Zone The Clerk read the following resolution which he re- C:�ange ported was unaniraously adopted by the Planning Com- -mission and referred by them to the Coini_ion Council. n RESOLVED: that the City Planning Commission recommends that the Zone Map of the Building Zone Ordinance of the City of Ithaca be amended by making the following changes in Zones: (1) The coi�2.lercial district on the west side of Stewart Avenue between Cascadilla Creek and a point one hundred feet north of Osy1un Place, be changed to "A" residence district. (2) In view of the location of two churches at Seneca and Geneva Streets and the fine residential character of the neighborhood the Planning Co:.tirission recorl_lends that, the west side of North Geneva Street fro-.:_1 State Street to Seneca Street and for 100 feet west of the west line of North Ge:.ieva Street be made a "B" residence district. " On motion of Alderman i:_yers, the Secretary was directed to take. the necessary steps so that the Council night hold a public hearing on the proposed changes at their next regular meeting.. Boulevard Lights The Clerk read a co::-munication fro:i the Gas & Electric Corlpany addressed to the Chairman of the Lighting Com- m1ttee of the Board of Public 7vorks setting,- forth a proposition to purchase the existing ornaiental lighting equipment, and also read the following resolution subriitted by the Board of Public Works: RESOLVED: that the Board of Public Works recom,-.iends to the Co.--irion Council that the City of Ithaca sell to the New York State Electric & Gas Corporation for con- sideration of $6, 750 all the existing boulevard and orna:_ie:-ital lighting standards, equipment and system now 0%-4-ned by the City. Ayes--5 Nays--0 Carried The i: ayor explained the proposed sale and transfer of the boulevard lighting system and recommended that the Council approve. The Clerk reported in regard to the redemption of Tax the tax deed for the property of :aggie 3rodie on Deed Terrace Place aizd the Attorney recoimiended that the Council approve'a.nd authorize the ayor to execute deed to the purchaser. Carried Taxi Rates Alderman Lowe reported that his Co:_�:_littee had given careful consideration and :_lade careful investigation in regard to the proposed change in the ordinance with respect to taxi rates and that if the Council had a xz ;atato fix a minimum rate the Cori::iittee reco�:.iended the following minims and :axi au.i rate schedule x'Ii ni mizi Maxi..Zun 1 Passenger 250 75� 2 40 1.00 55 1.25 „ 70 1. 50 5 85 1.75 Or two minutes of waiting time mininium 5¢ Maximum 10¢ Attorney Treman explained the legal side of the question and stated in his opinion the Council had a right to fix ninimm as well as naximi ri rates if they so desired. Nornan Stagg, as Attorney for the local taxicab operators many of whom were present, explained their stand in the natter and objected a long other things to a minimum rate of less than 50¢. There, was a general discussion of the :_ia,tter and an endeavor :jade to establish a rate schedule that would be fair to both the public and taxi operators. Alderman 1.1yers moved, that the ordinance be adopted in accordance with the request of the rates desired by the taxi operators and the wording of the ordinance referred to the City Attorney mid 111r.Stagg. The City Attorney questioned the right of the Alderlen to adoptan ordinance in this fashion and it was,therefore, agreed that the Attorneys should retire, prepare the ordinance in final form and present saLle for adoption. Traffic Light During a short recess Alder:_ian 2iyers reported that the new traffic light at the corner of Albany and Buffalo Streets would be in operation the following day; Taxi cab Ordinance The Attorneys then submitted a:iend-me to the ordinance as requested. By Alden_ian Gill: seconded by Alder:-.ian Sc?=.aons: RESOLVED: that Section 3 of Chap. IV of the City Ordinances be and the sa:_ie hereby is amended as follows and to take effect upon publication: The last two sentences of the third paragraph begii-zing, "A License so issued. . . . . . . " are hereby a�.iended to read as follows: "The license so issued with photograph attached shall be displayed by the licensee at all times in a conspicuous place on the rear of the driverts seat when engaged in operating a taxicab. Such License shall be kept clean and in no may defaced. " The last sentence of the fifth p^r:graph,beginning, "The fee for this license. . . . . . . . ", is hereby .-mended to read: "The fee for this t-:xi cab owner l.s license shall be $5.00 per year (or fraction thereof) for one taxicab or vehicle for hire and $2. 50 per year (or fraction thereof) for each additional vehicle operated by the licensee, and the license shall expire at the end of the calendar yeas. " The seventh paragraph is hereby repealed and in place thereof the following three paragraphs are here- by enacted: "A nini�im charge of 500 shall be :_lade for every trip in a taxicab within the city li:�its, plus 25¢ additional for each extra stop to discharge 39 c. c. --3- 10-5-1932 passengers. No more shall be charged than 750 for one person, or 50¢ each for two or _-.yore, nd no less than 160 per person. No more shall be charged than 100 for each three ninutes of waiting time. When a taxicab is rented on a time basis or when a vehicle for hire is rented, the -rate shall be agreed upon before the use begins. Every taxicab shall display in a pro_linent place on the rear of the driver ' s seat a rate card to be furnished by the City at a charge of 251 apiece, showing the above standard of rates., together with the nave of the owner of the car, and the number of the owner ' s license.
