Fabbroni Building Inspector Town of Ithaca Dated: June 23, 1977 Publish: June 25, 1977 Zoning Board of Appeals -13- June 30, 1977 With respect to the 225 Coddington Road property specifically, it was MOVED by Mr. Peter Francese and duly seconded by Mr. Edward Austen, as follows: WHEREAS, the Zoning Board of Appeals of the Town of Ithaca has heard the Appeal presented by Mr. Johann Gebauer and his attorney, Mrs. Laura Holmberg, for special permit to allow more than three unrelated boarders, roomers, lodgers, or other occupants or to convert the ground floor into a third dwelling unit at 225 Coddington Road, being a part of Town of Ithaca Tax Parcel No. 6-54-7-45, together with supporting evidence thereof as presented by Mr. Gebauer, at a public meeting held by said Board on June 30, 1977, and IN VIEW OF the fact that the structure located on Tax Parcel No. 6-54-7-45 and known as 225 Coddington Road, Ithaca, N.Y., was knowingly constructed in violation of the Town of Ithaca Zoning Ordinance (particularly the basement renovations), therefore, BE IT RESOLVED, that the Zoning Board of Appeals of the Town of Ithaca deny and hereby does deny said Appeal. There being no further discussion, the Chair called for a vote. Aye - Francese, Austen, Hewett, King. Nay - None. The Chair declared the MOTION to be carried unanimously and the Appeal therefore denied. Chairman Francese declared the matter of the 225 Coddington Road Appeal duly closed and the matter of the 229 Coddington Road Appeal duly adjourned at 10:28 p.m. APPEAL OF EASTERN ARTIFICIAL INSEMINATION COOPERATIVE, INC., APPELLANT, FROM THE DECISION OF THE BUILDING INSPECTOR DENYING EXTENSION OF A NON -CONFORMING USE AT 219 JUDD FALLS ROAD, TAX PARCEL NO. 6-63-1-3.4, ITHACA, N.Y. PERMISSION IS DENIED UNDER ARTICLE XII, SECTION 54 AND ARTICLE V, SECTION 18 OF THE TOWN OF ITHACA ZONING ORDINANCE. Chairman Francese declared the Public Hearing in the above -noted matter duly opened at 10:30 p.m. and read aloud from the Notice of Public Hearings as posted and published and as noted above. Mr. Bruce Bean of the EAI Co -Op was present, as was Attorney Robert I. Williamson and Architect Peter Levatich, Attorney Williamson addressed the Board and stated that Cornell owns the land and in the '30s the facility was built including the barns. Attorney Williamson pointed out that there has been accommodation for 300 bulls all these years, adding that the Cooperative works with the United States Department of Agriculture and Cornell University, and further adding that their product goes throughout the world. Attorney Williamson stated that they received a denial of their application to reconstruct and better improve their v Zoning Board of Appeals -15- June 30, 1977 reduced side yard of 20+ feet because of the separation necessary between the new barn and the quarantine facility which was recommended to be 150 feet to 200 feet by the Cornell University Vet College and is actually less than 150 feet. There being no further discussion, the Chair called for a vote. Aye - Francese, Austen, Hewett, King. Nay - None. The MOTION was declared to be carried unanimously. Fabbroni Building Inspector Town of Ithaca Dated: June 23, 1977 Publish: June 25, 1977 Zoning Board of Appeals -14- June 30, 1977 facilities because they are a non -conforming use. Attorney Williamson noted that Peter Levatich was the Architect for the project. Attorney Williamson stated that in back of the building that fronts on Judd Falls Road, they wish to reconstruct a barn and add a barn which would house some of the bulls which are outside, inside, adding that it will be hidden from Judd Falls Road and screened by landscaping from the proposed apartments that have been approved. Attorney Williamson stated that when these apartments were approved these developers said they did not disapprove of the Cooperative's expansion. Attorney Williamson introduced Mr. Bruce Bean, Production Manager for the EAI Co -Op. Mr. Bean stated that they are presently seeking Cornell University approval but their correspondence is very favorable. Mr. Bean stated that the requirements of the Health Department would be complied with totally. Mr. Bean introduced Mr. Peter Levatich, Architect, Mr. Levatich presented a Levatich noted that the plan outside fenced -in pens. Mr. would be replaced by probably a plan, plot plan dated June 22, 1977. Mr. calls for replacing a quonset but and Levatich stated that the quonset but pole barn in the location shown on the Mr. Fabbroni asked how far the proposal is from the south lot line, with Mr. Levatich responding, about 25 feet. Attorney Williamson stated that the Cooperative works very closely with Cornell and the Vet School, adding that there will be no additional cars and there will be no more outdoor pens. Mr. Fabbroni wondered why the building is so close to the lot line, with Mr. Levatich responding that the veterinarians are very anxious to have as great a distance as possible between the barns and the quarantine barn. Attorney Williamson stated that any variance would be in complete compliance with the Tompkins County Health Department and approval of Cornell. Mr. Fabbroni pointed out to the Board that it should make note of any variance granted with regard to the side yard. MOTION by Mr. Jack Hewett, seconded by Mr. Peter Francese: RESOLVED, that the Zoning Board of Appeals of the Town of Ithaca authorize and hereby does authorize the expansion of the Eastern Artificial Insemination Cooperative, Inc., a legal non -conforming use located at 219 Judd Falls Road, Parcel No. 6-63-1-3.4, as per plot plan dated June 22, 19771, presented by Architect Peter Levatich, subject to the approval of the Tompkins County Health Department and Cornell University, and further RESOLVED, that included in this approval is approval of the Zoning Board of Appeals Attorney Buyoucos pointed was listening to an appeal Inspector, and in no way is to this is not an action of the Board of Appeals. -7- January 30, 1979 out that what the Board was doing here from the decision of the Building be construed as complying, adding that municipality; it is an action of. the Chairman Francese wished the record to show that he had visited the site. PERMISSION IS DENIED UNDER ARTICLE XII, and Bennett and at Mr. Fabbroni's suggestion they