Call to order and Pledge of Allegiance - 5:30 p.m. 2. Report of Tompkins County Legislature and Ithaca Common Council - None 3. Persons to be Heard and Board Comments James Hamilton, Conservation Board member Mr. Hamilton was here to remind the board that the Conservation Board has researched, studied and recommended that the billing for water be done on a 3-tier block structure increasing rate so that water conservation would be promoted and he wanted to remind the board how they think it should work. The 3-tier system would penalize waste, encourage conservation and charge most people what it costs to bring the water to them. He didn't think the presentation scheduled for tonight would be for that structure and he wanted the Board to understand how that would promote conservation. Mr. Hamilton stated that when you just increase water rates, people don't really conserve; economists call this an inelastic price. It costs more and people just pay it. In those municipalities where there is a 3-tier increasing block structure, the charge is lower for those trying to conserve, an average rate for those average or regular users and then at a certain point, a prime rate which basically says, hey, you need to watch what you are doing and you are going ot pay a prime rate because you are wasting water. He stated that in communities where water availability is a problem, this has worked and is necessary due to shortages. Here in our area, when the sustainability study was done by Katie Stoner a few years back, the Conservation Board was astounded that 40% of the Towns' greenhouse emissions came from pumping water up the hill. All that pumping accounts for a huge part of our emissions and the Town decided to buy offsets but that doesn't take the carbon dioxide out of the air. Mr. Hamilton stated that the reasons for not using the 3-tier structure do not convince him or other members of the Conservation Board that it is not viable. He stated that he uses less than half of the minimum amount and it is not fair; he and others are essentially subsidizing other users. Bolton Point Presentation on draft New Water Rate Structure (Attachment 1) Linda Woodard, Mayor of Cayuga Heights and Joan Foote, General Manager, Bolton Point Ms. Woodard explained that she started on this a long time before becoming Mayor when and she noticed that her consumption was much lower than the minimum and she asked the then Mayor why and was told that is the minimum. She was invited to look into it, and she did. Ms. Woodard stated that she took the water consumption data for 2014 and 2015 and started attending the Water Commission meetings. There had been discussion for years about whether the rate structure was fair and although her motivation in the beginning was money, she stated that she is an ecologist by training and it did make her feel like there was no incentive to conserve and in fact the people using less than the minimum were subsidizing the rest. Ms. Woodard stated that the Commission was reluctant to make changes without solid evidence to how it would affect the hard costs of the Commission which make up 75% of the cost of the process. Only 25% is related to actual amoimts of water. The Commission wanted to make sure those infrastructure or hard costs could be dependably met. Ms. Woodard stated that she took the data and wrote a computer program to model the various scenarios, starting with paying from the first gallon used and she added that when she was listening to Mr. Hgimilton, it all sounds good, but there are a lot of parameters that have to be taken into consideration; there are different sizes of meters and pipes £ind an excel sheet just didn't take those into account. The computer model attempts to. Ms. Woodard said the Commission was looking for something that was fair and proposed a number of scenarios. The most fair would be to pay for every gallon you use but that couldn't be done when they tried balancing that with the need for stability in the amount of money needed in hard costs. There were 10-12 scenarios looked at and discussed over months and months and the rate structure that seemed to fit everything the best was to reduce the minimum to 5,000 gallons and in doing that, the rate itself would be raised about 10%. The people who use less than 5,000 will see their bills go down by a little bit less than half and people using between 5-9,000 gallons will see a slight reduction; those that use more than 10,000 gallons will see a 10% increase. The proposal does not account for a penalty type tier and that would be difficult. The Town's biggest consumer is Ithaca College and they will be paying 10% more under this scenario. Ms. Woodard went through charts showing the results particular to the Tovm. The charts show that 55% of town residents are under the 10,000 minimum with about 18% under the 5,000 usage. The rate structure is complex with type of user and pipe size and meter size, but what one would want is to have the payers as close as possible. The highest users are paying a disproportionately lower cost. TB 09-12-2016 Filed 09/16/2016 pg. 2 Ms. Woodard explained that the Town of Ithaca has a little over 50% of the users of the Commission and the largest user in Ithaca College. Mr. Goodman added that under this