Planning and Development Committee
Alderman Nichols requested that Item XIV(C) be moved up and acted upon;
the committee have worked on it and copies of pertinent material have

Alderman Nichols also reqeusted the addition of two items which have
been approved by the Board of Public Works and referred to the Council:
(1) adoption of resolution of City of Poughkeepsie requesting higher
State reimbursement for maintenance of arterial highways within
City Limits

Letter trijim Jean E. Dean Re: Traffic Belle Sherman Area
Mayor Bordoni read the following letter, copies of which had been given
all aldermen:
"May 28, 1930
Mr. Joseph A. Rundle, City Clerk
Dear Mr. Rundle:
We are concerned about the speed of the westbound traffic between Cob
Street and Elmwood. Often, drivers are unable to stop at the downhill
stop sign at the corner of Mitchell and Cornell Streets. This is the
four -way stop corner just above Belle Sherman Elementary School.
We wish to discuss this hazardous situation at the Common Council
meeting.on Wednesday, June 4, 1980.

Tompkins County Area Development Cor .
R. Davis Cutting representing the i.C..Area Development Corp. spoke to
the Council, requesting the City's continued financial support for the
corporation's work, and presented a 1979 -80 Report on Industrial
Development Activities and Goals. Discussion followed on the floor
concerning its role in the Cherry Street Park development. It was
agreed a meeting will be arranged with the T.C. Area Development Corp.
+o discuss the issue.
Alderman Boothroyd arrived at the meeting at 8:08 p.m.
Curb Cuts for the Handicapped
Mb. Al xe Leonar o, 104 Third Street, asked why no curb cuts have
been made on his street, even though they have been done in the neigh-
borhoods around his. Mayor Bordoni assured him they will be done in
his neighborhood in the Fall.
Conservation Advisory Council - W. Burbank
Chm. Burbank of the Conservation Advisory Council spoke briefly to the
Council giving an update on two projects the Council are working on:
a Bikeways Survey - -500 questionnaires are being distributed in the area
in order to get input for use in further development of the Bikeways;
and a tentative city's odd -even parking system study. Mr. Burbank
requested the Council to delay action on the ;.ssue until the study is
completed.

COMMUNICATIONS FROM THE MAYOR:
Affirmative Action
Alderman Saccucci asked Mayor Bordoni if the action taken by the Black
Caucus would have the effect of delaying the Ithaca Center project; lie
also asked if the CIty is following the right Affirmative Action Program.
Mayor Bordoni replied that the action by the Black Caucus might delay the
project, the report that was sent to Washington by the Black Caucus was
not accurate, and the City has the facts and figures to disprove it. In
addition, he said the City is following the right Affirmative Action
Program.
(400"" CITY CLERK'S REPORT:
City Clerk Rundle—reported that he had received a communication from the
Department of Agriculture and Markets regarding the dog fee structure.
fie requested that, if the Council intend to consider changing the dog
license rates this year, they give it some thought in the near future.
The Department of Agriculture and Markets will print the licenses for
Ithaca on a computer with the actual rates thereon, which will save the
Clerk's office a tremendous amount of work.

INTERGOVERNMENTAL RELATIONS COMMITTEE:
Upgraded Sewage Treatment Facility
Alderman Slattery presented a resolution recommended by the Sewer
System Planning Committee regarding the upgraded sewage treatment

h'1EREAS, the City_of"Ithaca is--currently completing a Facilities Plan
for an upgraded sewage treatment facility, and
WHEREAS, said plan outlines the elements of the proposed treatment
plant, including a sewer service area, and
WHEREAS, a Sewer System Planning Committee has been established by the
City of Ithaca, the Town of Ithaca, and the Town of Dryden (see resolu-
tions attached), and such Committee has already negotiated an agreement
on the financing of the Sewer System Evaluation Survey (.copy attached),
and said agreement has been adopted by the respective municipalities;
NOW, THEREFORE, BE IT RESOLVED, That it is agreed among the City of
Ithaca, the Town of Ithaca, and the Town of Dryden that it is their
joint intent that the proposed upgraded sewage treatment facility will
treat the sewage collected within the general limits of the afore-
mentioned sewer service area, and
BE IT FURTHER RESOLVED, That these three municipalities will continue
negotiations through the Sewer System Planning Committee with the in-
tention of --reaching an intermunicipal agreement, prior to the completion
(400.", of the design phase, with respect to the ownership, operation, and
financing of the proposed facilities, and
BE IT FURTHER RESOLVED, That such an agreement shall include a system
of equitable user charges and a comprehensive sewer use ordinance or
regulation which will provide for, among other things, such industrial
pre - treatment program and such industrial cost recovery as may be
required by U.S. Environmental Protection Agency regulations.

