the nominations be closed. Alder_-ian Barns seconded this
motion which was unanimously carried. Alderman Barns then
gloved that the Secretary cast one ballot for Alderman Lowe
to be Acting :.;ayor. The __lotion was seconded and carried
and the Secretary cast the ballot and '..'•.ayor Smith declared
Alder::ian Lowe duly elected as acting Mayor.

Welfare ':ayor Smith explained and recom vended a change
Depart.ient in the organization set up of our Welfare
Depart.--lent ; patterned after our Board of Public
Works with a Board of Public 7clfare who would engage a
competent Welfare Officer rather than the present set up
of a politically appointed Co:vilssioner.
,'After some favorable discussion of the sugges-
tion it was roved by Alder::lan Ca:' pbell, seconded and carried,
that the Charter & Ordinance Co-I.:iittee, the Charity Co-1-ittee,
the City ,attorney and the City Clerk be a special cor_r:*'ittee
to work out the details and report at a subsequent ,iecting.
City The Clerk reported that it was the Council 's
Depositories duty at this time to designate depositories
for City funds and approve bonds of said
depositories.

RESOLVED: that the matter of designating
depositories, approving their bonds, and agreeing upon
a rate of interest to be paid on City depositories, be
referred with power to the Finance Co-i:iittce.

Board of The Clerk reported that he had received a
Education certified copy of the ':-inutes of the meeting of
Auction the Board of Education wherein they had decided
Sale that a certain portion of the land of the
East Hill School grounds were no longer needed for their
purposes and that they requested the Co--i-ion Council to sell
such lands at public auction pursuant to the General City
Law, and credit the proceeds of such sale to the funds of the
Bo-.rd of Education.

are no longer needed for educational purposes and has requested
the Com.:�on Council to sell said lands and to credit the proceeds
thereof to the funds under the control and adrAnistration of the
Board of Education of said City.
RESOLVED: that the lands hereinbefore described be sold at
public auction to the highest bidder in accordance with the
provisions of section 23 of the General City Lam; that such sale
shall be subject to the approval of the a:iayor of the City of
Ithaca; that the City Clerk be directed to advertise said lauds
for sale as prescribed by lar% ; that the City Clerk be directed to
conduct such sale, which sale shall be held in the Cor_rion
Council Roo--.Zs, City Hall, Ithaca, New York, at a time to be
fixed by said Clerk; that the right be reserved to reject any
bt5all bids; that the high bidder for such lot shall conplete
his purchase within ten days after the ap-oroval of the sale
by the Iaayor, and that in the event of his failure so to do he
shall be chargeable with any loss upon a resale of said lot ;

conveying said lands for and in behalf of the City of Ithaca;

Cornell St. The Clerk reported that the Board of
Right--of-tray Public 17orks requests an additional approppria-
tion of $3, 200 to acquire a right-of-way
necessary in the development and extension of Cornell Street
which has been approved as a C.5.A. project. It was suggested
that instead of making an additional appropriation for this
purpose, the Council might authorize thic expense as a charge
against the :coney already appropriated for other C.W.A. projects.

Minutes Minutes of the preceding meeting duly approved.
Resurfacing Mr. Oliver Brooks and ::sir. R.A. Hutchinson
Assessments again appeared before the Council requesting a
refund be made, or a credit be allowed on
this year 's taxes to the extent of the amount paid
by the property owners along No. Cayuga Street north
of Cascadilla Creek as resurfacing assessments, claim-
ing that such assessments were, in vier of previous
and subsequent procedure in regard to assessing for
resurfacing, Unjust and unfair to those property
owners.
On motion of Alder an Lowe the request was
referred to the City Attorney for opinion as to the
legality of such a refund.
Denniston, Dr Stagg,Thaler & Stagg on behalf of
Clam: for Harold P. Denniston submitted a petition re—
services. questing the Council to approve and order the
payment of a bill of Dr. Denniston in the ara6unt
of $40 for services rendered through the Welfare
Department to Willia.- Tooner, a recipient of public
relief. The Clerk was requested to return the bill
to the ±�aedical Society and request of them a written
reco mendation in regard to its disposition. The
City Attorney was also requested to investigate the
case and be prepared to render an opinion as to the
City ' s liability for the payment of this claim.
Auction The iiayor called attention to the fact
Sale that it was tiie to hold an auction sale as
requested by the Board of Education and authorized by
the Co..1-,.�on Council at their last -meeting. In
accordance with the provisions of Section 23 of the
General City Law, and resolution of the Common Council
duly adopted at their meeting o_z 8anuary 3, 1934, the
City Clerk offered the property described in the
duly published notice of sale to the highest bidder.
The property was sold for 0318 to the only bidder,
Mr. George Hack.