scenario, IC pays around $500K a year and that would go up by about $50K. Mr. Levine asked about the effect on families because this seems to raise the bill by 10% but does that really parallel the increase in the cost of the water delivered. If a family is using 12,000 gallons and their rate goes up; is that really the cost of the additional water or are they being charged more than the actual costs. He was interested in seeing a structure that leaves the family alone and he can understand how users of less than the 10,000 minimum may feel it isn't fair even if the cost for that minimum is the actual cost of delivering the water regardless of how much is actually delivered. Mr. Levine said that water is very unique in that most of the cost is not the water itself but yet you are charging more for that water. Ms. Woodard explained that they did look at dividing the 75% costs of the operations evenly amongst all users depending upon the number of meters and it was badly skewed and a lot of people would be penalized because the rate would increase so much; Mr. Levine asked how and she responded that most would see a significant jump compared to what they are paying now and Mr. Levine said what she was saying was that they get 10,000 included gallons with the base cost even if you use less and Ms. Woodard was saying that is a penalty but he doesn't see it that way, the base costs are the base costs. Mr. Levine went on to say that he contributes to water conservation in other ways; being a vegetarian, he has been told eating a hamburger is like a months' worth of showers so a base amount is a base amount. Ms. Woodard responded that you can't do it from a consumption basis alone. Ms. Foote added that it is complicated because of the variables involved such as weather, but yet we have big fixed costs and estimates on what may or may not need to be replaced. Now the Commission is trying to look at ways to encourage the conservation yet still have everyone chip in for the infrastructure. Mr. Levine responded that he understands the concept but it is going to affect families and Ms. Woodard added that it will affect industry also. Most of the municipalities were concerned about the effect on their businesses. Mr. Goodman added that this has been going on for 3 years and many, many scenarios have been looked at and this is the compromise between all the differing points and options through those years from the partners. Ms. Bleiwas asked for estimates on the costs for different levels of usage in maybe 500 gallon usage increments with current and new costs. She would like to see how this affects larger families. 5. Discuss the draft Agreement for Municipal Cooperation - Bolton Point Mr. Goodman and Ms. Foote gave a detailed overview of the changes that are suggested that will streamline and reflect more accurately how the Commission works today. Acknowledge Receipt of SCLIWC's 2015 Independent Audit - Bolton Point TB Resolution 2016 - 120: Acknowledge Receipt of the Independent Financial Statements of the Southern Cavuga Lake Intermunicipal Water Commission for the Year Ending 2015 Whereas Sciarabba Walker & Co., LLP has conducted an audit of the year ending 2015 financial records of the Southern Cayuga Lake Intermunicipal Water Commission (SCLIWC) and submitted their report of findings, now therefore be it Resolved, that the Town Board hereby acknowledges receipt of the certified Financial Statements from Sciarabba Walker, Co. Public Hearing regarding a proposed local law amending the Town of Ithaca Code, Chapter 270 entitled "Zoning," to revise provisions related to solar facilities A substantive change was identified; the wording did not convey the desired concept that the array footprint in certain zones should not be over 10 acres and instead says the parcel cannot be over 10 acres. The change will be made and a new public hearing advertised and held on October 17,2016. 8. Discuss and consider setting public hearings for October 6^** regarding: TB Resolution 2016 - 121: Setting Public Hearings Regarding: 2017 Assessment Rolls for Special Benefit Districts and Special Benefit Areas and the Southern Cavuga Lake Intermunicipal Water Commission's 2017 Preliminarv Budget Be It Resolved that the Ithaca Town Board will hold a meeting beginning at 5:30 p.m. at the Town Hall, 215 North Tioga Street, Ithaca, New York on the day of October, 2016 at which time a public hearing will be held to allow for public comments on the following topics: 1. 2017 Assessment Rolls for Special Benefit Districts and Special Benefit Areas 2. Discuss and consider creation of a Maintenance Supervisor Position at Public Works TB Resolution 2016 - 122: Creation of Maintenance Supervisor position Whereas, the Town of Ithaca established compliance under the New York State Civil Service Agency to qualify employment positions in the Town of Ithaca in accordance with Section 22 of Civil Service Laws, Rules and Regulations; and Whereas, by regulation of Civil Service Law the Town must create a position and approve the job description before making an appointment; and Whereas, the Town has determined the need to create a Maintenance Supervisor position; now, therefore, be it Resolved, the Town Board of the Town of Ithaca does hereby establish the following position in accordance with the applicable New York State and Tompkins County Civil Service rules: 1. Discuss and consider authorization for the Supervisor to sign Construction and Design Contract with NYS DOT for the Gateway Trail TB Resolution 2016 - 123 : Authorizing the Implementation, and Funding in the First Instance. 