TAXI ORDINANCE Alderman Perry presented a draft of a proposed amendment 77ho taxi ordinance and Attorney Powers explained the changes from the old ordinance. A number of taxi operators were present, and after discussion, it was agreed that the proposed ordinance does not adequately cover local conditions and it was moved By Alderman Gibb, seconded by Alderman Morris : Resolved, that the ordinance be referred back to the Charter and Ordinance Com.iii.ttee for further study and recommendation. } Carried. MAYORtS REPORT Mayor Comfort thanked the Council for its fine cooperation during the past year and stated that during the year ::head, continued cooperation of all departments will be required to maintain city services at their present level. APi'OINTMENT CITY CHAMBERLAIN Mayor Comfort announced that it ,could be in or 7or at this time for the Council to appoint a City Chamberlain in accordance with provisions of the City Charter By Alderman Perry, seconded by Alderman Morris: Resolved, that C. Pursuar:i.t to the authority granted by section twenty-b of the general c _ty law of the State of New York, a tax equal to one per centum of ii7 gross income for the period from July first, nineteen hundred thirty-seven to June thirtieth, nineteen hundred forty-six, is hereby imposed upon every utility doing business in the City of Ithaca which is subject to the supervision of the state dopar,�- -ment of public service, which has a gross income for the "o. m..onths ending May thirty-first in excess of five hundred doll aY s except motor carriers or brokers subject to such supervisicr article three-b of the public service law and a tax equal to per centum of its gross operating income is hereby imposed for the same period upon every other utility doing business in the City of Ithaca which has a gross operating income for the twelve- months ending May thirty-first in excess of five hundred dollars which taxes shall have application only within the territorial limits of the City of Ithaca, and shall be in addition to any an, all other taxes and fees imposed by any other provision of law for the same period. Such taxes shall not be imposed on any t-ai saction originating or consummated outside of the territorial limits of the City of Ithaca, notwithstanding that some act be necessarily performed with rest ct to such transaction within such limits. 4. Council Proceedings -2- June 6,, 1945 LOCAL LAW - 1% LOCAL UTILITY TAX The Clerk reported that it would be in order to act on the proposed Local Law continuing -the 1 tax on corporations which was tabled at the Meeting held May 2. 1945, A LOCAL LAW to amend local law number 2 of the City of- Ithaca for the year nineteen hundred thirty-seven, as amended, in re- lation to continuing the tax on gross incomes or gross oper- ating incomes of corporations and persons furnishing utility services in the City of Ithaca, as authorized by section twenty- b of the general city law of the State of New York, By Alderman Gibb; seconded by Alderman Slocum BE IT ENACTED BY THE COMMON COUNCIL OF THE CITY OF ITHACA AS FOLLOWS: Section 1. Sections one and four of local law number 2 for the year nineteen hundred thirty-seven as last amended., are hereby "a- mended to read as follows: Section 1. Tax on the furnishing of utility services. Pursuant to the authority granted by section twenty-b of the general city law of the State of New York, a tax equal to one per centum of its gross income for the period from July first, nineteen hundred thlty- seven to June thirtieth, nineteen hundred forty-six, is hereby im- posed upon every utility doing business in the City of Ithaca which is subject to the supervision of the state department of public service, which has a gross income for the twelve months ending Mays '-h.irty-first in excess of five hundred dollars except motor carrier, or brokers subject to such supervision under article three-b of the public service law and a tax equal to one per centum of its gross operating income is hereby imposed for the same period upon every other utility doing business in the City of Ithaca which has a gross operating income for the twelve months ending May thirty-first in excess of five hundred dollars which taxes shall have applicatior only within the territorial limits of the City of Ithaca, and shall be in addition to any and all other taxes and fees imposed by any other provision of law for the same period. Such taxes shall not be imposed on any transaction originating or consummated outside of the territorial limits of the City of Ithaca, notwithstanding that some act be necessarily performed with respect to such transaction within such limits. 4, Every utility subject to tax hereunder shall file, on or before September twenty-fifth, December twenty-fifth, March twenty-fifth, and June twenty-fifth, a return for the three calendar months pre- coeding each such return date including any period for which the tax imposed hereby or by any amendment hereof is effective, each of which returns shall state the gross income or gross cperating in- come for the: period covered by each such return.
