Minutes of the preceding meeting were duly

Cliff St Mr. Thomas Austen explained to the Council

ent permitted to make deferred payments as he was
able to or whenever he sold a lot.

Pronerty Mr. and Mrs. Reyna explained in detail the
history and circumstances leading up to
transfer of her property to the City at Tax
Sale and the subsequent acquirement of it
at public auction by Mr. Fay "Allen_.
The Aldermen expressed sympathy for her •
point of view, but the City Attorney pointed
out that as a matter of law property owners
are negligent and must suffer the consequences ,
if they do not avail themselves of the privilege
on Grievance Day to see to it that their
property is correctly assessed, and that in this
case Hr. Allen holds a prior legal title
to the property in question.
Attorney Treman also questioned the
legality of the City repaying Lir. Allen the
cost of the lot plus interest.

of Social Welfare who was making a study and
investigation of our Charity Department, stated
that her official written report was not quite '
ready but discussed,however, with the Aldermen
various phases of charity and welfare work
in general'without reference to our local
department. She stated her report would be
filed later.

A request was received from Ir.F.P.Hemans
for a permit to establish a Funeral Home
in an "A" or "B" residential district. This use
was deemed by the Alderman, to come within the
provisions of Section ga of the Building Zone
Ordinance is a "Publicc or semi public use"
and the request was therefore referred to the
Planning CoA::ni sr ion for report and recorir. enc'a-
tion to the Board of Zoning Appeals in �!

that the, Common Council, pass a resolution accepting

y s t e Chief of Police Marshall made a report, on the
Department 's ex?�eriance for the past few months in the
. use of the new teletypewriter system. He reported the
service a s unsatisfactory and the results obtainable
as very discouraging and recom ended that in viev of
these condi tions and the fact that the Department 's
appropriation was exhausted in so far as being able to
meet the expenses of this system, that the Council
request the discontinuance of the teletypewriter.

�e tion It Section 135 of Chapter 503 of the Laws
of 1 0 entitled "An Act to Consolidate and Revise the
Several Acts relative to the City of Ithaca"(being the
L Ithaca City Charter) as amended, is hereby amended
f/ to read as follows:
Section 135. The Board shall have power to repair,
11 ? construct or build any sidewalk or portion thereof upon
any of the streets, highways, alleys or other public
r places in the City, in such manner and with such
material as in the judgment of the Board .aay be deemed
best, and determine the width, grade and location
of such sidewalk.
Upon request in writing to the Superintendent of
Public Works, any owner or owners of property shall be
given permission to build, repair or rebuild the sidewalk
along or in front of his property without expense to the
City, in conformity, however, with all the requirements
of the Board as to the time of building,repairing or
rebuilding, material to be used therefor, dimensions,
grade and location thereof and manner and method of
construction.
The Board of Public Works after public hearing,
notice of which shall be either advertised, served
personally, or mailed, as the Board shall determine,
may require the making,laying and/or grading of any
sidewalk or street driveway between the sidewalk and
gutter, or the relaying, repairing and/or regrading of
any unsi ritly,irregular, defective or poorly—drained
sidewalk or street driveway by the owner or owners of any
land in front of or along which the Board of Public Works
deems it advisable to make such i nprovement or repair;
and fix, determine, and prescribe the grade,location,
width, and other dimensions thereof, the kind and quality
of materials to be used, the manner and method of con-
struction, and such other requirements as the Board may
determine, and provide that such improvement or repair be
done within a stated time of reasonable length.
In case such work or improvement (mentioned in
either of the three preceding paragraphs) is not done
within such time or in such manner, the Board of Public
Works may cause the same to be done under its supervision,
either by contract or by the City under the direction
of the Superintendent of Public 17orks.
On petition of interested property owners for a
uniform sidewalk improvement in a street, or on its own
motion,the Board of Public Works may direct that new
sidewalks be laid on any street or part thereof,pursuant
to plans and specifications therefor prepared and
adopted by it. Before determining to make such improve-
ment, the Board shall hold a public hearing upon such
proposed new improvement, after giving notice to the
property owners affected, either personal ly,by mail,or
by advertisement. After such public hearing, the Board
may determine to make such i-iprovement, either by contract
or by the City under the direction of the Superintendent
of Public Works.
The Board shall have power to require all persons
owning or occupying property in the City, and the owners
of unoccupied property therein, to remove all snow,ice
and dirt from the sidewalk on any public street or
public place in front of the premises so owned or occupied
by them,and to keep the same free therefrom,and from any
encroachment or obstruction; and in case of neglect or
refusal on the part of such owner or occupant to remove
the saine, the Board may perform the labor at the owner's
expense.
It shall be the duty of the owner or owners of the
property along or in front of which such a sidewalk
exists to maintain such sidewalk and the area (if any)
between it and the curb in a safe condi.ti on,and the

grass thereon, if any, properly mowed&
Section II. Section 136 of Chapter 503 of
the Laws of 1908, being the Ithaca City Charter,
as amended, is hereby amended to read as follows:
Section 136. Upon the completion by the
contractor or by the City under the direction of
the Superintendent of Public Works of the work
mentioned in Section 135, the Superintendent of
Public Works shall report the total cost thereof
and the Board of Public Works shall hold a hearing
thereon, notice of which shall have been given to
the owner or occupant of such property either
personally, by mail, or by advertisement. Upon the
approval and ap_oortionment of the cost- of such
improvements to the owners of the properties
affected, the Board may direct that .such cost as
apportioned be paid by each such owner;and if not
paid within thirty days, such cost as apportioned
shall be levied by the Common Council as an
improvement assessment and shall be collected in the
same manner as any unpaid improvement assessment.
