Association: Change to School Closings -- Alderman Gutenberger reported

PETITIONS AND HEARINGS OF PERSONS
Property Tax
Mary Jane Noble, 338 Spencer Road,

COMMUNICATIONS FROM THE MAYOR:
Mayor Bor oni announced the designation of the softball. fields
at Cass Park as Union Fields, a ceremony to take place in the Spring,
or at the beginning of the softball season. The designation. took place
as a result of the recommendation of the Ithaca Amateur Softball
Association's Board of Directors of February 2, 1981 and a resolution
of the Common Council of October 3, 1979.
CITY ATTORNEY'S REPORT:
City Attorney Shapiro referred to a packet from the Planning Department
to all aldermen with respect to the purchase of M.A.C. and said he had
been in contact with the school district staff.

RESOLVED, That the purchase of the G.I.A.C. be referred to the Budget
and Administration Committee.
Carried Unanimously
City Attorney Shapiro also reported that the two lawsuits with Cornell
University continue.
CITY CONTROLLER'S REPORT:
In response to Al erinan Saccucci who, at a previous meeting, requested
information relating to the unexpended lines in the 1980 budget and
relating ultimately to the amount of cash surplus remaining from opera-
tions in 1980, Dep. Controller Cafferillo reported that lie had prepared
a line -by -line itemization of those amounts. $72,076 represents the
results of operations for the fiscal year 1980. He said that the balance
of unexpended appropriations has no direct relationship to the fund
balance or to the available cash surplus; only to the result of opera-
tions- -the amount of revenues received in excess of the expenses incurred.
Alderman Saccucci requested that the surplus of $72,076 be used ex-
clusively to reduce taxes in 1981; Mr. Cafferillo reported that this has
already been done.
HUMAN SERVICES COMMITTEE:
A derman Schuler reported that the Work Plan for the Human Services
Committee for 1981 includes working toward the establishment of a
sobering up facility with Tompkins County, and asked the Council to
support the Human Services Committee's work toward this goal.

Resolution of Common Council introducing proposed changes to zoning map
and providing for public notice ana p>iblic hearing

BE IT RESOLVED, That Ordinance No. 81- entitled "An Ordinance amending
the Official Zoning Map of the City of Ithaca, New York" be, and it
hereby is, introduced before to -° Common Council of the City of Ithaca,
New York, and
BE IT FURTHER RESOLVED, That the Common Council shall hold a public hearing
in the matter of the adoption of the aforesaid ordinance, to be held in
Council Chambers, City [fall, 108 E. Green St. in the City of Ithaca, New
York on the 4th day of March, 1981 at 7:30 o'clock P.M., and
BE IT FURTHER RESOLVED, That the City Clerk give notice of such public
hearing by the publication of a notice in the official newspaper,
specifying the time when and the place where such public hearing will be
held, and in general terms describing the proposed ordinance; such notice
shall be published once at least fifteen days prior to the public hearing,
and

ORDINANCE NO. 81-
AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP OF THE CITY OF ITHACA,
NEW YORK.
BE IT ORDAINED AND ENACTED by the Common Council of the City of Ithaca,
New York, as follows:
SECTION 1, AMENDING ZONING MAP.
"1. That the Official Zoning Map of the City of Ithaca, New York,
as last amended, is hereby amended and changed so that the following
described area presently located in the R -3b Residential District is
reclassified and changed to the R -2b Residential District classification:
All that tract or area of land fronting on the west side of Linn Street
extending west approximately 140 feet to the present boundary between
R -21) and R -3b districts, and from the north bank of Cascadill.a Creek
beginning with premises known as 110 -112 Linn Street and extending
through premises known as No. 216 -218 Linn Street; and all that tract
or area of land fronting on the east side of Linn Street between Linn
and University Avenue, extending through property known as No. 128
University Avenue (Tax Map Parcel 47 -415) and thence north along the
present boundary between R -3b and R -3a districts, approximately 175 feet
east of Linn Street, including premises known as No. 115 through 219 Linn
Street."
2. That in accordance herewith the City Clerk is hereby directed to
make or cause to be made the necessary changes on said Zoning Map.
SECTION 2. EFFECTIVE DATE.
This ordinance shall take effect immediately and in accordance with law
upon publication of a notice as provided in 3.11(B) of the Ithaca City
Charter.

