Call to order and Pledge of Allegiance Mr. Goodman called the meeting to order at 5:32 p.m. 2. Report of Tompkins County Legislature and Ithaca Common Council - None 3. Persons to be Heard and Board Comments • East Hill Trail - Bob Beck Mr. Beck talked about the efforts of the Dryden Rail Trail Task Force advocating for the Rail Trail connections that will eventually meet up with our trails. The town of Dryden has a website with a brochure and commonly asked questions - Dryden.ny.us/board-commission-list/rail-trail- task-force. Mr. Beck stated that the Dryden Town Board is now firmly behind the project and he has been working hard contacting land owners and talking about getting easements where necessary and most have been supportive. Mr. Goodman thanked him for his efforts. 4. Moved to November Public bearing regarding a proposed local law amending the Town of Ithaca Code, Chapter 270 entitled "Zoning," to revise provisions related to solar facilities - Pulled/rescheduled to next meeting 5. 5:30 p.m. Public bearing regarding the Preliminary Town of Ithaca 2017 Budget Mr. Goodman opened the public hearing at 5:45 p.m.; there was no one wishing to address the board and the hearing was closed. 6. Discuss and consider amendments to the Town of Ithaca 2017 Budget Preliminary budget amendments (Attachment 1) Mr. Goodman reviewed the amendments sent out by Mr. Solvig which focused on the fiber connection, phones and in-house wiring needed to support those, the sales tax revenue distributions, and the Youth Services figures being corrected. Mr. Goodman turned to the board for questions. Mr. DePaolo asked about the Youth employment numbers and he was assured that the numbers are what were asked for by them. Mr. DePaolo asked about the cabling and thought that was an oversight on our part for not anticipating that additional amount of money for the project overall. IB 10/17/2016 Pg. 1 He asked if this piece of the project was put out for competitive bid or quote and Mr. Goodman responded that there is just the one so far because he wanted a number to use in the budget discussions. General Discussion Mr. DePaolo asked whether the increases to the two water main capital projects were reflected in the budget. Discussion followed and Mr. Solvig stated that the total amount is in the budget but the separate lines seem to be slightly off and can be amended. Mr. DePaolo asked why a public hearing is needed when the maximum amount will be approved in the budget; Ms. Brock explained Article 12C that states what the process is for increasing the amount of an approved Public Interest Order. The board does not need to reauthorize the project but does have to approve the increase, subject to permissive referendum. Ms. Hunter asked about the personal services line under Building and Grounds and the significant increase and Ms. Drake explained the Maintenance Supervisor and Maintenance Worker distribution across the different lines throughout buildings and departments at both locations and this was approved earlier by the Board and shown here in the different lines that make up the personnel costs for those positions. 7. Discuss and consider approval of budget related items: Mr. DePaolo asked about the rationale for the 2% increase in wages, which seems to be above the COLA, and whether that was tied to union negotiations. Mr. Goodman responded that the town has historically given the same increase to non-union employees as union employees. Mr. DePaolo asked if the 2% assumption is sustainable if the taxpayer is not getting that same 2% increase in their wages. Mr. Goodman responded that that is a consideration in the future if inflation stays where it is and Ms. Leary added that this was also done to offset some of the increase in the employee share of the insurance premium increase. TB Resolution 2016-133: Approval of 2017 Employee Wages Whereas, the governing Town Board of the Town of Ithaca has reviewed the proposed wages for the Town of Ithaca non-collective bargaining employees for the year 2017, utilizing the 2% wage scales approved by the Town Board October 6, 2016; and Whereas, the Board has reviewed the wages established by the collective bargaining agreement with the Public Works unit represented by Teamsters Local 317; now, therefore, be it Resolved, the Town Board of the Town of Ithaca does hereby approve the said wages for the non-collective bargaining employees 2ind collective bargaining employees for 2017, as filed in the Human Resources Office. Moved: Rod Howe Seconded: Tee-Ann Hunter Vote: Ayes - Howe, Hunter, Levine, Leary, Goodman, Bleiwas and DePaolo TB Resolution 2016-134: Approval of Southern Cavuga Lake Intermunicipal Water Commission Employee Wages for 2017 TB 10/17/2016 Pg.2 Whereas, the governing Town Board of the Town of Ithaca has reviewed the proposed wage scale and wages for Southern Cayuga Lake Intermunicipal Water Commission's (Commission) non- bargaining employees for the year 2017 and bargaining employees as based on the UAW contract; and Whereas, the Commission approved of the employee wage scale and wages for 2017 at their October 13,2016 meeting; now, therefore, be it Resolved, the governing Town Board of the Town of Ithaca does hereby approve the SCLIWC 2017 wage scale and wages as detailed on the attached sheet. Moved: Bill Goodman Seconded: Tee-Ann Hunter Vote: Ayes - Goodman, Hunter, Levine, Leary, DePaolo, Howe and Bleiwas TB Resolution 2016 - 135: Approval of Health Insurance Contributions by Non-Collective Bargaining Employees for 2017-2018 Whereas, the Town has settled the collective bargaining contract with Teamster Local 317 for the Public Works unit for 2015 - 2018, which established new employee health insurance cost share amounts; and Whereas, the Personnel & Organization Committee has discussed the current status of employee contributions and the intent to have comparable cost share amounts for health insurance premium for the different employee groups; and Whereas, the Personnel & Organization Committee recommends decreasing the employee cost share for health insurance for 2017 for all non-collective bargaining employees hired prior to January 1, 2016 from 9% to 8% of the PPO plan monthly premium for either individual or family coverage, and increase the employee cost share from 6% to 7% of the Platinum Plan monthly premium for either individual or family coverage; and for 2018 set the employee cost share amounts at 9.5% for the PPO Plan and 9% for the Platinum Plan; and Whereas, the Personnel & Organization Committee recommends amending the employee cost share for the non-collective bargaining employees hired in 2016, which are only eligible to enroll in the Platinum Plan, be the same cost share as those hired prior to 2016 at 7% cost share for 2017 and 9% cost share for 2018 with the cost share for future years to be determined in 2018; now, therefore, be it Resolved, that the Town Board of the Town of Ithaca does hereby approve for effective 1/1/2017 for all non-collective bargaining employees hired prior to January 1, 2016 decreasing the cost share from 9% to 8% of the PPO plan monthly premium for either individual or family coverage and increasing the cost share from 6% to 7% of the Platinum Plan monthly premium for either individual or family coverage; and set the employee cost share for 2018 at 9.5% for the PPO Plan and 9% for the Platinum Plan; and be it further TB 10/17/2016 Pg.3 Resolved, the employee cost share for the non-collective bargaining employees hired in 2016, which are only eligible to enroll in the Platinum Plan, be the same cost share as those hired prior to 2016 at 7% cost share for 2017 and 9% cost share for 2018 with the cost share for future years to be determined in 2018; and be it further Resolved, that the payroll deductions of the employees' cost share be the same amount for January through December, starting with the first pay date in January. Moved: Pamela Bleiwas Seconded: Eric Levine Vote: Aye - Bleiwas, Levine, Leary, Goodman, DePaolo, Hunter and Howe TB Resolution 2016-136: Approval of Revision of Health Insurance Poiicv for all Town employees not covered by a collective bargaining agreement that are hired on or after January 1.2017 Whereas, the Tovm Board adopted the current Health Insurance Policy in December 2015;and Whereas, the Personnel & Organization Committee recommends modifying the Health Insurance policy to be comparable to the policy established in the Teamsters collective bargaining agreement; and Whereas, the Personnel & Organization Committee has reviewed and recommends the revised Health Insurance Policy, which clarifies when changes to coverage would be effective and establishes that non-collective bargaining employee hired on or after January 1, 2017 would be eligible for the Platinum Plan only, at a fifteen percent (15%) cost share; now, therefore, be it Resolved, the Ithaca Town Board hereby approves the recommended revised Health Insurance Policy, which establishes that non-collective bargaining employees hired on or after January 1, 2017 would be eligible for the Platinum Plan only at a fifteen percent (15%) cost share; and be it further Resolved, the Human Resources Manager is directed to update the policy in the Personnel Manual. Discuss and consider approval of digital phone and fiber connection contract through Finger Lakes Technology Group and authorization for Supervisor to sign same Mr. Goodman recapped earlier discussions on the project and reported that Finger Lakes Technology Group is a vendor under NYS OGS and the County and City have used them for similar services under the NYS contract. Given that, it is not necessary to go out to bid for this. Ms. Carrier-Titti added that the fiber connection will also replace the need for two servers and other associated infrastructure and increase the interdepartmental flow, saving money in a TB 10/17/2016 Pg.4 number of ways. Mr. Goodman added that staff were excited after the demonstration and pleased with the options and capabilities that will be there for them after this is done. Ms. Hunter asked about the length of the contracts and what would happen if we wanted to go with different phones after 5 years or if we are unhappy with FLTO and the fiber. Ms. Carrier- Titti responded that we would be able to upgrade to other phones or move to a different supplier of phones that are digital if we were unhappy after 5 years. As for the fiber, the actual fiber is theirs and we "rent" the use of it just like we do with TWC right now. The fiber contract is 10 years and the cost goes down after three years on the assumption that other companies or residences will sign up to access the fiber. She added that the County and City have been very happy with