PURPOSE OF MEETIDTG The Mayor announced the meeting was called to
appoint an acting City Judge, since City Judge elect Mintz is unable;
to assume his duties due to illness.
The Mayor announced the nomination of Harold E. Simpson as act-
ing City Judge and it- was regularly moved seconded and carried that
nominations be closed,
By Alderman Gillette, seconded by Alderman Bangs;
Resolved, that the nomination of Harold E. Simpson be and hereby
is approved, and
BE IT FURTHER RESOLVED that he be appointed to the position of
Acting City Judge for the period of one year.
Unanimously carried and approved.

This is a report on the activities of the City Government of
Ithaca durin, !• the past two years, Its purpose is to summarize
so.-tie of the peculiar and unusual probleias we have faced and our

over to Captain John F. McCarthy w1io, with Common Council ap-

carried on the wore with marked success in spite of such dif-
ficulties as waninZ interest among volinntear personnel, com-
plicated and publicly unpalatable rules and directions froh,

Salva,,r-e lias 1�een one of our bir `obs. The city has co-
operated fully in t.h.e salva�e pro:,ra:ms. Our rail re.,rjoval from
L-ddy, Tio,:>a,. ax,-,d Efate streets and the scrappin of the old
street railip.4, brid8e over Fall Creak contributed 352 tons of
scrap metal. C;Ur cit-v trucks have collected salva3ed tin and
other metals at the tLme of the periodic drives. This work is
of the 6.poatest ii.,:z portance to tlne war effort. It is continuing;
under the leadersi-iii) of Adios A. Barns, a former me.mber of tfIiis'-'
Council, ;;W io is spending, a Great deal of time and effort through-
out the city in encouraSing, t10'a salva,,.--e of scrap -_,,aetal, i;a.,)er
fats, clo-bill: -'s etc.
Under the successful leadership of Mrs, Flexner, Mrs.
MacDaniels and now Mrs. R. C. Osborn, the varried activities
of the Community War Services section and the Volunteer Office
have gone forward. While the activitiep of these sections are
not as tangable as those of Civilian Protection, they are never-
theless important, including recreation, welfare, hedlth and
several other programs.
One of the most serious effects of the war on City Govern-
ment was the freezing of building material end equipment and
the prohibition on new construction. With new construction
impossible for the duration, maintenance costs on worn out
streets, bridges, and equipment has increditably increased.
In order to pve*ent a disasterous period of borrowing after the
war, the city has embarked upon a very complete program of post
war planning. This council has wisely set up 5 reserve funds
for the Buffalo Street bridge, the reconstruction of No. 6 fire
station, street paving generallybridge construction generally,
and purchase of Public Works equipment. These reserve funds now
total $211,876. I believe we all agree that thio is said pro-
cedure and that additional funds should be set asaide to as great
an amount as may be possible within the limits of sensible
budgets practices. These reserves will be of great benefit when
construction again becomes possible and in addition may enable
us to absorb part of the unemployment that may follow the close
of war production.
In addition, we are now engaged in the preparation of post-
war plans for 7 of our older bridges. Preliminary plans are now
being prepared with the assistance of a state grant of $1800.
under the State Postwar Planning Commission.
Other plans are under way and city Engineer Leon Case has
forwarded considerable material to the State Commission, whose
officers have praised the work done by Ithaca in postwar planning..
Under the direction of City Engineer Cass, the City has
elven very serious consideration to the construction of equip-
ment and materials. All Public Works trucks not absolutely
essential to efficient operation have been put up. Under a
careful program of mileage conservation, Mr. Cass has reduced
city truck mileage to miles from miles in normal
years to and gasoline consumption to gal from
gal. in 1941. This is in connection with the saving of equip-
ment and tires, It has been accomplished by careful attention
to truck routing, consolidating service calls, etc.
8eginninr in January of 1943, we were faced with a serious
flood condition in the north end of the city resulting from an
ice jam in Fall Creek. This Council, in a special emergency
meeting, authorized them use of city employees and equipment
in pumping out flooded cellars and private homes. Manu of our
Public Works officials and employees spent long overtime hours
in pumping and blasting ice, Although it appeared that the
difficulty was caused by an unusual combination of high lake
level and low temperature bheher than the condition of the creek
bed, it did appear after a careful survey, the City Engineer
that considerable improvement in the Fall Creek chanel Gould be
made.With the cooperation of Gov, Dewey and the State Dept. of
Public t°iorks, the services of a state dredge were secured and
the mouth of Fall Creek was opened from the Waite boathouse out
to deep water in the lake. In addition, considerable chanel
work was done by our own forces in the creek proper, including
the removal of trees, stumps, gravel and other obstacles.
The Fall Creek flood again emphtaized the importance of the
lake level problem which has plagued city administrations for
years. The City Engineer and Mayor discussed this problem generally
and in great detail with the Governor and State Dept. of Public
Works and were given assurance that treater care would be taken
by the state in the matter of lake level control.
During the past year four deaths have occurred in our
official faAly. Chief Rielly died on Nov. 16. , Sam Norton
and Roy Hopper* both members of the Board of Public Works,
died in the month of September and Roy Halvorson, who resigned
from the Board to enter the Army was killed in action in the
South Pacific, All of these men will be missed from public
service and from the life of the cormnunity.
What the next two years may brine forth, I am sure none
of us can foretell. We will continue to have difficulties
with man powers our public works and equipment will continue
to deteriorate. We will have biggerobs to do and fewer and
poorer tools with which to do them, Fortunately, we have at
the head of every department an experienced man upon whose
reaouroetulneas we *an rely to Darr us through. Perhaps the
war will end and we will be faced with the problem of rbgearing
our activities to peace time routines,; Perhaps we will be faced
with unemployment and relief problems, Whatever the case may
be, we can be certain that the next two years will produce their
share of headaches and hardwork. Be that as it may, T look
forward to the next two years with complete confidence that we
will contin*e to give public service perhaps not on a grand
scale and perhaps with delays now and then, but service that at
least will protect the health, welfare and safety of our com-
munity and carry us through until such time as we can return to
normal.
I am very grateful for the unfailing cooperation of the
departments of City government and to the head and able work of
our many city officials who serve the people of Ithaca without
compensation, My confidence in the future is based in no small
part on the assurance that this cooperation and effort will
continue,

OF THE CITY OF ITHACA, THEIR POWERS AND DUTIES

Be it enacted by the Common Council of the City of Ithaca as
follows .-
Section 1. Section 19 of the Ithaca City Charter, being
Chapter 503 of the Laws of 1908, as last amended by Chapter 387 of
the Laws of 1920, is hereby amended to read as follows :
Assessor and associate assessors; their powers and duties.
The assessors in office when this act goes into effect shall serve
during the remainder of the term for which they were appointed. �
Thereafter as their several terms expire, successors shall be ap-
pointed to serve for the regular term of three years. The asso-
ciate assessors shall not at any time both belong to the same po-
litical party. It shall be the duty of the assessor with the aid
of the associate assessors to prepare and file with the city clerk
on or before the first day of idiarch in each year, an assessment-
roll of all the taxable and exempt real property in said city.
Upon completion of said roll, the assessor shall give notice of
the time and place when and where the assessor and associate
assessors will sit for hearing grievances and reviewing the assess-
ments therein, and such grievance day shall not be later than the
fifteenth day of March in each year. Such notice shall be pub-
lished at least three times in the official newspaper designated
pursuant to Section 232, and shall also be posted in twenty public
and conspicuous places in the City of Ithaca at least ten days be-
fore the day specified t'-ierein. The assessment-roll, after such
hearing and review, shall be completed, certified and filed with
the clerk of the said city on or before tho twenty-fourth day of
April in each year. The assessor shall possess all the powers
and authority of town assessors and be governed by the general
statutes relating thereto so far as applicable. He shall perform
the duties required of him in relation to the assessment of prop-
erty in the city for the purposes of levying taxes imposed either
under the provisions of this act or by the board of supervisors
of Tompkins County. He shall make four copies, of the assessment-
roll, one of which shall be kept in his officef one furnished to
the city chamberlain for the collection of city taxes, one fur-
nished to the board of supervisors for the collection of state and
county taxes and one furnished to the board of education for the
collection of school taxes. The associate assessors shall assist
the assessor in the preparation of the assessment-roll and shall
act with the assessor as a board of revision$ equalization and
grievance, each to have equal power with the assessor in altering
and changing assessments by a majority vote.
The salary of the assessors and the terms of payment shall be
fixed by the common councilo
Section 2. This Local Law shall take effect immediately.