Motor -o erated Vehicle Ordinance

ORDINANCE NO. 80 -8
AN ORDINANCE ADDING CHAPTER 62 ENTITLED "MOTORCYCLES AND POWERED
VEHICLES" TO THE CITY OF ITHACA MUNICIPAL CODE.
BE IT ORDAINED AND ENACTED by the Common Council of the City of Ithaca,
New York, as follows:
Section 1. That a new Chapter to be known and designated as Chapter 62
entitled "Motorcycles and Powered Vehicles" is hereby added to the City
of Ithaca Municipal Code to read as follows:
CHAPTER 62
MOTORCYCLES AND POWERED VEHICLES
g 62.1 Title
This Chapter shall be known and may be cited as the City of Ithaca
"Motorcycle and Powered Vehicle Law."
g 62.2 Purpose
The purpose of this Chapter is to protect the public health, welfare
and safety by prohibiting the operation of motorcycles and other
powered vehicles off road on public property and by regulating the opera-
tion of motorcycles and other powered vehicles on private lands and
places in the City of Ithaca in a manner which will be compatible with
the use of such private lands, and which will promote the safe and proper
use of motorcycles and other powered vehicles for recreation and minimize
detrimental effects of such use on the environment.
g 62.3 Definitions
The following words shall have the meanings respectively ascribed to
them for purposes of this Chapter:
A. Motorcycle, a motor- driven vehicle having a seat or saddle for the
use of the rider and designed to travel with not more than three (3)
wheels in contact with the ground, but excluding a tractor.
B. Powered vehicle, a vehicle designed to carry one or :;,re persons,
operating on wheels and propelled by an internal combustion engine,
except, however, vehicles designed to be used for gardening, agriculture,
or lawn or property maintenance.
g 62.4 Operation of motorcycles prohibited
A. No person shall operate a motorcycle or powered vehicle on private
lands in the City of Ithaca at any time without the written consent of
the owner or other person legally in possession of said premises, unless
such consent is obviously implied by the nature of the premises (e.g.
parking lots to be used by the public).
B. No person shall operate a motorcycle or powered vehicle on any
off -road public property within the City of Ithaca at any time.

9 62.10 Offenses; penalties

Unless otherwise specifically provided by state statute, any person
who violates any provision of this Chapter shall be guilty of a mis-
demeanor and upon conviction subject to a fine of not more than One
Hundred Dollars ($100.00) or imprisonment not exceeding thirty (30)
days, or both.
Section 2. This ordinance shall take effect immediately and in
accordance with law upon publication of a notice as provided in
(awoeSection 3.11 (B) of the Ithaca City Charter.

Games of Chance Ordinance - -to be laid on table for July Council action

DATE: 2 June 1980
Please be advised that both the undersigned and Deputy Chief Walter
Pagliaro have reivewed the draft of the above mentioned ordinance that
you provided to me.

Initially it is our feeling that the City Judge, City Prosecutor
and the District Attorneys' office be requested to also review,
evaluate and respond to this particular ordinance prior to its possible
adoption. This will provide some unity, of all those bearing responsi-
bility within this ordinance, and further provide additional input to
the Charter and Ordinance Committee for their final evaluation.
Under Section 14.10, Subdivision #9, it is our feeling that
possibly allowing licenses twelve (12) time per year, to each and every
organization, for this type of an event, is somewhat excessive. A
reduction in the number of times a license can be issued in any calendar
year should be considered. Also within the same section, the ordinance
allows "Games of Chance" to be conducted to 2:00 A.M. on both Saturday
and Sunday. We feel that this will seriously conflict with our ability
to control ABC Violations, and that the hours should be ammended to read,
1:00 A.M. Saturday and Sundays.
Under Section 14.10 "Enforcement ", the ordinance stipulates that
the Police Department will exercise control and supervision of all
'Games of Chance ". It would be beneficial i the Charter and Ordinance
Committee could advise the undersigned exactly to what extent the
control and supervision was implied within this meaning. Obviously, it
would not be possible to provide personnel, under existing restraints,
for each and every Game conducted within the City, for its duration.