Street The Clerk read a com..uni cat ion fro;.l
Railway Ithaca Railway Incorporated requesting the
Franchise Council to waive the annual payment of
0500 stipulated in their Franchise as a tax for the
privilege of using the public strects. There ti�as a
general discussion of the matter ; Alderman Shag
opposed the request on the grounds that the Railr,ay
had already cost the taxpayers far too .uch money,
Alder_an Capbell likewise viewed the situation and
questioned the state:_Zent that busses could not run,
without more thorough investigation, whereas
Alder-_lan Howland pointed out that the continuance of

Street Railway service might be worth $500 to the City
especially to the many people in the north and west parts of Town
who work at the University. Attorney Stephens read a condensed
income and expense state-ment submitted by the Railway Company,
but the items were not in sufficient detail to permit of a
definite conclusion.

RESOLVED: that the Finance Coy-i.iittee further investi-
gate this matter and report at the next meeting.

Local Law The Clerk read a communication from the Mayor
Welfare wherein he submitted a local law to ai_lend the
Dept. Ithaca City Chatter with reference to the
ad-.iinistration of public welfare, and reco:.rmended that
it be enacted. He explained that this amendment was the
work of the Special 0mv- ittee of Six Aldermen, the
Attorney and Clerk who had been designated by the Council
for such purpose. Alderan Shaw objected to voting on
the arleAdment without making a more detailed study of
its provisions, and it was therefore, agreed that the
Clerk should distribute copies to the AlderKien and that
action would be taken on the wiend icnt at a subsequent
:.ieeting to be called by the ?'ayor.
Central The question of continuing the Central Index
Index for the 1.'elfare Department was referred to
the Charity Coi:littee with power.

R.R. Co. RESOLVED:that the Hayor and City Clerk be and
they hereby are authorized to execute and attach
the corporate seal to the agree:.ients sub:_Zitted by the
D.L.&!v.R.R. and the L.V.R.R. for the construction and
::.iainteizazce of culverts and drainage ditches on their
respective rights—of—?gay for the purpose of draining low

Inlat The Clerk read a resolution of the Planning
Co:.i__.ission wherein they requested the Council
to petition Colonel Green to send a. State dredge to
Ithaca.

of the City of Ithaca are hereby pledged for the pay-
ment and retirement of such temporary loans out of
the taxes to be received for the current fiscal year.

and reviewed the situation with respect to the
Bonds depositories and their bonds in accordance with
previous action of the Council and submit a report and
recommendation.

Preston The Clerk reported that the Board of Health
Melton recommends that Hr. Allan H. Tre:.ian,the present
Case Attorney of record for the City in its action
against Preston Melton, be continued.

RESOLVED: that the Council hereby authorizes
Hr. Allan H. Trevan to continue as Attorney of record
for the City in its actions against Preston Melton.

Attorney Stephens reported on the status of
this case and explained and recom ended the proposal
to arbitrate these actions instead of carrying the,_:
through the Courts. Alderman CoEfort gloved the
approval of the suggestion to arbitrate and the appoint-
ment of Aldermaaz Rogalsky as the City s arbitrator.
Alderman RogalsXy moved to aDend the notion to

authorize the Mayor to appoint an Alderman as
arbitrator fro:.i the ''e,rd in which the Melton
property is located. The aiend:_:ent was carried
and the '`ayor appointed Alden-_l-an Lowe to act as
the arbitrator for the City.
Contribution The Y'ayor reported that Carl Crandall
for N.R. S. had requested the City a-zd County to each
Court House contribute $250 to finance the cost of the
Lease equipment needed for the new N.R. S. office
in the old Court House, as well as executing with the
County, a lease of the old Court House property
fro_:: the Baptist Church. The Finance Co. .littee
reported that this r-_latte-r had bee_i referred to the.:,
but that in view of the lack of any i_zfor_Iation
in regard to the requests that would warrant such
action and they were unwilling to reco:,li-lend
approval by the Council. After so__.e discussion it
was agreed that the requests should be tabled until
further infor_:ation was available.
Report The City Cho—mberlain sub.fitted his annual
report which was received and ordered filed.
Brashear H-ayor Smith reported that 1.`r.Ca.rl iiisrmr
Plu_lbing had declined the appoint font as Plu:-.Zbing
Co 1:-nission Co;--rAssioner because he was not at the
present time a resident of the City, and that because
of this fact 'r. Harry Brashear had been duly
appointed to this office.
Sniper At Alder-.--mn Comfort ' s suggestion the
Right of Finance Conmiittee was given a vote of thanks
itiVay when they reported they had secured the necessary
right—of—way from Tfr. Sniper for Cornell Street
Extension at a cost of only $2, 000 instead of the
$3 i200 as originally asked. -