CONTRACT FOR FIRE PROTECTION - CAYUGA HEIGHTS Attorney Powers pre-
sented a proposed contract a copy of which is herewith appended)
with the village of Cayuga Heights, for fire protection in that '
village.
He stated that a similar agreement was in effect until recently,
and as a result of its cancellation the Fire Underwriters have
charged the village from B to C class which considerably increases
the rate for insurance.
He stated that the proposed contract has been approved by the
officials of the village and must be approved and executed by the
Board of Fire Corffiaissioners and approved by the Common Council,

the expenses of coal coordinator which sum shall be paid to said

APPROPRIATION TO BRIDGE DESIGN ACCOUNT The Clerk reported that the
bridge engineers have requested thattest borings be made at the site
of the State Street bridge over the Inlet and at the Lake Street -
bridge over Fall Creek, and the Board of Public Works at a meeting
held Janun 26 3944, requested the Common Council to appropriate
the sum of '; 1506 for this purpose,

CAPITAL RESERVE FUND AUTHORIZED - WATER AND SEWER DEPT. The Clerk
reported that at a meeting held January 26, 1944, the Board of Public
Works unanimously adopt a resolution requesting the Common Council
to set up a capital reserve fund for the construction, reconstruction
or acquisition of capital improvements in the Water and Sewer
system in the City of Ithaca and authorize the Board of Public

Works to appropriate the sum of $302000 thereto together with such
additional funds as from time to time may become available , said
fund to be made available upon request of the Board at such time as
, such improvements become necessary and possible,

WHEREAS the Board of Public Works of the City of Ithaca has
reque:5ted this Common Council to establish a Capital Reserve fund
for the constructions reconstruction or acquisition of capital
improvements in the water and sewer system of the City of Ithaca,
and has certified that it has available for appropriation to such
fund the sum of `,,30,000.00 as a cash surplus accumulated largely
by reason of the inability of the department to make such improve-
ments during the emergency period, and
WHEREAS it appears that there is a considerable amount of
construction and reconstruction of capital improvements in the sewer
and water system that are necessary or will become necessary in the
future, which cannot now be completed and must be postponed and
deferred until the end of the present emergency by reason of short-
age of materials and labor, and
'VVTIEREAS at the end of such emergency there will or may exist
an acute need for this type of capital improvement, and
ViTIEREAS it appears desirable in the interest of sound economy
and for the purpose of avoiding the necessity of issuing bonds and
incurring expense and interest obligations at such time as this
type of improvement may be possible, to establish a Capital Resorve
Fund for such purpose.
NOW THEREFORE BE IT RESOLVED, pursuant to Section 6c of the
General Municipal Law of the State of New York:
1. That there be and hereby is established a Capital Reserve
Fund for the construction, reconstruction or acquisition of a type
of capital improvement, to wit, capital improvement in the sewer and
water system of the City of Ithaca, which fund shall be known and
designated as ''City of Ithaca, Capiial Reserve Fund No. 6, Sewer
and -Water"s which fund may be referred to as "Capital Reserve Fund
No. 6".
2. That the Board of Public Works be - and hereby is authorized
to appropriate to such fund the sum of �$300000.00 now available
for such purposes together with such other sums as may hereafter
become available and as may be appropriated thereto by said Board.
3. That the City Clerk be and he hereby is directed to de-
posit such funds as soon as monies thorefor may be made avail-
able upon appropriation of the Board of Public Works, together with
such other amounts assaid Board may appropriate to such fund from
time to times in one or more of the banks or trust companies de-
signated as depositories of the funds of the City of Ithaca; the
money in such fund so deposited shall be kopt in a separate bank
account.
4. That the City Clerk be and he hereby is authorized to in-
vest the monies in such fund in the obligations of the State of
New York or of the Federal Government in such manner and at such
times as may from time to time be determined by this Council; any
interest earned or capital gains realized on the monies so deposited
or invested shall accrue to and become a part of such fund, and the
separate identity of such fund shall be maintained, whether its
assUts consist of cash or investments or both.
5. That the City Clerk shall keep a separate account of the
fund hereby established in tho manner provided by Section 6c Par.
10 of the General ;:Municipal Law of the State; of New York. s
6. That expenditures shall be made from such fund only by
requisition by the Board of Public Works and authorization by this
Council and for a specific capital improvement of tho type for
which this fund is created, viz. construction, reconstruction or
'equisition of improvements in the sewer and water system of the
"ity of Ithaca.

The claiment alleged that on December 16, 1943 she suffered a
fracture of the left leg when she fell due to an icy condition of
the sidewalk at the bus terminal in East Green Street.
A letter from the manager of the bus terminal was presented
stating that every precaution is taken at all times to ke;;p the
walksin the vacinity of the bus terminal in good condition and that
the walks were cleaned and salt applied at various intervals during

AUCTION SALE -- CITY PROPERTY Attorney Powers explained that in
1935 the Welfare Department took a mortgage on property owned by
Charles K9 Tarr at 423 E. Lincoln St. , ' and in November 1940 ac-
quired the property at a City Tax Sale, and that on September 21,
1942, the same property was conveyed to John H. Post as director
of Public Welfare of the City of Ithaca by the treasurer of Tompkins
County.
He stated that the property is not needed or desired for city
purposes and since an offer has been received for the property
that it should be sold at public auction after which a valid con-
veyance may be given and it was moved,

on Monday, February 14th and my absence from the city will auto-
matically create a vacancy in the post.
I wish you all the best of luck and I will miss the association of
a fine group of men.

serve for the remainder of the year 1944.

Assessor Thorne went to Albany for a hearing to be held on Feb. 29
and March 1 on proposed legislation authorizing review of assess-
mentsby the State and that the trip should be approved by the Council,

ASSESSORS TRAINING SCHOOL-ALBANY N.Y. The Clerk reported that a
school for assessors is to be held in Albany during March on a date
uncertain at this time, and that Assessor Thorne has request per-
mission to attend this school together with one associate assessor,

APPROPRIATION TO WELFARE DEPARTMENT The Clerk reported that the
former Charles K. Tarr property at 425 E. Lincoln St., the sale of
which was authorized at the Council meeting held February 2, 1944s
was sold to John H. Post as director of Public Welfare for the sum
of $850 which has been paid into the general fund, and that a
similar sum should be appropriated to the Welfare Department ,

REVIEW OF RENTALS AT BUS TERMINAL Alderman Gillette suggested that
a review of rentals charged at the bus terminal might be in order
since the Greyhound Lines are acquiring other lines and the Clerk
was directed to bring the matter to the attention of the Board of
Public Works.
SUNDAY MOVIES Mayor Comfort reported receipt of a request from a
theater company for permission tb run a mid-night show on Saturday.
He stated that the proceeds of the show are to go to the Red
Cross. Attorney Powers called attention to a State Law as well as
a local ordinance which prohibits shows of any kind before 2 P.M.
on Sundays, and it was agreed that permission could not be given. >