Weport on Odd -even Parking Ordinance
Alderman Slattery reported that the committee had invited the Supt.
of Public Works, Parking, Traffic and Transit Committee of BPW, Director
Van Cort, the Transportation Committee and the Planning & Development
Board to a meeting on May 19, 1980 in the Planning Office to review the
Odd -even Parking Ordinance. A resolution reaffirming the present ordi-
nance was prepared for presentation to Council for action; however, the
Environmental Commission requested that action be delayed on the issue
until they have completed a study on it.

RESOLVED, That the issues of Odd -even Parking, and Neighborhood Permit
Parking, be referred to the Environmental Commission for a report back
to the Charter and Ordinance Committee no later than September 1, 1980.

Transient Vendor Fine Schedule
Alderman Slattery reported that in discussion with City Judge Clynes,
it was the judge's feeling that the existing ordinance needs a lot of
work on it.

RESOLVED, That the Transient Vendor Ordinance be referred to City
Attorney Shapiro for review and report back to the Charter & Ordinance
Committee so that they in turn can make a recommendation to the Common
Council.

PLANNING AND DEVELOPMENT COMMITTEE:
County Transportation Commission Request for Resolution of Support
Alderman Nichols reported-that the Board of Public Works h endorsed
the County Transportation Commission's Resolution at its meeting on
May 28, 1980 and the Planning and Development Committee endorsed it
based on a couple of word changes.
RESOLUTION AUTHORIZING THE ITHACA- TOMPKINS COUNTY TRANSPORTATION
COMMISSION TO SPONSOR AND FILE APPLICATION TO FEDERAL AND STATE FUNDING
AGENCIES FOR FUNDING ASSISTANCE FOR RURAL /SUBURBAN TRANSPORTATION
DEMONSTRATION PROGRAMS FOR PERSONS COMMUTING TO WORK AND TO MANAGE SUCH
DEMONSTRATION PROGRAMS ON AN AD HOC BASIS

WHEREAS, the Ithaca- Tompkins County Transportation Commission is pre-
paring a project plan for increased opportunities for rural /suburban
transportation in Tompkins County, and
WHEREAS, the Commission has requested permission from the municipalities
which created the Commission to authorize the Commission to makd appli-
cation to Federal and State funding agencies to initiate a program for a
two- or three -year Rural /Suburban Transportation Demonstration Program
for persons commuting to work, and
WHEREAS, the Commission has agreed to submit the project plan to the
municipalities for review and comment prior to acceptance of any grant
offers from funding agencies, and that the individual municipalities
will be kept involved in the process to insure a unified cooperative
approach;
NOW, THEREFORE, BE IT RESOLVED, That the City of Ithaca does encourage
and authorize the Ithaca - Tompkins County Transportation Commission to
file application for funding assistance for said program and to general
administer, expend funds, and establish policy during the demonstration
period, keeping each municipality informed as to progress.

Guidelines for Site Selection for Subsidized Housing
Alderman Nichols reported that the committee have been working on rules
which will be available in the Planning Department for prospective
developers which will make the city's participation fairly clear. She
expects the guidelines will be available for a vote at the July meeting.

document, copies of which were given to each alderman. She reviewed
briefly the schedule.

Resolution Authorizing the Director of Plannin and Development To Seek
Increased State Aid to Cities or the Purpose of Maintainin Portions
o State Highways Inside—f—heCity of Ithaca

WHEREAS, the City of Ithaca maintains the state arterial highways in-
side the City, and
WHEREAS, the New York State Department of Transportation has recognized
that the current level of reimbursement (forty cents per square yard)
g is inadequate and has recommended an increase to seventy -five cents per
square yard; and
WHEREAS, the City of Ithaca Board of Public Works estimates that the
cost of maintaining the state arterial highways inside the City is
currently seventy -five cents per square yard and will increase by twenty -
five cents per square yard every five years;
NON, THEREFORE, BE IT RESOLVED, That the Director of Planning and Develop -!
ment of the City of Ithaca be authorized to request that New York State
Department of Transportation reimbursement to localities for maintaining
state arterial highways be increased from the present level of forty cents:
per square yard to one dollar and fifty cents per square yard.