of the unexpired term. All appointments to the board shall be made
so that no more than three co mmissioners shall belong to the
same political party.
Pursuant to the provisions of the Public Welfare Law, the
Board shall be responsible for the administration of all Public
Relief and Care in the City of Ithaca. The Board shall meet at
least once each month at such tine and place as it may determine.
At the first meeting of the Board in each year a chairman shall be
nominated and elected by ballot, and at all meetings shall preside,
and be entitled to vote on all questions. Special meetings ._lay be
called by the chairman or by any three members of the board by
giving twenty—four hours written notice of such meeting. A
:majority of the members of the board shall be necessary for the
transaction of business, but less than a majority may meet and
regularly adjourn from time to time. In case any commissioner shall
be absent from three successive regular meetings without such
absence being excused by an appropriate resolution of the board,
his office shall be doomed to be vacant and a successor shall be
appointed to fill his unexpired term as in the case of a vacancy.
The commissioners shall receive no compensation for their services
but shall be entitled to reimbursement for necessary expenses
and disburse_ants incurred in transacting official business, when
such expenses were duly authorized and a proper verified claim
therefor has been duly approved and audited by the board. Any
commissioner may be removed from office by a two—thirds vote
of the Conlon Council upon charges preferred in writing, served
upon the commissioner against whom they are preferred, and after
such commissioner has had a reasonable opportunity to answer
such charges.
The board shall have power to :,lake and enforce, without the
publication thereof, such orders, rules and regulations, not
inconsistent with the Public Welfare Law, as it may deem necessary
for the conduct of its business and the administration of relief.
On or before the first day of May in each year, the board shall
file with the Common Council, an estimate and requisition for an
amount of money necessary to cover the administrative expenses of
its department, together with an estimate of the cost of
administering Welfare Relief and Care, for the current year. The
board shall have the power and it shall be their duty regurlarly
to audit and approve, and file with the City Clerk for payment, all
bills and expenses incurred by or under the jurisdiction of such
board; the Common Council, however, shall have the right filially to
audit and -review all such claims at any time. The board shall
have no power to incur obligations or audit or approve any claims
or disbursements in excess of the amount of -coney appropriated
to the board for such purpose by the Common Council.
The board shall have the power to appoint, by an
affirmative :majority vote thereof, and at pleasure in like manner to
remove, a Director of Public 7elfare who shall act as its clerl,
and secretary and be its chief executive officer. The board ;hall
direct him in the perfornance of his duties and subject to the
Ipproval of the Common Council, fix his compensation. Subject to
the general direction of the Board, he shall exercise the po?ers
and duties of a city public welfare official as prescribed by
the Public Welfare Law, Before entering upon the duties of his
office, the City Public ;Welfare Officer ;hall tahc and file Tith
the City Cleri the constitutional oath of office and file ;pith
such clork ;, surety bond for the faithful perforrance of his
duties. Such bond shall be approved as to its form and
sufficiency by the Common Council, and its cost shall be a charge
against the city. With the consent and approval of the Board of
Public Welfare, the City Public Welfare Officer may employ such
assistants as nay be deemed necessary .properly to ad minister
Public Relief and Care in the City of Ithaca.
Section 3. Section 6 of said Act is hereby aAended
as follows:
The words " six Commissioners of Public Telfa.re, a Director:
of Public alfare" are substituted for the ~-words "a Co`ziosioner of
Charities", and the words "a 8upc intendcnt of Public ":forks" are
substituted for tie word "a Jity Superintondont" .

C.W.A. Co-,imissioner Filler read a request from the
Board of Public Works for the sum of $7, 200 to carry on
approved C.T;.A. projects; he explained in detail the
reasons for this request. Commissioner Sawdon also spoke
briefly on the matter. After some discussion led by
Alderman Gill, it was moved,

RESOLVED: that the request of the Board of Public
be approved and $7, 200 be and the same is hereby appropriat-
ed from unappropriated revenues to the C.W.A. fund for the
purpose of paying the City ' s share of the expense of
approved C.W.A. projects.

Commissioner Miller assisted by Commissioner
Sawdon and City Engineer Eustance explained the request
of $5,000 additional for the special Airport improvement
as a C.T7.A. project. After a very lengthy discussion,
during which the Mayor called on each Alderman to express
his personal opinion on the proposition, it was
finally .roved,

WHEREAS, the Common Council on Dec. 19, 1933 duly
adopted a resolution appropriating 013, 500 for the purpose
of Financing its share of the cost of improving the Airport
as a C o .A. project,
WHEREAS, it is estimated that such sum is insuffici-
ent for such work and the Board of Public Works C.W.A.
Committee so reports and requests an additional ap-gropriation
of $5, 000 nor, therefore,
RESOLVED: that said resolution adopted Dec.19, 1933
for an ailount of 013, 800 be and the same is hereby }
amended to read as follows:
RESOLVED, that the reconl::lexzdation of the C.W.A.
Corimitt ee be approved and 018, 800 be and the same hereby is
appropriated to the C.W.A. Fund for the City ' s share of
the cost of the special airport i;-mrovenent project ,
and further,
RESOLVED, that a temporary loan in anticipation of
a bond issue be and the sa:ie hereby is authorized in the
sui of $18, 800 to furnish money for such purpose and the
Mayor and City Cler'. be and they hereby are authorized to
negotiate and execute such temporary loan in behalf of
J_". City and further,
R_'SOLVED: that the faith and credit of the City c-'
Ithaca are pledged for the payae;zt of principal acid
interest on such loan to ::zaturity.