The Mayor welcomed Hugh G. Slocum as the new member of the
Common Council.
HEARING ON CENTRAL GREYHOUND LINES PETITION Mayor Comfort opened
tip; public hearing duly advertised for this time, to hear any per-
son interested in the petition filed at the Common- Council meeting
held. ',,larch 1, 1944,, by the Central Greyhound Lines, Inc. of New
Yo:ok, for consent of the local authorities for the operation of an
omnibus line upon certain streets in the city, and a transfer of
the franchise now held by Stanley J. Mekos to the Central Greyhound
Lines, Inc.
No one appeared in opposition to the petition and the Mayor
declared the hearing closed, and it was moved,

Resolved, that the City of Ithaca, hereby consents to the
assignment of the franchise granted to Stanley J. Mekos, to operate
upon certain streets in the City of Ithaca, N.Y. to the Central
Greyhound Lines, Inc. , of- New York and that the said franchise of
the said Stanley J. Mekos, be assigned to Central Greyhound Lines,
Inc. , of New York$ upon all the terms and conditions contained in
the said franchise of the said Stanley J. Mekos, heretof ore granted
by the- City of Ithaca, N.Y. to Stanley J. Mekos on the second day
of May, 1934.

heretofore on the 11th day of February 1944, make application to

petition in writing praying for consent- or permission of the said
local authorities of the City of Ithaca,, N.Y. to establish and
operate a motor vehicle line or route upon and along the highways,
streets or avenues of the City of Ithaca, Tompkins County, State
of New York,, for the purpose of obtaining- a motor vehicle lino be-
twoon the City of Ithaca, Tompkins County, N.Y. and the City of
Elmira, Chemu.ng County, N.Y. thru the Village of West Danby, Spencer,,
Van Etten, Swartwood, Erin, Breesport, Horsoheads, and Elmira
H(;ights, and to and from the points in each of them for the trans-
portation of' persons and property for corlpensation, and,
W-HEREASS the said Mayor and Council of the City of Ithaca, N.Y.
did receive the said petition and place the same on file and did
thereafter by resolution duly adopted, order and direct that a
public hearing upon said petition be held as required by law on the
5th day of April 1944, at 5:00 o' clock P.M# at the Council Chambers
in tho City-Hall at the City of Ithaca, N.Y. , and,
VFHEREAS,, it appears from said petition that the Central Grcy-
Hound Lines, Inc. , of New York is purchasing, the operating rights
for the aforesaid route from Stanley J. Mekos, doing business as

Ithaca, N.Y. convening at the regular session the 5th day of April

issue; and does hereby grant and issue to the said Central Grey-
hound Lines, Ina. of New York, consent or permission to operate
rotor vehicles for the transportation of persons and property for
compensation upon and along the followin- highways, streets, and
avunu3s of the said City of Ithaca, N.Y.
Entering the City of Ithaca, N.Y. from Elmira, N.Y. on Albany
Street, and continuing on Albany Street to State Street; thence on
State Street to Tioga Street; thence on Tioga Street to Greene
Street; thence on Greene Street to the (Municipal Bus Terminal,
leaving the City of Ithaca from the P,lunicipal Bus Terminal on
Greene Street to Albany Street; then on Albany Street to City line.
upon the following terms and conditions;
1. ) That the Central Greyhound Lincs, Inc. of New York shall
provide motor vehicles sufficient in capacity and number to reason-
ably accommodate the traveling public in and out of the City of
Ithaca, N,Y. and along the said motor vehicle line or route.

c.,mply with all provisions of the Laws of the State of New
Yo,:,k applicable thereto and with all laws and ordinances of the

5.. ) That the said Central Greyhound Lines, Inc. of New York
shy != obey and observe each and every condition of this consent to
ic:s full intent and meaning.
4, ) That the said Central Greyhound Lines, Inc. of New York
shall comply with all rules and regulations of tho Public Service
C,mr liission of the State of New York.
5. ) That the said Central Greyhound Lines, Inc. of New York
shall promptly- pay to the said City of Ithaca, N.Y. for any damages
to the highway, guard rails or bridges occasioned by the said
Central Greyhound Lines, Inc. of New York, its agents, servants and
employees, which shall occur by reason of the granting of this con-
sent, ordinary wear and tear excepted.
6. ) That in tho event any damages shall be caused to the said
City of Ithaca, N.Y. of any kind, name or nature in addition to
damages to the highway, guard rails or bridges, as hereinabove
provided, by reason of any neglect or fault of the said Central
Greyhound Lines., Inc. of New York, or its agents, servants or em-
ployees, the said Central Greyhound Lines, Inc. of New York shall
compensate the said City of Ithaca, N.Y. to the amount and to the
extent of such damages and the expenses, in connection therewith
and shall save the City of Ithaca, N.Y. , harmless on account thereof.
7. ) That the said Central Greyhound Lines, Inc. of New York
shall make all reasonable effort to maintain and operate said motor
vehicle line or route in all seasons of the year.
8. ) That this franchise and consent shall continue for ton (10)
7oars from the data of its approval by the Public Service- Commission
of the State of Now York and from year to year tharcafter, unless
rc,,, oked for cause.
9. ) That this consent may be revoked for cause after a hearing
and after ten days ' notice in writing thereof to be given to the
said Central Greyhound Lines, Inc. of Now York, and such notice may
be given by mailing a copy thereof addressed to the said Central
Greyhound Lines, Inc. of New York at its last known place of business.
10. ) That the Central Greyhound Lines, Inc, of New York shall at
all times comply with the Laws of the State of Now York in regard
to financial responsibility and insurance against any and all losses
which may arise from personal injury, or property damage.
11. ) That the Central Greyhound Lines, Inc. of New York, ' shall
not carry passengers from points within the City of Ithaca, N.Y, to
other points within the City of Ithaca., N.Y. and the said Central
Greyhound Lines, Inc. of New York shall use its best efforts to keep
such local passengers from riding upon its motor busses.
BE IT FURTHER RESOLVED, that the iiayor of the City of Ithaca,
be and he hereby is authorized and directed to execute and d^liver
to the said Central Greyhound Lines, Inc. of New York upon demand,

therefor a formal consent in writing acknowledged or proved as are
deeds entitled to be recorded* containing the consent or permission
herein granted and the terms and conditions in this resolution
stated, but the adoption of this resolution shall/ovemed to be the
granting of said consent and may be evidenced by a certified copy
hereof, and the execution and delivery of said formal consent in
writing shall only be as, when and if desired by said Central
Greyhound Lines, Inc. of New York, and which provision is made for
the purpose of permitting the said Central Greyhound Lines Inc.
of New York to obtain and record a public record thereof ,

BE IT FURTHER RESOLVED, that said consent of said local author-

COUNTY WELFARE DISTRICT PROPOSED Mayor Comfort reported that
County Supervisor, H. N. ordon has been studying the possibility of
combining the City and County Welfare Depts. into one County District
and has asked for- permission to present the matter to the Council
for consideration.
The Mayor stated that he felt the matter should first be studied
by the Council Committee on Public Welfare after which recommendations
could be made to the Council,

Resolved, that the matter be referred to the Committee on
Public Welfare for study and recommendations.

CITY COURT BUDGET A letter from City Judge Mintz was presented re-
questing consi oration of a revised budget estimate for that dept.
indicates an increase of ' 360 in the appropriation.
Judge Mintz recommended that the Acting City Court Clerk re-
ceive 15 and bonus per diem, and that the Court Clerk be bonded
in rho amount of ;i2,000,

Resolved, that this Council approve the bonding of the City
Court Clerk, and that the a:: onded budget request be referred to the
Finance Committee for study and recommendation.

