The undersigned BIDDER proposes and agrees, if this Bid is accepted, to enter into an agreement with the OWNER to purchase 6,000+/- yards of Unscreened topsoil (the "topsoil") located at 3111 Byrne Hollow Crossing in the Town of Cortlandville, Cortland County, New York. The topsoil is fiom the construction of Phase 1 and Phase 2 of the Gutchess Lumber Sports Complex & Park and was declared surplus material by the Cortlandville Town Board on September 21, 2022. 2. BIDDER accepts all the terns and conditions of the Advertisement or Notice to Bidders including the requirement to provide a certificate of liability insurance in the amount of $1,000,000 naming the Town as an additional insured and provide proof of workers' compensation/state disability insurance coverage. Payment must be made within 30 days of the bid award or prior to removal of the topsoil, whichever occurs first. 3.
