Public Mayor Bergholtz read the legal notice of the public hearing

Use Permit pursuant to the BuildingZone Ordinance; Sec.9(e)1
The Mayor asked if anyone wished to be heard. '!
Professor Bretz said that he had been informed that the
Council would grant this permit and on that point he would
say no more; but for the information' of the public and as !
matter of record he desired to make two points very clear.'
First : that the people of Cornell Heights stand now just
where they have stood right along; ooi)osed to the gra.ntir
of thi.s special permit and opposed to the granting of any
permit Cr spbcial grant when the majority of the property
3mers and public opinion are against it.
Second: that they are opposed to the recoimend?,tions of the
planning Commi scion with the so--called "restrictions". I
That he wished it clearly understood especially by the 1
a,.).nlicant, that the people of the Heights had in no way
compromised or suggested any of the requirements made by I
the Planning Commission and that these were not acceptable
s t all.. That these provisions diel not restrict the apwii-
cant from doing anything that he had asked and in fact it
would ha-:e been much more acceptable to the Heights had the ;
Co:m.».ssion faced the problem squarely and said "Yes" or "ido'!
wththout adding any qualifying conditions which only make it )
more ease to grant other uoecial permits with similar
meaningless conditions. He also pointed out that the
fact that the Planning Co:ii.hzssion saw fit to state that
their action did not set a precedent, wh,s only to call 'I
attenti on to the fact that they thought it might.

In conclusion he said that the Heights realized that they
had been beaten on every ,-joint, yet they are` strongly I
opioced to granting this special permit in this case. 'i