4DDITIONAL AiPROPRIATION - ENGINEERIS OFFICE BUDGET ITEM NO. 116
A request from the Board of ublic tivorks was presented for an addit-
ional appropriation in the amount of 111,500 for expense in connection
with the installation of bench markers throughout the city.
It was explained that these markers must be installed before
the proposed sewer survoy may be made and is a proper charge against
the Engincerts Office,

ported that the cities contribution to the Employeest Retirement
System is $544 in excess of the estimate and suggested that the
Council appropriate that amount at this time,

ADDITIONAL APPROPRIATION - MOSQUITO CONTROL, BUDGET ITEM NO.156
The Clerk reported that at a special meeting held April 4, 1944,
the Board of Health requested an additional appropriation of $1,000
for Mosquito Control work.
It was explained that the Health authorities are greatly con-
cerned about the possibility of the spread of tropical diseases by
mosquitoes and that an extensive program of control is to be put
in operation at an early date,

PURCHASE OF LOTS- FROM COUNTY The Clerk reported that at a meeting
held September 1, 19430 the sum of $200 was appropriated to pur-
chase 20 lots now owned by the County in the vicinity of VanNattafs
dam and since the County did not complete the deed during 1943 that,
the fund was closed out in surplus at the close of business in 1943,
and should now be reappropriated,

J. E. MOYNIHAN DAMAGE CLAIM The Clerk reported that a claim for
damages to his car in the amount of $6.90 was filed with the Board
of Public Works on March 22, 1944 by J* E. Moynihan of 406 Triphammer
Rd. -
He stated that the damage was caused by a city truck on March 7,
1944, and that the Board of Public Works recommends payment of the
claim,

be approved and settlement authorized for a sum not to exceed $6.90.

DAMAGE CLAIMS MARIA GAVRONSKY AND DIMITRI GAVRONSKY Claims aggre-
gating $12,500 filed by Maria and Dimitri Gavronsky of 212 Linden
Ave. , Ithaca, N.Y. through attorney V.K.D. Ross were presented.
The claimant alleged that on March 3, 1944, Maria Gavronsky
suffered a fracture of her right arm and other injuries when she
fell due to an icy condition of the sidewalk in front of premises
at 108 College Ave.
City Attorney Powers recommended denial of the claims since

the final Budget with recommendations, for the current year.
Since the adoption by the Council of the Tentative Budget in
Docember 1943, the following changes have been formally approved by

Certain minor changes in the estimated revenues together with
a tax levy CO, $14.80 per thousand on the taxable valuation of
38,332,782.00 results in a total income of $934,619.00 of which
X5681034.75 is derived from taxes and $366?584.25 from miscellaneous
revenues,
The Finance Committee recommends that the above noted surplus
of $78$564.00 be allocated as follows:
Street Paving $20.9000.
Bridges 3 000.
Public Works Equipment 23,564.
as recommended by the Board of Public Works, and that it be invested
in War Bonds as additions to reserve funds already established for
Postwar Work.
The Finance Committee wishes once again, to express its appreci-
ation of the fine cooperation of all City Departments and of the
{ Mayor and Cole~non Council in so capably handling the city finances
during the past year, and thereby making it possible to present such
a favorable Budget Statement for the current year.
With this Budget, the City of Ithaca makes its largest payment
on Bonds and Interest, and from now on such payments decrease from
year to year so that unless some unforseen emergency arises, the
' city► s financial rating, now at a high level, should reach a still
higher level in the not too distant future.

Attorney Howard Cobb were presented.
The claimants alleged that on March 25, 1944 at 104-106 W.
Green St. , Paul Porter, an infant age 12 suffered severe burns and
other injuries when he placed a lighted match over a pipe connected
with an underground gasoline storage tank causing an explosion

PROPOSED LOCAL LAW TO CONTINUE THE 1% UTILITY TAX The Clerk pre-
sented the fob+lowing Loca Law prepared by City Attorney Powers,
which would continue the 1% tax on- corporations furnishing util-
ity services in the City of Ithaca, and stated that in accordance
with provisions of the City Home Rule Law it must lay upon the
table for a period of at least seven days;
A LOCAL LAW to amend local law number 2 of
the City of Ithaca for the year nineteen hun-
dred thirty-seven, as amended, in relation to
continuing the tax on gross incomes or gross
operating incomes of corporations and persons
furnishing utility services in the City of
Ithaca, as authorized by section twenty-b of
the general city law of the State of New York.
BE IT ENACTED BY THE COMMON COUNCIL OF THE CITY OF ITHACA AS
FOLLOWS:
Section 14 Sections one and four of local law number 2 for
the year nineteen hundred thirty-seven as last amended, are here-
by amended to read as follows;
Section It Tax on the furnishing of utility services. Pur-
suant to the authority granted by- section twenty-b of the general
city law of the State of New York, a tax equal to one per centum
of its gross income for the period from July first, nineteen hun-
dred thirty-seven to June thirtieth, nineteen hundred fourty-five
(four) , is hereby imposed upon every utility doing business in the
city of Ithaca which is subject to the supervision of the state
department of public service , which has a gross income for the
twelve months ending May thirty-first in excess of five hundred
dollars, except motor carriers or brokers subject to such super•
vision under article three-b of the public service law and a tax
equal to one per centum of its gross operating income is hereby
imposed for the same period upon every other utility doing business
in the City of Ithaca which has a gross operating income for the
twelve months ending May thirty-first in excess of five hundred
dollars, which taxes shall have application only within the

territorial limits of the City of Ithaca, and shall be in addition
to any and all other taxes and fees imposed by any other provision
of law for the same period. Such taxes shall not be imposed on
any transaction originating or consummated outside of the territ-
orial limits of the City of Ithaca, notwithstanding that some act
be necessarily performed with respect to such transaction within
such limits. M
4. Every utility subject to tax hereunder shall file, on or
before September twenty-fifth, December twenty-fifth, March
twenty-fifth, and June twenty-fifth, a return for the three '
calendar months preceding each such return date including any
period for which the tax imposed hereby or by any amendment here- $
of is effective, each of which returns shall state the gross in-
c3me or gross operating income for the period covered by each such
.return. Returns shall be filed with the City Chamberlain on a
form to be furnished by him for such purpose and shall contain
such other dat ,.y information or matter as the City Chamberlain
may require to be included therein. Notwithstanding the foregoing
provisions of thissaction, any utility whose average gross income
or average gross operating income, as the case may be, for the
foresaid three months ' periods is less than fifteen hundred
dollars, may file its returns for such periods on June twenty-
fifth, nineteen hundred thirty-nine, June twenty-fifth, nineteen
hundred forty, Juno twenty-fifth, nineteen hundred forty-one,
June twenty-fifth, nineteen hundred forty-two, June twenty-fifth,
nineteen hundred forty-three, (and) June twenty-fifth, nineteen
hundred forty-four, and June twenty-fifth; nineteen hundred forty
five , respectively. The City Chamberlain, in order to insure pay-
ment of the tax imposed, may require at any time a further or
supplemental return, which shall contain any data that may be
specified by the City Chamberlain. Every roturn shall have an-
nexed thereto an affidavit of the head of the utility making the
same, or of the owner or of the co-partner thereof, or of a prin-
cipal officer- of the corporation, if such business be conducted by
a corporation, to the effect that the statements contained therein
arc true.
Section 2. This Local Law shall take effect immediately.

mendations o the Finance ommittee made at the meeting held April
281 1944 and approved by the Council at that time, resolutions es-
tablishing such trust funds were presented and acted upon as fol-

Further, that the tentative budget for 1944 amounting to
$934, 619.00 as already agreed upon, could be balanced by applying
a tax rate of $14.80 for all general City purposes, and a tax rate
of $5.14 on pension, bonus and insurance exempt property for all
highway purposes. He suggested that it was incumbent on the Council
at this time to officially approve the budget, fix the tax rate,
levy the taxes and make appropriations.

