TOWN OF ITHACA
LOCAL LAW NO. 14 OF THE YEAR 2023
A LOCAL LAW AMENDING TOWN OF ITHACA CODE CHAPTER 148,
ENVIRONMENTAL QUALITY REVIEW, TO ADD ALL SIGNS
EXCEPT OFF-PREMISES SIGNS TO THE TYPE II LIST
Be it enacted by the Town Board of the Town of Ithaca as follows:
Section 1. Chapter 148 (Environmental Quality Review) of the Town of Ithaca Code,
Section 148-6, titled “Type II actions” is amended by replacing current Section 148-6 with the
following:
“In addition to those actions listed in 6 NYCRR § 617.5, the following are hereby designated
as Type II actions:
A. All tree planting, landscaping, and trimming by the Town of Ithaca Highway
Department.
B. All signs except off-premises signs.”
Section 2. Transition provision. For sign-related applications that are pending as of the
law’s effective date, Section 148-6.B shall apply to incomplete and complete applications where
no determination of environmental significance has been made as of the law’s effective date.
Section 3. In the event that any portion of this law is declared invalid by a court of
competent jurisdiction, the validity of the remaining portions shall not be affected by such
declaration of invalidity.
Section 4. This local law shall take effect immediately upon its filing with the New York
State Secretary of State.