FLTO and we do not foresee any problems. Ms. Carrier-Titti also explained that FLTO is offering two free months of "rent" if the contract is signed by the end of October because FLTO would like to plan for the laying of the fiber and start digging before the ground freezes. Discussion turned to the contract itself and Ms. Brock had a number of questions and some board members were not comfortable authorizing the signing of something they haven't seen. Discussion followed and other board members thought the contract was very boiler-plate and felt they could vote on the concept, which is clear, and the standard contract as a base subject to Ms. Brock's approval. Ms. Brock suggested changes to the verbiage to reflect that which the board agreed to. The changes to the resolution removed the reference to the "submitted" contract and instead approved entering into an amended contract based on the submitted quotes and referenced those as well as adding the standard verbiage making it subject to the approval of the attorney for the town. TB Resolution 2016 - 137 : Approval of contract with Finger Lakes Technologies Group for a dark fiber connection for the Department of Public Works and digital phone services and equipment for Town Hall and Department of Public Works and authorization for the Supervisor to sign same Whereas the Personnel and Organization Committee has recommended the contract with Finger Lakes Technologies Group(FLTG) for dark fiber connection to the Department of Public Works and the digital phone services and equipment as proposed in the submitted contract, and Whereas the Budget Committee has also reviewed the proposed contract and added the line items to the proposed 2017 Town Budget, and Whereas the Town Board has discussed and considered the proposed contract amounts at its Budget meeting on October 6^*^ and the regular meeting on October l?***, and Whereas the services and vendor are on the NYS OGS approved services list and therefore there is no need to go out to bid, now therefore be it Resolved that the Ithaca Town Board does approve entering into an amended contract with FLTG for a dark fiber connection, digital phones services and equipment with their TB 10/17/2016 Pg. 5 specifications costs and lease durations as described in the proposed service contract and the quotes from FLTG numbered FLTQ 8535 and 8536 dated July 19, 2016 and upon approval of the Attorney for the Town, and hereby authorizes the Town Supervisor to enter into said amended contract on behalf of the Town. No issues were noted, (on file with Planning Dept) TB Resolution 2016-138: Acknowledge Receipt of the inspection reports of the Ferguson (Laughing Goat) and Cummins (Indian Creek Farm) agricultural easements Whereas, Michael Smith conducted inspections of the Ferguson (Laughing Goat) and Cummins (Indian Creek Farm) agricultural easements and submitted his report for the Board's review as required by the conditions of the easements, now therefore be it Resolved, that the Town Board hereby acknowledges receipt of the aforementioned report and accepts it as complete. Acknowledge receipt of independent audit of the Town of Ithaca year ending 2015 TB Resolution 2016 -139: Acknowledge Receipt of the Independent Financial Statements for the Fiscal Year ended December 31.2015 Whereas Sciarabba Walker & Co., LLP has conducted an independent audit of the financial records of the Town of Ithaca for the Fiscal Year ended December 31, 2015 and submitted their report of findings, now therefore be it Resolved, that the Town Board hereby acknowledges receipt of the Financial Statements fi-om Sciarabba Walker & Co., LLP. Discuss and consider comments regarding the DEIS for Maplewood Mr. Goodman reminded the board that this is the time for our comments as an involved agency and Ms. Hunter asked if there was interest in talking about the need for renewable energy for the project. Ms. Ritter stated that the developers are not necessarily going for LEAD certification but they have made a number of changes to the energy design because that was a big issue during all the public hearings. She stated that they are getting a lot of accolades in terms of the buildings and energy use from Sustainable Tompkins and Tompkins County Climate Initiative so they are doing very well in that area now. The board asked for more time to review the DEIS and Mr. Goodman stated that members can submit their own comments as individuals also and Ms. Ritter added that the Planning Board and Planning Staff will be submitting comments and questions. 13. Discuss and consider setting a public hearing for Public Interest Orders: Ms. Hunter questioned the increase amounts and what they are based upon. Mr. Weber responded that the bids came in higher than the estimates made in 2015 and put to bid in 2016; three bids were higher and one was lower. In estimating this for 2017, he took that information and added anticipated standard increases. Mr. Weber added that the one company that bid lower than the estimates is the company we are not allowing to do these projects because they haven't finished the one they started. Ms. Hunter still thought it was a little high and she wondered if stating that we are willing to pay that much more will influence the bids we receive. Mr. Goodman noted that those past results are public information and bidders attend the