Resolved, that the budget estimates and requisitions, as agreed
upon, be and the same hereb are finally approved, adopted and con-
firmed in the total sum of 1934,619.00 in accordance with the
detailed budget statement appended herewith, and
WHEREAS, available and estimated revenues total $275,042.09
and- estimated revenues to be used for ','Jelfare relief only, total
$91,542.16 thereby leaving $568,034,75 as the amount to be raised
by taxation] and
WHEREAS' the Assessment Roll for 1944, certified and filed by
the City Assessor, has been footed and proved by the City Clerk
and shows the total net taxable value of, $38,332,782.00, and
�`LTIEREAS, the total Constitutional tax limit for City and School
purposes combined amounts to ;>999,757.94 for 1944, of which
w308,409.27 has already been levied for School purposes, thereby
leaving a balance of $691,348.67 for City purposes, therefore,
BE IT FURTIiER RESOLVED, that the tax rate for all highway
purposes be and the same hereby is established and fixed at C5.14
per $1000, of valuation exempt by reason of pension, bonus and/or
insurance, and that the tax rate for general City purposes for the
fecal year 1944 be and the same hereby is established and fixed
at $14.80 per $1000. of taxable valuation as shown, certified and
extended against the respective properties of the 1944 City Tax
Roll thereby making a total tax levy, as near as may be, of
$568.034.75, and
BE IT FURTHER RESOLVED, that the . amount of said tax levy be
spread and levied and the same hereby is levied upon and against the
respective properties shown on said City Tax Roll in accordance with
their respective net taxable valuations at the rate of $14.80 per
$1000. of such taxable valuations, and
BE IT FURTHER RESOLVED, that the City Clerk be and he hereby
is directed to extend and apportion the City tax as above, and that
upon the completion of the extension .of said Roll the Clerk shall
prepare a warrant on the City Chamberlain for the collection of said
levy, and the Mayor and City Clerk hereby are authorized and
directed to sign and affix the Corporate Seal to such warrant and
forthwith to file the same with said Roll with the City Chamberlain,
and
BE IT FURTHER RESOLVED, that upon the execution- and filing of
said warrant and Tax Roll with the City Chamberlain, the amounts of
the City tax set opposite each and every property shall thereby be-
come tax liens, due, payable and collectable in accordance with

WAGI' ADJUSTIt-EENTS -- DEPT. OF PUBLIC WORKS The Mayor reported that
the Board of ublic orks, at a special meeting held May 3, 1944,
discussed at length a petition signed by 26 employees in the High-
way and Labor Depts. for an increase in wages, and finally agreed
upon a temporary increase for the duration., of 5 cents per hour for
all employees in the following groups in the Water and Sewer Dept.
as well as those under the general fund; foreman, skilled labor
semiskilled labor, and common labor, with the understanding that the,
employee is to work 40 or more hours weekly, except in case of sick-
ness or other emergency,
The Mayor also reported that the estimated cost of these in-
creases will be X6500 per year for the Depts, under the general
fund, and while it is expected there are sufficient funds in the
various budget appropriations, he stated that the Board by resolution
_requested the Common Council to agree to provide funds if it is
found necessary,
By Alderman Shurger, seconded by Alderman Crawford;
Resolved, that the action of the Board of Public Works in grant-
ing a temporary increase of 5 cents per hour, conditioned on the
employee working at least 40 hours per week be approved, and
BE IT FURTHER RESOLVED, that it is the sense of this Council
that extra funds be appropriated from the contingent fund if neces-
sary, to provide for the increases.

read a report of the activities of the Fire Department for the
year 1943- citing a total valuation of property, including contents,
of $1,157975.00 involved with a total damage sustained of

EXTENSION OF Ir/ATER MAIN FROM E. ITHACA TANK APPROVED The Clerk
reported that at the request of the New York State College of Agri-
culture, the Board of Public Works approved. subject to the approval
of the Common Council the extension of a 4 inch water main from
the storage tank in E. Ithaca to the cattle barns now being con-
structed east of the Judd Falls Rd. It was reported that the main
is to be laid at the expense of the College of Agriculture

FIRE INSURANCE - CITY BUILDINGS The Clerk reported receipt of a
letter from the Ithaca Insurance Agency, calling attention to the
fact that the present policy expires on August 1, 1944, and that
on reviewing the schedule , the Company Engineers recommend an in-
crease of at least 10% in insurance.
The letter also called attention to the possibility of secur-
ing blanket coverage for city property and called attention to the
advantages of this form of insurance, the cost of which will be
approximately $700 more than the present cost

He also reported that through efforts of University Officials that

COUNTY- WELFARE DISTRICTS At the request of the Le agu-, of Women
Voters, copies of the s atement made to the Board of Supervisors,
together with other matterial, in regard to the consolidation of
City and County Welfare activities were distributed to the Alder-
men.

INVESTMENT - CAPITAL RESERVE FUND The Clerk suggested that a com-
mittee be appointed to decide upon the investment of funds to be
set aside for Capital improvement provided for in the 1944 budget.

Finance Committee and City Clerk with authority to invest the funds.

ZONE CHANGE - SOUTH iv IADOW ST. The Clerk reported that at a meeting
held June 22., 1944$ the Planning Commission acted upon a request
by property owners in blocks 85 and 91, being that area between
W. Green St. and Fulton St. in S. Meadow St., that the residential
portion of these blocks be changed to Commercial Zone. It was
explained that only a small portion now remains in the Residential
Zone and that the property owners feel that the change would en-
hance the value of their property, and that the Planning Commission
recommends to the Council that this change be made

be accepted, ara..d the Clerk directed to advertise for a -public
hearing thereon as provided by Sec. 83 of the General City Law,

TAX COLLECTION Chamberlain Snyder reported that the tax collections
are approximately 94% complete which is slightly better than last
years collectionsfor the same period.
DAMAGE CLAIM - JOHN REYNOLDS Attorney Powers reported that a
claim for damages to his car caused by a collision with a Water
Dept. truck at the intersection of Lake Ave. and Madison St. in
the amount of ,325628 as filed by John Reynolds of 604 N. Cayuga St .
was denied by- the Board of Public Works on recommendation of the
City Attorney.

FIRE INSURANCE MUNICIPAL BUILDINGS The Clerk reported that the
committee appointed to study the matter of xenewal of Fire Insurance
on Municipal Buildings, agreed that blanket coverage would be prefer-
able 'and that at the request of the eAm;littee , the Tnsurance' Co.
has submitted two new schedules of coverage, one based on a 122f
increase over the appraisal made in 1941 and one based on a 20%
increase.
The Clerk also reported, that at a pnceting held July 1,2, 1942,
the Board- of Public Works by resolution, recommended an independent
appraisal . and the appropriation of funds for such appraisal

LOCAL LAW .. RE AIRPORT The following proposed Local Law providing
for the development of facilities at the airport was, presented by
Attorney Powers:
A LOCAL LAW PROVIDING FOR THE DEVELOPP,U,]�NTT OF CERTAIN FACILITIES
IN A DESIGNATED AREA OF THE ITHACA MUNICIPAL AIRPORT BY PRIVATE
OR OTHER CAPITAL AND ESTABLISHING A PROCEDURE THEREFOR.
Be it enacted by the Common Council of the City of Ithaca as follows;
Section le The Ithaca City Charter as enacted by Chapter 503 of
the Laws of 1908, is hereby amended by adding thereto a new section-
to be known as section ,one hundred and twenty-three-b which shall
read as follows:
®123-b. Development of facilities by private or other capital;
conditions; restrictions; procedure.
1. Purpose. Whereas it is deemed necessary and usirable
in the public interest to promote the fullest possible use of the
Ithaca Municipal. Airport by making ground space available, in a -
restricted area, for the development by private or other capital,
of suitable facilities for the storage and maintenance of air-
craft, for aeronautical research and ex1ocrimentation, .or for other
purposes related to aircraft operation or the aircraft industry,
except manufao-turing�,now. -therefore it is the purpose of this secs.
tion to make possible such development under proper restrictions
designed to safeguard the public interest and insure the maximum
effective use of said airport. ,