are here. SECTION 54 AND ARTICLE V. SECTION 18, OF THE TOWN OF ITHACA ZONING ORDINANCE. Chairman Francese declared the Public Hearing in the above -noted matter duly opened at 8:30 p.m. and read aloud from the Notice of Public Hearings as posted and published and as noted above. Attorney Robert I. Williamson was present. Attorney Williamson stated that he rather felt like the cart was before the horse because anything the Board of Appeals does is conditioned upon the Planning Board approving the extension. Attorney Williamson stated that they wanted to sign their contract with McGuire and Bennett and at Mr. Fabbroni's suggestion they are here. Attorney Williamson stated that the proposed addition is to the rear of the unit which is the home office of the Eastern Artificial Insemination Cooperative, Inc., and will be 3,200 square feet, that is, two stories to the rear, containing 1600 square feet each. Attorney Williamson stated that the extension is all office building, no barns, with no additional help coming in so the parking area will be adequate for this additional space. Attorney Williamson noted that there are 125 parking spaces already, including six for visitors. Attorney Williamson stated that the addition would not be seen from Judd Falls Road, it is between that building and the barns, adding that the outside exterior will be cement block, painted white, the same as the building now is. Attorney Williamson stated that they were assured by the restaurant owners that they would appear if necessary to support them. Attorney Williamson stated that the exterior location as well as the plan have been submitted and Mr. Fabbroni is going over the entire building as to building and fire codes. Attorney Williamson noted that the Planning Board approval is contingent upon the approval of the ZBA. Attorney Williamson stated that Mr. Bruce Bean, Project Manager, was present. Chairman Francese asked Mr. Bean if this facility were needed because they are overcrowded, to which Mr. Bean responded, yes, adding that it is an expansion of the facilities, but no personnel expansion. Mr. Bean stated that Mr. Fabbroni has detailed plans and noted that Zoning Board of Appeals -8- January 30, 1979 the storage tank is being moved to the south end as shown on the plans. Chairman Francese asked Mr. Bean if he could foresee this as meeting their needs for some time to come, to which Mr. Bean responded, yes. Chairman Francese noted that the- use is just office, with Mr. Bean responding, not quite, the first floor is storage, the second story is computer area and clerical. There will be no more than eight (8) children in the home at one time, the age range of the resident children will be from 12 to 17, upon admission, no person will be kept in the home after age 21. 4. There will be no more than four (4) automobiles permanently parked on the premises at one time. 5. The children are not allowed to have automobiles. 6. The choice as to which children are accepted by Group Homes lies entirely with the administrators of the Group Home. They will accept only children who agree voluntarily to come. The home will not be used as a detention or residential center to which children with psychopathic problems or children charged with, or found to be guilty of, serious criminal or serious delinquent acts, will be sent. Courts do not have power to assign children to the home, without approval of the home. 7. All children must attend public school. 8. It is expected that the average stay will be between ten and fourteen months. 9. The house in question is located in a multiple residence zone. Immediately to the south is a public junior high school, immediately to the northeast is an apartment complex of ten buildings with fifteen apartments in each building. The nearest single family dwelling lot is over 300 feet to the west. 10. No one appeared in opposition to the granting of this Appeal. Two neighbors from Utica Street, the previous location of this facility, appeared and stated that this Group Home were good neighbors and caused no difficulties whatsoever. One person, a potential neighbor, said he would approve. The Board finds that the occupancy of the Group Home in its previous location on Utica Street in the City of Ithaca has not created adverse effects on neighboring properties but appears, instead, to have obtained the approval of owners of property in the neighborhood. 11. The Chairman of the Zoning Board of Appeals lives in the area and has visited the site and finds it to be appropriate for this particular use. 12. This Board has received several letters including the Tompkins County Youth Bureau, New York State Department of Social Services, Tompkins County Department of Social Services, and Tompkins County Probation Department, all speaking in favor of group homes and saying what an important public service they perform. 13. This home is presently located in an area rezoned to Multiple -Family at the time Lansing East (now Warren - wood) was built. Questions that must be addressed in considering this case are: 1) The garage apartment is presently being used in violation of the Zoning Ordinance. Some commitment to discontinue use for other than legal accessory building use should be addressed. 2) Has house been connected to public water and sewer? If not, has Health Department reviewed adequacy of private systems for occupancy intended? 3). Many issues on Group Homes seem to be regulated by State agencies. For example, State architects review the structure and certify it is in compliance for the use intended. Our multiple residence law says once five or more unrelated people live in a building, it must comply with the multiple residence building code. State says Group Home is considered a bonafide family under zoning. Our ordinance specifies by blood, marriage or adoption as the principle criteria. So, where we stand on adequacy of the structure for intended use and compliance with zoning is subject to some opinion of Mr. Buyoucos as to whether State approvals and opinions super- sede normal reviews, particularly the family issue. 4) Finally,. from a land use and location point of view, this home is uniquely located for its intended intensive use in that a multiple family complex and school property completely surround the lands.