C.W.A: Commissioner griller appeared in behalf of the
Board of Public Uorks and the special C.W.A.
C=-,�littee, with relation to the present extended period
of 0.17.A, work from February 15th to ,'ay l st. He spo'.;e
specifically of the present plans for completing the
special airport project in the light of the newly
established policy of the Govermient not to allow directly
any percentage of the cost for ..laterial. He also spoke
of the proposed swim::ling pool and log cabin at VanNatta' s
D--,L,-.i. He suggested that if the r 19,, 800 could be used for a
modified plan for the airport, it would then be necessary
to approiDriate only $13, 200 additional for the City ' s
share of the cost of material for all other projects
during this period.
At this point Aldermen Gill and Bishop cage
into the meetings and there was a general discussion of
the whole proposition.
Contiiissioner 1:iiller sub._litted figures to shoe
that the total .cost of the projects proposed for this
period a_-_�ounted tot$180, 000 and showed that of this w.iount
the City was being asked to furnish only $32, 000.

AGAIN?, permit me to point with pride to our financial position;
All bond obligations paid promptly, debt limit only 3.8%; no floating
or special assessment debt ; a small amount of temporary obligations
for relief work ; a relatively low City tax rate ; a surplus at the end
of the year; .and all City taxes collected.
The Water Department , a municipally operated public utility that
is self sustaining, likewise met all its current and bond obligations
and closed its fiscal year with a, surplus.

Tax A petition was received from hr. Allen Seeley, as
Deed Mortgagee of the premises at 7114 Park Street, request-
ing the Common Council to quit claim to him whatever
title was secured by the City as result of a tax sale
of these premises. The City Chamberlain reported that
:sr. Seeley had agreed to pay the total cost of tax
liens against this property and that the case was similar
to those explained and acted upon at the last meeting;
also that the City Attorney approves granting

Petition A petition was received from Stanley Mekos re-

RESOLVED: that the appplication of Stanley Mekos,
dated the 30th day of liarch,l934 and the consent of the
Council of the City of Ithaca, N.Y. to operate a rotor
orsnibus service upon, along and through certain streets of
said city, will first be considered at a stated .meeting of
the said Council to be held in the City Hall of said city
at 7: 30 P.? . on the 2nd day of --4ay,1934, and that a notice
of said sleeting shall be published daily, except Sundays,
in the Ithaca Journal, which is the newspaper in said city
having the largest circulation, at the expense of such
applicant, for at least ten days last prior to the time
of such hearing.

Attorney Stephens stated that in his opinion
the Legislature actually has no right to pass 3nabling Acts
of this nature because of the prohibition contained in
the State Constitution.

Salary The Clerk reported that the Board of Public

State Supplementing the explanatory letter he had sent
Dredge to each Alder.man, mayor Smith e-xplained the proposal
to have a state dredge improve navigation at this end of
the lake and at the mouth of Fall Creel,; thereby reclaiming
for the City some 24 acres of swamp land as well as
eliminating a flood menace and a nosquito nuisance.
At his suggestion the aldermen agreed to think
over the proposal with particular reference to cost, and be
prepared to take whatever action they deemed proper at the
next meeting, so that any expense to the City could be
included in the budget or otherwise financed; possibly as
a T.E.R.A. 17orl: Project.
Truck The ILayor reported that there was some question
Bids as to the Cor.,M,on Council 's intent in directing the Board of
Public Works to include an itcra in their Budget to cover
the cost of the proposed new trucks.) He asked Co;iaissioner
?:filler to explain the Board's decision; which he did.
Alder._lan Shaw questioned the Superintuende_it , who
ackaitted that no large trucks were now being rented,, but
that he thought it would b_e necessary to rent one within
a week or two.
Alderman Comfort stated that there was no
justification for the City renting trucks when they knew
that trucks rust soon be purchasedg and he reco;,inended that
the 3oard be given authority to secure the trucks as soon as
possible, as he was satisfied that they needed them.
Aldermman Shaw agreed that the trucks were needed
but objc:cted to their purchase at this time on the grounds
that in his opinion the Superintendent should be able to
plan his work for the next two months with the present
equipment and also for the reason that to purchase them at
this tine would require the pay._ient of interest on the rioney
that tiroiild have to be borrowed to )ay for the trucks.

MINUTES The minutes of the regular meeting were
corrected and approved ; also the minutes of the
adjourned meeting were approved.
Coleman Mr. John Cole:_ian called attention to a sign
Property on #i s property at Brindley and Buffalo Streets
adjacent to the railroad siding. The matter was
referred to the Ordinance Committee and City Attorney.
Public The Hayor opened the public hearings as
Hearing advertised on the petitions of James J. Taylor and
Stanley Hekos for permission to operate motor buses over
certain streets in the City. Hr. Taylor' s petition was
considered first. No one appeared to oppose the request
and Hr. Peer, representing the Chamber of Commerce appear-
ed in favor of granting -consent.

