Superintendent of Public Works Frisbee; Police Chief Steinmetz; Clerk & Treasurer Mangione. Absent: Trustees: Robinson and Salton, Superintendent of Public Works Cross, Fire Superintendent Tamborelle. Call to Order: Mayor Supron called the meeting to order at 7:06 p.m. 1. The following officials who were elected on March 18, 2014, affirmed their Oath of Office which was administered by Village Clerk Mangione: Kathryn D. Supron, Mayor; Christopher Crooker, and Linda Woodard, Trustees. Maryann Friend joined the meeting at this time; she had been sworn into the office of trustee March 26, 2014 by Clerk Mangione. 2. Public Hearing on Proposed Local Law 2014: Override Tax Levy Cap for FYE2015 (Exhibit 2014-72) No members of the public were in attendance. The Public Hearing ended at 7:13 p.m. 3. Public Hearing on the Village’s Tentative Budget for FYE2015. (Exhibit 2014-73) No members of the public were in attendance. The Public Hearing ended at 7:16 p.m. 4. Approval of Meeting Minutes: Resolution #7432 BE IT RESOLVED THAT: Minutes of the March 10, 2014 Village of Cayuga Heights Board of Trustees Meeting be approved as written in Exhibit FYE2014-74. Motion: Trustee Hamilton Second: Trustee Crooker Discussion: It was determined that an insufficient number of trustees were in attendance who were at the meeting in question to vote to approve the minutes. These minutes will be tabled until the April 21, 2014 meeting. Motion tabled 5. Approval of Meeting Minutes: March 25, 2014 (Exhibit 2014-75) It was determined that an insufficient number of trustees were in attendance who were at the meeting in question to vote to approve the minutes. These minutes will be tabled until the April 21, 2014 meeting. 6. Report of Fire Superintendent Tamborelle (Exhibit 2014-76) Mayor Supron commented that that Annual Fire Council Installation Banquet held at the Ithaca Country Club on March 22, 2014 was an enjoyable event, as is customary. 7. Report of Asst. Superintendent of Public Works Frisbee (Exhibit 2014-77) Mr. Frisbee extended his welcome to new board members, Maryann Friend and Linda Woodard. There were no questions on his submitted report. He concluded by sharing that the Village has had four (4) water main breaks over the cold weather season which is fewer than in some past years and fewer than other municipalities. Salt usage was under the Village’s allotment by forty (40) tons. This is again a favorable comparison to other municipalities who went over their allotments this winter. Brian Eden, who represents the Village on the Tompkins County Environmental Management Council, was in attendance and expressed his hope to be able to attend more Board of Trustee meetings. Over the past year he has been attending weekly Monday evening meetings of the Solar Tompkins group. Solar Tompkins facilitated around one hundred and fifty (150) solar installations this past year; their goal is to reach three hundred (300) in the coming year. He hopes that some of them will be in Cayuga Heights. 8. Annual Appointments (Exhibit 2014-78) Mayor Supron appointed Peter Salton as Deputy Mayor for the 2015 Official Year. Mayor Supron made the following appointments with a motion of approval for each: Resolution #7433 BE IT RESOLVED THAT: The Board of Trustees approves the appointment of Joan Mangione as Clerk & Treasurer for two official years. Resolutions of Gratitude to Elizabeth Karns and Diana Riesman (Exhibit 2014-80) Resolution #7472 IN APPRECIATION FOR OUTSTANDING PUBLIC SERVICE BY DIANA RIESMAN WHEREAS, Diana Riesman served the Village of Cayuga Heights as Trustee from April 2008 to April 2014, providing the Village with exceptional stewardship in the areas of Planning, Public Safety, and due diligence in all matters; and WHEREAS, Diana Riesman has brought respect, honor and integrity to the office of Village Trustee by leading example, exhibiting the highest level of ethics and maintaining excellent moral character; and WHEREAS, Diana Riesman volunteered numerous hours, exhibited outstanding community spirit in her service, acting as an agent of change, while maintaining a demeanor that made working with her a pleasure; and WHEREAS, Diana Riesman’s unwavering commitment, willingness and ability to understand and respond to the concerns of the people of the Village of Cayuga Heights has made a substantial contribution to the betterment of our community NOW, THEREFORE, BE IT RESOLVED that the Board of Trustees does hereby commend Diana Riesman for the dedication, enthusiasm and outstanding public service given to the Cayuga Heights community for the past six years. Tree City USA: The Village earned the designation of Tree City USA through the hard work and dedication of Village Forester Andre Bensadoun and the Shade Tree Committee with support from the Public Works Committee, Superintendent of Public Works Brent Cross and Assistant Superintendent of Public Works Jeff Frisbee. A plaque celebrating this achievement was hung by Mayor Supron and Mr. Bensadoun. The Tree City USA designation requires reapplication each year and the Shade Tree Committee has some projects in mind that will work towards the Village’s requalification. Trustee