Courtesy Tickets
Alderman Nichols reported that the committee has received a request, and
that Mayor Bordoni had received a request, to be heard before the com-
mittee takes a position in regard to courtesy tickets. She said the mat-
ter will be discussed at the next meeting of the committee on June 11,
1980.
Handicapped Accessibility to City Hall
Alderman Nichols reported that Herman Sieverding of the Planning Staff
has been working on this problem and has some additional material and
estimates which he will present to the committee at its next meeting on
June 11, 1980.

Centralized Purchasing
(Wwv'� Alderman Gutenberger announced that an informational meeting on
Centralized Purchasing will be held on June 24, 1980 at 7:00 p.m. in
the Central Fire Station.
Changes in 1980 Assessment Roll
722 -28 Nest Court Street

WHEREAS, the 1980 Tax Roll for the City of Ithaca included the property
known and numbered as 722 -28 Nest Court Street, owned by Louann Inc.,
IOS Cherry Street, and
IVIII:IZEAS, pursuant to Section SS4 (sub. 4A) of the Peal Property Tax Law,
the Director of Assessments has investigated in application for the
correction of an error in essential fact filed by said taxpayer, and

WHEREAS, said investigation revealed that the Board of Review determi-
nation was not entered in the computer file, and
WHEREAS, the Director of Assessment recommends that the assessed value
of 722 -28 West Court Street be changed from $79,000 to $71,100;
NOW, THEREFORE, BE IT RESOLVED, That the 1980 Tax Roll for the City of
Ithaca be amended to reduce the assessment of Tax Map 52 -3 -15, 722 -28
West Court Street, from $79,000 to $712100, and
BE IT FURTHER RESOLVED, That the City Chamberlain be authorized and
directed to make the appropriate changes in the Tax Roll and to prepai
a new tax bill for said property or make an appropriate refund if the
1980 City Taxes have been paid.

WHEREAS, the 1980 Tax Roll for the City of Ithaca included the property
known and numbered as 321 East Falls Street, owned by W. Tyler and
Elizabeth P. Reese, and
WHEREAS, pursuant to Section 554 (sub. 4A) of the Real Property Tax
Law, the Director of Assessments has investigated an application for
the correction of an error in essential fact filed by said taxpayer,
and
WIIEREAS, said investigation revealed that the Board of Review determina-
tion was not entered in the computer file, and
WHEREAS, the Director of Assessment recommends that the assessed value
of 321 East Falls Street be changed from $34,000 to $32,000;
NOW, THEREFORE, BE IT RESOLVED, That the 1980 Tax Roll for the City of
Ithaca be amended to reduce the assessment of Tax Map 12 -3 -8, 321 East
Falls Street, from $34,000 to $32,000, and
BE IT FURTHER RESOLVED, That the City Chamberlain be authorized and
directed to make the appropriate changes in the Tax Roll and to prepare
a new tax bill for said property or make an appropriate refund if the
1980 City Taxes have been paid.

WIIEREAS, the 1980 Tax Roll for the City of Ithaca included the property
known and numbered as 1314 East State Street, owned by Eileen Callinan,
and
W1111-REAS, pursuant to Section 554 (sub. 4A) of the Roal Property Tax Law,
the Director of Assessments has investigated an application for the
correction of an error in essential fact filed by said taxpayer, and
WIIEREAS, said investigation revealed that the Board of Review determina-

WIIEREAS, the Director of Assessment recommends that the assessed value
of 1314 East State Street be changed from $51,900 to $47,000;
NOW, THEREFORE, BE IT RESOLVED, That the 1980 Tax Roll for the City o

East State Street, from $51,900 to $47,000, and
BE IT FURTHER RESOLVED, That the City Chamberlain be authorized and
directed to make the appropriate changes in the Tax Roll and to prepare

1980 Cit Taxes Have been paid.

RESOLVED, That the Mayor and City Clerk are hereby authorized and
directed to execute an agreement with the Tompkins County Area Develop-
ment Corp. in the amount of $5,000 for funding of a half -time position.