PLANNING AND DEVELOPMENT COMMMITTEE:
Solid IYaste Recycling Committee
Al erman Nichols reported on tie activities of the committee, commenting
that she had discussed recycling with Frank Liguori of the Tompkins
County Planning. There are three parts to the study being conducted:'
(1) study of burning trash (probably on the site of the old hospital)
(2) search for alternative landfills and (3) recycling, which was
assigned to the County Environmental Management Council and County
Planning Board.
Alderman Nichols reported having had discussions with Mrs. Raff_ensperge1

RESOLVED, That the Planning and Development Committee, during the month
of February, shall enlist the services of a representative group of citizens
to study recycling of solid waste materials on behalf of the City of Ithaca
and present the list of members to the Common Council at the March meeting.

Commons Advisory Board

BE IT RESOLVED, That the Commons Advisory Board is hereby requested to
consider the project of publishing 20,000 copies of a Tourist Guide to
the City of Ithaca and to advise and recommend concerning content:, design
and financing before March meeting of Common Council.

Transportation Operating Assistance

Gadabout Transfer

RESOLVED, That this Common Council approves the transfer of all
appropriated 1980 funds and the assignment of all approved 1981 funds to
Challenge Industries on behalf of the Gadabout Program upon the effective
date of transfer as requested by the Tompkins County Chapter, American
Red Cross.

Civil Service Agreement

RESOLVED, That the Mayor and City Clerk be authorized and directed to
execute the Agreement between the City of Ithaca and the Ithaca City
School District for performance by the City of certain services in
connection with Civil Service platters, in an amount not to exceed
$12,724.24, which is the School District's share of said services.

1979 which prohibits the hiring of any personnel, including part -time,
seasonal and contractual positions, and

of Common Council have the power to act for emergency hiring of
personnel, and
BE IT FURTHER RESOLVED, That this resolution will be in effect unt:ij
rescinded by Common Council.

RESOLVED, That pursuant to Section 25 of Article 2 of the Local Finance
Law of the State of New York, the City Controller is hereby authorized
to borrow money in the name of and on the credit of the City of Ithaca
for current City expenses normally paid out of State Aid Per Capita
Revenue, by the issuance of a negotiable note or notes in an amount not
to exceed $1,500,000, and that such note or notes shall be issued in
amounts as may be needed in anticipation of the receipts of State Aid
Per Capita for the current fiscal year 1981 with local banks, and
BE IT FURTHER RESOLVED, That the full faith and credit of the City of
Ithaca hereby are pledged for the payment of and retirement of such
temporary Revenue Anticipation Notes before the close of said fiscal
year.

Fire Department Purchase of Fire En ine

the Seagrave Fire Apparatus, Inc. for
fire engine, at a cost of $79,736, and
WHEREAS, the Board of Fire Commissioners, at the Regular meeting of.
January 13, 1981, voted unanimously be honored, contract as it is
apparent that the contract
WHEREAS, the Fire Chief has been authorized by the Fire Commissioners
to request that Council declare an emergency allowing the purchase of
a truck without having to go to bid;
NOW, FHEREFORE, BE IT RESOLVED, That this Common Council declares that
an emergency does exist and authorizes the Fire Chief to purchase a
fire engine without the necessity of advertising for bids, at a cost
not to exceed $68,000, and
BE IT FURTHER RESOLVED, That payment for this engine be made from
Capital Reserve #1S - Fire Engines.

Alderman Nichols reported that the committee have met and currently
have several historic projects on which they are working.

Human Services Coalition
Alderman Holman reported that the Coalition are working on the 1981
Work Plan on which several city projects are shown.
NEW BUSINESS:
License Fees

RESOLVED, That the charges made by the City for licenses and encroach-
ments be referred to the Budget and Administration Committee for review
and update.

Zoning Code

RESOLVED, That the Zoning Code be looked at in the area that sets up
the timetable for procedures to be followed in the filing of zoning
appeals and that this matter be referred to the Charter and Ordinance
Committee

Water Supply
Alderman Dennis reported receiving a call by a resident concerned with
the water supply of the City of Ithaca; Mayor BOrdoni responded that
he had attended meetings with Board of Representatives and Town of Ithaca
with respect to the water table. Long -range water supply will be
investigated over the next few years.
