PUBLIC HEARING MINUTES
TOWN OF DANBY
August 5 , 1965

A public hearing was held by the Town Board of the Town
of Danby at the Town Hall at 7 : 30 P . M . on August 5 , 1965 , for
the purpose of hearing all persons regarding Town Expenditures
on Jennings Pond .
Board members present : Supervisor James H . Cortright ,
Councilmen Donald Makie , Donald Barber and Justices Henry
Makarainen and Moses Peter . Also Highway Superintendent
Chaffee , Zoning Officer Hatfield and about 25 townspeople .
Councilman Makie gave a resume of making Jennings Pond a
✓ ecreation spot for swimming boat launching , fishing and
picnicking at a cost around $ 2 , 600 . In 1964 a committee consisting
o f Joseph Short , Donald Makie and Wendell Bryce started preparing
the plan for the Danby Community Council . The Tompkins County
Soil Conservation District cooperated in the study . The Danby
Town Board entered the picture as the official body to apply
to the Parks Commission for a license .
A letter was read from Donald E . Ryan , regional park
manager of the Finger Lakes State Parks Commission which stated
opposition to any breakwater in the pond . He suggested that
the Town Board make a swimming area in the pond by cleaning
o ut the silt in a designated place , hauling in sand and gravel ,
. and installing lines and floats .
Supervisor Cortright opened the meeting to comments from
the floor . Some comments as follows :
Alfred Sebasta - " state owns lands so should improve - - - must have
some intent of doing . "
Gould Colman - " thanked committee for their work in preparing
plan for Community Council . " letter from Ryan ,
an example of administrative foot - slogging - - - -
urged the Board not to attach too much importance
to it except as a basis for compromise . " His
personal feeling is that it would be a s mart move
for Danby to go ahead on own - - if Danby wants to
grow .
Joe Short - " spent a lot of time on plans . " talked with Ryan
w ho says state does not have funds . " attractive
proposition and to heck with the state - - if state
w on ' t do it , let the Town , will be a feather in cap . "
Gerald Baker - " New York State owns it and we ' re paying taxes ,
the state should do something about it . "
Mrs . Short - '" state has committrrients ahead for several years ,
This would serve us locally if done ourselves . "
Mrs . Dotson - " neighborhood park not a state park where persons
are charged . "
Mrs . Tamblyn - " what way has Danby spent their money ? has not
. seen any changes . "
At this time Supervisor Cortright replied at length
the Town 's highway expenditures , etc . and Danby ' s long - range 701
plan which contains a proposal for a dam on Buttermilk Creek
between Jennings Pond and Treman Lake , which would form a 35 -
acre lake , with a camping area and golf course . Cortright feels
to go ahead with the Jennings Pond program is defeating the
purpose of our long - range planning .
Justice Peter remarked whatever the Town wants w'to do , he
thinks the State will discourage it . Peter wants to have a town
municipality .

Harold Bernhardt - " not for or against , should move slower
than some think . "
Walt Chapman - " interest in a community is centered around
recreation , suggested a town- owned facility . "
Reg Nelson - " swam in Jennings Pond as a youngster , why not
now or what about making swimming facilities at
a Town Center .
Supervisor Cortright thanked the people for coming and IL
invited anyone to stay for the Town Board meeting which
followed .
Supervisor Cortright called the Town Board meeting to
order at 9 : 15 P . M .
Minutes of the July meeting were read and approved .

2 . Department of Taxation & Finance regarding exemption
certificates which will be used for sales tax purposes
on and after August 1 .

Zoning - Makie reported Regional , Planning Board is still working
on revising zoning ordinance . Suggested a professional
engineer to evaluate plans for West Danby Water District .

H ighway - Superintendent Chaffee asked to set up Erwin Projects
for 1966 . Will cover under New Business .
Zoning - none
Planning Board - Chairman absent
Appeals Board - Chairman absent
B oard of Assessors - Chairman Bergman prepared a recapitulation
of assessment in the Town .
Town Hall Study - no report
W est Danby Water District - 1: - ; p : ve4-• 90 % of
the people in West Danby need the water and want
a water district . Engineer will be glad to meet
with Town Board . Supervisor will get information
from Attorney on Bond Issue .
Jennings Pond - Supervisor Cortright does not think it feasible
to develop Jennings Pond . An alternative sug -
gestion that the Town spend the money on hired
transportation to other parks drew no discussion
from the Board . Justice Peter asked about needs „1
of a municipally owned swimming pool . I , �{
Councilman Makie made a motion to make a swimming area out
of Jennings Pond . No one seconded . Motion lost .

Appointment to Planning Board - Councilman Barber moved to appoint
Darwin Geuther a member of the
Danby Planning Board for a
seven- year term . Seconded by
Makie . 5 ayes , 0 noes , carried .
Justice Peter moved to abolish the office of Tax Collector as
of January 1966 . Seconded by Makarainen . 5 ayes , 0 noes , carried .
Meeting with the Highway Superintendent to go over Highway Budget
was set for 8 P . M . August 12 .
Peter made the motion that the Supervisor check what other towns
are doing regarding exemption certificates which will be used for
Sales tax purposes . Seconded by Barber . 5 ayes , 0 noes , carried .
Barber moved to set up Project #29008 ( former Steam Mill Rd . )
and Project #29009 ( Peters . Rd . ) as Erwin, Projects for 1966 .
Seconded by Makarainen . 5 ayes , 0 noes , carried .