Woodard asked if it’s possible for a property owner to partner with the Village by tree cost-sharing in the right-of-way space adjacent to them. A discussion took place and a recommendation was made to ask the Shade Tree Committee to put together a thoughtful plan to suggest guidelines. The Arbor Day celebration this year will focus on a tree planting at the Cayuga Heights Elementary School. Mr. Bensadoun is attending a full day session covering safety concerns related to the planting of trees. c. Proposed Local Law B of 2014: Override tax cap. (Exhibit FYE2014-72) Resolution #7474 BE IT RESOLVED THAT: The Proposed Local Law B of 2014: Override tax cap is passed. VILLAGE OF CAYUGA HEIGHTS LOCAL LAW 2 OF THE YEAR 2014 A LOCAL LAW TO OVERRIDE THE TAX LEVY LIMIT ESTABLISHED IN GENERAL MUNICIPAL LAW §3-C Be it enacted by the Board of Trustees of the Village of Cayuga Heights as follows: Section 1 Legislative Intent: It is the intent of this local law to allow the Village of Cayuga Heights to adopt a budget for the fiscal year commencing in 2014 that requires a real property tax levy in excess of the tax levy limit as defined by General Municipal Law §3-c. Section 2 Authority: This local law is adopted pursuant to subdivision 5 of General Municipal Law §3-c which expressly authorizes a local governing body to override the property tax cap for the coming fiscal year by the adoption of a local law approved by a vote of sixty percent (60%) of said governing body. Section 3 Tax Levy Limit Override: The Board of Trustees of the Village of Cayuga Heights, County of Tompkins, is hereby authorized to adopt a budget for the fiscal year commencing in 2014 that requires a real property tax levy in excess of the amount otherwise prescribed in General Municipal Law §3-c. Section 4 Severability: If a court determines that any clause sentence paragraph subdivision or part of this local law or the application thereof to any person firm or corporation or circumstance is invalid or unconstitutional the court order or judgment shall not affect impair or invalidate the remainder of this local law but shall be confined in its operation to the clause sentence paragraph subdivision or part of this Local Law or in its application to the person individual firm or corporation or circumstance directly involved in the controversy in which such judgment or order shall be rendered. Section 5 Effective Date: This Local Law shall take effect immediately upon filing with the Secretary of State. Other New Business: The Village of Cayuga Heights Board of Trustees wishes to extend its condolences to the family of Fred Collier . Mr. Collier had been a trustee and longtime resident of the Village. The Board will prepare a resolution of appreciation for his service to the community at a future date. Mayor Supron has continued to recruit appropriate individuals to serve on the committee to reexamine zoning. 11. Report of the Trustees: No other topics to discuss this evening. 12. Report of Police Chief Steinmetz (Exhibit 2014-81a,b,c) There were no questions for the Chief on his reports. He wished to bring to the Board’s attention that one of the officers has applied for acceptance to a specialized school which would train the individual in alcohol and drug offence enforcement. 13. Report of Superintendent Cross (Exhibit 2014-82) Supt. Cross was attending a Zoning Board of Appeals Meeting at the same time as this Board meeting; his topics were deferred until the next meeting on April 21st, with the exception of the following. Resolution #7475 TO AUTHORIZE THE ACCEPTANCE AND ADOPTION OF THE MULTI-JURISDICTIONAL ALL- HAZARD MITIGATION PLAN UPDATE FOR VILLAGE OF CAYUGA HEIGHTS, TOMPKINS COUNTY, NEW YORK WHEREAS, the Tompkins County Planning Department, with the assistance from Barton & Loguidice, P.C., has gathered information and prepared the Multi-Jurisdictional All-Hazard Mitigation Plan Update for Tompkins County, New York; and WHEREAS, the Multi-Jurisdictional All-Hazard Mitigation Plan Update for Tompkins County, New York has been prepared in accordance with the Disaster Mitigation Act of 2000 and Title 44 Code of Federal Regulations (CFR), Part 201;and WHEREAS, Title 44 CFR, Chapter 1,Part 201.6{c)(S) requires each local government participating in the preparation of a Multi-Jurisdictional Mitigation Plan or Plan Update to accept and adopt such plan; and WHEREAS, the Village of Cayuga Heights, has reviewed the 2013 Hazard Mitigation Plan Update, has found the document to be acceptable, and as a local unit of government, has afforded its citizens an opportunity to comment and provide input regarding the Plan Update and the actions included in the Plan; WHEREAS, the Village Cayuga Heights will consider the Tompkins County HMP update during the implementation and updating of local planning mechanisms, and will incorporate the hazard assessment data, hazard vulnerabilities, and mitigation actions in these mechanisms, where applicable; NOW THEREFORE, BE IT RESOLVED, that the Village of Cayuga Heights, as a participating jurisdiction, adopts the Multi-Jurisdictional All-Hazard Mitigation Plan Update for Tompkins County, New York, dated December 2013.
