Re: Rogue Creek Cidery submittal
Please consider the following as you review the submittal from Mr. David Jordan:
1. Mr. Jordan is appealing the determination / interpretation issued August 2, 2019 by
the Town Code Enforcement Officer / Zoning Officer, John Norman, which is the first
attachment to the submittal.
2. This is not an Area Variance appeal or a Use Variance appeal. While a long letter and
numerous attachments have been submitted, which extend to include site plan matters
discussed with the Planning Board in September and which relate more broadly to the
NYS Agriculture and Markets Law as well as the NYS Alcohol and Beverage Control
Law, the question is most precisely focused on the words in the August 2nd letter.
Which words in that letter does Mr. Jordan take issue with in regard to his opinion that
they do not comport with the Zoning Ordinance; which words need to added or
deleted from that letter in order to be an accurate interpretation of the ordinance in his
opinion?
3. The last attachment of the Jordan submittal would appear to be an application to the
Planning Board as submitted. It does mostly reflect what was in the application to the
Planning Board, however the sketch plan has been revised to show less parking as
described by Mr. Jordan in the letter to the BZA.
4. The Planning Board meets in two days -- I will forward the minutes of the September
19 meeting by email when they are approved.
