RESOLUTION # AUTHORIZATION TO RELEVY OUTSTANDING GRASS AND
WEED CONTROL CHARGES ONTO THE 2023 TAX ROLL OF
THE TOWN OF CORTLANDVILLE

ADOPTED
WHEREAS, pursuant to Chapter 98 of the Code of the Town of Cortlandville the Highway
Superintendent of the Town is authorized by Section 98-4 to enforce grass and weed control,
therefore
BE IT RESOLVED, the Town Board does hereby authorize the following outstanding grass and
weed control charges for the year 2022, as submitted by the Town Highway Superintendent and
Code Enforcement Office, be relevied onto the 2023 tax roll of the Town of Cortlandville:

was ordered to mow the property listed above.
Invoice for payment was mailed by USPS mail and certified mail on June 2, 2022.
To date, payment has not been received. Per Section 98-4 of the Town of
Cortlandville Code, any payment that has not been received by November 1 will be
collected in the manner as any unpaid town tax (attached).
Please make payment of $580.00 by November 1, 2022, to avoid the levy of the
unpaid charges to the 2023 Town/County tax bill.

town can result in risks to public health and can also detract from the character of neighborhoods. While it is
recognized that certain areas may be maintained for natural habitats and other legitimate purposes, the failure
of property owners to care for their property through neglect or lack of concern requires that measures be
taken to ensure the maintenance of reasonable health and neighborhood standards.

good health and neighborhood preservation and, to that end, shall cut and remove therefrom all grass, weeds
or other uncultivated vegetation located thereon which reaches six inches of growth.

vegetation as prescribed in § 98-3 <8477505> hereof, the Superintendent of the Town Highway Department
shall cause notice of said condition to be given, by certified mail, return receipt requested, to the owner of
record of such parcel as shall appear on the latest tax roll of the town. In the event that such condition is not
remedied within 10 days of receipt of said notice, the Superintendent of Highways shall cause the condition to
be remedied and the grass, weeds or other uncultivated vegetation to be removed and shall charge the cost of
such removal to the owner of record of said property. The Superintendent of the Town Highway Department
shall mail a statement to said owner of record requesting the payment of such cost, which shall become due
and payable within 30 days from the mailing thereof. If such cost is not paid within such time and interest not
paid by November 1 of the year in which such cost is incurred, such cost and interest at the rates charged on
unpaid taxes applicable to said property and shall be collected in the manner as any unpaid town tax.
