LOCAL LAW NO. 15 OF THE YEAR 2023
A LOCAL LAW AMENDING CHAPTER 270 OF THE TOWN OF ITHACA CODE,
TITLED “ZONING,” AND THE TOWN ZONING MAP TO REZONE TAX PARCEL
#24.-4-2, LOCATED AT 1296-1298 TRUMANSBURG ROAD BY SUPERIMPOSING A
LIMITED HISTORIC COMMERCIAL OVERLAY DISTRICT OVER THE BASE
MEDIUM DENSITY RESIDENTIAL DISTRICT
Be it enacted by the Town Board of the Town of Ithaca as follows:
Section 1. Rezoning of Lands. Chapter 270 of the Town of Ithaca Code,
titled “Zoning,” is amended by rezoning Tax Parcel No. 24.-4-2, Located at 1296-1298
Trumansburg Road as described on Schedule A, which is incorporated into this local law,
by superimposing a Limited Historic Commercial Overlay District on that Tax Parcel
over the base Medium Density Residential District.
Section 2. Amendment of Zoning Map. The official zoning map of the
Town of Ithaca, effective April 1, 2004, revised December 11, 2006, August 13, 2012,
January 13, 2014, December 11, 2017; January 24, 2022; February 13, 2023; and June
12, 2023, as amended to date, is hereby further amended by rezoning the lands described
in this local law in the manner set forth in this local law.
Section 3. Partial Invalidity. In the event that any portion of this law is
declared invalid by a court of competent jurisdiction, the validity of the remaining
portions shall not be affected by such declaration of invalidity.
Section 4. Effective Date. This local law shall take effect immediately upon
its filing with the New York Secretary of State.
Schedule A
Description of Property Being Rezoned
Tax Parcel No. 24.-4-2, Located at 1296-1298 Trumansburg Road
ALL THAT TRACT OR PARCEL OF LAND, situate in the Town of Ithaca, County of
Tompkins and State of New York, being more particularly described as follows:
BEGINNING at the intersection of the center line of New York State Route 96 known as
Trumansburg Road, with prolongation of the center line of the straight part of County
Highway No. 139 known as Hayts Road;
Running thence southeasterly along the center line of the Trumansburg Road 218 feet to a
point;

Running thence south 64 degrees west, passing a pipe at about 28 feet and continuing
along a fence, a total distance of 151.7 feet to a point marked by an iron fence post;
Running thence north 32 degrees west 228 feet, in part along a fence, to a center line of
Hayts Road, passing a pipe at about 208 feet;
Running thence easterly along the prolonged center line of the straight part of Hayts Road
131 feet to the point or place of beginning.
Said premises are shown on a survey map entitled "Survey Map Hayts School Property,"
prepared by Thomas G. Miller, Engineer and Surveyor, dated August 13, 1965, and
recorded in the Tompkins County Clerk’s Office in Map Drawer 1970 25 on December
17, 1970.