RESOLVED, That the 1980 Authorized Equipment List for the Water and
Sewer Fund be amended by eliminating the purchase of a pavement breaker
at a cost of $1,200, and including the purchase of a concrete mixer
at a cost of $1, 740 as requested by the Board of Public Works, and
BE IT FURTHER RESOLVED, That the difference of $540 be transferred as
follows:

RESOLVED, That $6,000 be transferred from the Sewer Contingency G1990
to Sewage Treatment Plant G8150 -312 for replacement of Pump #3 in the
main pumping station.

Cass Park Dasher Boards Capital Project, Increase of Funds

WHEREAS, a capital project was established for the installation of
dasher boards at the Cass Park Ice Rink in the amount of $50,000, and
WHEREAS, after review of the bids by the City Engineer, it was the
consensus of the Board of Public Works that said project would cost
$70,575;

1981 Revenue Sharing Requests

WHEREAS, the City of Ithaca has set a deadline for receiving Revenue
Sharing Applications for July 1, 1980, and
WHEREAS, due to the anticipated budget constraints for the year 1981,
it is questionable that the City will be able to appropriate any Revenue
Sharing Funds to Human Services providers, and
WHEREAS, this Common Council does not want to exclude the possibility
of a Human Service provider having a unique idea that, if funded
through Revenue Sharing, would directly result in a savings of dollars;
NOW, THEREFORE, BE IT RESOLVED, That the City of Ithaca will receive
applications for Revenue Sharing Funds for 1981 provided the applica-
tions conform to the following criteria:
1. The proposal must be for something that is unique (not
the traditional capital investments or staff positions).
2. The proposal must clearly indicate how a savings would
result from its implementation.
3. The proposal must meet all criteria for Revenue Sharing.

City Contribution to Gadabout

WHEREAS, the City of Ithaca has set aside $11,000 for transportation
service to the disabled community, and
WHEREAS, Gadabout now has in place a system with the capability of pro-
viding transportation service to the disabled, and
WHEREAS, a program has been developed between the City and Gadabout
whereby Gadabout would provide additional transportation service to
the disabled in addition to purchasing an additional lift - equipped
van with this allocation, and
WHEREAS, the terms of this program are subject to approval by the Red
Cross Board of Directors and the execution of a contract between the
City and the Tompkins County Red Cross;
NOW, THEREFORE, BE IT RESOLVED, That further action on this arrangement
with Gadabout be referred to Budget and Administration Committee with
the power to act pending approval by the Red Cross Board of Directors
and execution of a contract between the City and Tompkins County Red
Cross.

Amendment to 1980 Tax Roll

WHEREAS, the 1980 Tax Roll for the City of Ithaca included 169 parcels
of property having an exemption for the aged, and
WHEREAS, pursuant to Section 5S4 (sub. 4A) of the Real Property Tax
Law, the Director of Assessments has investigated and determined that
an error in essential fact exists, and
WHEREAS, said investigation revealed that the exemption for the aged
was improperly calculated, and
WHEREAS, the Director of Assessments recommends that the total assessed
value of the 169 parcels be changed from $2,924,875 to $2,484,975;
NOW, THEREFORE, BE IT RESOLVED, That the 1980 Tax Roll for the City of
Ithaca be amended to reduce the total assessment of the 169 parcels from
$2,924,875 to $2,484,975, and
BE IT FURTHER RESOLVED, That the City Chamberlain be authorized and
directed to make the appropriate changes in the Tax Roll and to prepare
a new tax bill for said properties or make an appropriate refund if the
1980 City Taxes have been paid.

informational letter with the corrected 1980 City Tax bills being sent
to those taxpayers claiming exemption for the aged, and
WHEREAS, it is necessary for Common Council to approve all enclosures
for tax bills;
NOW, TFIFREFORE BE IT RESOLVED, That this Common Council authorizes the
enclosure of the City Chamberlain's informational letter with the
corrected 1980 City Tax bills.