2. Agreements. The Mayor, with the approval of the Board
of Public Works, is hereby authorized to execute agreements with
individuals or corporations, permitting the erection of buildings
and other facilities on that part of the municipal airport lying
west of a line drawn northerly and southerly along the east face
of the present hanger building, as more particularly shown on a
map thereof dated August 2, 1944 and filed in the office of the
City Engineer, upon such terms as said Board may determine, subject
to the general conditions hereinafter set forth.
3. Preliminary Investigation. Before approving any proposed
agreement, the Board shall investigate and determine the following
matters :
As That the proposed use is related to the storage and
maintenance of aircraft, to aeronautical research and exporimentaw,
Lion, or to other purposes related to aircraft operation or the
aircraft industry, except manufacturing,, that it will be of bene-
fit to the community as a whole, and that it will not interfere
with or be detrimental to the general use of the airport.
B. That the character and reputation of the applicant is
satisfactory; that his previous experionce is such as to indicate
proper operation of the proposed facilities; and that the applicant
has a .financial standing consistent with' the proper construction
and operation of the proposed facilities#
4. General Conditions. The following general conditions
shall apply to and be incorporated in any agreement executed
hereunder;
A. No agreement hereunder shall el,tend for a period exceed-
ing the probable useful life of the proposed facility, as determined
by the Board of Public Works on the basis of the materials and
type of construction used therein, and in no event for a period
exceeding twenty years . Agreements relating to the use of land
only, without the erection of permanent structures, shall run from
year to year only. At the expiration of such agreement, all right
and title in and to such facilities shall revert to the City of
Ithaca. Nothing herein contained shall prevent the Board, upon
the expiration of such agreement, from negotiating a new agreement
with the same operator under such terms and conditions as the Board
may doom proper, subject to the general provisions of this section
so far as applicable thereto.
B. The use or uses of the proposed facility shall be stated
in the agreement and no other or different use shall be permitted
except by approval of the Board of Public Works ; under no circum-
stances shall manufacturing be considered a permiss^.ble use.
C. No agreement nor any right thereunder shall be transferred.

refereels' doed in foreclosure, an assignment for the benefit of
creditors, a conveyance or assignment by a trustee in bankruptcy,
and all other similar transactions shall be deemed assignments or
transfers within the meaning of this paragraph.
D. In considering the approval of any request for a change
in use or for a transfer or assignment of any agreement or any
rights thereunder,, the Board shall follow the same procedure and
apply the same standards applicable to original applications.
E. No facility shall be constructed until the plans and
specifications therefor shall have boon approved by the Board of
Public Works, and all construction shall be in accordance with such
plans ,.nr1 �o . _:�i.cations.
F. The applicant shall comply with all general rules and
regulations governing the use and operation of the airport and with
all State and Federal laws and regulations .
G. Nothing herein contained shall be construed to exempt any
facility constructed with private capital from general real prop-
erty taxation.
H. Upon the violation of any of the conditions B, C, E, or F
of this paragraph,* the Board may serve upon the operator a written
notice requiring that he cease and desist from such violation
within ten days after the service of such notice, and upon his

failure to comply with such notice, the agreement shall be deemed
terminated and all right and title in and to said facility shall
, thereupon revert to the City and no compensation shall be payable
to the operator therefor. Upon the substantial abandonment of
the permitted use or uses for a period exceeding six consecutive
months, the City of Ithaca may, at its election, terminate any such
agreement upon ten days written notice and- upon the payment to the
operator of the- then value of the facility, such value to be arrived
at by agreement: or if the parties shall fail to agree, then by
arbitration in the City of Ithaca in the manner provided by statute.
The remedies set forth in this paragraph shall not be exclusivo but
shall be in addition to all other legal or equitable remedies avail-
able to the City of Ithaca.
I. Nothing herein contained shall be deemed to prevent con-
demnation by the City of Ithaca of any facility= constructed- pursuant
to any such agreement and the questions of public necessity, com-
pensation and all other matters shall be determined pursuant to
the Condemnation Law of the State of Novi York.
5. Miscellaneous Provisions. The Board of Public Works is
hereby vested �-rith all the powers necessary to carry this section
into effect. Said Board may make additional rules and regulations
governing agreements hereunder not inconsistent with the foregoing.
It shall be the duty of the Board to exorcise its power and author-
ity hereunder in a uniform manner and vdth out discrimination against
any applicant viho conforms with this section, and with the rules
and regulations of the Board adopted pursuant hereto; all fees and
charges shall be uniform, but this requirement shall not prevent
the Board from making such variation in the fees or charges as it
may deem equitable in consideration of Location, accessibility or
other considerations. The Board shall provide generally for the
orderly developcmont of the area above designated and may set aside
and reserve specific areas therein.
6. Reservations. The Board shall grant no special or
private rights or privileges in that portion of the airport not
included in the area hereinabove designated, but such area shall
be used in common by the general public for aircraft operation
under such general regulations as the Board may adopt.
Section 2. This local law shall take effect immediately.

UNIFORMS - POLICE DEPT. Alderman Shurger reported that the; Police
Committee has made, no decision in regard to the proposal that
uniforms for the Police Dept. be provided by the city and he re-
quested the Aldermen to give the matter consideration for discussion
at the r,,ext meeting of the Council.
COUNTY WELFARE DISTRICT Alderman Bangs reporting for the Welfare
Committee presented a comparative statement (herewith appended)
• showing the cost of Welfare Administration in the City and County
for the years 1943 and 1944.
The statement indicated that thy; cost to the city would be
considerably increased if the County system was adopted and the
Committee submitted the following statement:
"Under present conditions, it would seem that no saving or
benefit to the City of Ithaca is apparent in the adoption of a
unified County system of Public Welfare Administration. "

TAXI RATES The 'Playor reported receipt of several complaints in
regard to taxi rates charged in the. city. He stated that the Prosel..`-
Ordinance governing rates was adopted in 1932 and should be revised

with Cayuga Heights and has been approved by the Board of Fire
Commissioners who have requested approval of the Council

will probably be formerly approved at th.o next meeting of the Board.
Alderman Crawford reported that ho has attended the Board.

3. Preliminary Investigation. Before approving any proposed
agreement, the Board shall investigate and. determine the following
tters :
A. That the proposed use is related to the storage and
1 rriaintenanco of aircraft, to aeronautical research and experimonta-
tion, or to other purposes related to aircraft operation or the
aircraft industry.. except manufacturing.. that it will be of bene-
fit to the community as a whole, and that it will not interfaro
wit;.i or be detrimontc�l to the general us:; of the airport.
B. That the character and reputation of the applicant is
satisfactory; that his previous experience is such as to indictt-o
proper operation of the proposed facilities; and that the applic ant
has a financial standing consistent with the proper construction
and operation of the proposed facilities,
4. :neral Conditions. The followin, general conditions
sh-,l_1 apply to and be incorporated in any agreement executed
herounde.r. :
A. No agreement hereunder shall elLtend' for a period exceed-
ing the probable useful life of the proponod facility, as determin:;d
b,j the Board of Public Works on the basis of the materials and typ ;
of construction used therein, and in no event for a period exceeding
tv erity years. Agreements relating to the use of land only, without
tht, erection of permanent structures, shall run from year to year
only. At the expiration of such agreements all right and title in
and to such facilities shall revert to the City of Ithaca. Nothing
herein contained shall prevent the Boards upon the expiration of
such agroemonto from negotiating a now agp?cement with the same
operator under such terms and conditions a.s the Board may doe3ni prop_.:°,
subject to the �=;onoral provisions of t1is section so far as <<ppli-
cablo thereto.
B. The use or uses of the proposed. facility shall be statod
in the agreement and no other or difforont use shall be permitted
except by approv-al of the Board of Public u;or. ks; under no circum-
stances shall manufacturing bo considered a permi.iss^blo use .
C. No agreement nor any right ticrounder shall be trans-
ferrod or assigned except by permission of t:'hce Board of Public Works.
A refereels ded in foreclosure , an assignment for the benefit of
creditors, a conveyance or assignment by a trustee in bankruptcy,
and all other sim_ilar transactions shall be domed assignments or
transfers within t1ao rr.eaning of this paragraph.
D. In considering the approval of any request for 4 c z-AngE:
in use or for a transfer or assignInt oi' any agreement or any
rights thereunder: the Board shall follow -'(,he same procedure and
apply th(, sa_mc; standards applicable to ori(;inal applications.
U. No facility shall be constructed until the plans and
specifications therefor shall have been approved by the Board of
Public Works., D-nd all construction shall bE: in accordance with sucih
plans and specif_i_ca1-ions.
F. The applicant shall comply w:�th all general rules arid
regulations go-v orning the use and opo.rat:i.or, of the airport and I th
all State: and Fo-deral laws and regulations,