.fir. Sullivan appeared as Attorney for
Stanley Mekos and presented a petition signed by about
300 residents on the proposed route outside the City
requesting favorable consideration of the petition.
Fr. Weinstein, representing the Elmira—Ithaca
Transportation Company reouested the Council to give
careful consideration to this petition with particular
reference to the fact that the Bus Company he represents
also runs from Elmira to Ithaca.
During further discussion Mr. Sullivan
stated that the petitioner was willing to pay $25.00
per nonth for the Bus franchise. It was pointed out
that it had not been the practice for the Council to
require any franchise stipulation in granting a, bus
franchise.

between the City of Ithaca., Tompkins County, N.Y. and the
City of El ira, Che__1ung County, N.Y. through the Village
of West Danby, North Spencer, Spencer,VanE tt en,
Swartwood, Erin, Breesport and Horseheads, to and fron
points in each of them and all streets and routes therein
specified, said franchise to be given as required by
Section 26 of the Transportation Corporation Law of
the State of New York.
WHEREAS, due public notice has been given and
published that said application would first be considered
and heard at the noting of the Council to be held in the
City Hall of the City of Ithaca, W.Y. on the 2nd day of
? ay, 193 +, and said hearing having been duly had,
Now, Therefore,
RESOLVED, that the Council of the City of
Ithaca, N.Y. does hereby grant to Stanley ickos the

right and privilege to use the streets, highways and
public places of the City of Ithaca, K.Y. hereinafter
enu=merated, for the purpose of operating a motor bus
line for carrying passengers, freight , :sail and express.
This franchise grants the use of the following
streets, highmays and public places of the City of
Ithaca, N.Y.
Entering the City of Ithaca, I\T.Y. , on Spencer
Street, thence proceeding northerly on Spencer Street fron
the said city line to the intersection of Spencer Street
with Cayuga Street, thence proceeding on Cayuga Street,
fro-._i its intersection with Spencer Street northerly
to its intersection with Green Street , thence proceeding
easterly o_z Green Street fro:: its intersection with
Cayuga Street to the Bus Termii,.lal on Green Street,
thence returning to the city line. of the City of Ithaca

This franchise is granted subject to certain
conditions and reservations which ;hall be and continue
as conditions precedent to the validity thereof and the
grantee by the acceptance hereof understands that the
non-fulfill:le_zt of the terns and conditions of such
franchise upon his part, or upon_ the part of his successors
or assigns, shall be cause for the revocation thereof
by this body; and this Council 'does grant this consent
within the meaning of Section 26 of the Transportation
Corporation Law.
But there shall be reserved to the Co�mion
Council the power to fix and change from tine to tine in
the interests of public convenience, the terminals of
the bus line.
In the event that any or all of the
designated streets, highways and public places become ins--
passable or are obstructed by accident or by public .corks
undertaken by the municipality or by corporation
having rights in such highways, then any other streets,
highways or gays of the City of Ithaca, N.Y. running in
the sa.-.ie general direction, may be temporarily used by
said grantee, his successor or assigns, to reach the
Ithaca ter:iinus. Any. deviation from the regular route
shall be temporary only and said _regular route shall be
used at all tines when it is available to traffic.
The grantee, his successors or assigns, shall
not carry passengers fro=m points within the City of
Ithaca to other points within the City of Ithaca, and the
said grantee, his successors or assign's, shall use his
best efforts to keep such local passengers fron boarding
his conveyances within the territory of the City, whether
entering or leaving the same.
This franchise shall be exercised subject to
the Lads of the State of New York, and the lawful ordinan-
ces of the City of Ithaca, including those regulating the
speed of motor vehicles of si Zilar type.
This franchise shall continue ten years fron
the .date of its.approval by the Public Service Cor..m:_iission
of the State of Ne.? York.
This franchise shall not be sub-let or
assigned, and no transfer of all or any part of the rights
and privileges granted under this franchise shall be r:ade
by the grantee, except to such corporation as may be
foa=led by hire for the operation of said bus line, .without
fon-ml application and consent by the Council of the City
of Ithaca, IT.Y.
The grantee, his successors and assigns,
shall __make every diligent effort to adapt the regularity
Of its service to the convenience of the people of the
City of Ithaca and those living along and near its route.
He shall __mako every reasonable effort to furnish continuous
service throughout the year and to overco::.le conditions

Nuisance Garage complaining of the nuisance created on

Taughannock Conmissioner Evans, as Chairman of the
Boulevard Highway Committee of the Board of Public Forks,
reported that his Corin-ittee had been given power to
investigate and decide on the proper treatment for
Taughannock Boulevard ; that the Corziittee decided
to temporarily i::lprove by grading and oiling the
north portion of the highway which is later to be
abandoned and to construct a permanent bituminous top
on the south portion which will continue to be used
after the completion of the grade crossing elimination.
He stated that this would mean a finished road from the
concrete at the City line for about 1,722 feet to
where the new road leaves the present subbase. He
reported that this portion could be so improved at a
cost of �'2, 000; that the Cor.raittee recon ends this
treatment and are ready to proceed if the Common
Council will furnish the i_loney, 11ayor Smith outlined
the present financial plan of borrowing on temporary
loans at low interest rate for such permanent
bettermeiits; such temporary financing to be retired
later by issuing bonds.