100% of the Federal-aid costs of a Transportation Federal-aid Project, and TB 09-12-2016 Filed 09/16/2016 pg. 5 Appropriating Funds Therefore (Gateway Trail Preliminary Engineering / Design and Construction / Construction Inspection / Construction Support) Whereas, a project for the Gateway Trail, P.I.N. 375452 ("the Project") is eligible for funding under Title 23 U.S. Code, as amended, that calls for the apportionment of the costs of such program to be borne at the ratio of 80% Federal funds and 20% non-Federal funds; and Whereas, the Town of Ithaca desires to advance the Project by making a commitment of 100% of the non-Federal share of the costs of Preliminary Engineering / Design and Construction / Construction Inspection / Construction Support. Now, therefore, be it that the Ithaca Town Board, duly convened does hereby Resolve, that the Ithaca Town Board hereby approves the above-referenced project, and it is further Resolved, that the Ithaca Town Board hereby authorizes the Town of Ithaca to pay in the first instance 100% of the Federal and non-Federal share of the cost of PE/Design and Construction/CI/CS work for the Project or portions thereof; and it is further Resolved, that the sum of $489,543.00 is hereby appropriated from H8-7110.201 (Gateway Trail) and made available to cover the cost of participation in the above phases of the Project; and it is further Resolved, that in the event the full Federal and non-Federal share of the costs of the project exceeds the amount appropriated above, the Town Board of the Town of Ithaca shall convene as soon as possible to consider appropriating said excess amount immediately upon the notification by the NYSDOT thereof, and it is further Resolved, that the Supervisor of the Town of Ithaca be and is hereby authorized to execute all necessary Agreements, certifications or reimbursement requests for Federal aid on behalf of the Town of Ithaca with the New York State Department of Transportation in connection with the advancement or approval of the Project and providing for the administration of the Project and the municipality's first instance funding of project costs and permanent funding of the local share of Federal-aid and state-aid eligible Project costs and all Project costs within appropriations therefore that are not so eligible, and it is further Resolved, that a certified copy of this resolution be filed with the New York State Commissioner of Transportation by attaching it to any necessary Agreement in connection with the Project, and it is further Resolved, this Resolution shall take effect immediately. Discuss removing Ithaca College properties from the Town of Ithaca Fire Protection District Mr. Goodman reported on his meeting with President Rochon and their counsel where Mr. Rochon stated that they would not be contributing to fire services reasoning that the College does contribute by paying for College Circle Apartments and that other non-profits are not being asked for contributions. The implication was that they would take legal action and seek an injunction against the Town if we attempted to continue this. Mr. Goodman added that the City of Syracuse has begun asking the hospitals for contributions to fire services for the same type of reason as we ask the colleges; they make up a significant portion of tax exempt properties. Mr. Goodman asked the Board if they wanted to continue looking into this and have Ms. Brock do further research. The Board did want to look more into the possibilities and Ms. Brock explained the process and the possibilities of a special election if it went to a referendum. The timing of the petition and referendum would determine whether it would or could be folded into the regular election cycle(s) or a special election would have to be held. Mr. Goodman explained how the Cornell contribution is applied, noting that we get a benefit of about a third of that contribution. He reminded the Board that Mr. Engman has been appealing to IC for years and this was not unexpected. He added that Mr. Rochon fell back to the usual argument that Ithaca College provides a lot of benefits to the Town in employment and that will be the argument they will probably make in the court of public opinion that will start. He added that the last numbers that were done showed 22% of the calls are to Ithaca College properties so close to a quarter and our costs are close to $4M for fire service. Mr. Levine stated that they are forcing our hand to do this because we have been trying for years to talk to them about this and they finally agree to meet and simply say no and no negotiating. They say they provide benefits to the Community but it is our town, not the community at large that is subsidizing their fire service and the cost for fire services is half of our residents' tax bill. Ms. Bleiwas asked what would happen if there was a fire and Ms. Brock responded that she believes there is a provision in town law that the service is provided and then billed for and she will look for the details on that for the next meeting. Mr. Goodman added a continued discussion on this to the next study session. 