any facility constructed with private capital from general real prop-
erty taxation.
11. Upon the violation of any of he conditions B,C,�, or IF
of this paragraphs the Board may serve, upon the operator a written.
notice requirin�, that ho cease and desist' from such violation ,iithin
ten days after the service of such notice., and upon his failure to
comply with such notice, the agreement shal_a. b deemed terninztod
nd ill right an6i. titlo in and to said facility shall. thereupon re-
v. rt to the City a,nd no compensation shall be pnya.ble to the operator
therefor. Upon tlha substantial- abandonment of the permitted use or
uses for a period. exceeding six consecu.t.i.vo months , the City= of
Ithaca may, at its election, terminate any suchh agreamen.t upon ten
days written notice and upon tho payneni; to the; operator of the then

value of the facility, such value to be arrived at by agreement,
or if the parties shall fail to agree, then by arbitration in the
City of Ithaca in the manner provided by statute. The remedies set
forth in this paragraph shall not be exclusive but shall be in. ad-
dition to all other legal or equitable remedies available to the
City of Ithaca.
I. Nothing herein contained shall be deemed to prevent con-
demnation by the City of Ithaca of any .facility constructed pursuant '
to any such agreement and the questions of public necessity, com-
pensation and all other matters shall be determined pursuant to the
Condemnation Law of the State of New York.
5. Miscellaneous Provisions. The Board of Public Works is
hereby vested with all the powers necessary to carry this section
into effect. Said Board may make additional rules and regulations -
governing agreements hereunder not inconsistent with the foregoin .
It shall be the duty of the Board to exercise its power and author-
ity hereunder in a uniform manner and without discrimination against
any applicant who conforms with this section, and with the rules
and regulations of the Board adopted pursuant hereto; all fees and
charges shall be uniform, but this requirement shall not prevent
the Board from making such variation in the fees or charges as it
may deem equitable in consideration of location, accessibility or
other considerations. The Board shall provide generally for the
orderly developement of the area above designated and may set aside
and reserve specific areas therein.
6. Reservations. The Board shall grant no special or
private rights or privileges in that portion of the airport not
included in the area hereinabove designated, but such area shall
be used in common by the general public for aircraft operation
under such general regulations as the Board may adopt .
Section 2. This local law shall take effect immediately.

that the sidewalk in the 100 block of S. Cayuga St. on which he

ZONING ORDINANCE Alderman Perry reported that the Planning Comm.
are working on the new Zoning Ordinance and Map and hopes to pr sent
it to the Council for action in th-- near future.
INCREASED MUNICIPAL AIRPORT FACILITIES Mayor Comfort reported that
since receipt of the report made by 77gineors from the C.A.A. and
American Air Lines calling attention to the limited facilities of
the present airports that considerable thought has been given to the
advisability of acquiring land on which an adequate airport could be
constructed,

REPOR3 OF SALAH'i SURVEN COMMITTr.,rE Mayor Comfort presc;nted the re-
port submittod by the Special Salary Survey Committee together with
proposed rules and schedule showing range of salaries and increments
proposed.
He called attention to the fact that the report takes into ac-
count all salaried employees but does not cover hourly rate employees
under the Board of Public Works, the schedule for which will be
pr.:>santed at a later date. He stated that the schedule covering
hourly rate employees contemplates no changes in rates as that
schedule was adopted by the Board and has been in operation for some
time.
After discussing the schedule as presented, it was agreed that
action should be deferred to a later meeting.

The Special Committee appointed by the Mayor to prepare a
Compensation Plan for all employees in the Civil Service of tine
City of Ithaca respectfully submitsits report herewith.
' The plan consists of a prescribed salary range, with min-
imam and maximum limits, together with annual maximum increments,
for each class of positions established in the classified plan
previously approved by the Municipal Civil Service Commission.
The purpose of the plan is to insure that all positions similarly ;
classified shall have the same salary range and that all officers ,
and employees shall receive compensation comensurate with the
duties and responsibilities of their positions and the length
and nature of training and experience required.
In preparing the plan, the Committee has carefully con-
sidered the requirements of each position in the service and
has made comparative studies with the salaries paid for similar
work in local business and industry. The plan has been reviewed
with each of the Boards and Commissions, as bo its own employees
and their relative compensation and has been approved by each.
The Committee has also met with a representative of the Bureau j
of Municipal Service of the State Dept. of Civil Service. After
extended discussion and some minor adjustments suggested by this
representative, he expressed himself very well satisfied with
the plan as now submitted.
The annexed schedule shows the various job classifications
now in existence, the salary or range of salaries now being
paid in each, the proposed salary range and the maximum annual
increment permitted. The annual increment is arranged to com-
pensate the employee for reasonable progress and increased
efficiency in his position, with consideration given to the
nature of the work and the length of time probably required
for a new employee to reach the maximum of his efficiency.
The salary ranges as proposed are base rates, any temporary �
cost of living adjustment being in addition to the rates shown.
The following procedure is suggested for the adoption of
the plan:
1. The tentative approval of the plan which w ill form the
basis for the necessary salary adjustments by the departments
in submitting their budget requisitions for 1945, such salary
adjustments to be effective January 1, 1945. In general,
present salaries below the maximum for the class will be ad-
justed on the basis of length of service of the employee. Persons
now receiving more than the established maximum will continue i
to receive their present salary.
2. Prior to January 1, passage of a Local Law authorizing j
the Coim on Council to set up a Compensation Plan and prescribe
rules for its operation. This Local Law is necessitated by
existing charter provisions giving to various Boards and Com-
:mittees the authority to establish salaries within their depart-
ments. This power will remain in the department but will be
subject to the Compensation Plan and must be exercised within
its limits.
3. Adoption of suitable rules governing the operation of
the plan. A copy of the proposed rules is hereto annexed.
The Committee recommends the adoption of the Compensation
Plan as herewith submitted. It is the unanimous judgement of

reasonable salary increments, will prevent inequalities in the

will provide for fair compensation for all officers and employees
based upon the relative importance of their positions and the

such a plan is strongly recommended by the State Department of
,. Civil Service in connection with and as a necessary part of a
classification plan such as that already in effect and is in
j line with the modern personnel practices of up to date govern-
mental and industrial organizations.