Relief Airport project. Through the Finance Coru.iittee, the City
accepted the opportunity of securing this additional aid
but in view of the fact that no definite approval had yet

taken by the Aldermen at this tire.
The Mayor called on City Engineer Eustance to
explain why part or all of the P..,,.A.. application should
be withdrawn. The Engineer pointed out that. the :.lain
reason is the increased percentage of aid not? 'granted by ,
the T.J.R.A. which was not available at the time the
P.W.A. application i7as filed. He also sub_iitted and

Because the regular meeting for July came on Independence
Day, the meeting was adjourned until this time.
Iliayor Smith was in Albany in regard to obtaining spoil
from a State dredge for the swamp land near Stewart Park,
which dredge had been promised for deepeni_?1'4 the barge canal
in the Inlet. He also was endeavoring to secure a portion
of the Federal fund granted to the State for the construction
of main highways in Cities.
Because Acting Mayor Lode also was out of the City,
Alderrlan Gill presided.

County Representatives of the Tompkins County Agricultural
Fair and Horticultural Society appeared before the Council
and pointed out that the new ordinance prohibiting Carnivals
was so broad by its ternis that it would not pernit the usual
entertain:ient in conjunction with the regular County Fair ;
and asked the Council to amend the ordinance to exempt the
County Fair fro.:i such provision.

Damage The Clerk reported that John McAuliffe,
Claim 306 W. Court Street today filed an informal claim
of $3.75 for damages alledged to have been caused
by a falling limb from a tree during a storm in August 1933•

Terrace Alderman Campbell requested that an appropriation
Place of MOO be made for the completion of Terrace Place as
a Mork project, pointing out that the Board of Public
Works had approved the sarae if the Council would appropriate the
money and if the property owners would furnish the necessary deeds.
He pointed out that the improvement as planned contemplated the
acquisition of a small portion of the Williams and the Deriano
properties and recoz.ionded that the City pay for such portions of
these properties, as are necessary, in the anount of theproperty
frontage irlproveaent assessment that would be levied thereon.

Gill At the suggestion of I%iayor Smith,those
Alderman present stood for a few minutes in silent
.Deceased tribute to the memory of former Alderman,
John Gill, who recently passed away.
Noble, The Mayor then welcomed and introduced
John A. ,Jr. John A. Noble, Jr. ,as Alderman from the Third
Ward, recently appointed to fill the vacancy created
by the resignation of Alderman Shaw.
As a special order of business, the Mayor
announced it was in order to nominate and appoint a
successor to tmr. Gill. He pointed out that it was custorz4ry
for the other Alderman from the sane Ward to make a
nomination and reco=ended that it be for some one of
the sar_ie political party.
Alderman Bishop reported that he had
planned to nominate John R. Sigler but that just prior to
the meeting he had learned that the nominee must be a
taxpayer and that for this reason he had no nomination to
make at this tine. There were no other nominations,
and on MOTION of Alderman Howland the matter was postponed
until the next meeting.
Bill- Hr. Sherman Peer reported that he had

present Bill-Board Ordinance that would permit the erection
of more billboards in the Cityq
The Mayor called for a vote on the matter; it
was unanimous in opposing any change in the present
ordinance or perrlitifig the erection of any additional)
billboards in the City.
Liability Attorney Stephens reported that the Veterans
Insurance of Foreign Wars had raised the question as to
Airport whether or not the City would carry liability
Insurance to cover the air show and pageant in connection
with the dedication of the Airport.
The Attorney reco;xr_iended that the Field be
leased to the V.F.17. for the period of the pageant. Since.
the field was under the control of the Board of Public
17orks the natter was referred to that body.
Committee .mayor Smith announced the appointment of
Appoint- Alderman Comfort as r_lenber of the Finance Cor_r-
ments. -mittee, and the appoint:_ient of Alderman Rogalsky
as Chairman of that Co_riittee. Also the appointment of
A1denian Noble to fill the vacancy in the Standing Corr

Welfare The Clerk reported that Director of Welfare

You are further directed to carefully value the
services and wages paid employees, to avoid unnecessary duplications
and to purchase only useful, quality merchandise, to the end
that taxes may be kept at the lowest possible level and monies
made available to pay Ithacais bonded indebtedness.
We commend the action of the Board of Public Works
in its endeavor to follow the request of this Council to reduce
its budget during 1934.

Welfare Father Byrne appeared before the Council
Nurse in behalf of the Board of Public Welfare and
thoroughly explained the reasons for requesting that they be
allowed to continue the e7_�ploy lent of TTs. Hartsock ps
Welfare Wurse at a salary of $20.00 per -Meek.
Alderman Campbell suggested that some other
nurse who Night be eligible for relief be employed, so
that the City might obtain reimbursement of part of
the salary.
Alderman Barns complimented the Welfare
Board on the creditable way in which they are handling the
very difficult task of adequately, yet efficiently,
administering relief. He agreed with Father Byrne in the
desirability of continuing airs, Hartsock, and Alderman
Bishop concurred.