openings so they know what those amounts were. Mr. DePaolo stated that this is a 30% increase and seems high and couldn't we move to the next lowest bid. Mr. Weber stated that the other bids were all over the estimates but he can have the bid tabulation ready for the Public Works Committee meeting Wednesday morning. Ms. Brock added that the amount can decrease without going through the process again but it cannot increase. Discuss and consider award of contract for the Edgewood Sanitary Sewer Manhole Rehabilitation Project TB Resolution 2016 -143: Authorization to Award the Contract for the Edgewood Sanitary Sewer Manhole Rehabilitation Project Whereas, the adopted 2016 Ithaca Town Budget included $300,000 for Sanitary Sewer Rehabilitation, which includes Manholes; and Whereas, pursuant to the New York State Environmental Quality Review Act ("SEQRA") and its implementing regulations at 6 NYCRR Part 617, it has been determined by the Town Board that approval, construction and implementation of the Edgewood Sanitary Sewer Manhole Rehabilitation Project (the "Improvement" or "Project") are a Type II Action because the Action constitutes "replacement, rehabilitation or reconstruction of a structure or facility, in kind, on the same site," and thus approval, construction and implementation of the Improvement are not subject to review under SEQRA; and Whereas on October 5, 2016, the Director of Public Works/Highway Superintendent (Director) received quotes for the Project; and Whereas, the Director has reviewed the quotes and qualifications of the bidders and has determined the lowest responsive bid in the amount of $16,500.00 was made by the lowest responsible bidder. TB Resolution 2016-144; Authorization to Apply for Funding through the Transportation Alternatives Program for a Sidewalk Along a Portion of Route 96B/Danbv Road between Ithaca College and the Citv/Town Municinal Boundary Whereas, the New York State Department of Transportation (NYSDOT) has announced the availability of funding under the federal Transportation Alternatives Program, which includes a category for provisions of facilities for pedestrians and bicycles, and Whereas, the assistance toward the cost of the project shall not exceed 80% of the approved total project costs, and Whereas, the Town of Ithaca's adopted Transportation Plan (2007) and the preliminary draff NYS Route 96B Pedestrian Study (2016) both recommend construction of a sidewalk along Route 96B/Danby Road between Ithaca College and the City/Town municipal boundary, and Whereas, the estimated total cost provided by CHA Consultants, as part of the Route 96B Pedestrian Corridor Study, is $1,477,500 for design and construction of the 0.6 mile sidewalk, and Whereas, grant applications are due by October 21, 2016, now, therefore be it Resolved, that the Supervisor of the Town of Ithaca is hereby authorized and directed to file an application for funds from NYSDOT in accordance with the provisions of the Transportation Alternatives Program, in an amount not to exceed $1,477,500 for such financial assistance to the Town of Ithaca for a walkway along a portion of Route 96B/Danby Road. Happy Lane, Indian Creek, Orchard Hill, Hopkins, Elm Street, Westhaven, Coy Glen, Updike, Ridgecrest, Holly Creek and Conifer were the roads surface treated with oil and stone. Constructed a snowplow turnaround at the end of Peachtree Road. Brush and limbs were trimmed back at various locations in Town. Assisted Tompkins County, Ulysses, Town of Lansing, Town of Dryden, Newfield and Enfield. Stone for 2016 projects was stockpiled. Trucked millings back to plant for compensation. Installed driveway culverts at Burleigh Drive and Lexington Drive. Ditching on Snyder Hill Road and Penny Lane was done. Several staff members attended Level 1 and Level 2 Supervisory training sessions. Crack filling at the Town Hall parking lot and other locations within the Town was completed. Roadside mowing and mowing of utility easements has continued. Crosswalk, stop bar and speed hump paint stripping was completed for the season. The equipment was cleaned and serviced for storage. Brush and limbs which obscured traffic signs continued to be trimmed and removed. • Ditching and rip-rap work on Culver Road continued. • Repairs to several sections of driveway drainage structures on Wildflower Drive were repaired. • The first group of three long-term seasonal employees ended work on Sept. 30^. • Roadside mowing was completed. Parks, Trails, and Preserves: • Weekly site inspections were performed. • Consultant continued treatment and removal of herbaceous invasive species at East Ithaca Preserve. • Hazardous tree removals at various park and trail sites and various locations in Town proceeded as weather allowed. • Little League baseball summer practice season ended in September. Valentino Field maintenance and weekly mowing continued. Our new Ventrac field grooming equipment was used to add and grade out three tons of additional infield clay. The field was aerated and fertilized. Additional watering was required a few more times. Tutelo Park pavilion was rented out numerous times. The compost pile was turned monthly. This happened for 4 hrs on Tues, 2 hrs on Wed & 4 hrs on Thurs. All happened this week. They might be new tenants. There's usually turnover for that unit every year. Neighbor doesn't know what to do.
