Special meeting duly called by the Mayor to
consider the Natter of paving East State Street and such
other matters as Tray regularly be brought before
the meeting.
Coy The Layor read a report of his attendance at the
Mayor 's Conference at Glens Falls, characterizing this
Conference as being one of the best ever held. In connec-
tion with his report he recommBnded that Ithaca adopt
the saane plan that has worked out to advantage in Buffalo
in connection with unemployment and charitable relief,
whereby they required all able bodied men to work for the
City at least one day before they may receive any
charitable aid.
The Minutes of the preceding meeting were
duly approved.
�;iflg The 14ayor called for a general discussion of
the East State Street paving program, stating that in so
far. as he was concerned he vlrould take no sides in the
matter and would have an open mind, relying upon the
Alderman to decide what should be done.
Alderman Sammons asked what the situation was
with respect to the resurfacing program before he voted
on the paving of East State Street. Mayor Bergholtz re-
plied that the Council had informally voted unanimously
at the last meeting to approve such a program if and when
presented by•the Board and that he had cast the deciding
favorable vote at the Board meeting to present such a
program which would later in the meeting be presented
to the Council for formal ratification and approval.
In explaining his vote for the resurfacing
program he stated it was his conviction that the City would
receive a substantial sure next year fro.i the Gas Tax
before any assess,.ients were levied_ for this resurfacing
and that he, therefore, hoped that the- resur.-"'acing could
be done without_lassessment.
On this point Attorney Treman gave an opinion
that no change in the method or waiver of assessment
could legally be made retroactive to effect any work done
before such law was amended even though the assessment
therefor had not been levied. This precipitated a
General discussion until the Mayor directed consideration
of the proposition of ?paving East State Street and request-
ed the Clerk to read the various amounts authorized from
time to time by the Common Council in anticipation of a
Bond issue. The total amount including the resurfacing
program tentatively agreed upon, amount to $186, 623.
Alderman Gill questioned the need- of prolonging
the discussion stating that every one seemed to understand
the situation and that he was absolutely opposed to any
such construction this year.
Alderman Causer stated that he was very much in
favor of improving the disgraceful condition of that
portion of East State Street by some type of pavement
but he was not in favor of letting a $50, 000 contract for
this job because he was convinced that the City could build
a road with its own labor and at much less ex,)ense that
would_ last at least 10 years or more.

Alderman Atkinson reported that he was
reliably informed that the State was building
a certain type of road, similar-, to that sugvested
by Coriniissioner Evans, for only $6,000 per mile.
Mayor Bergholtz called upon Superintendent
Feller to explain the various types of road con-
struction and what had been planned for East
State Street. Superintendent Feller explained
that building; roads was just like most anything
else, that is, "You get just about what you
pay for. "
After explaining various types of new con-
struction he estimated that a 2" retread similar
to the ;Mecklenburg Road could be built at a cost
not to exceed $3,000, but stated that this would
be only temporary relief and estimated that'
within six months or early next Spring it
would break up and need patching.
Alderman Gill insisted that this road
could be temporarily improved with a surface
, that should last three or four years, from funds
in the General "Maintenance Budget and thereby
relieve the bad pavement condition- of East
State Street and at the same time relieve the
tax payers of an7T additional tax or assessment.
In order to bring the matter. to a head
Alderman Gill moved and Alderman Casterline
seconded,
RESOLVED: that the request and requisi-
tion of the Board of Public Works for $50,000.
to construct a concrete paving, curb and gutter,
etc. , in East State Street from Mitchell Street
to the City Line be and the same i s hereby
refused and rejected.

Although this motion was lost, the Mayor pointed.
out that it would be useless to put a motion
approving the project and providing the money by
Bond Issue since it was quite evident that such
a proposition would not receive the required
number of eight affirmative votes and he therefore
suggested that the matter of pavinL-; E. State St. ,
be cropped.

The Clerk reported that the Board of Public
Works had filed a requisition with the Common
Council in the suzl of $41,720 for a resurfacing
program.

certain streets in accordance with the following

RESOLVED: that the Cora- on Council hereby
approves the. recommendetion of the Boar(; of Public
Works ana t..e proposed resurfacing prograra

submitted and pursuant to the power and authority vested
in the Cora-]on Council by Art. 2a, General City Latin and
Sec.3 Chap. 1 of the City Ordinances, the Com:tlon Council
hereby authorizes the issuance of obligations of the
City of Ithaca in the sum of $41,720 for the express
purpose of resurfacing various streets as setforth in
the above schedule, it beinL expressly understood that
said bonds will be in addition to and part of Series "H"
Improvement Bonds, part of which issue has already been
authorized ; this amount bringing, the grand total

The Clerk reported that the agreements, approved
o_i,no on by the City Attorney, between the City and the
Neer York State Electric & Gas Corporation for their use
of the City Traffic Light Conduits for boulevard
light cable were ready for the -1 ayor I s .signature.

Minutes of the preceding meeting were duly

yles requested permission for 1,,r. 2:Tiles to remodel his
house at Highland Avenue and Heights Court, in an
"A" residence district, into an Apartment -House,
with 5 apartments.
Mr. LAiles explained his position in the
matter and apologized for having; started the
work without a proper permit. -
The petitioners requested that the matter be
referred to the Planning .Oonslission for report
in accordance with the Ordinance, but explained
that it was i:miaterial from their view point as to
what particular section of the Ordinances the
Permit might be granted.

RESOLVED: that this matter be referred
to the Planning Comm-,fission both under Section 9
paragraph F and Section 8 paragraph A but in
any event to be reported back to the Con-ion
Council.

a right-of-way for a gas pipe line across- the
City 's Six }Mile Creel-c water shed property;and
