Theatres Congressman Henry appeared before the Council as a representative of Cornell Theatres, Ine. and ` reauested that the City Ordinance regulating Sunday Observance be amended so as not to limit the time of motion picture entertainments to certain hours after 2 P.M. but to permit such exhibitions at any Ordi- time after 2 P.M. II of the City Ordinances be and the 1 same hereby is amended to read as follows and to take effect upon publication. Sec. 15-SUNDAY OBSERVANCE. On I.Bunday no..lierson shall tyublircly bry out or noisily proclaim for sale any newspaper, article of food,or other thing. No circus, theatrical representation or public show of any kind shall be given in the City of Ithaca, on Sunday, with the exception however, that baseball games, foot ball games, and motion picture entertain- ments and exhibitions, are hereby permitted on Sunday `after 2 otclock in the afternoon. Ayes--Gill, Lowe,Causer, Casterline,Rlyers, Hines,Rogalsky Nays---O Carried and Approved Voting Mayor Machine A communication was received from the Automatic Voting "Lachine Corporation making the City an offer in connection with remodeling the present type of voting 'machines, but no action was taken., Spiritualist Meetings Chief Marshall requested the Council to express its views in regard to the proposed Spiritualist meeting in view of the City Ordinance „ prohibiting mediuns, fortune tellers,pkrenologists etc. , stating that in his opinion the ordinance did not contemplate the prohibition of Spiritualist meetings. Mr. Swick and Mr. Erway were present and explained that the meetings were to be conducted in a si`failiar manner as their regular meetings at Freev .ille and would be held at the K. P. Hall and that Mr. Cutler would conduct-cthe services. The Council decided that such meetings would not come within the meaning of the present ordinance and made no objection tonthe meeting proposed. Stewart -2- Park By Commissioner Rumsey:seconded by Cornmis! ioner VanCleef: RESOLVED: that the Stervaxt Park Comnission recommends to the Ithaca Trust Company, as Trustees of the Sterart Park Fund, that for the present and until such time as they may decide otherwise, they retain $100,000. as a Trust Fund, the income only to be used for the Permanent Improvement of Stewart Park, and that the balance of said fund be made available for the permanent improvement of Stewart Park this year. On motion of Alderman Causer, this matter was referred to the Finance Committee and City Attorney for investigation and report at the next meeting. $15,000. Whiting: WHEREAS, the Common Council has already provided $25.,000. for the use of the Board of Public Works for the construction of storm sewers, and WHEREAS, the construction of storm sewers by means of this appropriation has been about completed and there remains only a small balance in the Improvement Fund,and WHEREAS, the Board of Public Works feels that this work should continue during the- severe winter months in order to continue to help relieve the unemployment situation, now therefore, BE IT RESOLVED: that the Boar. of Public Works hereby requests the Common Council to furnish $15,000. additional for the use of the Board for the construction of storm sewers in and along the streets in the City of Ithaca; the proposed construction and cost thereof, to depend somewhat upon the severity of the weather but to be substantially in accordance with the following proposed schedule, and at an estimated cost respectively setforth therein; 1. Albany St. - Cascadilla to Seneca Court St. - Buffalo to Seneca $6,000. 2. Waite Ave. - Triphammer to Wyckoff 11500. 3. Columbia St. - Giles to Hudson 3,700. 4. Clinton St. - Albany to Geneva 600. 5. Thurston Ave. - off Waite -Ave. 400. 6. So. Plain St. - Park St. to Six Mile Creek x, 200. 7. N.Aurora St. - Buffalo to Seneca , 300. Carried and Approve".. In view of the fact that it reauires a vote of at least 5 Aldermen to act on this request action was postponed until the next meeting. Local Lain #1-1931 The Clerk called attention to the proposed Local Law +1-1931 entitled "An Act to amend the Ithaca City Charter In relation to sidewalks and certain powers of the Board of Public Works" which was proposed at the last meeting by the City Attorney, approved by the Council and laid on the table until this meeting. By Alderman Gill:seconded by Alderman Lowe: BE IT ENACTED by the Common Council of the City of Ithaca, as follows: Section 1. (To be approved by the