My hours are very limited. I happened to log into the email system this morning from home in advance of a meeting later. You are in luck today as it is the one day this week for office hours. The earliest I can meet with you would be at 2 PM. At some point you will need to describe what use(s) you propose to undertake. It has already been explained that some of the uses the town understood were being proposed exceed the authority of the Planning Board to consider for a special permit. That is why it is important to understand what use or uses are proposed. Further, and this is where I think it would be valuable for you to read the town's zoning ordinance, a special permit application is not just comprised of some forms. Rather, special permit review is really site plan review with an additional set of standards. You will need to submit a site plan prepared by a licensed professional. In order to engage a professional engineer to prepare a site plan, you will need to fully describe the intended uses to them. The description might not be as detailed as would be needed by an architect or engineer to design building plans to accompany a building permit application, but a site plan can only be prepared based on a good description of the intended use. While I can generate cover forms for you, a special permit application mostly consists of site plan sheets and materials prepared by you and/or an engineer. In my experience, people fill out the cover forms after they have a site plan prepared that they wish to submit. The thing is, thinking this through here, in my humble opinion it seems to me that going to the effort and expense of having a professional engineer create the required site plan and other materials to accompany a special permit application which could not be heard by the Planning Board obviously would be a profound waste of your time and resources. I will be in the office from 2 to 5 today. I can explain the site plan, special permit and other processes as described in the zoning ordinance. It would help immensely if you would take the time to read the relevant sections of the ordinance before we meet. It would also help immensely if you would please have with you a written list of the uses you propose (hopefully also annotated as to how you believe they relate to the uses delineated in the zoning ordinance for the Low Density Residential zone or not). If you are 10/22/2019 Zimbra https://mail.digitaltowpath.org/h/printmessage?id=23019&part=3&tz=America/New_York 3/3 looking to apply for something related to the tasting room use at 1582 Danby Rd., given Mr. Norman's recent letter to you (attached), I need to ask whether it is for a use that you believe may be, to quote from the letter "within the scope of a customary agricultural use, as defined and discussed above [in the letter], or perhaps within the scope of a specially permitted land use category" [of those listed within the Low Density Residential Zone of the ordinance]. If so, then a Special Permit application is indeed what you would submit, together with a proposed site plan prepared by a licensed professional engineer or landscape architect. However, if it is for a use that goes beyond those things, it is my understanding that it would not be possible for the Planning Board to approve a Special Permit for such a use (as it is beyond their authority). As explained in Mr. Norman's letter, it would be the Board of Zoning Appeals that would need to either interpret the ordinance and/or consider a use variance appeal. Either way, it would be helpful to meet in person at Town Hall so that I may explain the processes, answer any questions you may have, and provide the correct forms.