CITY OF ITHACA
A LOCAL LAW AMENDING SECTION 2.23 OF THE CITY OF ITHACA CHARTER
ENTITLED "ASSISTANTS AND DEPUTIES" HERE ALSO PROVIDING ADDITIONALLY
FOR THE POSITION OF DEPUTY CITY CONTROLLER
BE IT ENACTED by the Common Council of the City of Ithaca, New York
as follows:
SECTION 1. Amending Section 2.23 of the City of Ithaca. Charter
entitled "Assistants and Deputies" for the position of
Deputy City Controller.
1. That Section 2.23 of the City of Ithaca Charter entitled
"Assistants and Deputies" is hereby amended to read as follows:
"Section 2.23 Assistants and Deputies
1. The Common Council may create, establish or abolish the offices of
deputy city controller, the assistant city controller and deputy city
chamberlain. Such officers shall generally assist their superiors in
the execution of their powers and duties and may perform such part or
portion of such duties as designated by such superiors; and in the
absence, inability temporary lo their ree superiors,
to act as such when so shalhaveall thpowersosuch
office.
2. The deputy city controller, the assistant. city controller and
deputy city chamberlain shall be appointed, removed in the same manner
and serve for the same terms as their superiors.
3. The deputy city clerk shall generally assist the city clerk in thr
execution of his duties and may perform such part or portion of such
duties as designated by the city clerk; and in tiie absence, inability
or temporary vacancy of the city clerk, to act as such and when so
acting, shall have all the powers of same."
SECTION 2. EFFECTIVE DATE.
This local law shall take effect immediately upon filing
in the office of the Secretary of State.

Alderman Holman report� tiat the Tompkins County Chamber of Commerce
had forwarded a copy of the Tompkins County Travel Guide to the City
for approval before printing. She commented that the guide does a
better job of highlighting the city this year than before.

Petition regarding truck traffic
Alderman Saccucci reported receiving calls from constituents on Cliff
Street asking him to relay to Alderman Dennis the following message in
reference to a petition of over 1,000 signatures for DoT concerning
trucks going through East Hill, which is to be forwarded to NYSDoT:
"the same trucks that go through East Hill go through Cliff Street
first."
Alderman Holman explained to Alderman Saccucci that, due to lack of a
civic organization on East Hill, the petitions were distributed city.-
wide, and that all groups should join forces and bring the problem
before the Council.
Wave
Mayor Bordoni commented that the petition deals specifically with
State Street and Route 79 truck traffic.
Charter & Ordinance Meeting
Alderman Slattery announced that the Charter $ Ordinance Committee will
meet on Monday, June 23, 1980 at 7:30 p.m. in the Council Chambers. He
invited all aldermen to be present to review the Games of Chance
Ordinance.
Moratorium on Liquor Licenses
Alderman Slattery presented the following resolution:

December 31, 1980.
Alderman Boothroyd objected to action on the resolution because the
item had not appeared on the agenda; therefore Alderman Slattery

Ithaca College Baseball Team

WHEREAS, the Ithaca College Baseball Team has earned national recogni-
tion for the players, their College, and the community, and
WHEREAS, the players and coaching staff demonstrated their excellence
by winning the national championship in a double elimination contest
after overcoming a first round defeat, and
WHEREAS, their athletic skills have gained for them the National
Championship in Division 3 of the National Collegiate Athletic Associa-
tion, and
WHEREAS, they have shown themselves to be true champions, both on and
off the playing field, and
WHEREAS, this 1980 championship baseball team continues a tradition
of excellence and community pride;
BE IT RESOLVED, That this Common Council, on behalf of all the residents
of the City of Ithaca, offers its sincere congratulations to National
Champion Coach George Valsente, the coaching staff, and the players who
have kepi; Ithaca a synonym for quality and excellence, and
BE IT FURTHER RESOLVED, That the Ithaca College baseball team be and
hereby are, honorary citizens of the City of Ithaca.

NCAA LaCrosse Championship
Alderman Dennis noted that Richie Moran of the Cornell University
Athletic Department, Who serves on the City Planning & Development
Board, had done a magnificent job in organization and bringing the NCAA
LaCrosse Championship to Ithaca, New York. Mayor Bordoni directed that
a letter of commendation be drafted to Mr. Moran and a copy sent to
Cornell University.
