Town of Danby Zoning Variance Form, rev. June 2019
Applicant/Appellant Responses to Balancing Tests to be Examined by the Board of Appeals
NYS Town Law Section 267-B requires that the Board of Zoning Appeals, when considering
granting a variance from the area requirements of the Zoning Ordinance, must weigh or balance
the benefit to the applicant against the detriment to the health, safety and welfare of the
neighborhood or community. In making such determination the board must consider five criteria.
Please explain how the requested variance will relate to these criteria. The blank lines are
illustrative only -- use and attach additional nage(s) as necessary to fully exulain the rationale
sunnortine this anneal.
1. If granted, the requested variance would — / would not X produce the following change(s)
in the character of the neighborhood or affect nearby properties as follows:
This is an addition to an existing residential home. The addition will match the existing home in style
and character. It will not have an impact on the character of the neighborhood. For the most part it
will not be sen from the street due to a large group of trees that block its view.
2. Describe any feasible alternatives which exist to what is requested:
To maintain accessibility to the addition and allow it to function with the existing home layout there
really is no feasible alternative.
3. Describe how the requested area variance is / is not X substantial:
The existing lot has an irregular shape and a dense group of trees along it's southwest boarder. The
variance would only have an impact for a distance of fifty feet along this side of the property.
4. Describe how the requested change will or will not X have an adverse effect or
impact on the physical or environmental conditions in the neighborhood or district:
The addition has been designed to compliment the existing house and blends with it's existing
surroundings. The addition will completely contained within the area of the existing yard.
S. This alleged difficulty is the result of.-
The
fThe current owner would like to create an open gathering room that would be both accessible from
the front of the house as well as have access to the existing kitchen and dining room. The lot has
several limitations including, an irregular shape, large easement across the back, and a large drop in
grade from front to back. The original placement of the house and septic system, tight to the setback
lines has really limited the ability to add to the existing home.