COMPENSA'T'ION PLAN The report of the salary survey committee ( a
copy of which .7 erewith appended) together with the proposed rules
Eoverning the compensation plan, and the proposed schedul:; showing
salary range with minimum and maximum limits and maximum annual
increments, as set forth below, were again presented for discussion.
The Mayor reported that the Bd. of Health wish to reserve the
privilege of considering the salary range of the Sanitary Inspector
at a later date, as the possiblility of combining the duties of
?,bilk Inspector with those of the Sanitary Inspector is being con-
sidered.
RULES GOVERNING COMPENSATION PLAN
The salary of all employees of the City of Ithaca holding po-
sitions allocated to the classification appearing in the Compensation.
Plan as adopted, and as from time to time amended shall be governed
by the following rules ;
1. New Appointees
A new employee appointed to a position in n class shall be paid
the minimum rate of pay for the class.
2. Annual Increments
An employee receiving less than tho maximum rate for the class
to which his Dosition is allocated shall be eligible to receive an
increment not exceeding the maximum increment for the cl°tss fixed "
in the Compensation Plan every fiscal year until his rate reaches
the maximum. The salary and service record of each employee shall
be reviewed annually by his department head for the purpose of de-
termining which employees shall receive salary increases within
the range for the class to which their positions have been allocated.
Such salary increments are not automatic or mandatory, but may be
granted in the disereation of the appointing officer or board when
it satisfactorily appears to such officer or board that the service
record of an employee merits such increase.
Annual increments shall take effect on the first day of each
fiscal year. An employee must have served at least six months prior
to the first day of the fiscal year in order to be eligible to re-
cjive the annual increment. No employee shall be entitled to more
than one increment each fiscal, year.
3. Promotions
When an employee is promoted to a position in a higher class,
his salary shall be increased to th:: minii;lum rate for the higher
class..
4. Transfers

employee who is transferred unless his salary is below the approved
minimum of the now positions It an employee is transferred to a
position in a class having a higher salary than the class from which

provisions governing promotions shall apply. If an employee is

a maximum that is lower than the miniiaum of the class from which
the employee was transferred, such chanSo shall be deemed a demo-
tion and the provisions governing demotions shall apply.
5. Demotions
When an employee is demoted to a lower class position, he
shall be paid at a rate which is within the approved range for the
lower class position, the rate, within such range, to be set by
the board or body having authority to detorminn salaries for the
department concerned.
6. Reallocations Downward

rate of pay during period of incumbency (except in event of general
service-wide reductions) , but shall not be entitled to a salary in-
crease .
7. Reinstated Employees
A reinstated employee shall be paid at a salary rate within
the approved salary range for the position in which he is roinstat-
ed, such rate to be set by the board or body having authority to
determine salaries for the department concerned.
8. Part-Time EmploZment
When employmen is on a part-time basis, the rate to b paid
shall be in proportion to the minimum rate established for full time
employment in the same class.
9. Ovortime
W_ e_._._n an annual rate of pay has been establish- d for any class
of positions no additional compensation shall be paid for overtime,
except that in cases of extr.adordinary emergency a department head,
subject to the approval of the legislative body, may authorize
compensation for overtime work at such rates of pay as may be dowmec
advisable under the circumstances .
10. Salaries Exceeding Maximum

shall continue at that rate during the period of his incumbency

GENERAL INSURANCE SCHEDULE Mayor Comfort reported that he has been
under pressure from various Insurance agents in regard to the dis-
tribution of City Insurance especially in the Personal Liability
line and he appointed Alderman Gillette, Shurger, and Crawford as a
committee to study the matter and be prepared to make recommendations
at the December meeting of the Council.
ADJOURNMENT Mayor Comfort announced that the Special Airport Com-
mittee wil3 be ready to report on the progress of their study on
November 17, 1944, and on motion the meeting was adjourned to 7;30

The Mayor announced the meeting was called to receive reports
from the Special Committee, the appointment of which was authorized
by the Comfnon Council on September 6= 1344. ,E
Mr. V. A. Fogg, acting chairman of the committee, presented
copies of a report showing the commercial , economic, industrial,
and travel factors which indicate a definite need for air trans-
portation service.
After reviewing each section of the report , Mr. Hollister
described the site picked by the committee, and explained that it
is an unusual location since it is so near the center of the city
and being on high ground will seldom be fog bound as are other
fields located in valleys. He stateca that the site, which is lo-
cated between the Warren and Town Line Road, north of the Town of
Ithacats northem boundry, seems to meat all requirements for a
high class airport, and after preliminar-, inspection by represen-
tatives of C. A. A.. and the i;merican Airlines Co. was approved by
those representatives, and the C. A. A. has promised to approve
the site as a class 3 airport.
Mr. Hollister reported that options have been taken on the
property and that the next step necessary before further work can
be done will be surveys, the cost of l,,r•i-1.ich, is estimated as follows:
1. Deterit_ine property linet 01500.
2. Topographical survey 3500.
3. Soil test 1000.
which the city is asked to appropriate.
Mr. Rogalsl:y reported that Cornell University has appropriated
5000 for tiie purpose of taking options on the property and that
a further a pproDriation of P500 has been requested; that options
on 1,1462 acres have been secured wit'_a negotiations un&;r way for
another 3282 acres. He stated that thc; option contracts provide
for a payment; of 5% of the sale price and run for one year with the
priviledge of renewing for an additional year upon payment of an
additional 5j of the sale price.
During discussion of the report, questions on the cost of build-
ing the port, maintenance and other related subjects were asked,
and Mr. £iollis•tar stated that reasonable estimates would depend up-
on results of tl-i� surveys , but gave a tentative estimate of between
200,000 and 300000 for a class 2 air- ort and $1,250,000 for a
class 3 or 4 airport, and that cost of i:iaintenance would depend up-
on the class of .airport but could give no estimate of the-J cost.
It was stated that it is expected t'._at the Federal and State
Governments will participate in the cost of the port probably on
the; basis of 50;;; contribution by the Federal Government and the
remaining 50;) to be financed by the State and City.

APPROPRIATION FO--t AIRPORT SURVEY The Clerk reported that at a reg-
ular meeting held November 22, 1944, the Board of Public "Works rec-
oinmended. that t'_ze sum of $6,000 or so rauc . thereof as may be neces-
sary be appropriated for the purpose of co.�ipleting the necessary
surveys at the site of the proposed East Dill Airport.
Alderman Crawford expressed complete approval of the airport
project, but questioned the advisability;- of appropriating city funds
for the survey since it might be possible to interest the County in
tl.Le project, and county funds could be provided. It was pointed oat
that it is very in_p'ortant that the surveys be completed as early as
possible in order to secure Federal aid, and. it was moved

OVERHAULING i1".I<T G ivLTL'RS The Clerk reported that at the time the
parking meters wea?e insta led in February 2941, it was understood
that they should be overhauled and worn ?3a_rts replaced in about 3 yrs.
He stated that al_fiost 4 yrs. have elapsed and that quite often meters
are found to be sticking due to corrosion which indicates that the
work should be done at an early date, and as the Dual Co. are engaged
primarily in war production that until very recently, the company
would give no assurance as to the time w}ion the job could be under-
taken or the probable cost, and that '"lilliluli Simmers, who is in
charge of meter Maintenance, submitted or September 15, 1944, a bid
in the amount of 1`3 per meter plus the cost of parts fog a thorough
overhauling and cleaning, and that on December 2, a bid was received.
from the Dual Co„ in the amount of $3.75 per meter plus cost of pares.

Comm. for study and recommendation

.. Be it enacted by the Common Council of the City of Ithaca as follows:
a.
Section 1. The Ithaca City Charter as cnacted by Chapter 503 of the
Laws of 1908, is Iaereby amended by adding, thereto a new section to
be known as section thirty-five-a which shall read as follows:
®35-a. Compensation plan; rules governing its operation.
Notwithstanding any other provisions of this charter, or of
any ordinance or departmental rule, the Comn-on Council, by the maj-
ority affir:lative vote of the total vot5_ng power thereof, may es-
tablish and fror.i time to time amend a compensation plan governing
the salaries and wages of such officers and employees of th ° City
of Ithaca as said Council may determine, including a minimum and
maximum salary or wage rate and a maxi:nt�cn annual increment for each
classification included in such plan, and may adopt and from time to
time amend rules c~overning the operation thereof. The authority
hereby conferred shall not extend to tl-ie salaries of elc;ctive
officers of said city. The power and authority to fix salaries or
wages granted by any other provision of this charter to a particular
commission, board., or body shall continue to be .exercised by such
cor'imission, board or body, but such power and authority shall be
limited by and sl.all be exercised in conformity with the compen-
sation plan any the rules governing its operation.
Section 2. This local law shall take efioct immediately,