Danage A dauage claim filed September 17, 1934 by
Clair_: Casesar C. Fontana in the amount of 410.10 for dagages
to his property received by a falling limb during the
stores July 15, 1934 was found to be improperly drawn
and filed after the statutory limit ; it was therefore
rejected.
E. State A petition was received from most of the property
Bus owners on E.State Street, east of the 800 block request--
ing the Council to give a local Franchise to
Harry Cri spell for picking up and discharging passonger s
within said territory to and from the Dus Terminal. It
was pointed out that Hr. Cri spell ap--)asently had such
Franchise at the present time and that he had ;_lade no
additional application for such privilege. However, the
Council directed the Clerk to report that so far as they
were concerned they had no objection if Hr, Cri;yell
desired to give such service.

resurfacing assessments on Yo. Cayuga Street until the

Enabling Act to cancel such assessments and refund
any amounts paid thereon.

Franchise The Irlayor opened the Public Hearing as
Hearing advertised on an application of Frank Reynolds
of Auburn for permission to operate a motor vehicle
Bus route to Auburn via North Lansing,Genoa etc. ,and
over certain streets in the City of Ithaca. -
Attorney Davis, . representing the petitioner,
reported that in view of the fact that Attorney 24intz
was appearing in behalf of J..Jr. Giddings who operates a
bus route to Auburn via of Groton and who was opposing
the petition of Mr. Reynolds, they had agreed to request
the Council to adjourn the hearing until thety next
regular meeting so that the Attorneys could submit a
brief settingforth their argurients. The ;.iayor asked
if there was any objection to adjourn the hearing as
recorx:-qended, and hearing none, he adjourned the hearing
until the next regular meeting.
Lower,,..M. Mr. Lower, of Floral Avenue asked permission
to pick up old papers, magazines, boxes etc.,along the
garbage routes, and also to collect old clothing which he
agreed to turn over to the Clothing Bureau. The matter
was referred to Cora-littee.
Ithaca Mr. Sherman Peer, representing the Street
Railways Railway Company, submitted an Incor_ie--Expense
statement showing the Company was operating at a greater
loss this year than that for the same period last year.
He pointed out that the value of the Colpanyts Franchise
had depreciated to the point where it was worth nothing,
and also called attention to the fact that local and
interurban busses paid no-Franchise stipulation. Because
of the foregoing he requested the Council to consider
waiv;ng the paylent of their Franchise stipulation.
The matter was referred to the Finance Co=iittee.
Federal Ilr. 17illiw-i Wigley, General Chairman of the
Housing local Cotilittee of the Federal Housing
Survey Ad:lini stration requested the Council to authorize
the allocation of part of the regular relief moneys to
cover a work project to furnish one clerk and two
solicitors to help those persons interested in availing
themselves of the opportunity afforded under the
Federal Housing Act.
It was roved by Alderman Barns, seconded
and carried that the Council approve the sub.iission
of a work proj e,ct as requested by 11r. i7igley and that
sufficient funds be allocated fro-,'I the current month' s
relief allot:-lent to cover the City t s share of the labor
expense for this project ; the desirability of continuing
the project to be considexed at the next regular sleeting.

Briefs were presented in favor and in opposition to the
granting of this Franchise. Attorney I;intz, representing
the objectors also elaborated on the points in his brief.
Discussion brought out the sentiment that the objections
were matters for the Public Service Commission to
consider and that no real objection from the City ' s
standpoint had been presented.

RESOLVED: that the Common Council of the
City of Ithaca hereby does grant to Frank Reynolds of
Auburn the right and privilege to use the streets,
highways and public places of the City of Ithaca herein-
after enumerated for the purpose of operating a motor
bus line for carrying passengers, freight, mail and
express; under such ordinances, rules and regulations as
may now be in force, or may hereafter be adopted or
enacted; such right and privilege, however, is granted on
the condition that the petitioner secure the approval of
the Public Service Commission for the operation of the
desired route.
This Franchise grants the use of the follow-
ing streets, highways and public places: entering the City
from the north on Lake Street, thence southerly to Fall
Street, thence westerly to Tioga Street, thence southerly
to Green Street, thence westerly to the Bus Terminal; and
returning thence westerly on Green Street to Cayuga Street,
thence northerly to Fall Street, thence easterly to Lake
Street, thence northerly to the City line; provided
however, that the Police Department shall have the right
to temporarily or permanently change any part or all of
this route to another running in the sazze general
direction, when in it 's judgment public :necessity nay so
require.
In consideration of this grant and the
privilege of using the City Bus Terminal it is hereby
stipulated and agreed as a condition precedent to the
validity thereof, that the grantee by the acceptance
hereof agrees to pay to the City of Ithaca monthly in
advance a fee of $10.00.
This Franchise may be revoked by the City
of Ithaca. in the event that the grantee does not comply
with all of its terms, provisions and conditions; any
such revocation however, to be made only after a hearing
on at least thirty day 's notice to said grantee.

Auction The Clerk reported that the Board of
Sale Public Works, on the recommendation of the
City Chamberlain and with the approval of the City
Attorney, passed a resolution that certain properties
acquired by the City at Tax Sale were not needed for any
public or municipal purpose and that they should be
privately owned for the purpose of relieving the City
of all maintenance cost and other responsibility, that
they should be sold at public auction to again place
the°Z on the City Tax Roll.

fourteen acres that the Board feels should be acquired
at this tide for future use in connection with refuse
disposal.