Mayor Feb.13,1931 after due notice and Public Hearing as required by law) Dofflemyer Report . Assessor Dofflemyer made an interesting report on his attendance at the School for Assessors held in Albany under the auspices of the 21ayor 's Congerence and State Tax Commission. He stressed the great value of such Schools and pointed out among other things that a copy of the City Tax Maps should be approved and filed with the State Commission. By Alderman Muser:seconded by Alderman Hines: RESOLVED: that a set of Tax daps be pro- vided and filed with the State Tax Commission for approval. Carried. Bool,Fred. Charity Dept. Commissioner Green submitted his Annual Report for 1930 which was accepted and ordered filed. He also reported that he had .acted on the Council 's suggestion and hired Iii. Fred Bool on part time as Assistant in the Charity Department and recommended that the Council fix his pay at $4.00 per day. By Alderman Hyers: seconded by Alderman Hines: RESOLVED: that the temporary employment of Mr. Fred Bool in the Charity Department be approved and that he be paid at the rate of .00 per day for each day served. Sa.inburg - 5 Mary Brazo 5.00 Ithaca �enorial Hosp. 481.20 E.B.Fulkerson 15.00 A.H.VanOrder 35. 00 Broome County 344-00 1 •1 Mr. Harold Simpson appeared before the Common Council as Chairman of a Committee of the Tompkins County BarrAssociation which has been considering the rather obsolete provisions of the Ithaca City Charter with relation to the City Court and explained the proposed new "City Court Act" which they have prepared for presentation to the Legislature in order to make operation of the City Court more effective and up to date and thus afford the citizens and residents of the City much better court service. He explained that the changes proposed were procedural only, and recommended that the Council appoint a Committee to'meet with the Committee from the Bar Association to review and consent to this Act. Judge Crowley also spoke on behalf of the proposed change, and as President of the Bar Association suggested and invited the Common Council to meet with the Bar Association at Luncheon at 12:15 Saturua.y in the Bank' Restaurant. By Alderman Rogalsky: seconded by Alderman Causer: RESOLVED: that the Common Council appreciates the opportunity to meet with the Bar Association on this matter and accepts with pleasure the invitation, and further, RESOLVED: that` this meeting be adjourned to 12:15 Saturday, Feb. 7th at the Bank Restaurant to meet with the Bar Association for the purpose of taking any action on the proposed City Court Act that may be deemed necessary, and transact any other business that may properly come before the meeting. Carried. 00121 ON COUNCIL ADJOURNED REGULAR _EFTING _ FEB. 7.1971. Pursuant to invitation Mayor Bergholtz and Alder-men--Lowe, Causer,Wers,Hines,Rogalsky,Hoffman met with the Tompkins County Bar Association at 12:30 P.M. in the Bank Restaurant in connection with the proposed City Court Act. After an excellent luncheon as guests of the Bar Association and a few remarks from City Judge Daniel Crowley who presided the Mayor assuraed the Association that the Council was behind then and appreciated the services they were rendering in formulating a new City Court Act. After thanking the Association for their hospital- ity the Council adjourned to the Common Council Chamber at the City Hall where they were joined by Aldermen Gill City Court and Sammons. Act By Alderman Hines: seconded by Alderman Causer: RESOLVED: that the Com.ion Council hereby goes on record as approving in principal the proposed new City Court Act which is to be presented to the Legislature for adoption. Carried. A. $15,,000- The Mayor suggested that the Council act at this A&aitional time on the resolution of the Board of Public Works present- ed at the previous meeting; requesting an additional aporo- priation of $15,000 for storm sewer construction. By Alderman Loge: seconded by Alderman Causer: RESOLVED: that the resolution in the Minutes of the meeting on Januar�r 7,1931 authorizing a Bond issue in the sum of $25,000 be and the same is hereby amended as follows: In the third paragraph the amount of the Bond issue is hereby increased from $25,000 to $40,000. and in next to the last paragraph the bonds shall be numbered serially from 1 to 40 inclusive instead of from 1 to 25 inclusive and shall mature in each of the years 120 1942 to 1949 inclusive instead of from 1942 to 1946 inclusive.