13. TB Resolution 2016 - 124f: Authorization for the Town Supervisor to sign contract with O'Brien & Gere for the recommissioning of Town Hall HVAC Whereas the O'Brien & Gere Engineering, Inc. performed various evaluation and maintenance services for the Town Hall HVAC systems and the next step is to recommission the system, and Whereas there were some changes to the original contract and scope of services, and Whereas this is a Type II action under SEQR consisting of routine or continuing agency administration and management, and/or Maintenance or repair involving no substantial changes in an existing structure or facility, now therefore be it Resolved that the Town Supervisor is authorized to sign the submitted contract for the recommissioning service on behalf of the Town Board, Town of Ithaca. 14. Report of Town Officials/ Town Committees Mr. Weber reported that the Trumansburg Road Tank replacement is complete and back online and functioning. Ms. Terwilliger reported that we are receiving a lot of calls about the water bills being significantly higher than usual and she wanted the Board members to be aware. She stated that all calls are being referred to Ms. VanOelder and Ms. Arasi at Bolton Point and some of the reasons they think the bills are higher is that the new meters are reading consumption accurately and the drought this past quarter. Mr. Goodman reported that Mr. Lesser wants to move the historical house and he is working with a group trying to figure that out. 15. Intermunicipal Organizations - None 16. Caller says that the only access into the apartment is via that porch and he is downstairs and outside and his fiance is inside and on the second story. Female extricated by IFD, house uninhabitable as it is the only egress to the house. IFD will help them relocate for the night. Stairs to the second floor apartment, pulled away from wall and collapsed, dropping two males to the ground. They said they were bruised a bit and shaken, but did not need medical care. Found 2 occupants ouside of the apartment building reporting their CO detector was activated. Occupants took down CO detector and placed it ouside on the porch and it stopped activiating. Found 0 readings in hallway and entire living quarters. Found 35 ppm in the garage. Garage overhead door was opened and readings came down to 0. Occupants car was removed from garage. IFD Determined that the only thing that could produce CO was the vehicle. The apartment stove, dryer, water heater and apartment heat source are all electric. The only source, vehicle, could be the cause. IFD explained car can not be in garage running. Occupants claim when they start the car they pull it outside the garage and turn it off. Garage is very airtight with no fresh air to it. Also the garage, water heater room, entrance hallway do not have either a smoke detector and/or a heat detector. She stated that the buildings in the upper area at the Overlook Apts (300's) do not have their buiiding numbers up causing confusion for police/sheriff/ambulance to locate. Perfect Painters were hired to paint the patios facing the parking lots in both the lower and upper buildings at Overlook, but the hired heip left the buildings without a # on them at least a month ago. She spoke to management & maintenance about a wk & half ago and nothing has happened. They told her they have been trying to reach Perfect Painters and no response. They also have done poor clean-up and no power wash/tarps during/after their work. The numbers in the lower half of the complex have been put up, but not the upper ones. Shouldn't management do something about the building numbers to avoid confusion when emergency vehicles are summoned up to the area? Water motor gong was ringing. Fire alarm panel indicated the Garden Level Sprinkler Flow. Maintenance staff on scene reported that the compressor had failed and the Dry valve had tripped, but there was no fire. Investigation confirmed that the belt on the compressor had failed and the system was wet. There were three leaks in the system. The water supply valve was shut down ad the main drain valve opened to drain the system down. This is a partial impairment for just the Garden Level. The fire alarm panel was reset, with a trouble for the sprinkler system. The facility staff was placed on Fire Watch until the system is repaired and restored to normal condition. The maintenance supervisor was informed that the needed to contact his sprinkler contractor to make repairers to the system and put it back in service. A complaint will be forwarded to the Codes Division of hte Town of Ithaca. 8/9/2016 Desc: FIRE SAFETY VIOLATIONS 600-5 Warren Rd CLOSED 8/29/2016 Desc: Tenant, Noe Fernandez lives in 600 Warren Rd # 53D is complaining about 2nd hand cigarett smoke coming through the bathroom vent. Vent issue maybe? His wife is pregnant and exposed to the 2nd hand smoking coming through the other apt. He notified his landlord. They stopped by and tried to fix something (he wasn't specific about what was done) to make it better a few weeks ago, but still not working.
