINGS BEFORE COUNCIL;
Mr, Leonard Ferris, 104 Short Street., requested the Council to direct
the Board of Public Works or the Charter and Ordinance Committee to
investigate a condition on Franklin Street whereby a non-profit.
property owner (Ithaca Zen) has enclosed the sidewalk right- of. -way by
fence which prohibits pedestrians from walking across the property,
Mayor Bordoni agreed, in the absence of Alderman Banfield, to take the
matter to the Board of Public Works for review.