Taugha.nnock The Clerk called attention to a
Boulevard previous resolution of the Council authorizing
Appro. an appropriation of $2, 000 in anticipation of an
i,mprove.ient bond issue. He stated that an expense of
$1, 801-76 had been incurred under this authorization for
the ir_lprove::lent of Taughannock Boulevard and that because
such a bond issue is now not contemplated he recommended
this authorization be rescinded and an appropriation to
cover this cost be :lade from surplus funds.
It was moved, seconded and carried
that the authorization referred to be rescinded, that an
appropriation of $1,1801-76 be :lade fro-._1 surplus funds and
the Clerk authorized to reconcile his accounts accordingly.

Street Reporting for the Finance Committee
Railway on the request of the Street Railway for the expunge;.ient
Franchise of their x;500 Franchise stipulation, Alderman Comfort
stated that the Cormittee feels that a proposition should
be made to the Railway Company to deed the City, on the
termination of their operation all their rights—of—way
and the car barn property

this time waiving present and future p-)zr:ment of their
Franchise stipulation. The suggestion was approved and
the Finance COi:nittee was authorized to negotiate with

Ithaca The Clerk read a ccorgr.-iunieation
Railway from !fr. Peer, as Vice President, of
Ithaca Railway Inc. , wherein he offered
certain rights-ems way and real estate of the
traction company in lieu of further payment of
their annual franchise stipulation; such rights
and property to be deeded to the City on condition
that a right-of-tray for street car purposes shall
remain in the Company until they abandon operation.
It was agreed that the proposition offered should
be accepted s absta.ntia,lly as presented and on
motion of Alderman Barns the matter tras referred to
the Finance Corr ittee with power.
Budget The Aldermen then toot_ up con-
sideration of the Budget esti.ro.ates for 1935 that
had been prepared by the va rious de-D art-;eats and
offices. After soi°iie discussion it i4as agreed
that the Clerk prepare mimeograph copies of the
proposed Bud et esti>_::a,tes and furnish each
Alderman with a copy so that a more thorough study
of the problem of how best to finsnce the increased
size of the Budget could be made individually.

The Aldermen took up the detailed considera-
tion of the Budget esti,,-,sates for 1935.
During the discussion the Clerk was given
various instructions, viz. , to consult the Attorney
in regard to a resolution with reference to retirement
also in regard to securing ,.iore equal representation
for the. City on the Board of Supervisors; to confer with
the Public Buildings Committee of the Board of Public
Torks in regard to the labor item in their -oublic

buildings budget; to confer i,.rith the Board of Public
Works in regard to their estimate for high way maintenance
as the saxiie might be effected if the $10, 000 request
were granted for the surface treatment of 4 miles
of dirt strects, also in regard to an inclusion of th-e

wages of certain regular City employees who might be
employed on rrork relief projects; to notify the City

ivill be available in the City Engineer 's office so that
he may check his Assessment Rolls and Assessment 11,--j)s;
to look up the Law, governing the special Fire Relief
Fund; to notify the Board. of Public Works that the
Council approves their suggestion and authorizes the
establishment of an equip.nient depreciation reserve
fund to be credited with all moneys received for the
rent-al of City equipment and to be used for the
re-ola-cerient and purchase of new equipmen.t.
. The Chairman of the Police Committee was
directed_ to notify the Police Commissioner that he wias
authorized to purchase a ne,-v coupe for the Police
Department i-ith funds remaining to the credit of the
Police Department in the 1934 Budget Appropriation.
The Council considered the items 101 to 185
inclusive and then, realizing that there was not
sufficient time to consider the complete Budgetthey
adjourned the meeting to reconvene at 7:30 P.–

The mayor asked for the ratification of the reappoint-

the Board of Health for a tern of three years; on ::lotion
the nominees were approved and appointed.

the appointment was confirmed.
The Layor asked for the approval of the appointment
of Philip C. Sainburg as Comaissioner and Hember of the
Board of Public Welfare for a ter_-. of 6 years; on motion
the appointment was approved.
The '%ayor announced the appointment of Alderman
Scott as a member of the Standing Conmittee with relation
to the Board of Public 7elfare to fill the vacancy caused by
the death of Alderman Gill; all other Standing Conqittee
appointments to continue for 1935 as previously. coustituted,
Federal A con—iunic:ation was received fron the
Housing Federal Housing Administration recuosting an
appropriation so that their local representative :_light
secure the services of 35 canvassers and 7 clerks as a local
work relief project. On ;_lotion the :latter was laid on
the table.
Larkin, A damage claim was -received from
Clara John J. Larkin, �r219 Eddy Street a]�od ;ing damages
to his property during a stoma in July 193.4. on :.notion
the clain was rejected.
Auction The Clerk reported that the rosolutio-i-i
Sale adopted by a na.jori.ty vote at the nceting of
December 5, 1934 authorizing the Chamberlain to hold an
auction sale of property acquired by the City through tax
sales, required a 3/4 vote of the full no bcrship of the
Council to becoAo legal and suggested that tine Natter again
